FINDINGS OF FACT AND CONCLUSIONS 1. The individual signing below has further been properly detegated the responsibility for rendering the decision by the Director of Spokane County Division of Building and Planning. 2. The proposal is to divide approximately 3 acres into 2 tracts for 1 e,cisting single-family residence and l new additional residential tract. 3. The proposai is located north of and adjacent to Valley Way and approximately '/4 mile west of Flora Road, in the SE'/4 of Section 13, Township 25 North, Range 44 E.W.M., Spokane County, Washington. 4. The existing zoning of the property described in the application is Urban Residential-3.5 (UR-3.5), wliich was established in 1991. Pursuant to Section 58.17.195 of the Revised Code of Washington (RCVV), this proposal conforms to the requirements of the existing UR-3.5 zone. 5. The Spoka.ne County Comprehensive Plan designates this area as Urban. The development and uses, as proposed and conditioned are in accord with the Urban Category. This proposal is also compatible with the surrounding uses, which are primarily single-family residences. 6. The Spokane County Arterial Road Plaa identifies Valley Way as a Collector Arterial, with a future right-of-way width of 70 feet. The existing right-of-way width is 40 feet. Tn order to implement the Arterial Road Plan, the County Engineer requires a dedication of 2.5 feei of additional right-of-way. In addition, to the required right-of-way dedicatioa, a 12.5-foot wide strip of the subject property along the frontage of Valley Way is to be set aside as a Future Acquisition Area. Therefore, as conditioned, (such as improvements, sidewalks, dedications and acquisition areas) the proposal conforms ta tiie Road Plan. 7. The proposed site is located within the Public Transportation Benefit Area (PT}3A). The Spokane Transit Authority (STA) Broadway Route No. 18 provides connecting services to the site. 8. The proposed short plat will be served by a public water system. Waste water disposal will be as authorized by tlie Director of Spokane County Division of Utilities. 9. Tlie required public notice and comment period was prnvided for this proposal. In addition those agencies having a potential interest in the proposal were notified and comments solicited. Recognizing the recommended conditions and Spokane County development standards, the proposed short plat makes appropriate provisions far the public heatth, safety and general welfare and that the public use and interest will be served by platting the subdivision. The subdivision proposal is generally consistent with RCW 58.17 and the County subdivision regulations, promoting the public healih, safety and general weifare in accordance with standards est,ablished by the State and Spokane County. The Spokane County Division of Building and Planning shall prepare and record with the County Auditor a Titte Notice specifying a future Iand acquisition area for road right-of-way and utilities. If any of the above improvements are made within this area, they shall be relocated at the applicant's expense when roadway improvements are made. d. The future acquisition area, until acquired, shall be private property and may be used as allowed in the zone, except that any improvements (such as landscaping, parl.ing, surface drainage, drainfield, signs or others) shall bc considered interim uses. e.
