IN THE MATTER OF ) FINDINGS OF FACT,
SHURT PLAT NO. SP-965-94 ) CONCLUSIONS AND
DECISION
THIS MATTER, an application for subdivision of land, from Louis B. Nees has been
receiv and decided upoa, pursuant to Spokane County Subdivision regulations, on the
/3 day of July,1994.
FINDINGS OF FACT AND CONCLUSIONS
1. The individual signing below has further been properly delegated the responsibility for
rendering the decision by the Spokane County Duector of Planning.
2. The proposal is to divide approximately 1.2 acres into 21ots for residential uses and
those uses pernaitted in the underlying zone.
3. The praposal is generally located at the southeast corner of 13th Avenue and McDonald
Road in the SE 1/4 Secdon 22, Township 25 North, Range 44 E.W.M. Spokane
County, Washi.ngton.
4. The existing zoning of the property described in the application is Urban Residential-
3.5 (LJR-3.5) (ZE-101-41) established on January 1, 1991 consistent with the Progrdm
to Implemenc the Spokane County Zoning Code. Pursuant to RCW 58.17.195 the
proposal does conform to the r+equirements of the existing UR-3.5 zone.
5. The Spokane County Comprehensive Plan designates this area as Urbaa. The
development and uses proposed are generally ia acxoni with this category.
6. The sitie contains an existing single family residence with a detached garage.
Surrounding uses are prunarily single family residences with some duplexes.
7. The required public notice was provided for this proposal and agencies having a
potenrial interest in the project were notified and recammendations solicited.
8. One letter from an adjoining property ow,ner was received. The adjacent owner was
amenable to a single family residence locating on the site, but was opposed tio a duplex.
9. The site is located within the Public Transit Benefit Area (P'I'BA). The nearest available
bus rQute is Route 21 adjacent to the site which provides service to the Pence-Cole
Valley Transit Center.
10. The Spokane County ArGerial Road Plan identifies McDonald Road as a Minor Arterial.
To implement the Arterial Road Plan, the Spokane County Engineer has requested that
a 15 foot wide strip along McDonald Road be set aside as a Future Acqui.sition Area.
Twelfth Avenue is designated as a Local Access saeet.
11. The proposal will be served by a public water system, and waste water disposal will be
by a public sewer system.
12. The Central Valley School District (No. 356) has co~ented on the pmposed short
plat. The Disaict has indicated that existing school facilities are inadequate to serve the
proposed short plat and has requested that applicant negotiate with the Distnct to
provide appropriate capital facilities as required by the Revised Code of Washington
(RCW) 58.17.110. Approval of this short plat should include coaditions requinng that
pravisions for appropriate facilities be in place prior to recording this final plat in the
form of a written agreement between the property owner and the school districG
13. The Spokane County Pazks Department has commentred on the proposed short plaL
The Pazks Department has indicated that existing park facilities are inadequate to meet
curnent and grojected needs and that they are in tbe process of drafting an ordinance for
a per lot park mitigation fee. Prior to implementadon of the ordinance, the Pazks
Deparnnent requests, as a conditioa of pla.t approval, that project applicants reach a
voluntary autigatioa agreement pursuant to the Revised Code of Washington (RCR)

82.02 and RCW 58.17.110, or present to the Parks Department a letter agr+eeing to
abide by the provisions of the mitigadon ordinance ooce it is adopted.
14. Recognizing the recommended conditions and Spokane County development standards,
the proposed short subdivision makes appropriate provisions for tbe public health,
safety and general welfare and that the public use and interest will be served by platting
the proposed short subdivision.
15. The subdivision proposal is generally consistent with RCW 58.17 and the County
subdivision regulations, promoting the public health, safery and general welfare in
accordance with standards established by the State and Spokane County. The Planning
DepartmenL has considened the provision of public facilities as cited in RCW 58.17.110
(2). More specifically:
a. open spaces
b. draiaage ways
c. public and/or private rights-of-way
d. traisit
e. potable water
f. sanitary waste disposal
g, parks and recreation facilities
h. piaygrounds
i. schools and schoolgrounds
j . sidewalks
16. The project is exempt from environmental review uader the State Envinonmental Policy
Act pursuant to WAC 197-11-800 (6) (a).
17. The applicant has requested that a condition of approval prohibiting duplex dwellings
be included as part of this decision.
18. The pre 'luninary plat map incorrectly labels the road to the south of the subject property
as lZth Avenue. The cornect road name should be 14th Avenue.
19. The Spokane Councy Engineer provided the following special informadon: "The
applicant is advised that the required road improvements for McDonald Road were
installed per CRP# 971. No RID agreement is required at this time for McDonald
Road.
DECISION
Based upon the above noted Findings of Fact and Conclusions, Short Plat Application
SP-965-94 is hereby APPROVED until August 1, 1997, subject to condirions noted
below. Most of the conditions of approval shall be accomplished by the applicant andlor
sponsor prior to finalizatioa of the short subdivision. This decision is final unless
appealed in writing, consistent with adopted appeal procedures.
PLANNING DEPARTMENT CONDITIONS
1. All conditions imposed by the Planning Departnaent shall be binding on the
"Applicant", which term shall iaclade the owner or owners of the property, heirs,
assigns and successors.
2. The proposal shall comply with the Urban Residential-3.5 (UR-3.5) zone, as ammended.
3. The fuial plat shall be designed substanrially in conforrmance with the preliarinary plat
of record. No iacrease in density or number of lots shall occur without a change of
condition application submittal and approval.
4. The Planning Director/designee shall review any proposed fjnal plat to ensur+e
compliance with these Findings and Cond.itions of Approval.
5. Appropriate road name(s) shall be indicated.

6. The preliminary plat is given conditional approval for three (3) years, specifcally to
August l, 1997. The applicant may request an extension of time by submitting a
written request approximately forty-five (45) days prior to the above expiration date.
7. Appropriate utility easements shall be indicateri on copies of the pmposed final plat.
Wntten approval of utility easements by appropriate utility companies shall be received
with the submittal of the final plaL
8. Three (3) current certificates of tide shall be fumished to the Planning Department prior
to filing the final plat.
9. The Spokane County Plarining Department shall prepare and recard with the County
Auditor a Tide Notice specifying a future land acquisidon area for road right-of-way
, a.nd otilities. The reserved future acquisition area Tide Notice shall be released, in full
or in part, by the Planning Department. The notice should be recorded within the same
time frame as an appeal and shall provide the following:
a. At least 15 feet of reserved future acquisition area for road right-of-way and
udlities along McDonald Road. NOTE: The County Engineer has not requined
new roadway dedication oa McDonald Road.
b. Futum building and otber setbacks required by the Spokane County Zoning Code
shall be measured from the reserved future acquisltion area.
c. No required landscaping, pazking, '208' areas, drainfield or aUowed signs should
be located within the future acquisition area for road right of-way and utilities. If
any of the above improvcmenLs are made withi.n this area, they shall be relocated
at the applicant's expense when roadway improvemenis are made.
d. The future acquisition area, until acquired, shall be private progerty and may be
used as allowed in the zone, except that any unprovements (such as landscaping,
parldng, surface drainage, drainfield, signs or othe,rs) shall be considered intenm
uses.
10. The final plat map shall indicate by a clear, dashed line the required yard setbacks from
all private, "Tract X" or public roads. The dedicarion shall contain the following
statement:
"Side yard and rear yard setbacks shall be determined at the time building pennits are
requested unless these setbacks are specifically drafted on this final plat/. The setbacks
indicated on this plat may be varied from if proper zoning approvals are obtained."
11. No water plan is required, and a simple tap is needed at the time of build.ing perniit
release.
12. A survey is required grior to the filing of a final plaL
13. The Owner shall negotiate with the Spokane County Parks Department aad
submit a recorded copy of a voluntary agreement making provisions for public
parks prior to finalization and recording of this plat. The agreement shall
provide a written description of the subject property to which the agreement
applies and also state the dollar amount and any other agreed to miagating
measures.
The Owner shaU also notify aay potential purchasers who have made an
agreement to purchase property within said plat pursuant to the Revised Code
of Washington (58.17.205), that adequate provisions for parks must be made
coaditioned on a future agreement betwreen the plattor aad Spokane Couaty
Pazks Department.

14. The Owner shall negotiate with the Central Valley School District No. 356 and
submit a recorded copy of a voluntazy agreement making provisions for public
schools prior to finalization and recording of this piat. Tlle agreement shall
provide a writoen descripaon of the subject property to which the agreement
applies and also state the dollar amount and any other agreed to mitigating
measures.
The Owner shall also notify any potential purchasers who have made an
agreement to purchase property withi.n said plat pursuant to the Revised Code of
Washington (58.17.205), that adequate provisions for school facilities must be
made conditioned on a future agreement between the plattor and school disarict
Voluntay agreements between the Owner and School District shall conform ta
the requinements of the Revised Code of Washington Chapter 82.02.
15. The final plat dedication shall contain the following statement:
"Duplex dwelling units are prohibited."
COUNTY ENGINEER'S DEPARTMENT CONDITIONS
1. The conditional approval of the plat is given by the County Eagineer subject to
dedication of right-of-way and approval of the road system as indicated in the
preliminary plat of record.
2. No construction work is to be performed withia the existi.ng or proposcd public right-
of-way until a peimit has been issued by the County Engineer. All work is subject to
inspecdon and approval by the Counry Engineer.
3. Individual driveway access permits are required prior to issuance of a building permit
for driveway approaches to the county road system.
4. Existing county roads providing direct access to the plat shall be paved and/or curbed to
Spokane County standards.
5. Sidewalks are required along the arterial on McDonald Road.
6. The word "applicant" shall include the owner or owners of the property, his heirs,
assigns and successors.
7. To construct the road i.mprovements stated herein, the applicant may, with the approval
of the County Engineer, join in and be a willing participant in any pedtion or resolurioa
wtuch pirpose is the formation of a Road Impmvement District (RID) for said
improvements, pursuant to RCW 36.88, as amended. At such time as aa RID is
created or aay Road Improvement Project is sanctioned by Spokane County, the
improvements required (curb, sidewalk, drainage control and paving to existing
pavement) will be at the sole expense of the undersigned owner(s), their heirs, grantees
and assigns. This provision is applicable to 13th Avenue.
8. As an alternative method of constructing the road improvements stated herein, the
applicant may, with the approval of the County Engineer, accomplish the road
unprovements stated herein by joini.ng and participating in a County Road Project
(CRP) to the extent of the required road improvements. At such tune as an RID is
created or any Road Improvement Project is sanctioned by Spokane Counry, the
improvements required (curb, siciewalk, dra,inage control and paving to existing
pavement) will be at the sole expense of the nndersigned owner(s), their heirs, grantees
and assigns. T'his provision is applicable to 13th Avenue.

9. The following statement shall be placed in the plat dedication:
"The owner(s) or snccessor(s) in interest agree to authorize tlle County to place
their name(s) on a petition for the fonnation of a Road Improvement District
(RID) by the petition method pursuant to Chapter 36.88 RCW, which petition
includes the owner(s)' property, and further not to object, by the signing of a
ballot, to the formation of an RID by the resolution method pursuant to Chapter
36.88 RCW, which resoludon includes the owner(s)' property. If aa RID is
formed by either the petition or resolution method as provided for in Chapter
36.88 RCW, the owner(s) or successor(s) further agree:
(a) that the improvement(s) or construcdon contemplated within the proposed
RID is feasible;
(b) that the benefits to be derived fram the formaaon of the RID by the property
included therein, tQgether with the amount of any County parncipation,
exceed the cost and expense of formation of the RID; and
(c) that the property within the proposed RID is sufficiendy developed.
Provided further that the owner(s) or successor(s) shall reta.i.n the right, as
authorized under RCW 36.88.490, to object to any assessment(s) on the
property as a result of the improvements called for in conjunction with the
formadon of an RID by either petition or resoludon method under Chapter
36.88 RCW, and to appeal to the Superior Court the decision of the Board
of County Comrnissioners affinning the final assessmeat roll.
It is further agreed that at such time as an RID is created or any Road
Improvement Project is sanctioned by Spokane County, the improvements
required (curb, sidewalk, drainage control and paving) will be at the sole
expense of the undersigned owner(s), their heirs, grantees and assigns
without participation by Spokane County.
The RID waiver contained in this agreement shall expire after ten (10) years
from the date of execution below. However, the owner(s) or successor(s)
agree that if said RID waiver expires without construction of the required
improvements, the owner(s) or successor(s) agree to construct the required
improvements at their own expense, pay to Spokane County the then
estimated cost of the required improvennents to enable the County to
complete the same, or furnish a bond or other secure method suitable to the
County (which may include the execution of annother RID waiver agreement)
providing for or securing Lo the County the actual construction of the
improvements.
All of the requirements of this agreement shall run with the land and shall be
binding upon the owner(s), their successor(s) or assign(s)." This provision
is applicable to 13th Avenue.
10. The County Engineer has designated Typical Roadway Secaon Number Two Minor
Arterial standard for the improvement of McDonald Road, which is adjacent to the
proposed development.
11. T'he County Engineer has designated Typical Roadway Section Nnmber Two Local
Access standaird for the improvement of 13th Avenue, which is adjacent to the
proposed development. This will require the addidoa of approximately 8-10 feet of
asphalt along the frontage of the develogment. T'he construction of curbing and
sidewal.lc is also required.
12. The proposed subdivision shall be improved to the stand.ards set forth in Spokane
County Board of Commissioners Resolution No. 80-1592, as amended, which
resolution establishes regulations for roa.ds, approaches, drainage and fees in new
construction.
13. The County Engineer has examined this development proposal and has detarmined that
the impact of this proposal upon the existing county road system warrants the
dedication of additional right-of-way and the roadway improvements herein specified.

14. The following statement shall be placed in the final plat dedication: "The private road as
shown hereon is an easement which provides a means af i.ngress and egress for those
lots within the subdivision having frontage thereon.
15. The County Arterial Road Plan identifies McDonald Road as a Minor Arterial. The
existing right-of-way width of 50 feet is not consistent with that specified in the Plan.
In or+der to implement the Arterial Road Plan, in addition to the required right-of-way
dedication, a strip of property 15 feet in width along the McDonald Road frontage shall
be set aside in reserve. This property may be acqwred by Spokane Counry at the rime
when arterial improvements are made to McDonald Road
16. There may exist utilities, either undergmound or overhead, affecang the subject
property, including property to be dedicated or set aside for future acquisition.
Spokane County assusnes no financial obligation for adjustments or relocation
regazding these utitities. Applicant(s) should check with the applicable utility purveyor
and the Spokane County Engineer to detennine whether applicant(s) or the utility is
responsible for adjusoalent or relocation costs and to make arrangements for any
necessary work.
17. Official Counry Road Maps indicates that the existing right-of-way for 13th Avenue is
50 feet. The applicant's surveyor has indicated an existing right-of-way of only 45
feet. Should the Official Road Map be found in error the applicant shall comply with
the following conditions:
Dedication of 5 feet of additionai right-of-way along 13th Avenue.
Applicant shall ded,icate the applicable radius on McDonald Road and 13th Avenue.
COUNTY HEALTH DISTRICT CONDTTIONS
1. The final plat shall be desigaed as indicated on the preliminary plat of record aad/or any
attached sheets as aoted
2. Sewage disposal method shall be as authorized by the Director of Utuities, Spokane
County.
3. Water service shall be coordinated through the I?irector of Utilides, Spokane County.
4. Water service shall be by an existing public water supply when approved by the
Regional Engineer (Spokane), State Department of Health.
5. Prior to filing the final plat, the sponsor shall demonstrate to the satisfaction of the
Spokane County Health District that an adequate and potable water supply is available
to each tract of the plat
6. Prior to filing the final plat, the sponsor shall present evidence that the plat lies withi,n
the recarded service area of the water system proposed to serve the plaL
7. A public sewer system will be made available for the plat aad individual service will be
provided to each tract prior to sale. Use of individual on-site sewage disposal systems
shall not be authorized.
8. 1'tie dedicatory language of the plat will state: "A public sewer system will be made
available for the plat auad ind.ividual seTVice will be provided to each tiract prior to sale.
Use of individual an-site sewage d.isposal systems shall not be authorized."
9. The dedicatory language on the plat shall state: "Use of private wells and water
systems is prohibited."
10. The plat dedicarion will contain a statement to the effect that: "The public water system,
pursuant the Water Plan approved by county and state health authorides, the local fire
protection district, County Building and Safety Deparmtnet and water purveyor, shall
be installed within this plat, and the subdivider will provide for individual domestic
water service as well as fire prntection to each traet prior to sale of each uact and prior
to issuance of a building pemiit for each tract."

1. Any water service for this project shall be provided in accordance with the Coordinated
Water System Plan for Spokane County, as amended.

BUILDING AND SAFETY DEPAItTMENT CONDITIONS
1. The applicant shall contact the Depanment of Buildings at the earliest possible stage of
designldevelopment in order to be informed of code requirements
administeredJenforced as authorized by the State Building Code Act.
Design/development concerns include: FIRE APPARATUS ACCESS ROADS; FIRE
HYDRANT/FLOW; APPROVED WATER SYSTEMS; BUII.DING

VERA WATER AND POWER
1. The plat requires only simple connections to an existing, approved water system which
will provide adequate domestic water to ensure the public health, safery and general
welfare. Therefore, Vera Water and Power doe.s not require the preparation of a water
plan for this project.

"Findings and Order" should the short plat be approved.
