KATCHER ) DECISlON THIS MATTER, an application for subdivision of land from David A. Katcher has been received and was decided upon, pursuant to the Spokane County Subdivision Ordinance, on the 2011° day of April, 1998. FINDiNGS OF FACT AND CONGLUSIONS . The individual signing below has further been properly delegated the responsibility for rendering this decision by ihe Director of Spakane County Division of Building and Ptanning. 2. The proposal is to divide approximately 4.55 acres into fiour (4) lots approximately 1.1 acres in size. An existing single family residence, garage and multiple accessory buildings are located on the property. The existing buildings will remain on one lot and the three newly created lots will be vacant. • 3. The proposal is located west of and adjacent to Long Road, approximately 600 feet north of Indiana Avenue in the in the southwest of Section 7, Township 25 North, Range 45 East W.*., Spokane County, Washington. The site address is 2201 N. Long Road and the assessor"s parcel number is 55073.0103. 4. The existing zoning of the property is Suburban Residentia!-1 (SR-1). The applicant has requested approval of the short plat for the purpose of developing singte family residences which are permitted uses in the SR-1 zone. Pursuant to Revised Ccde of Washington (RC11V) 58.17.195, this proposal conforms to the requirements ofi the existing SR-1 zone. 5. The Spokane County Comprehensive Plan designates this area as Urban. The Urban category is intended to provide for the development of single family, two family and multi-family residential development with densities ranging from 1 to 17 units per acre. The development and uses, as proposed and conditioned, are consistent with the purpose and intent of the Urban category. 6. The proposal is located inside the tnterim Urban Growth Area (IUGA) boundary adopted by the Spokane Board of County Commissioners on April 11, 1997. 7. An existing single family residence, garage and accessory structures are located on the subject property. The surrounding land uses are primarily single famity residences on lots ranging from 1/2 acre to five acres and larger in size. The area is pnmarily suburban to semi-rural in nature. Large animal keeping is common in the surrounding area. The Spokane River is tocated approximately mile north of the site. Roads in the area are typically asphalt without curb or sidewalks. S. The Spokane County Arterial Road Plan identifies Long Road as a local access street. The existing right-of-way width is 60 feet. Provisions for roadway improvements are contained in the conditions of approval submit#ed by the Spokane County Division of Engineering and Roads. 9. The property is located inside the Public Transpo►tation Benefit Area (PTBA). 10. The proposed short plat will be served by public water. Waste water disposal will be handled by the use of individual on-site sewage disposal systems. 11. The required public notice was provided for this proposal and agencies having a potential interest in the project were notified and recommendations solicited. 12. A notice of application which included a 14-day public comment period was mailed to adjacent property owners on March 20, 1998. No comments were received in response to the notice of application. 13. Recognizing the recommended conditions of approval and Spokane County development standards, the proposed short plat makes appropriate provisions for the public health, safety and general welfare and the public use and interest will be served by approving the short plat. The short plat proposal is generally consistent with RCW 58.17 and the Spokane County subdivision regulations, promoting the public health, safety and general welfare in accordance with standards established by the State and Spokane County. The Division of Building and Planning has considered the provision of adequate public facilities as cited in RCW 58.17.110 (2). More specifically: a. open spaces f. sanitary waste disposal b. drainage ways g. parks and recreation facilities c. public and/or private right-of-ways h. playgrounds d. transit i. schools and school grounds e. potable water j. sidewalks 14. The project is exempt from environmental review under the State Environmental Policy Act pursuant to WAC 197-11-800 (6) (a). DECISION Based upon the above Findings of Fact and Conclusions, Short Plat Application SP-1177-98 is hereby APPROVED for five (5) years, specifically to April 20, 2003 and subject to conditions noted below. This decision is final unless appealed in writing, consistent with adopted appeal . procedures. CONDITIONS OF APPROVAL All the below conditions imposed shall be binding on the "Applicant," which term shall include the owner or owners of the property, heirs, assigns and successors. SPOKAIVE COUNTY DIVISION OF BUILDING AND PLANNING 1. The proposal shall comply with the Suburban Residential-1 (SR-1) zone and other applicable Zoning Code chapters, as amended. 2. The final short plat shall be designed substantially in conformance with the preliminary plat of record. 3. The preliminary short plat is given conditional approval for five (5) years, specifically to April 20, 2003. The applicant may submit an extension of time application thirty (30) days prior to the above expiration date. Application(s) for extension of time shall be processed under the provisions of Chapter 12.100.118 (Extension of Time) of the Spokane County Subdivision Ordinance. 4. Prior to filing the final short plat, the applicant shall submit to the County Division of Building and Planning Director/designee for review any proposed final short plats to ensure compliance with these Findings and Conditions of Approval. 5. A survey is required of the subject property prior to filing the final short plat. 6. Appropriate road names and street addresses shall be indicated on the final short plat map. 7. Appropriate utility easements shall be indicated on the final short plat map. Approval of utility easements by utility companies must be received prior to filing the final short plat. Findings and Decision SP-1177-98 2 8. The dedication shail contain the following statement: "Setbacks shall be determined at the time building permits are requested unless setbacks are specifically drafted on this final short p1at. The setbacks indicated on this subdivision may be vaned from if proper zoning or variance approvals are obtained." 9. Four (4) current Certificates of Title shall be fumished to the County Division of Building and Planning prior to filing the final short plat. 10. The Spokane County Division of Building and Planning shall prepare and record with the Spokane County Auditor a"Title Notice" noting that the property in question is subject to a variety of special conditions imposed as a result of approval of a land use action. This 'Title Notice" shall serve as official public notice regarding conditions of approval affecting the property in question. The "Title Notice" shall be recorded within fifteen (15) days of final disposition of the approved land use action and sha11 only be extinguished by the Spokane County Division af Building and Planning. The "Title Notice" shall generally provide as follows: The parcel of property legally described as (legal description and tax parcel number) is the subject of a land use action, imposing a variety of special development conditions, by a Spokane County Hearing Body or Administrative Official on (date) and as maybe amended, altered or supplemented by official action or as already changed. File No. SP-1177-98 is available for inspection and copying in the Spokane County Division of Building and Planning. SPOKANE COUNTY DIVISION OF ENGINEERtNG AND ROADS 1. That conditional approval of the plat by the County Engineer is given subject to approval of the road system as indicated in the preliminary plat of record. 2. No construction work is to be performed within the existing or proposed Public right-of-way until plans have been accepted by the County Engineer and a permit has been issued by the County Engineer. AI( work is subject to inspection and approval by the County Engineer. 3. Approach Permits are required for any access to the Spokane County road system. 4. The applicant shall grant applicabfe border easements adjacent to Spokane County Right of Way per Spokane County Standards. 5. The proposed driveway shall serve a maximum of three lots as per adopted Spokane County Road Standards. Use of the easement by four or more Iots shall require submission of road and drainage plans and other documentation for acceptance by the County Engineer. 6. To construct the road improvements stated herein, the applicant may, with the approval of the County Engineer, join in and be a willing participant in any petition or resolution which purposes is the formation of a Road lmprovement District (RID) for said improvements pursuant to RCW 36.88, as amended. Af such time as an R!D is created or any Raad Improvement Project is sanctioned by Spakane County, the improvements required (curb, sidewalk, drainage control and paving to existing pavement) will be at the sole expense of the undersigned owner, their heirs, grantees and assigns. This provision is applicable to Long Road. 7. As an alternative method of construc:ing the road improvement stated herein, the applicant may, with the approval of the County Engineer, accomplish the road improvements stated herein by joining and participating in a County Road Project (CRP) to the extent of the required road improvement. At such time as an RID is created or any Road Improvement Project is sanctioned by Spokane County, the improvements required (curb, sidewalk, drainage control and paving to existing pavement) wi11 be at the sole expense of the undersigned owner, their heirs, grantees and assigns. This provision is applicable to Long Road. Findings and Decision SP-1177-98 3 ~ 8. That the following statement shall appear within the dedicatory language of the fnal piat: That in consideration of Mutual Benefits now or to be hereafter derived, do for themselves, their heirs, grantees, assigns and successor(s) in interest hereby request and authorize Spokane County to include the above described property in a Road Improvement District (RID) and to support the formation of a Road Improvement District for improvement of the road(s) described befow by requesting and authorizing Spokane County to place their name(s) on a petition for the formation of a Road Improvement District pursuant to RCW 36.88.050, or by requesting and authorizing Spokane County to cast their ballot in favor of a RID being formed under the resolution method pursuant to RCW 36.88.030, and/or by not filing a protest against the formation of a RID being formed under the alternative resolution method provided for in RCW 36.88.065 and Chapter 35.43 RCW. If a RID is proposed for improvement of the road(s) described below, said owner(s) and successor(s)further agree: (1) that the improvements or construction contemplated within the proposed RID are feasible and (2) that the benefits to be derived from the formation of the RID by the property included therein, together with the amount of any County participation, exceeds the cost and expense of formation of the RID, and (3) that the property within the proposed RID is sufficiently developed; provided, themselves, their heirs, grantees, assigns and successor(s) shall retain the right, as authorized under RCW 36.88.090, to object to any assessment(s) on the property as a result of the improvements catled for in conjunction with the formation of a RID by either the petition or resolution method under Chapter 36.88 RCW and to appeal to the Superior Court the decision of the Board of County Commissioners confirming the final assessment roll; provided further, it is recognized that actual assessments may vary from assessment estimate so long as they do not exceed a figure equal to the increased true and fair value improvement(s) add(s) to the property. It is further acknowledged and agreed that at such time as a RIDis created or any County Road Improvement project is authorized by Spokane County, the improvements required shall be at the sole expense of the owner(s) of property within the RID or served by the improvements without any monetary participation by Spokane County. " The RID waiver contained in this agreement shall expire after ten (10) years from the date of execution below. This provision is applicable to Long Road. 9. The County Engineer has designated a Local Access Roadway Section for the improvement of Long Road which is adjacent to the proposed development. This will require the addition of approximately 6-8 feet of asphalt along the frontage of the development. The construction of curbing and sidewalk is also required. 10. The proposed plat shall be improved to the standards set forth in Spokane County Board of Commissioners Resolution No. 95-0498, as amended, which establishes regulations for roads, approaches, drainage and fees in new construction. 11. The County Engineer has examined this development proposal and has determined that the impact of this proposal upon the existing County Road System warrants the roadway improvements herein specified. SPOKANE COUNTY DIVISION OF UTILITIES 1. Pursuant to the Board of County Commissioners Resolution No. 80-0418, the use of on-site sewer disposal systems may be authorized. This authorization is conditioned in compliance with all rules and regulations of the Spokane County Health District and is further conditioned and subject to specific application approval and issuance of permits by the Health District. 2. The dedication shall state: Each new building shall be double plumbed with a dry side sewer for connection to future area-wide wastewater collection systems. NOTE: Plans acceptable to the Division of Utilities may be required. 3. The dedication shall state: The double plumbed dry side sewer shall be extended to the public right-of-way or as required by the Division of Utilities. To facilitate connection to the future public Findings and Decision SP-1177-98 4 f sewer system. Double plumbing dry side sewer plans acceptabie to the Division of Utilities may be required. 4. Side sewer easement with a width acceptable to the Division of Utilities shall be shown on the face of the plat as "Sewer and Utilities Easement". 5. Any water service for this project shall be pravided in accordance with the Coordinated Water System Plan for Spokane County, as amended. SPOKANE REGIONAL HEALTH DfSTRICT 1. The final plat shall be designed as indicated on the preliminary ptat of record andlor any attached sheets as noted. 2. Appropriate utility easements shall be indicated on copies of the preliminary plat of record for distribution by the Building and Planning Division to the utility companies, Spokane County Engineer and the Spokane County Health District. Written approval of the easements by the utility companies must be received prior to the submittal of the final plat. 3. Sewage disposal method shall be as authorized by the Director of Utilities, Spokane County. 4. Water service shall be coordinated through the Director of Utilities, Spokane County. 5. Water service shall be by an existing public water supply when approved by the Regional Engineer (Spokane), State Department of Health. . 6. Prior to filing the final plat, the sponsor shall demonstrate to the satisfaction of the Spokane Regional Health District that an adequate and potable water suppiy is available to each tract of the plat. - 7. Prior to filing the final plat, the sponsor shall present evidence that the plat lies within the recorded service area of the water system proposed to serve the plat. 8. A plan for water facilities adequate for domestic use, domestic irrigation use, and fire protection use shall be approved by the water purveyor. Said water plan must have been approved by the fire protection districf and the appropnate heaith authorities. The heaith authorities, water supplier (purveyor), and the fire protection district will certify, prior to the filing of the final plat, on the face of said water plan that the plan is in conformance with their requirements and will adequately satisfy their respective needs. Said water plan and certification will be drafted on a transparency suitable for reproduction. 9. The purveyor will also certify prior to filing the final plat on a copy of said water plan that appropriate contractual arrangements have been made with the plat sponsor for construction of the water system, in accordance with the approved plan and time schedule. The time schedule will provide, in any case, for completion of the water system and inspection by the appropriate heaith authorities prior to application for building permits within the plat. The contractual arrangements will include a provision holding Spokane County, Spokane Regionaf Heafth District, and the purveyor harmless from claims by any tract purchaser refused a building permit due to failure of the plat sponsor to satisfactoriiy complete the approved water system. 10. Prior to filing the final ptat, the sponsor shall demonstrate io the satisfaction of the Spokane Regionai Health District that suitable sites for on-site sewage disposal systems are available on tracts B, C and D. 11. Subject to specific application approval and issuance of permits by the Health Officer, the use of individual on-site sewage system may be authorized. 12. Katcher has been received and was decided upon, pursuant to the Spokane County Subdivision Ordinance, on the 20'" day of April, 1998. FINDINGS OF FACT AND CONCLUSIONS 1. The individual signing below has further been properly delegated the responsibility for rendering this decision by the Direcior of Spokane County Division of Building and Planning. 2. The proposal is to divide approximately 4.55 acres into four (4) lots approximately 1.1 acres in size. An existing single family residence, garage and multiple accessory buildings are located on the property. The existing buildings will remain on one lot and the three newty created Iots will be vacant. 3. The proposal is located west of and adjacent to Long Road, approximately 600 feet north of Indiana Avenue in the in the southwest'/. of Section 7, Township 25 North, Range 45 East W.M., Spokane County, Washington. The site address is 2201 N. Long Road and the assessors parcel number is 55073.0103. 4. The existing zoning of the property is Suburban Residential-1 (SR-1). The applicant has requested approval of the short plat for the purpose of developing single family residences which are permitted uses in the SR-1 zone. Pursuant to Revised Code of Washington (RCVU) 58.17.195, this proposal conforms to the requirements of the existing SR-1 zone. 5. The Spokane County Comprehensive Plan designates this area as Urban. The Urban category is intended to provide for the development of single family, two family and multi-family residential development with densities ranging from 1 to 17 units per acre. The development and uses, as proposed and conditioned, are consistent with the purpose and intent of the Urban category. 6. The proposal is located inside the Interim Urban Growth Area (IUGA) boundary adopted by the Spokane Board of County Commissioners on April 11, 1997. 7. An existing single family residence, garage and accessory structures are located on the subject property. The surrounding land uses are primarily single family residences on lots ranging from '/Z acre to five acres and larger in size. The area is pnmarily suburban to semi-rural in nature. Large animal keeping is common in the surrounding area. The Spokane River is located approximateiy %4 mile north of the site. Roads in the area are typically asphalt without curb or sidewalks. 8. The Spokane County Arterial Road Pfan identifies Long Road as a local access street. The existing right-of-way width is 60 feet. Provisions for roadway improvements are contained in the conditions of approval submitted by the Spokane County Division of Engineering and Roads. 9. The property is located inside the Public Transportation Benefit Area (PTBA). 10. The proposed short plat will be served by public water. Waste water disposal will be handled by the use of individual on-site sewage disposal systems. 11. The required public notice was provided for this proposal and agencies having a potential interest in the project were notified and recommendations solicited. ~ 12. A notice of application which included a 14-day public comment period was mailed to adjacent property owners on March 20, 1998. No comments were received in response to the notice of application. 13. Recognizing the recommended conditions of approval and Spokane County development standards, the proposed short plat makes appropriate provisions for the public health, safety and general welfare and the public use and interest will be served by approving the short plat. The short plat proposal is generally consistent with RCW 58.17 and the Spokane County subdivision regulations, promoting the public health, safety and general welfare in accordance with standards established by the State and Spokane County. The Division of Building and Planning has considered the provision of adequate public facilities as cited in RCW 58.17.110 (2). More specifically: a. open spaces f. sanitary waste disposal b. drainage ways g. parks and recreation facilities c. public and/or private right-of-ways h. playgrounds d. transit i. schools and school grounds e. potable water j. sidewalks 14. The project is exempt from environmental review under the State Environmental Policy Act pursuant to WAC 197-11-800 (6) (a). DECISION Based upon the above Findings of Fact and Conclusions, Short Plat Application SP-1177-98 is hereby APPROVED for five (5) years, specifically to April 20, 2003 and subject to conditions noted below. This decision is final unless appealed in writing, consistent with adopted appeal procedures. CONDITIONS OF APPROVAL All the below conditions imposed shall be binding on the "Applicant," which term shall include the owner or owners of the property, heirs, assigns and successors. SPOKANE COUNTY DIVISION OF BUILDING AND PLANNING 1. The proposal shall comply with the Suburban Residential-1 (SR-1) zone and other applicable Zoning Code chapters, as amended. 2. The final short plat shall be designed substantially in conformance with the preliminary plat of record. 3. The preliminary short plat is given conditional approval for five (5) years, specifically to April 20, 2003. The applicant may submit an extension of time application thirty (30) days prior to the above expiration date. Application(s) for extension of time shall be processed under the provisions of Chapter 12.100.118 (Extension of Time) of the Spokane County Subdivision Ordinance. 4. Prior to filing the final short plat, the applicant shall submit to the County Division of Building and Planning Director/designee for review any proposed final short plats to ensure compliance with these Findings and Conditions of Approval. 5. A survey is required of the subject property prior to filing the final short plat. 6. Appropriate road names and street addresses shall be indicated on the final short plat map. 7. Appropriate utility easements shall be indicated on the final short plat map. Approval of utility easements by utility companies must be received prior to filing the final short plat. This will require the addition of approximately 6-8 feet of asphalt along the frontage of the development. The construction of curbing and sidewalk is also required. 10. The proposed plat shall be improved to the standards set forth in Spokane County Board of Commissioners Resolution No. 95-0498, as amended, which establishes regulations for roads, approaches, drainage and fees in new construction. 11. The County Engineer has examined this development proposal and has determined that the impact of this proposal upon the existing County Road System warrants the roadway improvements herein specified. SPOKANE COUNTY DIVISION OF UTILITIES 1. Pursuant to the Board of County Commissioners Resolution No. 80-0418, the use of on-site sewer disposal systems may be authorized. This authorization is conditioned in compliance with all rules and regulations of the Spokane County Health District and is further conditioned and subject to specific application approval and issuance of permits by the Health District. 2. The dedication shall state: Each new building shall be double plumbed with a dry side sewer for connection to future area-wide wastewater collection systems. NOTE: Plans acceptable to the Division of Utilities may be required. 3. The dedication sha11 state: The double plumbed dry side sewer shall be extended to the public right-of-way or as required by the Division of Utilities. Any water service for this project shall be provided in accordance with the Coordinated Water System Plan for Spokane County, as amended. SPOKANE REGIONAL HEALTH DISTRICT 1. The final plat shall be designed as indicated on the preliminary plat of record and/or any attached sheets as noted. 2. Appropriate utility easements shall be indicated on copies of the preliminary plat of record for distribution by the Building and Planning Division to the utility companies, Spokane County Engineer and the Spokane County Health District. Written approval of the easements by the utility companies must be received prior to the submittai of the final plat. 3. Sewage disposal method shall be as authorized by the Director of Utilities, Spokane County. 4. Water service shall be coordinated through the Director of Utilities, Spokane County. 5. Water service shall be by an existing public water supply when approved by the Regional Engineer (Spokane), State Department of Health. 6. Prior to filing the final plat, the sponsor shall demonstrate to the satisfaction of the Spokane Regional Health District that an adequate and potable water supply is available to each tract of the plat. _ 7. Prior to filing the final plat, the sponsor shall present evidence that the plat lies within the recorded service area of the water system proposed to serve the plat. 8. A plan for water facilities adequate for domestic use, domestic irrigation use, and fire protection use shall be approved by the water purveyor. Said water plan must have been approved by the fire protection district and the appropriate health authorifies. The health authorities, water supplier (punreyor), and the fire protection district will certify, prior to the filing of the final plat, on the face of said water plan that the plan is in conformance with their requirements and will adequately satisfy their respective needs. Said water plan and certifrcation will be drafted on a transparency suitable for reproduction. 9. The purveyor will also certify prior to filing the finat plat on a copy of said water plan that appropriate contractual arrangements have been made with the plat sponsor for construction of the water system, in accordance with the approved plan and time schedule. The time schedule will provide, in any case, for completion of the water system and inspection by the appropriate hea(th authoriiies prior to application for building permits within the pfat. The contractual anangements will include a provision holding Spokane County, Spokane Regional Health District, and the purveyor harmless from claims by any tract purchaser refused a building permit due to failure of the plat sponsor to satisfactorily complete the approved water system. 10. Prior to filing the final plat, the sponsor shall demonstrate to the satisfaction of the Spokane Regional Health District that suitable sites for on-site sewage disposal systems are available on tracts B, C and D. 11. Subject to specific application approval and issuance of permits by the Health Officer, the use of individual on-site sewage system may be authorized. 12. The dedicatory language of the plat will state: "Subject to specific application approval and issuance of permits by the Health Officer, the use of individual on-site sewage disposal systems may be authorized."
