FINDINGS OF FACT AND COIYCLUSIONS 1. The individual signing below has been properly delegated the responsibility for rendering this decision by the Spoka.ne County Director of Building and Planning. 2. The proposal was to divide 1.2 acres into 2 tracts for one existing single family residence, one additional residential lot, and for those uses permitted in the underlying Urban Residential-3.5 (UR-3.5) zone. 3. The subject preliminary short plat was approved by Spokane County Division of Building and Planning on July 20' 1994. 4. The proposal is located south of and adjacent to 4`" Avenue and approximately 180 feet west af Felts Road in the Northeast 1/4 of Section 20, Township 25 North, Range 44 E.W.NI., Spokane County, Washington. 5. The existing zoning of the property is Urban Residential-3.5 (UR-3.5), which has remained the sarr►e since the original preliminary plat approval and continues to conform. 6. The proposal is located in an area designated as Urban by the Spokane County Comprehensive Plan; which has remained the same since the original preliminary plat approval and continues to conform to the Plan. The Proposal is vvithin the IUGA. 7. Spokane County has established specific criteria for coasidering the extension of time for the expiration of preliminary plats, short plats, or binding site plans. These criteria arz found in Chapter 12.100.118 (Extension of Time) of the Spokane County Subdivision Ordinance and have been used as a basis for this decision. The following are the reievant sectioa(s) of Chapter 12.140.118 and the Division of Building and Planning response: 1) That some portion of the existing preliminary subdivision or binding site plan has beea finalized since the project was approved and the remaining lots would form a unified development consistent with the original approval; RESPONSE: No portion or the originally approved short plat has been finalized. . I" Extensioa of Time Findings File No. SP-964-94 Page 2 2) That the preliminary subdivision, short subdivision, or binding site plan rema.ins generally consistent with the original plat or binding site plan that was approved, and the sponsor has taken substantial steps towards finalizing the plat or bindings site plan, which shall include one, but is not limited to the following: a. surveying the lots within the development, b. arranging for public services to the site, c. obtaining necessary financing for all or a portion of the preliminary subdivision, short subdivision, or binding site plan; d. the completion of studies or other requirements which were part of preliminary subdivision, short subdivision, or binding site plan approval; RESPONSE: The appl icant states that the survey work has been completed and that personal matters have delayed the submittal of the final piat. 3) That at the time prelimi.nary approval was granted, development of the proposal was conditioned upon the extension of public senrices which are not }ret available. This provision shall not apply to public utility extension which the project sponsor would normally fund. RESPONSE: Not Applicable 4) That administrative delays have caused the inability of the applicant to finalize the plat within the five (5) year time period. RESPONSE: Not Applicable 8. This request for an extension of time, as conditioned, represents no significant change in the approved original prelimizlary plat and will not be adverse to the public healtha safety and general welfare. 9. No additional conditions have been recommended by the various reviewing agencies and departments, including the County Division of Building and Planning, the County Division of Engineering and Roads and others. 10. SP-964-94 ) CONCLUSIONS AND DE CIS IO N CcunV Eaginecrira THIS MA1"TER, an application for subd.ivision of land, from Del Schanz has been received and d~ecided upon, pursuant to Spokane Covnty Subdivision regulations, on the c;,~P day of July, 1994. FINDINGS OF FACT AND CONCLUSIONS 1. The individual sigming below has been properly delegated the responsibility for rendering the decision by the Spokane County Director of Planning. 2. The proposal is to divide approximately 1.2 acres into 31ots for an existing single family residence, 2 new residences and those uses permitted in the Urban Residenual-3.5 (LJR- 3.5) zone. Duplexes are permitted in thc Urban Residential-3.5 zone on lots with an area of 20,000 square feet or greater. The proposal does have the potential for 2 duplexes. 3. The proposal is generally located south of and adjacent to 4th Avenue and approximately 180 feet west of Felts Road in the NE 1/4 of Section 20, Township 25 North, Range 44 E.W.M. Spokane County, Washington. 4. The existing zorung of the property desCribed in the application is Urban Residential-3.5 (UR-3.5) previously established as Agricultural (A) zoning in 1942 a.ad redesignated Urban Residential-3.5 on January 1, 1991 consistent with the Prograaz to Implement the Spoka.ne County Zoning Code. Pursuant to RCW 58.17.195 the proposal does conform to the requirements of the existing Urban Residential-3.5 (UR-3.5) zone. 5. The Spokane County Compnehensive Plan designates this area as Urban. The development and uses proposed are generally in accord with this category. 6. One single fainily residence is located on the site. Surrounding uses are primarily single family nesideoces on lots ranging from 1/2 to 1 acnes. 7. The required public notice was provideci for this proposal and agencies having a potendal interest in the project were notified and recommendations solicited. No comments have been raeceived from adjacent property owners. 8. The site is located inside the Public Transit Benefit Area (PTBA). The site is not served directly by public transit service, however, the Valley Transit Center is located 1/4 mile east of the site at the intersection of 4th Avenue and University Road. 10. The Spokane County Arterial Road Plaa identifies 4th Avenue as a rollectvr arterial with a future right of way width of 70 feeL The existing right of way width af 40 feet for 4th Avenue is inadequate to meet the Arterial Road Plan reCOmmendations. Therefore, the County Engineer has required dedication of a 10 foot wide strip of land along the site's 4th Avenue frontage. In addition, a strip of land S feet wide shall be set aside as a future acquisition area. 11. The proposed short plat is located in the Modern Eiectric Water District which will be provide service to the site. A potable watcr supply must be provided to each lot prior to final plat approval. 12. The Central VaUey School District No. 356 has commented on the proposed short plat. The Disirict has indicated tbat existing school facilities are inadequate to serve the proposed short plat and has requested the applicant negotiate with the District to provide appropriate capital fa,cilities as requirei by the Revised Code of Washington (RCR) 58.17.110. Approval of this short plat should include conditions requiring that provisions for appropriate facilities be in place prior to reconding this final plat in the fonn of a written agreement between the property owner and the school d.istrict. 13. The Spokane County Parks Department has cornrmented on the pr+oposed short plat. The Parks Department has requested a voluntary agreement be completed between the Parks Department and the property owner to mitigate impacts to the Counry Park system. The Spokane County Planning Department reconunends the property owner negotiate with the Spokane County Parks I)epartment to provide for appropriate capital facilities as required by the Revised Code of Washington (RCVV) 58.17.110. Approval of this short plat should include Conditions requinng that provisions for appropriate facilities be in place R , priar to recording this final plat in the forrn of a written agreement between the owner and the Spokane County Parks Department, 14. Subject to approval by the Spokane County Health District, individual on-site sewage disposal systems may be authorized. 15. Recognizing the recommended conditions and Spokane County development standards, the propased short subdivision makes appropriate provisions for the public health, safety and general welfare and that the public use and intenest will be served by platting the , pr+oposed short subdivision. The subd.ivision proposal is generally consistent with RCW 58.17 and the County subdivision regulauons, promoting the public health, safety and general welfare ia accordance with standands established by the state and Spokane County. Ile Planning Department has considered the provision of public facilities as cited in RCW 58.17.110 (2). More specifically: a. open spaces b. drainage ways c. public and/or private rights-of-way d. transit e. potable water f. sanitary waste disposal g. parks and recreation facilities h. playgrounds i. schools and schoolgrounds j. sidewalks 16. The project is exempt from environmental review under the State Environmental Policy Act pursuant to WAC 197-11-800 (6) (a). DECISION Based upon the above noted Findings of Fact and Conclusions, Short P1at Application SP-964- 94 is hereby APPROVED until August 1, 1997 subject to conditions noted below. Most of the canditions of approval shall be accomplished by the applicant and/or sponsor prior to finalization of the short subdivision. This decision is final unless appealcd in wridng, consistent with adopted appeal procedures. PLANNING DEPARTMENT CONDITIONS 1. All conditions imposed by the Planning Department shall be binding on the "Applicant", which term shall include the owner or owners of the property, heirs, assigns and successors. 2. The proposal shall comply with the Urban Residential-3.5 (UR-3.5) zone as amended. 3. The final plat shall be designed substaatially in conformance with the prelirninary plat of record. No increase in density or aumber of lots shall occur without a change of cond.ition application submittal and approval. 4. The Planning Director/designee shall review any proposed final plat to ensure compliance with these Findings and Conditioas of Approval. 5. Appropriate roa,d name(s) shall be indicated. 6. The preliminary plat is given conditional approval for three (3) years, specifically to August 1. 1997. The applicant may request an extension of time by submitting a written request approximately forty-five (45) days prior to the above expiraaon date. 7. Appropriate utiliry easements shall be indicated on copies of the proposed final plat. Written approval of utility easements by appropriate utility comparues shall be received with the submittal of the final plat. 8. Three (3) cunent certificates of tide shall be furnished to the Plann.ing Department prior to filing the final plaL FINDINGS AND DECISION SP-964-94 Page 2 9. The final plat map shall indicate by a clear, ciashed line the required yard setbacks from all private, "Tract X" or public roads. The dedication shall contain the following statement: "Side yard and rear yar+d setbacks shall be detemained at the time building permits are requested unless these setbacks are specifically drafted on this final plaL The setbacks indicated on this plat may be varied from if proper zoning approvals are obrained." 10. A plan far water facilities adequate for domestic service and fire protection shall be approved by the water purveyor, appropriate fire protection district, County Building & Safety Departnaent and Counry Health District. The agencies will certify on the Water Plan, grior to the filing of a final plat, that the plan is in confonnance vvith their respective needs and reguladons. The Water Plan and certification shall be drafted on a transparency suitable for reproduction and be signed by the plat sponsor. 13. The watier purveyor shall certify that appropriate contractual anangements and schedule of improvements have been made with the plat sponsor for construction of the water system in accorda.nce with the approved Water Plan. The time schedule shall provide for completion of the water system aad inspection by the appropriate health authorides prior to application for building pernuts within the fina,l plat. The arrangements or agreements shall include a provision hold.ing Spokane County and the purveyor harmless from claims by any lot purchaser refused a building pernut due to the failure of the subdivision sponsor to satisfactorily complete the approved water system. 14. The final plat dedication shall contain the following statement: "The public water system, pursuant to the Water Plan approved by county and state health authorities, the local fire protection district, County Building & Safety Department and water purveyor, shall be installed within this subdivision, and the applicant shall provide for individual domestic water service as well as firr protection to each lot prior to sale of each lot and prior to issuance of a building pennit for each loG" 15. No building permit will be issued for any lot within the fiaal plat until certified by a Washingoon state-licensed engineer that "the water system has been installed pursuant to the approved Water Plan for tbe final plat" including a signed license statnp. The oertification may be in the form of a letter, but is preferred to be certified on a copy of the Waier Plan as a schematic map showing the "as-built" water system. 16. The Water Plaa and the above condidans of approval regarding the Water Plan may be waived by the Planning Director/designee upon receipt of letters from the appropriate water purveyor and fire protecaon distnct stating that simple connections to an exisdng, approved water system will provide adequate domestic and fire protection water to ensure the public health, safety and general welfare. 17. A survey is required prior to the filing of a final plat. 18. The owner shall negotiate with the Central Valley School District No. 356 and the Spokane County Parks Departrnent and submit a recorded copy of the agreement(s) making appropriate provisions for public schools and parks pnor to finalization and recording of this short plat. The agreement(s) shall provide a written description of the subjeci property to which the agneement(s) apply(ies) and also state the dollar amouat per Iot and any other agreed to mitigaang measure(s). The Owner shall also notify any potential purchasers who have made an agreement to purchase property withi.n said short plat pursuant to the Revised Code of Washington (58.17.205), that adequate provisions for school facilities and parks must be niade condirioned on a future agreemeat(s) between the plattor, school district, and County Parks. Voluntary agreements between the Owaer, School District and County Parks shall conform to the requirements of the Revised Code of Washingtoa Chapter 82.02. 19. The final plat(s) shall be addressed in avcordance with RCW 58.17.280 and local ordinance. 20. The Spokane County Planning Department shaU prepare and record with the County Auditor a Tide Noace specif}nng a future land acquisition area for road right-of-way and utilities. The reserved future acquisirion area Tide Notice shall be released, in full or in FINDINGS AND DECISION SP-964-94 Page 3 patt, by the Planning Department, The notice should be recorded within the same time frame as an appeal and shall provide the following: a. At least 5 feet of reserved future acquisition area for road right-of-way and utilities, in addition to the existing and/or newly dedicated right-of-way along 4th Avenue. NOTE: The County Engineer has required 10 feet of new dedication. b. Future building and other setbacks required by the Spokane County Zoning Code shall be measured from the reserved future acquisition area. V c. No required landscaping, parking, '208' areas, drainfield or a1lovNed signs should be located within the futur+e acquisition area for road right-of-way and utilities. If any of the above improvements are made within this area, they shall be relocated at the applicant's expense when roadway impnovernents are made. d. The future acquisidon area, until acquired, shall be private property and may be used as allowed in the zone, except that any improvements (such as landscaping, parking, surface dtainage, drainfield, signs or others) shall be considered interim uses. e. The property owner shall be responsible for relocating such "interim" improvements at the time Spokane County makes roadway imprrovements after acquiring said future acqaisition area. COUNTY ENGINEER'S DEPARTMENT CUNDITIONS 1. The condirional approval of the plat is given by the County Engineer subject to dedication of right-of-way and appmval of the road system as indicated in the preliminary plat of record. 2. Plans, profiles, and cross-sections as designed to Caunty standards showing proposed street centerline and curb grades shall be submitted to the County Engineer for approval prior to construction and/or the filing of each final plat; road plans to be prepared under the direction of a licensed Professional Givil Engineer. 3. Drainage plans and design calculations showing the alignment of drainage facilities shall be submitted to the County Engineer for approval prior to construction and/or the filing of the final plaL Drainage plans to be prepared under the direction of a licensed Professional Civil Engineer. 4. No construcdon work is to be performed within the existing or proposed public right of- way until a perniit has been issued by the County Engineer. All work is subject to inspection and approval by the County Engineer. 5. Individual driveway access pennits are required prior to issuance of a building pennit for driveway approaches to the county road system. 6. Dedication of 10 feet of additional right-of-way along 4th Avenue is required. 7. Existing county roads providing direct access to the plat shall be paved and/or curbed to Spokane County standards. 8. Sidewalks aze required along the collector arterial on 4th Avenue. 9. The word "applicant" shall include the owner or owners of the property, his heirs, assigns and successors. 10. To construct the road improvements stated herein, the applicant may, with the approval of the County Engineer, join in and be a willing participant in any petition or resolution which purpose is the formation of a Road Improvement District (RID) for said improvements, pursuant to RCW 36.88, as amended. At such time as an RID is created er any Road Improvement Project is sanctioned by Spokane County, the improvements required (curb, sidewalk, drainage control and paving to existing pavement) will be at the sole expense of the undersigned owner(s), their heus, grantees and assigns. This provision is applicable to 4th Avenue. 11. As an alternative method of constivcdng the road inaprovements stated herein, the applicant may, with the approval of the County Engineer, accomplish the r+oad impravements stated hereul by joining and participanng in a County Road Project (CRP) FINDINGS AND DECISION SP-964-94 Page 4 to the extent of the required road improvements. At such time as an RID is created or any Road Improvement Project is sanctioned by Spokane County, the improvements required (curb, sidewalk, drainage cootrol and paving to eacisting pavement) will be at the sole expense of the undersigned owner(s), their heirs, grantees and assigns. This provision is applicable to 4th Avenue. 12. The following statement shall be placed in the plat dedication: "The owner(s) or successor(s) in int,erest agree to authorize the County to place their , name(s) on a petition for the formation of a Road Improvement District (RID) by the petition method pursuant to Chapter 36.88 RCW, which petition includes the owner(s)' praperty, and further not to object, by the signing of a ballot, to the formation of an RID by the resolution method pursuant to Chapter 36.88 RCW, which resolution includes the owaer(s)' pmperty. The County Engineer has designated Typical Roadway Section Number Two Collector Arterial standard for the unprovement of 4th Avenue, which is adjacent to the proposed development. This will require the addition of approximately 10-12 feet of asphalt along the frontage of the development. The construction of curbing and sidewalk is also required. 14. The proposed private road(s) as shown on the preliminary plat serving 21ots with extension to serve eight (8) or fewer lots is approved by the County Engineer. 15. Private road(s) shall be improved to Spokane County standard for an urban private road serving 21ots. 16. All vested owners shall siga and record private road documents as prescribed by the Spokane County Engineer. These documeats shall be r+eviewed and approved by the Spokane County Engineer prior to recording with the Spokane Couaty Auditor.
