In consideration of the approval by Spokane County of Short Piat No. 1154 - 97, hereinafter referred
to as the `plat°, undersigned covenants and agrees that:
The property owners within this Plat shall be hefd responsible for keeping open and maintaining the
surface path of natural or man-made drainage flow over and across their respective properties. tf the
property awner(s) fails to mair►tain the surface path of natural or man-made dreinage flow, or the
drainage swale, a notice of such failure may be given to the property owneKs). If not corrected within
the period indicated on said notice, Spokane County has the right to correct the maintenance failure,
or have it corrected, at the expense of the property owner.
Any natural drainage channels, creeks virith intermittent or canstant fiow, ar welkiefined natural draws
periodically subject to concentrated fiow of stormwater, shall be pfaced within an easemerit granted to
Spokane Courrty. No buildings shall be construded within the easement, and no fifl placed within the
easement without the expressed written consent of the Spokane Caunty Engineer. The easement shell
be of sufficient width to encompass the stormwater flow width and allow for emergency maintenance,
but in no cese shall the easemerrt be less then 10 ft in width.
There may exist properties (ocated uphill and adjacent to this subdivision which periodically discharge
stormwater runoff onto individual lots within this plat Runoff frorri nearby uphill properties should be
expected, and during snowmelt periods or wet seasons the lots may be subjected to higher amounts
of stormwater runoff that what is normally observed or anticipated. 8ecause stormwater runoff from
adjacent properties have discharged onto this plat prior to development. stormwater runoff will likely
continue to do so after development. ft is the responsibility of the individual lot owners to meintein
existing surface peths of runofif through their respective lats and to grade the lots in accordance with
applicable rules and regulations, so as to prevertit property damage.

Any building that is constructed on a lot in this Plat shall be set at such an elevetion so as to provide
positive drainage away from any drainage entry point to the building (including but not limited to a
window wel{, a window unprotected by a window well, or a doorway Said positive drainage shall
consist af a minimum slope of 3% away from the building for a distance af at least 10 feet from the
building. The lots shall be greded so that either a) all runoff is routed away from the building, and
conveyed over the lot to a natural drainage swale or approved drainage facility, or b) drainage
intercepted on the lot is disposed of on the lot in an approved drainage facility. The approved drainage
facitity shall be constructed in accordance with any applicable accepted plans on file at the County
Engineer's Office. Any revisions to the accepted drainage plans must be accepted by the County
Engineer's Office prior to construdion of said revisions.
This short plat is located w'rthin the Acquifer Sensitive Area (ASA) Treatment of storm runoff from
driveways shall be provided. The preferred method of treatment is to have the runoff from driveways
sheet flow over (awn turf or native-Lype grasses. ff a ditch is to be used to collect runoff from driveways,

THIS MATTER, an applicaiion for subdivision of land from Dan Kelly and Kim impecoven has been received and
was decidzd upon, pursuant to Spokane County Subdivision regulations, on the 8'h day of August, 1997.
FIlYDINGS OF FACT AND CONCLUSIONS
1. The indiviciual signina below has further been properly delegated the rzsponsibility for rendering the decision
by the Director of Spokane County pivision of Building and Ptanning.
2. The proposal is to divide approximately 39,260 sq. ft. (.90 acres) into 2 tracts for 1 existing business office
and 1 new additional business / professional office.
3. The proposal is located at the soutbwest corner of Alki Avenue and Argonne Road in the SE f4 of Section 18,
Township 25 North, Range 44 E.W.M., Spokane County, Washington.
4. The existing zoning of the property described in the application is Community Business (B-2)on the east half
of the site, which was established in 1991, pursuant to the Program to Implement the Spokane County Zoning
Code. The existing zoning on the west half of the site is Urban Residc,=ntiai-22 (UR-22), which was the
subject of an approved zone change from Urban Residential-3.5 (UR-3.5) to UR-22 (file no. ZE-1 b-96) in
1996. Pursuant to Section 58.17.195 of the Reviscd Code of Vb'ashington (RCVI), this proposal conforms to
the requirements of the existing B-2 and UR-22 zones.
5. The Spokane County Comprehensive Plan designates this area as Urban. The development and uses, as
proposed and conditioned, are in compliance with the Urban category.
6. 5urrounding ases are primarily single and multifamily residence and commercial.
7. The Spokane County Artcrial Road Plan identifies Argonne Road as a Principal Arterial with a future righi-
of-way width of 100 fcet. The existing right-of-way width is 60 feeL In order to implement the Arterial
Road Plan, a strip of property 20 feet in width along the Argonne Road frontagc is to be set aside as a Future
Acquisition Area. In addition, the Spokane County Arterial Road Plan identifies Alki Avenue as a Local
Access Road with a future rigbt-of-way width of 60 feet. The existing right-of-way width is 40 feet. In order
to implement the Arterial Road Plan, a strip nf prapcrty 6 feet in width along the Alki Avenue frontage is to
be set aside as a Future Acyuisitian Area. The County Eno' ineer has requested a dedication of 4 feet of
additional right-of-way width atong Alki Avenue. Therefore, as conditioned (such as improvements,
dedication* sidewalks and acquisition areas) this proposal conforms to the Road Plan.
8. The proposed site is located within the Public Transportation Benefit Area (PTBA). The Spokane Transit
Authoritv (STA) Vallc;y/Millwood Route 19 provides connecting services to the site.
9. The proposed short plat will be served by a public water system. Waste water disposal will be as authorized
by the Director of Spokane County Division of Utilities.
10. The reqnired public notice was provided for this proposal and agencies having a potential interest in the
project were notified and recommendations solicited.
11. No written comments were received from any adjoining proparty owners.
12. Recognizin ; the recommended conditions and Spnkane County development standards, the proposed short
plat makes appropriate provisions for the pubiic health, safety and general welfare and that the public use and
mterest wili be served by plattin; the subdivision.
The subdivision praposal is generally consistent with RCW 58.17 and the Gounty subdivision regulations,
promoting the public health, safety and general welfarz in accordance with standards established by the State
and Spokane County. lhe Counry Division of Building and Planning has considered the provision of
adequate public facilities as cited in RCW 58.17.110 More specificalty:

13. Z'he project is exempt from environmental review under vie State Environmental Policy Act pursuant to
WAC 197-11-800 (6) (a).
DECISION
Based upon the above noted Findings of Fact and Conclusions, Short Plat Application SP-1154-97 is bereby
APPROVED for five (5) years, specifically to September 1, 2002 and subject to conditions noted below. This
decision is final unless appealed in writing, consistent with adopted appeal procedures.
CONDITIONS OF APPROVAL
All the below conditions imposed shall be binding on the "Applicant," which term shall include the nwner or
owners of the property, heirs, assi ;ns and successors.
SPOKANE COUNTY DIVISION OF BUILDING AND PLANNING
l. The proposal shall comply with the B-2 and UR-22 zones, ZE-16-96 and other applicable Zoning Code
chapters, as amended.
2. The final short plat shall be designed substantially in confarmance with the prel'uninary plat of record. No
increase of density or number of tracts shall occur without a change of condition application submittal and
approval.
3. The preliminary shorl plat is given conditional approval for five (5) years, specifically to September l, 2002.
The applicant may submit an extension of time application at least thirty (30) days prior to the above
expiration date. Application(s) for extension of time shall be prncessed under the provisions of Chapter
12.100.118 (Extension of Time) of the Spokane County Subdivisian Ordinance. If the applicant complies
with the criteria of Chapter 12.100.118, the preiiminary approval and conditions will be changed to reflect
the adopted policy and development regulations at the hme of the extension application.
4. Prior to recording the final short plat, the applicant shall submit to the County Division of Building and
Ptanning Director/designee for review any proposed finai short plats to ensure compliance with these
Findings and Conditions of Approval.
S. A survey is required di the subject property prinr to recording the final short piat.
6. Appropriate road name(s) and street address for each tract shall be indicated on the final short plat map.
7. Appropriate utility easements shall he indicated on the final short plat map. Written approval of utility
easements byt atility companies must be ceceived prior to recording the final short piat.
8. 1fie final short plat map shall indicate by a dashed line the required setbacks from all private or public roads.
9. The final short plat shall include the foilowing statement: "Side yard and rear yard setbacks shall be
determined at the time building permits Are requested unless these setbacks are specifically drafted on this
final shart plet. The setbacks indicated on this plat may be varied fxom if proper zoning or variance
approvals are obtained."
10. Prior to recording the final short ptat, lhe applicant shall provide four (4) current Certificates of Title to the
Division of Building and Planning.
11. The applicant shall contact the County Division of Building and Plannina at the earliest possible stage in
order to be informed of code requirements administered/enforced as authorized by the State Buildine Co@e
Act. Design/development concerns include: addressing, ire apparatus access roads, firz hydrant/flow,
Approved water systems, building accessibilitv, construction rype, occupancy classification, exitmg, exterior
wall protection, and energy code regulations.

12. The Spokane County Division of Building and Planning shall prepare and record with the County Auditor a
Title Notice specifying a fucure land acquisition area for road right-of-way and utilities. The reserved future
acquisition area Titte Notice shall be released, in full or in part, by the County Division of Building and
Planning. The notice should be recorded the same time as the final short plat and shall provide the
fotlowing:
A strip of property 20 feet in width from the existing righi-of-way is reserved for future acquisition area
for addiaonal road right-of-way alnng Argonne Road.
b. A strip of properry 6 feet in width from the existing right-of-way is reserved for future acquisition area
for additional road right-of-way along Alki Road. Note: The County Engineer required a dedication of 4
feet of addrtionai right-of-way width along Alki Road.
c. Futttre building and other setbacks required by the Spokane County Zoning Code shgll be measured from
the reserved future acquisition area.
d. No required landscaping, parking, '208' areas, drainfield or allowed signs should be located within the
future acquisition area for road right-of•way and ucilities. If any of the above improvements are made
within this area, they shall be relocated at the applicant's expense when roadway improvements are
made.
e. The future acquisition area, until acquired, shall be private property and may be used as allowed in the
zone, except that any improvements (such as landscaping, parking, surface drainage, drainfield, signs or
others) shall be considered interim uses.
f. The property owner shatl be responsible for relocadng such "interim" improvements at the time Spokane
County makes roadway improvements after acquiring said future acquisition area.
SPOKANE COUNTY DIVISION OF ENGINEERING AND ROADS
1. Conditional approval of the plat by the County Engineer is given subject to dedication of righi-of-way and
approval ofthe road system as indicated in che Preliminary Plat of Record.
2. Road plans, profiles and cross sections as designed to County standards showing proposed street eenterline
and curb grades be submitted to the County Engineer for acceptance prior to construction andlor the filing of
a final plat; road plans to be prepared under the direction of a licensed professional Givil Engineer.
3. Drainage plans and design calculations showing the alignment of drainage facilities be submitted to tfie
County Engineer for acceptance prior to construction andlor the fiiing of final short plat. Drainage plans to
be prepared under the direction of a licensed professional Civil Engineer.
4. Applicant shall comply with Zone Reclassification file no. ZE-16-96.
S. Gonsuuction within all proposed public rnads shall be performed under the direct supervision of a licensed
engineerisurveyor, who shall furnish the County Engineer with "Record Drawings" and certification which
states the following, "I have reviewed the construction and to my knowledge find it to be in substantial
conformance with approved cenified plans and Standard Specifications except as noted."
6. No construction work is to be performed within the existina or proposed public right-of-way untii plans have
been accepted by the County Engineer and a permit has been issued by the County Engineer. All work is
subject to inspection and approval by the County Engineer.
7. AU canstruction within the existing or proposed public right-of-way is to be completed prior to fiiing the final
short plat or a bond in the amount estimated by the County Engineer to cover the cost of construction of
improvements. Construction certification, "Record Drawings" and monumentation of the street centerlines
shaJl be filed with the County Engineer.
8. Approach Permits are required fior any access to the Spokane County road system.
9. Dedication of 4 feet df right-vf-way along Alki Avenue and the applicable radius on Alki Avenue and
Argonne Road.

10. The applicant shall grant applicable bnrder easements adjacent to Spokane County right-of-way per Spokane
County Standards.
11. The Counry Engincer has designated aCommercial Lacal Access Roadway Section for the improvement of
Alki Avenue which is adjacent to the proposed development. This will require the addition of approximately
11-13 feet of asphalt along the frontage of the development. The construction of curbing and sidewalk is also
required.
12. The proposed plat shall be improved to the standards set forth in Spokane County Board of Commissioners
Resolution No. 95-0498, as amended, which estabiishes regulations for roads, approaches, drainage and fees
in new construction.
13. The County Engineer has examined this development proposai and has determined that the impact of this
proposal upon the existing County Road System wanants the dedication of additional right-of-way and the
roadway improvements herein specified.
14. The applicant should be advised that there may exist utilities either underground or overhead affecting the
applicant's properry, including property to be dedicated or set aside future acquisition. Spnkane Counry will
assume no financial obligation for adjustments or relocation regarding these utilities. The apQlicant should
check with the applicabte utilities And Spokane County Enpineer to deternnine whether the applicant or utility
is responsibte for adjustment or relocation costs and to make arcangements for anv necessary work.
SPOKANE COUNTY DIViSION OF UT1LITlES
1. Pursuant to the Board of Counry Commissioners Resolution No. 80-041 S, the use oF on-site sewer disposal
systems is hereby authorized. This authorization is conditioned in compliance with all rules and rebulations
pf the Spokane Regionnl Heatth District and is further conditioned and subjecc to specific application
approval and issuance of pernnits by the Health District.
2. The final short plat shall include the following statement: "Each new unit shall be double-plumbed for
connection to future area-wide collection systems."
3. Aay water service far this proposal shAll be provided in accordance with the Coordinated Water Sysiem Plan
for Spokane County, as amended.
SPOKANE REGIONAL HEALTH DISTRICT
1. Sewage disposal method shall be as authorized by the Director of the Spokane Gounty Division of Utilities.
2. A sewer maintenance agreement shall be created/maintained for this project and shall include:
a. Purpose: The purpose of this agreement is to provide for the utilizaaon and maintenance of a common
on-site sewage disposal system consiscing of a singular septic tank and/or drainfield. It is the common
interest of the parties whose premises are on sepurate lots to be responsible for the operation and
properties using the sewage system and located an a separate property.
b. Financial Assurance: The owners of the lots, tracts, parcels using the sewage system shall agree to
equally share the total costs of the neeBed repair, replacement, reconstruction, or other procedure
necessary to restore the sewage system. Failure of the property owners to perform the work necessary to
restore the system will result in Spokane Regional HeaIth District ordenng the work to be completed
with all costs associated therewith to be shared among property owners using the sewage system.
3. Water service shall be coordinated throu?h the SpoRane County Division of Utilities.
4. Water service shall be by an existing public water supply when approved by the Regional Engineer
(Spokane), State Department of Health.
5. Prior to recordirtg the final short plnt, the sponsor shall demonstrate to the satisfaction of the Spokane
Regional Health District that an adequate and potable water supply is avaitable to each tract of the plat.
6. Prior to recording the final short plat, the sponsor shall present evidence that the plat lies within the recorded
service area of the water system proposed ro serve the plat.
7. Subject to specific application approval and issuance of permits by the Health Ufficer, the use of individual
on-site sewage disposal systems may be authorized.

14. The applicant should be advised that there may exist utilities either
underground or overhead affecting the applicants property, including
property to be dedicated or set aside future acquisition. Spokane
County will assume no financial obligation for adjustments or
relocation regarding these utilities. The applicant should check with
the applicable utilities and Spokane County Engineer to determine
whether the applicant or utility is responsible for adjustment or
relocation coste and to make arrangements for any necessary work.

I received the above referenced Qroject applicabon on July 14, 1997. The SCS Soils Map identifies this area as
being Garrison Gravely Loam soils. The soil survey in this area is known to be accurate. Therefore, since this is
an approved soil for stonnwater disposal, no concept drainage plan is required.
We have no information that says there are any critical areas on this site.
I consider this proposal to be technicalty complete.
I recommend using the standard drainage condition.

Tliat the inclividuals ancl parties named herein as Iiaving an interesl in the above described property or project agree
to the following:
I. Reimburse Spakane County for praject review and insrection fees as specified in Cliapter 9.14 nf
(lie Spokane Counry Code. Tite fees will be based on actual salary c4sts incurred by Spokane
County for project reviews and / or inspections nlus a ten percent administrative charge, and will
be billed moncliiy as accrued. Any billing amounts dtie, includiiig any expenses incurred in the
collection of an overclue account, must be paici prior to the Caunty's acceptance of the project far
filing. If aproject is apprnved and/or filed willi a balance still owing, (lie unpaid ba(ance shatl he
paid witiiin 30 days of the invoice date.
2. The undersignecf agrees that tliese fees are due and payable upon receipt of the biliing as specifieci
ahove.
3. Any invoices not paid within 30 days af the invoice date will be consiclered delinquent. [f any
outstanding balance an the account for this project is not raid within 30 days cit the invnice date,
no furtller reviews of tlle project documents will be conductecl until the entire account balance is
paid. Any balance on the accotint for tliis nroject not paid within 65 days af tlle invoice date may
result in tegat action or the initiation of otiler collection procedures, including referral tn a
coliection agency. Tlie Snonsor will be liable for any and all expenses incurred by tlle County far
tlie collection af overdue accounts.
