1. Reimburse Spokane County for project review and inspection fees as specified in Chapter 9.14 of the Spokane County Code. The fees will be based on actual salary costs incurred
by Spokane County for project reviews and ! or inspections ptus a ten percent
administrative charge, and will be billed monihly as aeerued. Any billing amounts due,
including any expenses incurred in tlie collection of an overdue account, must be paid
prior to the County's acceptance of the project for filing. [f a project is approved and/or
filed with a balance still owing, the unpaid balance shall be paid within 30 days of the
invoice date.
2. The undersigned agrees that ttlese fees are due and payable upon receipt of the billing as
specified above.
3. Any invoices not paid within 30 days of tlie invoice date will be coiisidered delinquent.
If any au;standing balance on tiie account for tliis prAject is nnt paid within 30 days of
tlie invoice date, oo further reviews of the project documents will be conducted uotil the
entire aceount balance is paid. Any balance on the account for this project not paid
within 65' days of the invoice date may result in legal action or the iniliation of other
collection, procedures, including referral to a c.ollection agency. The Sponsor wiil be
liabte foc any and all expenses incurred by the County for the collection of overdue
accounts.

That the individuals and parties named herein as having an interest in the above described property or project
agree to the following:
1. Reimburse Spokane County for project review and inspection fees as specified in Chapter
9.14 of ihe Spokane County Code. The fees will be based on actual salary costs incurred
by Spokane County for project reviews and / or inspections plus a ten perceat
administrative charge, and will be billed monthly as accrued. Any billing mnounts due,
includiag any expenses incurred in itie collection of an overdue account, must be paid
prior to the County's acceptance of the project for filiog. If a project is approved and/or
filed with a balance still owing, the unpaid balance shall be paid within 30 days of the
invoice d?te.
2. The undersigned agrees that tiiese fees are due and payable upon receipt of the billing as
specified above.
3. Any invt,4ces not paid within 30 days of the invoice date will be cocisidered delinquent.
If any outstanding batance on the account for this project is not paid within 30 days of
tlie invoice date, no further reviews of the project documents will be conducted until the
eatire account balance is paid. Any balance on the account for this project not paid
within 65 days of the invoice date may cesult in legal action or the initiation of othet
collection procedures, including referral to a collection agency. The Sponsor will be
liable for any and all expenses incurred by the County for the collection of overdue
accounts.

SHORT PLAT SP-1184-98 ) CONCLUSIONS AND
DECISION
THIS MATTER, an application for short subdivision from Doug Lehinger has been received and vvas
decided upon, pursuant to Spokane County Subdivision regulations, on the 215t day of July 1998.
FINDINGS UF FACT AND CONCLUSIONS
1. The individual signing below has further been properly delegated the responsibility for rendering
the decision by the Directnr of Spokane County Division of Building and Planning.
2. The proposal is to divide approaimately l acre into 2 tracts for 1 existing single family residence
and 1 nQw additional residential tract.
s. The proposal is locaied north of and adjacent to 12th Avenue and appro.cimately 100 feet east of
Blake Road, in the SE'/4 of Section 22, Township 25 North, Range 44 E.W.M., Spokane County,
Washington.
4. The existing zoning of the property described in the application is Urban Residential-3.5 (UR-3.5),
which was established in 1991. Pursuant to Section 58.17.195 of the Revised Code of Washintton
(RCW), this proposal conforms to the requirements of the existing 'UR 3.5 zone. y
5. The Spakane County Comprehensive Plan designates this area as Urban. The development and
uses, as proposed and conditioned are in accord with the Urban Category. This proposal is also
compatible with the surrounding uses, which are primarily single family residences.
6. Tlie Spokane County Arterial Road Plan identifies 10th Avenue as a Local Access Road with a
future right-of way width of 60 feet. There is no existing right of-way, ln order to implement the
Arterial Itoad Plan, the County Engineer requices a dedication of 25 feet of right-of-way far the
e.ctension of l~th Avenue. In addition, a 5-foot wide strip of the subject property along the
frontage of l0 Avcnue is to be set aside as a Future Acquisition Area. The Spokane County
Arterial Road Plan also identifies l2th Avenue as a Local Access Road with a future right-of-way
rvidth of 60 feet. The existing right-of-way width is 54 feet. ln order to implement the Arteriat
Road Plan, the County Engineer requires a dedication of 5 fect of additional right-of-way along
12th Avenue. In addition, a 5-foot wide sirip of the subject property along the frontage af 12tr
Avenue is to be set aside as a Futurc Acquisition Area. Therefore, as conditioned, (such as
improvements, dedications and acquisition areas) the proposal cnnforms to the Road Plan.
7. T'he proposed site is located within the Pubiic Transportation Benefit Area (PTBA). The Spokane
Transit Authority (STA) Valtey/24th Avenue, Route 21 provides conneciing services to the site.
8. The proposed short plat will be served by a public water system. Waste water disposal will be as
authorized by the Director of Spokane County Division of Utilities.
9. The required public notice and comment period was provided for this proposal. 1n addition thase
aeencies having a potential interest in the proposal were notified and comments solicited. No
written comments were received from any adjoining property owner(s) regardine this proposal.
1 0. Recognizing the recommended conditions and Spokane County development standards, the
proposed short piat makes appropriate provisions for the public health, safety and general welfare
and that the public use and interest will be served by platting the subdivision. The subdivision
propnsal is generally consistent witll RCW 58.17 and the Cnunty subdivision regulations,
promoting tlie public health, safety and general wetfare in accordance wiih standards established
by the State and Spokane County. The County Division of I3uilding and Planning has considered
the provision of adequate public facilities as cited in RCW 58.17.110(2). More specifically:
a. open spaces f. sanitary tivaste disposal
b. drainage ways g. parks and recreatioil Facilities
c. public and/or private right-of-ways h. playgrounds
d. transit i. schools and school grounds
c. potable water j. sidewalks
11. Pursuant to the Washington Administrative Code (WAC) 197-11-500 (6) (a), tllis proposed short
plat is exempt from the State Environrnental Policy Act (SEPA) environmental review.
- DECISION
Based upon the above-noted Findings of Fact and Conclusions, Short Plat Application SP-l I84-98 is
hereby APPROVED for five (5) years, specifcallv to August l, 2003 and subject to conditions noted
below. Tl1is decision is final unless appealed in writing, consistent with adopted appeal procedures.
CONDITIONS OF APPROVAL
All the below conditions imposed shall be binding on the "Applicant," which term shall include the
owner or owners of the property, heirs, assigns and successors.
SPOKANE COUNTY DIVISION OF BUILDING AND PLANNIIVG
1. The proposal shall comply with the Urban Residential-3.5 (UR-3.5) zone and other applicable
Zoning Code chapters, as amended.
2. The fitial short plat shall be designed substantially in conformance with the preliminary plat of
record. No increase of density or number of tracts shall occur without a change of condition
application submittal and approval.
3. The preliminary short plat is given conditional approval for five (5) years, specifica[ly to August 1,
2003. Thc applicant may submit an extension of time application at least thirty (30) days prior to
the above expiration date. Application(s) for extension of time shall be processed under the
provisions of Chapter 12.100.118 (Extension of Timc) of the Spokane County Subdivision
Ordinance. If the applicant complies with the criteria of Chapter 12.100.118, the preliminary
approval and conditions will be changed to reflect the adopted policy and development regulations
at the time of the extension application.
4. Prior to recording the final short plat, the applicant shall submit to the County Division of Building
and Planning Director/designee for review any proposed final short plats to ensure compliance
with these Findings and Conditions af /1pproval.
5. A survey is required of the subject property prior to recording the final sliort plat.
6. Appropriate road name(s) and street address for each tract shall be indicated on the final short plat
map.

7. Appropriate utility easements shall be indicated an the final short plat map. Written approval of
utility easements by utility companies must be received prior to recording the final short plat.
8. The final short plat map shall indicate by a dashed line the required setbacks from all private or
public roads.
9. The final short plat dedication shall contain the foliowing statement: "Side yard And rear yard
setbacks shall be determined at the time building permits are requesied unless these setbacks are
spccifically drafted on this short p1at. The setbacks indicated on this plat may be varied from if
proper zoning or variance approvals are obtained."
10. Prior to recording the finat shoct p1At, the applicant shall provide four (4) current Certificates of
Title to the Division of Building and Planning.
11. The applicant shall contact the County Division of Building and Planning at the earliest possiblc
stage in order tA be informed of code requirements administered/enforced as authorized by the
State Building Code Act. Design/development concerns include: addressing, fire apparatus access
roads, fire hydranUflow, approved water systems, building accessibitity, construction type,
occupancy classifeation, exiting, exterior watl protection, and energy code regulaUans.
12. Tlie Spokane County Division of Building and Flanning shal) prepare and record with the County
Auditor a Title Notice specifying a future land acquisition area for road right of-tivay and utilities.
The Title Notice shall state the following:
a. A strip of property S feet in width from the existing and/or dedicated right-of-way is reserved
for future acquisition area for additional road right-of-way width along lOth Avenue. Note:
The County Engineer requires a dedication of 25 feet of right-of-rvay for the extension of 10th
Avenue.
b. A strip of property 5 feet in width from the existing and/or dedicated right-of-way is reserved
for future acquisition area for additional road right-of-way width along 12th Avenue. Note:
The County Engineer requires a dedication of 5 fect of right-of-way along 12th Avenue.
c. Future building and other setbacks required by the Spokane County Zoning Code shall be
measured from the reserved future acquisition area. d. No required landscaping, parking, '208' areas, drainfeid or allowed signs shauld be located
within the future acquisition area for road right-of-way and utilities. lf any of the above
improvementi~ are made within this area, they shall be relocated at the applicant's expense
when roadway improveinents are made.
e. The future acquisition area, until acquired, shall be private property and may be used as
allowed in the zane, except that any improvements (such as landscaping, parking, surface
drainage, drainField, signs or others) shall be considered interim uses.
f. The property owner shall be responsible fQr relocating such "interim" improvements at the
time Spokane County makes roadway improvements after acquiring said future acquisition
area.
SPOKANE COUNTY DIVISION OF ENGINEEItING AND ROADS
l. The conditional appraval of the short plat by the Count}r Engineer is given subject to dedication of
right-of-way and approval of the road system as i»dicated in the preliminary plat of record.
2. No construction work is to be performcd within the existing or propased pubiic ri~ht-of-way untii
plans have been aceepted by the County Engineer and a permit hac been issued by the Countv
Engineer. All worlc is subject to inspection and approval by the County Engineer.
3. The appropriate provision be made that the fallowing described property be held in trust until the
continuation of the streets be dedicated or deeded: A one (1) foot strip at the ends or edges of a11
strects that terminate or border the plat boundary.

4. Approach Permits are required for any access to the Spokane County c•oad system.
5. The applicant shnll dedicate 25 feet of rig,ht-of-way for the extension of Tenth Avenue.
6. The applicant sliall dedicate 5 feet of right-of-way along Twelftli Avenue.
7. The applicant shall grant applicable border easements adjacent to Spokane County riaht-of-way
per Spokane County Standards.
8. To construct the road improvements stated herein, the applicant may, with the approval of the
County Enoineer, join in and be a willing participant in any petitian or resolution which purposcs
is the formation af an Road lmprovement District (R1D) for said improvements pursuant to RCW
36.88, as amended. At such time as an RID is created or any Road Improvement Project is
sanctioned by Spokane County, the improvements required (curb, sidewalk, drainagc control and
paving to existing pavement) will be at the sole expense of the undersigned owner, their heirs,
grantees and assigns. This provision is applicable to Tenth Avenue and Twelfth Avenue.
9. As an alternative meihod of constructing the road improvement stated herein, the applicant may,
with the approval of the- County Engineer, accomplish the road improvements stated herein by
joining and participating in a County Road Project (CRP) to the extent of the required road
improvement. At such time as rai RID is created or any Road Improvement Project is sanctioned
by Spokane County, the improvements required (curb, sidewalk, drainage control and paving to
eYisting pavement) will be at the sole expense of the undersigned owner, their heirs, grantees and
assigns. This pravision is applicable to Tenth Avenue and Twelfth Avenue.
10. The final short plat dedication shall contain the following statement:
"In consideratic.n of Mutual Benefits now or to be hereafter derived, do for themselves,
their heirs, grantees, assigns and successor(s) in interest hereby request and authorize
Spokane County to include the above described properry in a Road Improvement District
(RID) and to suppoct the formation of a Road Improvemeni District for improvement of
the raad(s) described below by requesting and authorizing Spokane County to place their
name(s) on a petition for the formation of a Road Improvcment District pursuant to RCW
36.88.050, or by requesting and authorizing Spokane Caunty to cast their ballot in favor of
an RID being formed under the resolution method pursuant to RCW 36.88.030, and/or by
not filing a protest against the formation of an R1D being formed under the alternativc
resolution inethod provided for in RCVV 36.88.065 and Chapter 35.43 RCW.
"Tf an IZID is proposed for improvement of the road(s) described below, said owner(s) and
successor(s)further agree: (1) that the improvements or construction contemplated within
the proposed RID are feasible and (2) that the benefits to be derived from the formatinn of
the RID by the property includcd therein, together with the amount of any County
participation, exceeds the cost And expense of formation of the RID, and (3) that the
property within the propased RID is sufficiently developed; pruvided, themselves, their
heirs, grantees, assigns and successor(s) shall retain the right, as authorized under RCW
36.88.090, to object to any assessment(s) on the property as a result of the improvements
called for i4 conjunction with the formation of an RID by either the petition or resolution
method under Chapter 36.88 RCW and to appeal to the Superior Court the decision of the
Board of County Commissioners confirming the final assessment roll; provided further, it
is recognized that actual assessments may vary from assessment estimate so long as they
do nnt excEed a ftgure equal to the increased true and fair value improvement(s) add(s) to
the praperty.
`=It is furtlier acknowledged and agreed that at such time as an RID is created or any
Countv Road Improvement project is authorized by Spokane County, the improvements
required shall be at the solc cxpense of the awner(s) of propcrty within the RID or served
by tlie improvements wichout any monetary participation by Spokane County.

"Tlie R1D waiver contained in this agreement shall expire after ten (10) years from the date
of execution betaw. This provision is applicable to Tenth Avenue and Twelfth Avenue."
11. The County Engineer has designated a Local Access Roadway Section for the improvement of
Tenth Avenue which is adjacent to tlie proposed devetopment. This will require the addition of
approximately 27 feet of asphalt along the frontage of the develapment. The construction of
curbing and sidewalk is also required.
12. The County Engineer has designated a Local Access Roadway Section for the improvement of
Twelfth Avenue which is adjacent to the proposed development. This will require the addition of
appraximately 5-7 feet of asphall along the frontage of the development The construction of
curbing and sidewalk is also required.
13. The proposed short plat shall be improvcd to the standards set forth in Spokane County Board of
Commissioners Resolution No. 95-0498, as amended, which establishes regulations far roads,
approaches, drainage and fees in new constrvetion.
14. The County Engineer has examined this development proposal and has determined that the impact
of this proposal upon the existing County Road System warrants the dedication of additional right-
of-way and ihe roadway improvements berein specified.
15. The applicant shall execute a Spokane County Notice to the PubliC N9..4. which will allow
ingresslegress to Tract "A" over the non-maintained Tenth Avenue right-of-way.
SPOKANE COUNTY DIVISION OF U'I'ILITIES
1. A wet4live) sewer connection to the area-wide Public Sewer System is to be constructed. Sewer
connection pennit is required. Commercial developments shall submit historical and or estimated
water usage prinr to the issuance of the coanection permit in order to establish sevver fees.
2. The short plat dedication shall contain the following statement: "Public sewers shall be
constructed to provide for the connectian of each parcel to the County's system of sewerage. Uses
on properties withia the project shal) be required to connect to the sewer and pay applicable
charges per the County Sewer Ordinance. Sewer connection permits shall be required."
3. The short plat dedication shall cootain the following statement: "A public sewer system wi11 be
made available for the ptat, and individual services will be provided to each lot prior to sale. tJse
of individual on-site disposal systems shall not be authorized."
4. 'Ihe short plat dedication shall eontain the following statement: "Indiviclual tracts s}iall be subject
to payment of current applicable sewer connection charges and/or general facilities charges prior to
the issuance of a sewer corvnectian permit."
5. Applicant shall submit expressly to Spokane County Division of Utilities "under separate cover",
only those plan sheets showing sewer plans and specifications for the pubiic sewer connections and
facilities for review and apprnval. Commercial developments shall submit histarica) and or
estimated water usage as part of the sewer plan submittal.
6. Sewer plans acceptable to the Uivision of Utilities shall be submitted prior to recording af the final
short plat.
7. Any water service for this project shall be provided in accordance with the Coordinated Water
System Plan for Spokane County, as amended.

SPOKANE REGIONAL HEALTH DISTRICT
1. Sewage disposal method sllall be as authorized by thc Director of the Spokane County Division of
Utilities.
2. Water service shall be coordinated through the Spokane County Division of Utilities.
3. Water service shall be by an existing public water supply when approved by the Regional Engineer
(Spokane), State Department of Health.
4. Prior to recording the final short plat, the applicant shall demonstrate to the satisfaction of the
Spokane Regional fIealth District that an adequate and potable water supply is availabie to each
tract of the plat.
5. Prior to recording the final short plat, the applicant shall present evidence that the plat lies within
the recorded service area of the water system proposed to serve the plat.
6. A public sewer system will be made available for the plat, and individual serWice will be provided
to each tract prior to sale. Use of individual on-site sewage disposal systems shall not be
authorized.
7. The short plat shall contain the following statement: "A public sewer system will be made
available for the plat, and individual service will be provided to each tract prior to sale. Use of
individual on-site sewage disposal systems shall not be authorized."
8. The short plat dedication shall contain the following statement: "Use of private wells and water
systems is prohibited."
9. The short plat dedication shall contain the following statement: "The public water systeni,
pursuant to the Water Plan approved by County and State health authorities, the local fire district,
County Division of Building and Planning, and water purveyor, shall be installed within this short
plat, and the applicant shall provide for individual domestic water service as well as fire protection
to each tract prior ta sale af each tract and prior to issuance of a building permit for each tract."

1. A fire apparatus turnaround, approved by the firc district, shall be installed for the eastern most end
of 10th Avenue.

That the individuals and parties named herein as having an interest in the above described property or project

1. Reimburse Spokane County for project review and inspection fees as specified in Chapter
9.14 of the Spokane County Code. The fees will be based on actual saiary costs incurred
by Spokane County for project reviews and / or iaspections plus a tea percent

"Conditions of Approval" are suomitted to the Spokane County Planning Department for inclusion in the
"Findings of Fact, Conclusions and OrderlDecision" should the request be approved.
1. That cond.itional approval of the plat by the County Engineer is given
subject to dedication of right-of-way and approT,ral of the road system
as indicated in the prelimiraary plat of recard.
2. No construction work is to be performed within the existing or proposed
Public right-of-way until plans have been accepted by the County
Engineer and a permit has been issued by the County Engineer. All work
is subject to inspection and approval by the County Engineer.
3. That appropriate provision be made that the following described
property be held in trust until the continuation nf the streets be
dedicated or deeded: A 1 foot strip at the ends or edges af a??
streets that terminatE or border the plat boundary.
9. Approach Permits are required for any access ta the Spokane County road

8. To construct the raad improvements stated herein, the applicant rnay,
with the approval of the Courity Engineer, jain in and be a willing
participant in any petition or resolution which purposes is the
formation of a Road Improvement District (R?D) for said improvements
pursuant to RCW 36. E8, as amended. At such time as an RID is created
or any Road Irnprovc-ment ?roject is sanctioned by Spokane County, the
improvemen-ts ?-equired (curb, sidewalk, drainage control and paving to
existing pavement) will be at the sole expense of the undersigned
owner, their heirs, grantees and assigns. This provisian i-s applicable
to Tenth Avenue and Twelfth Avenue.
9. As an alternative method of constructing the road improvement stated
herein, the applicant may, with the approval of the County Engineer,
accomplish the road improvements stated herein by joining and
parti-cipating in a County Road Project (CRP) to tne extent of the
required road improvement. At such time as an RID is created or any
Road Improvement Project is sanctioned by Spokane County, the
improvements required (curb, sidewalk, drainage control and paving to
existing pavement) will be at the sole expense of the undersigned
owner, their heirs, grantees and assigns. This provision is applicable
to Tenth Avenue and Twelfth Avenue.
10. That the following statement shall apgear within the dedicatory
language of the final plat:
That in consideration of Mutual Benefits now or to be heraafter
derived, do for themselves, their heirs, grantees, assigns and
successor(s) in interest hereby request and authorize Spokane County to
include the above described property in a Road Improvement District
(RID) and to support the formation of a Road Improvement District for
improvement of the road(s) described below by requesting and
authorizing Spokane County to place their name(s) on a petition for the
formation of a Road Improvement District pursuant to RCW 36.88.050, or
}ay requesting and authorizing Spokane County to cast tlaeir ballot in
favor of a RID being formed under the resolution method pursuant to RCW
36.88.030, and/or by not filing a protest against the format?on of a
RID being farmed under the alternative resolution method provided for
in RCW 36.88.065 and Chapter 35.43 RCW.

If a RID is proposed for improvement of the raad(s) described below,
said owner(s) and successor (s) further agree: (1) that the imgrovements
or construction contemplated within the proposed RID are feasible and
(2) that the beneFits to be derivzci from the formation of the RID by
the property included therein, together with the amount Cf any County
participation, exceeds the cost and expense of formation of the RID,
and (3) that the property► within the proposed RID Is sufficiently
developed; provided, themselves, their heirs, grantees, assigns and
successor(s) shall retain the right, as authorized undEr RCW 36.88.090,
to object to any assessment(s) an the preperty as a result of the
improvements called for in canjunction with the formation of aRID by
either the petition or resolution method under Chapter 36.88 RCW and tc
appeal to the Superior Court the decision of the Board of County
Commissioners confirming the final assessment roll; provided further,
it is recognized Lhat actual assessments may vary from assessment
estimate so long as thEy do not exceed a figure equal to the increased
true and fair value improvement(s) add(s) to the property.
It is further acknowledged and agreed that at such time as a RID is
created or any County Road Improvement project is authorized by Spokane
County, the improvements required shall be at the sole expense of the
owner(s) or property within the RID or served by the improvements
without any monetary participation by Spokane County.
The RID waiver contained i-n this agreennent shall expire after ten (10)
years from the date of execution below. This provision is appl?cable
to Tenth Avenue and Twelfth Avenue.
11. The County Engineer has designated a Local Access Roadway Section for
th2 improvement of Tenth Avenue which is adjacent to the proposed
development. This will req•aire the addition of approx?mately 27 feet
of asphalt along the frontage of the development. The construction of
curbing and sidewalk is alsa required.
12. The Caunty Engineer has designated a Local Access Raadway Section for
the improvement of Twelfth Avenue which is adjacent to the proposed
development. This will require the addition of approxi:nately 5-7 feet
of asphalt along the frontaqe of the development. The construction of
curbing and sidewalk is also required.
13. The proposed plat shall be improved to the standards set forth in
Spokane County Board of Commissioners Resalutian No. 95-0498, as
amended, which establishes reaulations for rnads, approaches, drainage
and fees in new construction.

14. The County Engineer has examined this development proposal and has
determined that the impact of this proposal upon the Axisting County
Road System warrants the ciedication vf additional Right of Way and the
roadway improvements herein specified.
15. The applicant shall execute a Spokane Caur.ty Notice to the Public No.
4, which will allow inqress/egress to Tract '"A" over the non-maintained
Tenth Avenue Right of Way.
