is composed af grass lawms, pasture, gravel driveway,and and raofs. StQrnlwater flaws overland acrvss grass
lawms, and pasture to tbe sauth toward Valleyway_
The Rativnal Methods was usel to calcuiate the peak stormwater runofF for pre developed rAnditions and the
post dcvel4ped conditions and aniy had an increase of 0.04 cfs.
In accordance with "Soil Survey, Spokane Caunty, Washington", 1968, the sotl is categorized as:
GgA, Garrison gravelly loam,
Figure 2, page 6-3, of the "Guidefines for Stonnwater Management", by Spokane Courrty Engineers, tivas used

THIS MATTER, an application for short subdivision from Bill Malinal: has been received and was
decided upon, pursuant to Spokane County Subdivision regulations, on the 21 st day of April, 1998.
FINDINGS OF FACT AND CONCLUSIONS
1. The individual signing below has further been properly detegated the responsibility for rendering
the decision by the Director of Spokane County Division of Building and Planning.
2. The proposal is to divide approximately 3 acres into 2 tracts for 1 e,cisting single-family residence
and l new additional residential tract.

wliich was established in 1991. Pursuant to Section 58.17.195 of the Revised Code of Washington
(RCVV), this proposal conforms to the requirements of the existing UR-3.5 zone.
5. The Spoka.ne County Comprehensive Plan designates this area as Urban. The development and
uses, as proposed and conditioned are in accord with the Urban Category. This proposal is also
compatible with the surrounding uses, which are primarily single-family residences.
6. The Spokane County Arterial Road Plaa identifies Valley Way as a Collector Arterial, with a
future right-of-way width of 70 feet. The existing right-of-way width is 40 feet. Tn order to
implement the Arterial Road Plan, the County Engineer requires a dedication of 2.5 feei of
additional right-of-way. In addition, to the required right-of-way dedicatioa, a 12.5-foot wide strip
of the subject property along the frontage of Valley Way is to be set aside as a Future Acquisition
Area. Therefore, as conditioned, (such as improvements, sidewalks, dedications and acquisition
areas) the proposal conforms ta tiie Road Plan.
7. The proposed site is located within the Public Transportation Benefit Area (PT}3A). The Spokane
Transit Authority (STA) Broadway Route No. 18 provides connecting services to the site.
8. The proposed short plat will be served by a public water system. Waste water disposal will be as
authorized by tlie Director of Spokane County Division of Utilities.
9. Tlie required public notice and comment period was prnvided for this proposal. In addition those
agencies having a potential interest in the proposal were notified and comments solicited. No
written comments were received from any adjoining property owner(s) reggrarding this proposal.
10. Recognizing the recommended conditions and Spokane County development standards, the
proposed short plat makes appropriate provisions far the public heatth, safety and general welfare
and that the public use and interest will be served by platting the subdivision. The subdivision
proposal is generally consistent with RCW 58.17 and the County subdivision regulations,
promoting the public healih, safety and general weifare in accordance with standards est,ablished
by the State and Spokane County. Tbe County Division of Building and Planning has considered
the provision of adequate public facilities as cited in RCW 58.17.110(2). More specifically:
a. open spaces f. sanitary waste disposal
b. drainage ways g. parks and recreation facilities
c. public and/or private right-of-ways h. playgrounds
d. transit i. schools and school gcounds
e. potable water j. sidewalks
11. Pursuant to the Washington Administrative Code (WAC) 197-11-800 (6) (a), this proposed short
plat is exempt from the State Environmental Policy Act (SEPA) environmental review,
DECISION
Based upon the above-noted Findings of Fact and Conclusions, Short Plat Application SP-l 178-98 is
bereby APPROVED for five (5) years, specificalty to 14iay 1, 2003, and subject to conditions noted
below. This decision is final unless appealed in writing, consistent with adopted appeal procedures.
CONDI'I'IONS OF APPRUVAL
All the beiow conditions imposed shall be binding on the "Applicant," which term shall include the
owner or owners;of the property, heirs, assigns and successors.
SPOKANE COLTNTY DIVISION OF BUILDING AND PLANNING
1. The proposal shall comply with the Urban Residential-3.5 (UR-3.5) zone and other applicable
Zoning Code chapters, as ameaded.
2. T'he ftnal short plat shall be designed substantially in conformance with the preliminary plat of
record. No increase of density or number of tracts shall occur without a change of condition
application aubmittal and approval.
3. The preiiminary short plat is given conditional approval for five (5) years, specifically to May l,
2003. Tlle applicant may submit an extension of time application at least thirty (30) days prior to
the above expiration date. Application(s) for extension of time sha11 be processed under the
provisions of Chapter 12.100.118 (Fxtension of Time) of the Spokane Gounty Subdivision
Ordinance. If the applicant complies with the criteria of Chapter 12.100.118, the preliminary
approval and conditions will be changed to reflect the adopted policy and development regulations
at the time of the extension application.
4. Prior to recording the final short plat, the applicant shall submit to the County I?ivision of Building
and Planaing Directorldesignee for review any proposed final short plats to ensure compliance
with these Findings and Conditions of Approval.
5. A survev is required of the subject property prior to recording the final short plat.
6. Apprapriatz road name(s) and street address for each tract shall be indicated on the final short plat
map.
7. Appropriate utiliiy easements shall be indicated on the final short plat map. Written approval of
utiliry easzments by utility companies must be received prior to recording 1he final short plat.
8. The final short plat map shall indicate by a dashed line the required setbacks from all private or
public roads.

9. The final short plat dedication shall contain the following statement: "Side yard and rear yard
setbacks sllall be determined at the time building permits are requested unless these setbacks are
specifically drafted on this short plat. 'I'he setbacks indicated on this plat may be varied from if
proper zoning or variance approvals are obtained."
10. Prior to recordin~ the frnal short plat, the applicant shall provide four (4) current Certificates of
Tit1e to the Divisioo of IIuilding and Planaing.
11. The applicant shall contact the County Division of Building and Planning at the earliest possible
stage in ordet to be informed of code requirements administered/enforced as authorized by the
State Building Code Act. Design/development concerns include: addressing, fire apparatus access
roads, fire hydrantlflow, approved water systems, building accessibility, construction type,
occupancy classification, exiting, exterior wall protection, and energy code regulations.
12. The Spokane County Division of Building and Planning shall prepare and record with the County
Auditor a Titte Notice specifying a future Iand acquisition area for road right-of-way and utilities.
The Title Notice shall state the following:
a. A strip of property 12.5 feet in width from the exisiing and/ or dedicated right-of-way is
reserved as a future acquisition area for additional road right-of-way width along Valley Way.
Note: The County Engineer required a dedication of 2.5 feet of additional right-of-way along
Valley Way.
b. Future building and other setbacks required by the Spokane County Zoning Code shall be
measured from the reserved future acquisition area.
c. No required landscaping, parking, '208' areas, drainfield or allowed signs should be located
within the future acquisition area for road right-of-way and utilities. If any of the above
improvements are made within this area, they shall be relocated at the applicant's expense
when roadway improvements are made.
d. The future acquisition area, until acquired, shall be private property and may be used as
allowed in the zone, except that any improvements (such as landscaping, parl.ing, surface
drainage, drainfield, signs or others) shall bc considered interim uses.
e. The property owner shall be responsible for relocating such "interim" improvements at the
time Spokane County mal:es roadway improvements after acquiring said future acquisition
area.
SPOKANE COUNTY DIVISION OF ENGINEERING AND ROADS
l. The conditionat approval of the short plat by the County Engineer is given subject to dedication of
right-of-way and approval of the road system as indicated in the Preliminary Plat of Record.
2. No Construction work is to be performed within the existing or proposed public right-of-way until
plans have been accepted by the CQUnty Engineer and a permit has been issued by the County
Engineer. All work is subject to inspection and approval by the County Engineer.
3 Approach Permits are required for any access to the Spokane County Road System.
4. Dedication of 2.5 feet of right-of-way along Vailey Way is required.
5. The applicant shall grant applicable bocder easements adjacent to Spokane County right-of-way

6. To c;onstruct the road improvements stated herein, the applicant may, witli the approval of the
County Engincer, join in and be a willing participant in any pctition or resolution which pucposes
is the formation of a Road Improvemeat District (RID) for said improvements pursuant to RCW
36.88, as amended. At such time as an RID is created or any Road Improvement Project is
sanctioned by Spokane County, the improvements required (curb, sidewalk, drainage control and
paving to existing pavement) will be at the sole expense of the undersigned owner, their heirs,
grantees and assigns. This provision is applicable to Valley Way.
7. As an alternative method of constructing the road improvement stated herein, the applicant may,
with the approval of the County Engineer, accomplish the road improvements stated herein by
joining and participating in a County Road Project (CRP) to the extcnt of the required road
improvement. At such time as an RID is created or any Road Improvement Project is sanctioned
by Spokane County, the improvements required (curb, sidewalk, drainage control and paving to
existing pavement) will be at the sole expense of dle undersigned owner, their heirs, grantees and
assigns. This provision is applicable to Valley Way.
8. The final short plat dedication shall contain the following statement:
"in consideration of Mutual Benefits now or to be hereafter derived, do for themselves,
their heirs, grantees, assigns and successor(s) in interest hereby request and authorize
Spokane County to include the above-described property in a Road Improvement District
(RID) and to support the formation of a Road Improvement District for improveruent of
the road(s) described below by requesting and authorizing Spakane County to place their
name(s) on a petition for the formation of a Road Improvement District pursuant to RCW .
36.88.050, or by requesting and authorizing Spokane County to cast their ballot in favor of
an RID being formed under the resolution method pursuant to RCW 36.88.030, and/or by
not filing a protest against the formatian of an RID being formed under the alternative
resolution method provided for in RGW 36.88.065 and Chapter 35.43 RCW. ~
"If an RID is proposed for improvement of the road(s) described below, said owner(s) and
successor(s)further agee: (1) that the improvements or construction contemplated within
the proposed R1n are feasible and (2) that the benefits to be derived from the formation of
the RID by the property included therein, together with the amount of any County
participation, exceeds the cost and expense of formation of the RID, and (3) that the
propertv within the proposed RID is sufficiently developed; provided, themselves, their
heirs, grantees, assigns and successor(s) shall retain the right, as authorized under RCW
36.88.090, to object to any assessment(s) on the property as a result of the improvements
called for in conjunction with the formation of an RID by either ihe petition or resolution
method under Chapter 36.88 RCW and to appeal to the Superior Court the decision of the
Board of County Commissioners confirming the final assessment roll; provided further, it
is recognized that actual assessments may vary from assessment estimate so long as they
do not eacCecd a Fgure cqual to the increased true and fair valuc improvement(s) add(s) to
the property.
"it is further acknowledged and agreed that at such time as an RID is created or any
County Road Improvement project is authorized by Spokane County, the improvements
required shall be at the sole expense of the owner(s) of property within the RTD or served
bv the improvements without any monetary prirrticipation by Spokane County.
"The RID waiver contained in this agreement shall expire after ten (10) years from the date
of execution below. This provision is applicable to Valley Way."
9. The Countv Engineer has designated a Collector Arterial Roadway Section for the improvement of
Valley Way wliich is adjacent to the proposed development. This will require the addition of
approximately 8.5 to 10.5 feet of asphalt along the frontage of the development. The construction
of curbin~ and sidewalk is also required.

10. The appl icant shall provide documentation to the satisfactidn of the Count Engineer that the
proposed access to Tract "B" shall meet private driveway standards. Shauld the driveway serve
more than three lots it shall be constructed to private road standards. Road and drainage plans are
required for private roads and require additional information to be submitted as prescribed by the
County Enginecr.
11. The proposed short plat shall be improved to the standards set forth in Spokane County Board of
Commissioners Resolution No. 95-0498, as amended, which establishes regulations for roads,
approaches, drainage and fees in new construction.
12. T'he County Eng'rneer has examined this development proposal and has determined that the impact
of this proposal upon the existing County Road System warrants the dedication of additional right-
of-way and the roadway improvements herein specified.
13. The County Arterial Road pian identifies Valley Way as a 70-foot Coltector Arterial. The existing
right-of-way width of 40 feet is not consistent with that specified in the Plan. In order to
implement the Arterial Road Plan it is recommended that in addition to the required right-of-way
dedicatinn, a strip of property 12.5 feet in width along the Valley Way frontage be set aside in
reserve. fihis property may be acquired by Spokane County at the time when Arterial
ImprnvemenLs are made to Valley Way.
14. T'he applicant should be advised that there may exist utilities eit6er underground or overhead
affecting the applicants property, including property to be dedicated or set aside future acquisition.
Spokane County will assume no financiat obligation for adjustments or relocation regarding these
utilities. The appticant should check with the applicable utilities and Spokane County Engineer to
determine whether the applicant or utility is responsible fur adjustment or relocation costs and to
make arrangements for any necessary work.
SPOKANE COUNTY DIVISION OF UTILTTIES
l. Pursuant to the Board of County Commissioners Resolution No. 80-0418, the use of on-site sewer
disposal systems is hereby authorized. This authorization is conditioned in compliance with all
rules and regulations of the Spokane Regional Health District and is further conditioned and
subject to specific application approval and issuance of permits by the Health District.
2. The dedicatory language on the final short plat shall state: "Eaeh new building shall be double-
plumbed with a dry side sewer for connection to future area-wide wustewater collection systems."
Note: Plans acceptable to the Division of Utilities may be required.
3. 1'he dedicatocy language on the final short plat shall state: "The double-plumbed dry side sewer
shall be extended to the public right-of-way or as required by the Division of Utilities. To
facilitate connection to the future public sewer system, doubte-plumbing dry side sewer plans
acceptable to the Division of Utilities may be required."
4. Side sewer easement with a width acceptable to the Division of Utilities shall be shawn on the face
of the plat as "Sewer and Utilities Easement."
5. Any water service for this project shall be provided in accordance with the Coordinated Water
System Plan for Spokane County, as amended.
SPOKANF. REGIONAL HEALTH DISTRICT
1. Sewaee disposal method shall be as authorized by the Director of the Spokane County Division of
Utilities.

2. Water service shall be coordinated through the Spokane County Division of Utilities.
3. Water service shall be by an existing public water supply when approved by the Regional Engineer
(Spokane), State Department of Health.
4. Prior to recording the final short plat, the applicant shall demonstrate to tlle satisfaction of the
Spokane Regional Health District thnt an adequate and potable water supply is available to each
tract of the plat.
5. Prior to recarding the final short plat, the applicant shail present evidence that the plat lies within
the recorded service area of the water system proposed to serve the plat.
6. Prior to recordiog the final short plat, Uie applicant sliall demonstrate to the satisfaction of the
Spokane Regianal Health District that suitable sites for on-site sewage disposal systems are
available oo Tract B.
7. Subject to specific application approval and issuance of permits by the Health Officer, the use of
individual on-site sewage disposal systems may be authorized.
8. The final short piat shall contain the following statement: "Subject to specific application approval
and issuance of permits by the Health Officer, the use of individual on-site sewage systems may be
authorized."
. 9. The final short plat dedication shall contain the following statement: "Use of private wells and
water systems is prohibited."
10. The final short plat dedication shall contain the following statement: "The public water system
+ shall be installed within this short plat, and the applicant shall provide foc individual domestic

of a building permit for each tract."

l. The installation of a new fire hydrant will be required at the drivewav and Valley Way prior to

That tlie indiviclunls and parties namecl lierein as lilving an interest in ttie ahave described properly or praject asree
to the following:
1. Reirnhtirse Spokane County for project review and insrection fees as specifiecl in Chapter 9.14 of
tlie Spokane County Cocle. The fees wiil be basecl on actual salary costs incurred by Spokane
County for Project reviews and / or inspections plus a len percent aciministrative cliarge, and will
be billect monttily as accrued. Any billing nmaunts due, including any expenses incurred in tlie
callection of an overdue account, must be paicl prior ta tlie County's acceptance of the nroject for
filins. If aproject is approved andlor filed witli a balance still awing, tlie unpaid halance sliall be
paid within 30 days of the invoice date.
2. The undersigned agrees tliat tflese fees are due and payahle tipon receipt of tlie billing as specified
above.
3. Any invaices not paid witliin 30 clays aF tlie invaice ciate wili tie considered delinqtient. IF any
rnitstancfing halance on tlie account for tliis project is nol pnid witliin 30 days of the invoice date,
na furtlier reviews of the project clocuments will he conducted until tlie entire accotint bAlance is
raicl. Any baiance on tlie account far this project not paid within 65 days of the invoice date may
result in legal Action or tlie initiation of otlier cotlection procedures, tnclucling referral to a
collection agency. The Sponsor witl be liable for any and alt expenses incurred by tlie County for
the coliection of overdue accounts.
