Any building that is constructed on a lot in this Shart Plat shall
be at auch an elevation so as to provide positive drainage from any
drainage entry poiat to the building (including but not limited to a
window well, a window unprotected by a window well, or a doorway).
Said positive drainage shall consiat of a minimum slope of 3% away
from the building for a diatance of at least 10 feet from the
building. The lots shall be graded so tbat either a) all runoff is
routed away from the building, and conveyed over the lota to a
natural drainage awale or approved drainage fac3.lity, or b) drainage
intercepted on the loL is disposed of on the lot in an approved
drainage facility. The approved drainage facility shall be
constructed in accordance with any applicable accepted plans on file
at the County Engineer's Office. Any revisfons to the accepted
drainage plans must be accepted by the County Engineer's Office prior
to construction of said revisions.
The property owners within this Short Plat shall be responsible for
keepin3 opeaf and maintaining the surface path of natural or man-made
drainage flow over and across their respective properties. Each
property owner or authorized representative shall iafarm each
succeeding purchaser of any drainage easements on the property and
their responsibility for maintaining surface drainage paths and
swales within said easementa. If the property owner(s) faila to
maintain the surface path of natural or man-made drainage flow, or
the drainage ewale, a notice of such failure may be given tQ the
property owner(s). if not corrected within the period indicated on
said notice, Spokane County has the right to correct the maintenance
failure, or have it correrted, at the expense of the property owner.
This short plat is located within the Aquifer Sensitive Area (ASA)
Treatment of storm runoff from drivewaye ahall be pravided. The
pre€erred method of treatment is to have the runoff from driveways
sheet flow over lawa turf or native-type grasaes. If a ditch is to
he used to collect runoff from driveways, then the ditch is to be
grass-lined.

FIRST GLANCE, INC. ) DECISION
THIS MATTER, an application for subdivision of land from First Glance, Inc. has been
received and was decided upon, pursuant to Spokane County Subdivision regulations, on Uie 1 s'
day of July, 1997.
FINDINGS OF FACT AND CANCLUSIO1o1S
1. The inclividual signiilg below Iias fiirtlier been proparly delegated Uhe respansibility for
rendering the decision by the Director of Spokane County Division of Building and
Planning.
2. The proposal is to divide approximately 1.19 acres into 2 commercial tracts for those tises
permitted in the Regional Business (B-3) zane.
3. The proposal is located adjacent lo bnth Sprague Avenue and rirst Avenue,
approximately 300 feet west of Farr Road in the Northwest %a of Section 20, Townsllip 25
North, Range 44 East W.M., Spokane County, Washington.
4. The existing zoning of the property described in the application is Regional Business
(B-3), which was established in 1991. Pursuant to Revised Code of Washington (RCW)
58.17.195, this proposal conforms to tlie requirements of the existing (I3-3) zone.
5. The Spolcane County Comprehensive Plan designates this area as Major Commercial.
The development and uses, as proposed and conditioned, are in compliance with the
Major Commercial category.
6. Surroundinb vses are prir~iarily :.ommercial.
7. The Spokane County Arterial Road Plan identifies Sprague Avenue as a Principal Arterial
with a future right-of-way width of 100 feet. The exisiing rigbt-of-way width is 100 feet.
The Spokane County Arterial Road Plan identifies rirst Avenue as a Local Access Road
with a fiiture right-of-way width of 60 feet. The existing right-of-way widih is 60 feet
Therefore, the proposal conforms to the Arterial Road Plan.
8. The proposed site is located within the Public Transportation Benefit Area (PTBA). The
Spokane Transit Authority (STA) Route 9 at Sprague Avenue provides connecting
services to the site.
9. The nroposed short plat will be served by a public water system. Waste water disposal
will be as authorized by the Director of Spokane County Division of Utilities.
10. The required public notice was provicled for this proposal and agencies having a potential
interest in the project were notified and recorrunendations solicited.
11. No written comments were received from any adjoining property owners.
12. Recognizing the recommended conditions and Spokane County development standards,
the pranosed shar: rlat makes n-pprnpriate provisions for thc p,iGli~ l:caiih, 5afety ancl
generai welfare and that the public use anci interest will be served by platting the
subdivision.
The subdivision proposal is generally consistent with RCW 58.17 and the County
subdivision regulaUons, proraoring the public health, safety and general welfare in
accordance with standards establisUed by tbe State and Spokane County. The County
Division of Buiiding and Planning has considered the provision of adequate public
facilities as cited in RCW 58.17.110 (2). More specifically:
a. open spaces f. sanitary waste disposal
b. drainage ways g. parks ana recreation facilities
c. public and/or private riglit-of ways h. rlaygrounds
d. transit i. schools and school grounds
e. potable water j. sidewalks
e 13. The project is exempt from environmental review uilder dle State Environmental Policy
Act pursuant to WAC 197-11-800 (6) (a).
DECISiON
Based upon the above noted Findings of Fact and Conclusions, Short Plat Application
SP-1148-97 is hereby APPROVED for five (5) years, specifically to July 1, 2002 and subject to
conditions noted below. This decision is final unless appealed in writing, consistient witli
Adopted appeal procedures.
CONDITIONS OF APPROVAL
All the below conditions imposed shall be binding on the "Applicant," which term shall include
the owner or owners of the properly, heirs, assigns and successors.
SPOKANF COUNTY DIVISION OI+' BUILDING AND PLANNING
1. The proposal shall comply with the Regional Business (B-3) zone and other applicable
Zoning Code chapters, as amended.
2. The final short plat shall be designed substantially in confonnance with the preliminary
plat of record. No increase of density or nuraber of tracts shall occur without a change of
condition application submittal and approval.
3. The preliminary short plat is given conditional approval for five (5) years, specif cally to
July l, 2002. The applicant may submit an extension of time application approximately
thirty (30) days prior to the above expiration date. Application(s) for extension of time
shall be processed under the provisions of Chapter 12.100.118 (Extension of Time) of the
Spokane County Subdivision Ordinaace.
4. Prior to filing the final short plat, the applicant shall submit to the County Division of
Building and Planning Director/designee for review Any proposed final short plats to
ensure compliance with these Findings and Conditions of Approval.
5. A survey is required of the subject property prior to filing the final short plat.
6. Appropriate road names and street addresses shall be indicated on the final short nlat
map.
7. Appropriate utiliry easements shall be indicated on the final short plat map. Approval of
utility easements by utility companies must be received prior to filing the final shart plat.
8. The dedication shall contain the following statement:
"Setbacks shall be determined at the tinie bUilding permits are requested unless
these setbacks are specifically drafted on this final short plat. The setbacks
indicated on this subdivision may be varied from it proper zoning or variance
apnrovals are obtained."
9. The dedication shall contain the following statement:
"Any development of Tract B shall be consistent with the parking easement recorded
under Spokane Counry Auditor pocument No. 9406060067"
10. Four (4) currcnr Certificates of Title shall be furnished ul the Cuulity Division of
Building and Planning prior to filing the f nal short plat.
11. A nlan for water facilities adequate for domestic service and fire protection sliall be
approved by the water supplier, fire protection district, Spokane Counry Division of
Building and Planning and County healih authorities. The agencies will certify on the
Water Plan, prior to filing the final short plat or any phase of the preliminary short plat,
that the plan is in conforniance with their respective needs and regulations. The Water
Plan and certification will Ue drafted on a transparency suitable for reproduction and be
signed by the sponsor.

12. The purveyor will also certify on the Water Plan that appropriate contractual
arrangements and schedule of improveruents have been made with the sponsor for
construction of the water system in accordance with the approved Water Plan. The time
schedule for improvements will provide far completion of the water system and
inspection by the appropriate healtll authorities prior ta application for buildi.ng permits
within the final short plat. The arrangements or agreements will include a provision
holding Spokane County and the purveyor harmless from claims by any tract purchaser
refused a building permit due to the failure of the snonsor to satisfactorily complete the
approved water system.
13. The final short plat dedication will contain die following statement:
"The public water system, pursuant to the Water Plan approved by County and
State Health authorities, the local fire district, County Division of Building and
P12nning, and water purveyor, will be installed within this plat, and the applicant
will provide for individual domestic water service as well as fire proteetion to
each tract prior to sale of each tract and prior ta issuance of a building permit for
each tract."
14. No building permit will be issued for any tract within the final short plat until certified by
a Washington State-licensed engineer that "the water system has been iastalled pursuant
to the approved Water Plan for the final short plat," signed and stamped by said engineer.
The certification may be in the form of a letter, but is preferred to be certif ed on a copy
of tlie Water Plan as a schematic map sllowing the "as-built" water system.
15. The Water Plan and the above four (4) conditions of approval regarding the Water Plan
may be waived by the County Division of Building and Planning Directorldesignee upon
receipt of letters from the appropriate water purveyor and fire protection district stating
that simple connections to an exisiing approved water system will provide adequate
domestic and fire protection water to ensure the public health, safety and general welfare.
16. The Spokane County Division of Building and Planning shall prepare and record witli tlie
Spokane County Auditor a"Title Notice" noting that the property in question is subaect to
a variety of special coaditions imposed as a result of approval of a land use action. This
"Title Notice" shall serve as official public notice regarding conditions of approval
affecting the property in question. The "Title Notice" shall be recorded within fifteen
(15) days of fiiial d isPositiun of the apnroved Iand use action and siia'tl only be
extinguished by the Spokane County Division of I3uilding and Planniag. The "Title
Notice" shall generally provide as follows:

is the subject of a land use action, imposing a vanety of special development
conditions, by a Spokane County Hearing Body or Administrative Ofiicial on (date)
and as maybe amended, altered or supplemented by off cial action or as already
changed. File No. SP-1148-97 is available for inspection and copying in the Spokane
County Division of Building and Planning.
SPQI{ANE COUNTY DMSION OF CNGINEERING ANA ROADS
1. That conditional approval of the plat by the County Engineer is given subject to approval of
the road system as indicated in the preliminary plat of record.
2. That plans, profiles and cross sections as designed to County scandards showing proposed
street centerline and curb grades be submitted to the County Engineer for acceptance prior
to construction and/or the filing of a final plat; road plans to be prepared under the dixection
af a licensed Professional Civil Engineer.
3. That drainage plsins and design calculations showing the alignxnent of cirainage facilities be
submitted to the County Engineer for acceptance prior to construction and/or the filing of

4. Construction within all proposed public/private roads shall be performed under the direct
supervision of a licensed engineer/surveyor, who shall fiirnish the County Engineer with

construction and to my knowledge find it to be in substantial conformance with approved

5. No construction work is to be performed widiin the existing or proposed Public right-of-
way until plans have been accepted by the County Engineer and a permit has been issued
by the County Engineer. All work is subject to inspection and approval by the Caunty
Ensineer.
6. All construction witliin the existing ar proposed Public right-of-way is to be completed
prior to filing the f nal plat or a bond in the amount estimated by the County Engineer to
cover the cost of construction of imProvements. Constniction certification, "Record
Drawinss" and monumentation of the street centerlines shall be filed with the Caunty

7. Approach Permits are required for any access to the Spokane County road system.
8. The County Engineer has designated a Local Access Roadway Section for the improvement
of rirst Avenue which is adjacent to the pronosed develonment. This will requirc; the
addition of approximately 9-11 feet of asphalt along the frontage of the development. The
construction of curbing and sidewalk is also required.
9. The proposed plat shall be improved to the standards set forth in Spokane County Board of
Gommissioners Resolution No. 95-0498, as amended, which establishes regulations for
roads, approaches, drainage and fees in new constniccion.
10. The County Engineer has examined this development proposal and has deiermined that the
impact of this nroposal upon the existing County Road System warrants the roadwAy
improvements herein specified.
SPOKANE COUNTY DIVISION OF UTILITIES
1. A wet (live) sewer connection to the area-wide Public Sewer System is to be constructed.
Sewer connection permit is required.
2. Applicant shall submit expressly to Spokane County Utilities Department "under separate
cover", only those plan sheets showing sewer plans and specifications for the public
sewer connections and facilities for review and approval.
3. Arrangements for payments of applicable sewer charges must be made for prior to
issuance of sewer connection permit.
4. Concerns regarding Stormwater and Groundwater issues will be addressed separately by
the Water Resources Section.
5 Any water service for this project shall be provided in accordance with the Coordinated
Water System Plan for Spokane County, as amended.
SPOKANE REGIONAL HEALTII DISTRICT
1. Tbe final plat shall be designed as indicated on the preliminary plat of record and/or any
attached sheets as noted.
2. Appropriate udtity easements shall be indicated on the final plat of record for distribution
by tbe County Division of Building and Planning to the utility companies, Spokane
County Engineer, and the Spokane Regional Health District. Written approval of
easements by the utility companies shall be received prior to the submittal of the final
plat.
3. Sewage disposal method shall be as authorized by the Director of the Spokane County
Division of Utililies.
4. Water service shall be coordinated thi•ough the Spokane County Division oi' Utilities.
5. Water service shall be by an existing publiG water supply when approved by the Regional
Engineer (Spokane), State Department of Health.
6. Prior to filing the final short plat, the sponsor shall demonstrate to the satisfaction of tlle
SpokAne Regianal Health District that an adequate and potable vvater supply is available
to each tract of the plat.
7. Prior to filing the final short plat, the sponsor shall present evidence that the plat lies
within the recorded service area of the water system proposed to serve the plat.

8. A public sewer system will be made available for the plat and individual service will
be provided to each tract prior to sale. Use of on-site sewage disposal systems shall
not be authorized.
9. A statement shall be placed in the dedication to the effect that:
" A public sewer system will be made available to the plat and individual service
will be provided to each tract prior to sale. Use of individual on-site sewage
disposal systems shall not be authorized."
10. The dedicatory language on the final short plat shall state:
"Use of private welis and water systerns is prohibited."
11. The f nal plat dedication shall contain the foltowing statement:
"The public water system, pursuant to the Water Plan approved by County and
State Health Authorities, the tocal fire pratection district, County Division of
Building and Planning and water purveyor, shall be installed within this
subdivision and the applicant shall provide for individual water service as well as
fire protection prior to the sale of each tract and prior to the issuance of a building
permit for each tract."

The Spokane County Engi.neering Deparmnent has reviewed the above referenced application. The following
"Conditions of Approval" are submitted to the Spokane County Planning Department for inclusion in the
"Findings of Fact, Conclusions and Order/Decision" should the request be approved.
1. That conditional approval of the plat by the County Engineer is given
subject to approval of the road system as indicated in the preliminary
plat of record.
2. That plans, profiles and cross sections as designed to County standards
showing proposed street centerline and curb grades be submitted to the
County Engineer for acceptance prior to construction and/or the filing
of a f inal plat ; road plans to be prepared under the direction of a
licensed Professional Civil Engineer.
3. That drainage plans and design calculations ahowing the alignment of
drainage facilities be submitted to the County Engineer for acceptance
prior to construction and/or the filing of the final plat. Drainage
plans to be prepared under the direction of a licensed Professional
Civil Engineer.
4. Conatruction within all proposed public/private roads shall be
performed under the direct supervision of a licensed engineer/surveyor,
who shall furnish the County Engineer with "Record Drawings" and
certification which states the following, "I have reviewed the
construction and to my knowledge find it to be in substantial
conformance with approved certified plans and Standard Specifications
except as noted."
5. No construction work is to be performed within the existing ar proposed
Public right-of-way until plans have been accepted by the County
Engineer and a permit has been issued by the County Engineer. All work
is subject to inspection and approval by the County Engineer.

6. All construction within the existing or proposed Public right-of-way is
to be completed prior to filing the f inal plat or a bond in the amount
estimated by the County Engineer to cover the cost of construction of
improvements. Construction certification, "Record Drawings" and
monumentation of the street centerlines shall be filed with the County
Engineer.
7. Approach Permits are required for any access to the Spokane County road
system.
8. The County Engineer has designated a Local Access Roadway Section for
the improvement of First Avenue which is adjacent to the proposed
development. This will require the addition of approximately 9-11 feet
of asphalt along the frontage of the development. The construction of
curbing and sidewalk is also required.
9. The proposed plat shall be improved to the standards set forth in
Spokane County Board of Commissioners Resolution No. 95-0498, as
amended, which establishes regulations for roads, approaches, drainage
and fees in new construction.
10. The County Engineer has examined this development proposal and has
determined that the impact of this proposal upon the exieting County
Road System warrants the roadway improvements herein specified.
