The Spoka.ne County Engineering Department has reviewed the abowe referenced appiicatian_ The following
"Gonditioas of Approval" are submitted to the Spokane County Plauuung Departmen# for inclusian in the
"Futdings of Fact, Conclusions aad OrderlDec%sion" should the request be appraved.
1. That conditional approval of the plat by the County Engineer is given
subject to approval af the road system as indicated in the prelirninary
plat of record.
2. That drainage plans and design caZculations showing the alignment of
drainage facilities be submitted to the County Engineer for acceptance
pzior ta constructian and/or the filing of the final plat. Drainage
p1ans to be prepared under the directian of a licensed Prafessional
Civil Engi.neer.
3. No construction work xs ta be performed within the existing or proposed
Public right--af-way until plans have been accepted by the County
Engineer and a perma.t has been issued by the County Engineer. AIl work
is subject to inspection and approval by the County Err.gineer.
4. ,A,pproach Permits are required for any access to the Sgokarxe County roat3
system.
5. The applicant shall grant applicable border easements adjacent to
Spokane County Right of Way per Spokane County Standards.

6. To construct the road improvements stated herein, the applicant may,
with the approval of tha County Engineer, join in and be a willing
participant in any petition or resolution which purposes is the
formation of a Road Improvement District (RID) for said improvements
pursuant to RCW 36.88, as amended. At such time as an RID is created
or any Road Improvement Project is sanctioned by Spokane County, the
improvements required (curb, sidewalk, drainage control and paving to
existing pavement) will be at the sole expense of the undersigned
owner, their heirs, grantees and assigns. This provision is applicable
to Felts Road.
7. As an alternative method of constructing the road improvement stated
herein, the applicant may, with the approval of the Caunty Engineer,
accomplish the road improvements stated herein by joining and
participating in a County Road Project (CRP) to the extent vf the
required road improvement. At such timP as an RID is created or any
Road Improvement Project is sanctioned by Spokane County, the
improvements required (curb, sidewalk, drainage control and paving to
existing pavement) will be at the sole expense of the undersigned
owner, their heirs, grantees and assigns. This provision is applicable
to Felts Road.
8. That the following statement shall appear within the dedicatory
language of the final plat:
That in consideration of Mutual Benefits now or to be hereafter
derived, do for themselves, their heirs, grantees, assigns and
successor(s) in interest herehy request and authorize Spokane County to
include the above described property in a Road Improvement District
(RID) and to support the formation of a Road Improvement District for
improvement of the road(s) described below by requesting and
authorizirig Spokane County to place their name(s) on a petition for the
formation of a Road Improvement District pursuant to RCW 36.68.050, or
by requesting and authorizing Spokane County to cast their ballot in
favor of a RID being formed under the resolution method pursuant to RCW
36.88.030, and/or by not filing a protest against the formation of a
RID being formed under the alternative resolution method provided for
in RCW 36.88.065 and Chapter 35.43 RCW.

If a RID is proposed for improvement of the road(s) described below,
sai3 owner(s) and successor (s) f urther agree: (1) that the improvements
or construction contemplated within the proposed RID are feasible and
(2) that the benefits to be derived from the formation of the RID by
the property included therein, together with the amount of any County
participation, exceeds the cost and expense of formation of the RID,
and (3) that the property within the proposed RID is sufficiently
developed; provided, themselves, their heirs, grantees, assigns and
successor(s) shall retain the right, as authorized under RCW 36.88.090,
to object to any assessment(s) on the property as a result of the
improvements called for in conjunction with the formation of a RID by
either the petition or resolution method under Chapter 36.88 RCW and to
appeal to the Superior Court the decision of the Board of County
Commissioners confirming the final assessment roll; provided further,
it is recognized that actual assessments may vary from assessment
estimate so long as they do not exceed a figure equal to the increased
true and f air value improvement ( s) add ( s) to the property.
It is further acknowledged and agreed that at such time as a RID is
creaced or any County Road Improvement project is authorized by Spokane
County, the improvements required shall be at the sole expense of the
owner(s) of property within the RID or served by the improvements
without any monetary participation by Spokane County.
The RID waiver contained in this agreement shall expire after ten (10)
years from the date of execution below. This provision is applicable
to Felts Road.
9. The County Engineer has designated a Local Access Roadway Section for
the improvement of Felts Road which is adjacent to the proposed
deveiopment. This will require the addition of approximately 5-7 feet
of asphalt along the frontage of the development. The construction of
curbing and sidewalk is also required.
10. The proposed plat shall be improved to the standards set forth in
Spokane County Board of Commissioners Resolution No. 95-0498, as
amended, which establishes regulations for roads, approaches, drainage
and fees in new construction.
il. The County Engineer has examined this development proposal and has
determined that the impact of this proposal upon the existing County
Road System warrants the roadway improvements herein specif ied.

Any building that is constructed on a lot in this Short Plat shall
be at such an elevation so as ta provide positive drainage from any
drainage entry point to the building (including but not limited to a
window well, a window unprotected by a window well, or a doorway).
Said positive drainage shall consist of a minimum saope of 3% away
from the building for a distance of at least 10 feet from the
building. The lots shall be graded so that either a) all runoff is
routed away from the building, and conveyed over the lots to a
natural drainage swale or approved drainage facility, or b) drainage
intercepted on the lot is disposed of on the lot in an approved
drainage facility. The approved drainage facility shall be
constructed in accorda.nce with any applicable accepted plaais on file
at the County Engineer's Office. Any revisions to the accepted
drainage plans must be accepted by the County Engineer's Office prior
to construction of said revisions.
The property ownera within this Short Plat shall be responsible for
keeping open and maintaining the surface path of natural or man-made
drainage flow over and across their reapective properties. If the
property owner(s) fails to maintain the surface path of natural or
man-made drainage flow, or the drainage swale, a notice of such
failure may be given to the property owner(s). If not corrected
within the period indicated on said notice, Spakane County has the
right to correct the mainteaance failure, or have it corrected, at
tbe expenae of the property owner.
Thia short plat is located within the Aquifer Sensitive Area (ASA)
Treatment of storm runoff from driveways shall be provided. The
preFerred method of treatment is to have the runof€ from driveways
sheet flow over lawn turf or native-type grasses. If a ditch is to
be used to collect runoff from driveways, then the ditch is to be
grass-lined.
Any natural drainage cbannels, creeks with intermittent or conatant
flow, or well-defined natural draws periodically subject to
concentrated flow of stormwater, shall be placed within an easement
granted ta Spokane Couaty. No Buildings shall be constructed withfaa
the easement, and no fill placed within the easement without the
expressed written consent of the Spokane County Engineer. The
easement shall be of sufficient width te encompass the atormwater
flow width and allaw for emergency maintenance, but in no way case
shall the easement be less than 10 ft. in width.
There may exist properties located uphill and adjacenk to this
subdivision which periodically discharge starmwater runoff onto
individual lots within this plat. Runoff from nearby uphill
properties should be expected, and during snowmelt periods ar wet
8eaeons the lote may be subject to higher amounts of stormwater
runoff that what is normally observed or anticipated. Because
stormwater runoff from adjacent praperties have discharged onto this
plat prior to development, stormwater runoff will likely contiuaue to
do so after development. It is the responsibility of the individual
lot owners to maintain existing surface paths of runoff through
their respective lots and to grade the Iots ia accordance with
applicable rules and regulatione, ao as to prevent property damage.

THIS MATTER, an application for subdivision of (and from Zelma Sievers, on behalf of Gladys Smith, has been
received and was decided upon, pursuant to Spokane County Subdivision regulations, on the 25th day of July, 1997.
FINDINGS OF FACT AND CONCLUSIONS
1. The individual signing below has fvrther been properly delegated the responsibility for rendering the decision by
the Director of Spokane County Division of Building and Planning.
2. The proposal is to divide approximately one (1) acre into two (2) tracts for one existina single family residence
and one additional residential tract, along with those uses permitted in the Urban Residential-3.5 (UR-3.5) zane.
3. The proposal is located west of and adjacent to Felts Road between Desmet Avenue and Sharp Avenue in the
Northeast'/4 of Section 17, Township 25 North, Range 44 East W.M., Spokane County, Washingtun.
4. The existing zoning of the property described in the application is UR-3.5, which was establislied in 1991.
Pursuant to Revised Cocle of Washington (RCW) 58.17.195, this proposal conforms to the requirements of the
existing UR-3.5 zone.
5. The Spokane County Comprehensive Plan designates this area as Urban. Tlie developmcnt and uses, as proposed
and conditioned, are in compliance with this category.
6. Surcounding uses are primarily residential. First Addition to Felts Road Subdivision lies to the east of the subject
property, across Felts Road. Graham's Subdivision, Parts of Tracts 25 & 26, abuts the subject parcel to the west.
~ Residential lots in the immediate vicinity vary in size from .18 acre to 1.3 acres, the average being approYimately
.5 acre.

7. The Spokane County Arterial Road Plan identifies Feits Road as a Local Access Road with a future right-of-wav
. widdi of 60 feet. The existing right-of-way width is 40 feet. In order to impleraent the Arterial Road Plan, a strip
of property 10 feet in width atong the Felts Road frontage should be set aside as a Future Acquisition Area.
Therefore, as conditioned (such as improvements, dedication, sidewalks and acquisition areas) the proposal
conforms to the Road Plan.
8. The proposed site is located within the Public Transportation Benefit Area (PTBA). The Spokane Transit
Authority (STA) Route 12 at University Road provides connecting services ta within 2 blocks of the site.
9. The proposed short plat will be served by a public water system (Modern Electric Waier Company). Waste
water disposal will be as authorized by the Director of Spokane Countv Division of Utilities.
10. The required public notice was provided for this proposal and a~encies havina a potenfiial interest in tlte project
were natified and recommendations solicited.
11. No written comments were received from any adjoining property owners.
12. Recognizing the recommended conditions and Spokane County development standards, the proposed short plat
makes appropriate provisions for the public health, safety and general welfare and that the public use and interest
will be served by platting the subdivision.

The subdivision proposal is generally consistent with RCW 58.17 and the County subdivision regulations,
promoting the public health, safety and general welfare in accordance with standards established by the State and
Spokane Couaty. The County Division of Suilding and Planning has considered the provision of adequate publiC
facilities as cited in RCW 58.17.110 (2). More specifically:
a. open spaces f. sanitary waste disposal
b. drainage ways g. parks and recreation facilities
c. public and/or private right-of-ways h. playgrounds
d. transit i. schools and school grounds
e. potable water j. sidewall:s
13. The project is exempt from environmental review under the State Environmental Policy Act pursuant to WAC
197-11-800 (6) (a).
DECISION
Based upon the above noted Findings of Fact and Conclusions, Short Plat Application SP-1150-97 is hereby
APPROVED for five (S) years, specifically to August 1, 2002 and subject to conditions noted below. This decision is
final unless appealed in writing, consistent with adopted appeal procedures.
CONDITIONS OF APPROVAL
All the below conditions imposed shall be binding on the "Applicant," which term shall include the owner or oNvners of
the praperty, heirs, assigns and successors.
SPOK:ANE COUNTY DIVISION OF BUILDING AND PLA1'NING
1. The proposal shall comply with the Urban Residential-3.5 zone and other applicable Zoning Code chapters, as
amended.
2. The final sliort plat shall be designed substantially in conformance with the preliminary plat oF record. No
increase of density or number of tracts shall occur without a change of condition application submittal and
approval.
3. The preliminary short plat is given canditional approval for five (5) years, specifically to August 1, 2002. The
applicant may submit an extension of time application thirty (30) days prior to the above expiration date.
Application(s) for extension of time shall be processed under the provisions of Cbapter 12.100.118 (Estension of
Time) of the Spokane Gounty Subdivision Ordinance.
4. Prior to filing the final short plat, the applicant shall submit ta the County Division of Building and Plattning
Director/designee for review any proposed final short piats to ensure compliance with these Findings and
Conditions of Approval.
5. A sucvey is required of the subject property prior to filing the final short plat.
6. Appropriate road names and street addresses shall be indicated on the final short plat map.
7. Appropriate utility easements shall be indicated on the final sliort piat map.
8. The dedication shall contain the following statement:
"Setbacl:s shall be determined at the time building permits are requested unless these setbacks are
specifically drafted on this finai short plat. The setbacks indicated on this subdivision may be varied from if
proper zoning or variance approvals are abtained."

9. Four (4) curreat Certificates of Titte shall be furnished to the County Division of Building and Planning prior to
filing the final short plat.
10. No water plan is required, only a simple connection will be needed prior to the sale of each tract and prior to
issuance of a building permit for each tract
11. The Spokane County Division of Building and Planning shall prepare and record with the Spokane County
Auditor a"Title Notice" noting that the properiy in question is subject to a variety of special conditions imposed
as a result of approval of a land use action. This "Title Notice" shall serve as official public notice regarding
conditions of approval affecting the property in question. The "Title Notice" shall be recorded within fifteen (15)
days of final disposition of the approved land use action and shall only be extinguished by the Spokane Couoty
Division oFBuilding and Planr►ing. The "Title Notice" shall generally provide as follows:
The parcel of property legally described a.s (legal description nnd tax parcel nuneber) is the subject of a land
use action, imposing a variety of special development conditions, by a Spokane County Hearing Body or
Administrative Official on (date) and as maybe amended, altered or supplemented by official action or as
already changed. File No. SP-1150-97 is available for inspection and copying in the Spokane County
Division of Building and Planning.
SPOKANE COUNTY DIVISION OF ENGINEERING AND RUADS
1. That conditional approval of the plat by the County Engineer is given subject to approval of the road system as
indicated in the preliminary plat of record.
2. That drainage plans and design calculations showing the aiignment of drainage facilities be submitted to the
County Engineer for acceptance prior to construction and/or the filing of the final plat. Drainage plans to be
prepared under the direction of a licensed Professional Civil Engineer.
3. No construction tivork is to be performed within the existing or proposed Public right-of-way until plans have
been accepted by the County Engineer and a permit has been issued by the County Engineer. All work is subject
to inspection and approval by the County Engineer.
4. Approach Permits are required for any access to the Spokane County road system.
5. The applieant shall grant applicable border easements adjacent to Spokane County Right of Way per Spokane
County Standards.
6. To construct the road improvements stated herein, the applicant may, witli the approval of the County Engineer,
join in and be awilling participant ia any petition or resolution which purposes is the fonnation of a Road
Improvement District (RID) for said improvements pursuant to RCW 36.88, as amended. At such time as an
RID is created or any Rnad Improvement Project is sanctioned by Spokane County, the improvements required
(curb, sidewalk, drainagc controi and paving to existing pavement) will be at the sole expense of the undersigned
owner, their heirs, grantees and assigns. This provision ts applicable to Felts Road.
7. As an alternative method of constructing the road improvement stated herein, the applicant may, with the
approval of the County Engineer, accomplish ihe road improvements stated herein by joining and participating in
a County Road Project (CRP) to the extent of the required road improvement. At such time as an RID is created
or any Road Improvement Project is sanciioned by Spokane County, the improvements required (curb, sidewalk,
drainage control and paving to existing pavement) will be at the sole eYpense of the undersigned owner, their
heirs, grantees and assigns. This proviston is applicable to Felts Road.
8. The County Eogineer lias designated a Local Access Roadway Section for the improvernent of Felis Road whicll
is adjacent to the proposed developcnent. This will require the addition of approximately 5-7 feet of asphalt
along the frontage of the development. The construction of curbing and sidewalk is also required.
9. The proposed plat silall be improved to the standards set forth in Spokane County Board of Commissioners
Resolution No. 95-0498, as amended, which establishes regulations for roads, apprAaches, drainage and fees in
new construction.

10. The County Engineer has examined this development proposal and has detennined that the impact of this
proposal upon the existing County Road System warrants thc roadway improvements herein specified.
11. That the following statement shall appear within the dedicatory language of the final plat:
"That in consideration of Mutual 8enefits now or to be hereafter derived, do for themselves, their heirs,
grantees, assigns and successor(s) in interest hereby request and Authorize Spokane County to include the
above described property in a Road Improvement District (RID) and to support the fornzation of a Road
Improvement District for improvement of the road(s) described below bv requesting and authorizing
Spokane County to place their name(s) on a petition for the formation of a Road Improvement District
pucsuant to RCW 36.88.050, or by requesting and authorizing Spokane Counry to cast their ballot in favor of
a RID being formed under the resolution method pursuant to RCW 36.88.030, and/or by not filing a protest
against the formation of an RID being formed under the alternative resolution method provided for in RCW
36.88.065 and Chapter 35.43 RCW.
If an RID is proposed for improvement of the road(s) described below, said owner(s) and successor(s)further
agree: (1) that the improvements or construction contempiated within the proposed RID are feasible and (2)
that the benefits to be derived from the formation of the RID by the property included therein, together with
the amount of any County participation, exceeds the cost and expense of formation of the RID, and (3) that
the property withia the proposed RID is sufficiently devetoped; provided, themselves, their heirs, grantees,
assigns and successor(s) shall retain the right, as authorized under RGVV 36.88.090, to object to any
assessment(s) on the property as a result of the improvements called for in conjunction weth the formation of
an RID by either the petition or resolution method under Chapter 36.88 RCW and to appeal to the Superior
Court the decision of the Board of County Commissioners confirming the final assessment roll; provided
further, it is recognized that actual assessments may vary from assessment estimate so long as they do not
exceed a figure equal to the increased true and fair value improvement(s) add(s) to the property.
It is further acknowledged and agreed that at such time as aa RID is created or any County Road
Improvement project is authorized by Spol:ane County, the improvements required shall be at the sole

SPOKANE COUNTY DIVISION OF UTILITIE S
l. Pursuant to the Board of County Commissioners Resolution No. 80-0418, the use of on-site sewer disposal
systems is hereby authorized. This authorization is conditioned in compliance with all rules and regulations of
the Spokane County Health District and is fiirther conditioned and subject to specifre application approval and
issuance of permits by the Health District.
U2_ Each new dwelling unit shall be dauble-plumbed for coanection to future area-wide collection systems.
3. The termination point of the "double plumbing" shall be at the lot Iine or per the "approved double plumbing

Building and PlAnning Division to the utility companies, Spokane County Engineer and the Spokane Gdunty
Health District. Wriiten approval of the easements by the utiliry companies must be received prior to tlle
submittal of the final plat.
3. Sewage disposal metbod shall be as authorized by the Director of Utilities, Spokane County.
4. Water service shall be coordinated tluough the Director of Utilities, Spokane County.

7. As an alternative method of constructing the road improvement stated
herein, the applicant may, with the approval of the County Engineer,
accomplish the road improvements stated herein by joining and
participating in a County Road Project (CRP) to the extent of the
required road improvement. At such time as an RID is created or any
Road Improvement Praject is sanctioned by Spokane County, the
improvements required (curb, sidewalk, drainage control and paving to
existing pavement) will be at the sole expense of the undersigned
owner, their heirs, grantees and assigns. This provision is applicable
to Felts Road.
8. That the following statement shall appear within the dedicatory
language of the final plat:
That in consideration of Mutual Benefits now or to be hereafter
derived, do for themselves, their heirs, grantees, assigns and '
successor(s) in interest hereby request and authorize Spokane County to
include the above described property in a Road Improvement District
(RID) and to support the formation of a Road Improvement District for
improvement of the road(s) described below by requesting and
authorizirlg Spokane County to place their name(s) on a petition for the
formation of a Road Improvement District pursuant to RCW 36.88.050, or
by requesting and authorizing Spokane County to cast their ballot in
favor of a RID being formed under the resolution method pursuant to RCW
36.88.030, and/or by not filing a protest against the formation of a
RID being formed under the alternative resolution method provided for
in RCW 36.88.065 and Chapter 35.43 RCW.

If a RID is proposed for improvement of the road(s) described below,
said owner ( s) and successor (s) further agree :(1) that the improvements
or construction contemplated within the proposed RID are feasible and
(2) that the benefits to be derived from the formation of the RID by
the property included therein, together with the amount of any County
participation, exceeds the cost and expense of formation of the RID,
and (3) that the property within the proposed RID is sufficiently
deve.loped; provided, themselves, their heirs, grantees, assigns and
successor(s) shall retain the right, as authorized under RCW 36.88.090,
to object to any assessment(s) on the property as a result of the
improvements called for in conjunction with the formation of a RID by
either the petition or resolution method under Chapter 36.88 RCW and to
appeal to the Superior Court the decision of the Board of County
Cammissioners confirming the final assessment roll; provided further,
it is recognized that actual assessments may vary from assessment
estimate so long as they do not exceed a figure equal to the increased
true and fair value improvement ( s) add ( s) to the property.
It is further acknowledged and agreed that at such time as a RID is
creaLed or any County Road Improvement project is authorized by Spokane
County, the improvements required shall be at the sole expense of the
owner(s) of property within the RID or served by the improvernents
without any monetary participation by Spokane County.
The RID waiver contained in this agreement shall expire after ten (10)
years from the date of execution below. This provision is applicable
to Felts Road.
9. The County Engineer has designated a Local Access Roadway Section for
the impravement of Felts Road which is adjacent to the proposed
development. This will require the addition of approximately 5-7 feet
of asphalt along the frontage of the development. The construction of
curbing and sidewalk is also required.
10. The proposed plat shall be improved to the standards set forth in
Spokane County Board of Commissioners Resolution No. 95-0498, as
amended, which establishes regulations for roads, approaches, drainage
and fees in new construction.
11. The County Engineer has examined this development proposal and has
determined that the impact of this proposal upan the existing County
Road System warrants the roadway improvements herein specified.

I received the above referenced project application on July 9, 1997. The SCS Soils Map identfies this area as
being Garrison Gravely Loam soils. The soil suroey in this area is known to be accurate. Therefiore, since this is
an approved soil for stormwater disposal, no concept drainage plan is required. We have no infonnation that says
there are any critical areas on this site.
