Guthrie being owner of all lots in Flora Addition, County of Spokane,
State of w'asnington, as per map thereon recorded in the office of the
County Auditor of said County on JunE 12, 1979, do hereby declare the
following protective covenants a.nd condit ioms for the use and benefit
of all of said property which they own and for the use and benefit of
each and every purchaser of any af said property:
(a) LAND USE AND BUILDING TYPE. No lot shall be used except for
residential purposes. No building shali be erected, altered, placed or
permitted to remain on any lot other than one detached single-faunily
dwelling.
(b) LIVESTOCK AND POULTRY. No anirnals, livestock, or poultry of a.ny

THIS MATTER, an applicadon for subdivision of land, from A. Dale Pendergrass has been
received and decided upon, pursuant to Spokane County Subdivision regulations, on October
-10 , 1994.
FINDItYGS OF FACT AND CONCLUSIONS
1. The individual signing below has further been properly delegated the responsibility for
rendering the decision by the Spokane County Director of Planning.
2. The proposal is to divide approximately .91 acres into 21ots for single family uses and
those uses pennitted in the underlying zone which may include duplexes.
3. The proposal is generally located at the southwest corner of the intersection of Broadway
Avenue and flora Road, 400 feet south of the flora road overpass of I-90. More
particularly described as Lot l, Block 1 of Flora Acres Subdivision in the NE 1/4 of the
SE 1/4 of Section 13, Township 25 North, Range 44, EWM.
4. The proposal is a replac of Lot 1, Block l of the plat of Flora Acres Subdivision, Spokane
County Short Plat Ordinance, Chapter 2, Definitions, Secdon 2.31(C) defines replat as;
"Short Subdivision is the division of land for sale, lease, or transfer as follows:
Resubdivision of a recorded plat where four (4) or less total lots are created by dividing
the recorded lot or lots."
5. The existing zoning of the property described in the application is Urban ResideAtial - 3.5
(UR-3.5), previously established as Urban Residential - 3.5 (UR-3.5) (File #60-42)
zoning in 1960 and redesignated to Urban Residential - 3.5 (UR-3.5) on January 1, 1991
consistent with the Program to Implement the Spokane Counry Zoning Code. Pursuant to
RCW 58.17.195 the proposal does conform to the requirements of the existing Urban
Residential - 3.5 (UR-3.5) zone.
6. The Spokane County Comprehensive Plan designates this area as Urban. The
development and uses proposed are consistent with this category. The "Urban Category"
is intended to provide the opportunity for development of a"cirylike" environment which
includes various land uses, intensive residential development, public facilities and services
and promotes infilling to better utilize existing and proposed facilities and services. The
Urban category provides for residendal net densiries of 1 unit per acre to 17 units per acre.
7. 1'he site is currently occ:upied by a single family residencc on the northern portion of the
lot and a vacant mobile home pad on the southern pordon of the lot fronting on FIora
Road. Adjacent uses include singte family with large animal keeping to the west, single
family with orchards dnd large commercial gardens to the south, a single family residence
and duplex units directly ac;ross Flora Road to the east and single family to the north.
8. The required public nodce was provided for this proposal pursuant to Chapter 5.5 (4) of
the Spokane County Short Plat Ordinance and agencies having a potendal interest in the
project were notified and recommendations solicited. '
9. No written commencs were received from adjoining property owners.
10. The site is located within the Public Trdnsit Benefit Ar+en (PTBA). Spokane Transit
Authority (STA) Route # 1$, provides service to the site on Broadway Road. STA Route
#18 the Broadway Feeder provides conneccing service via the Pence-Cole Valley Transit
Center located at University Street and 4th Avenue.
11. The Spokane County Arterial Road Plan identifies Flora Road as a Pri.ncipal Arterial
having an existing width of 60 feet and a proposed width of 100 feet. Broadway Avenue
is idenafied as a Minor Arterial with An exisang width of SO feet and a proposed width of
90 feet. As condizioaed the proposal is found to be consistent with the Spokane Counry
Arterial Road Plan.
12. , The Cena-al Valley Schaol Districc No. 356 has commented on the proposed shon plat.
The District has indicated that existing school facilities are inadequate to serve the
pmposed short ptac and wishes to negotiate with the owner to provide adequate capital
facilities as required by the Revised Code of Washington (RCW) 58.17.110. Review bv
county legal counsel indicates the eondition requested by the School District can be
requiretl for developmen~S. Approval of this short plat should include conditions requiring
that provisions for appropriate faciliries be in place prior to recording this final short plat in
the form of a written agreement between the property owner and che schoat district.
13. The proposed short plac will be served by a public water. Waste water disposal will be as
authorized by the Director of Utilides.
14. The proposal is within the service area of Verra Water & Power. No water plan is required
as the site will be served by simple connections to an exisang approved water system.
15. Recognizing the recommended canditions and Spokane County development standards,
the proposed short subdivision makes xppropriate provisions for the public health, safety
and general welfare and that the publie use and interest will be served by platting the
proposed shon subdivision.
The subdivision proposal is generally consistent with RCW 58.17 and the County
subdivision regulations, promoting the public health, safety and general welfare in
accordance with standards established by the state and Spakane County. The Planning
Department has considered the provision of public facilities as cited in RCW 58.17.110
(2). More specifically:
a. open spaces
b. drainage ways
c. public and/or private rights-of-way
d . transit
e. potable water
f. sanitary waste disposal
g. parks and recreation facilities
h. playgrounds
i. schools and school graunds
j. sidewalks
16. The project is exempt from environmental review under the State Environmental Policy
Act pursuant to WAC 197-11-500 (E) (a).
DECISIqN
Based upon the above noted Findings of Fac:c and Conc:lusions, Short Plat Application
SP-974-94 is herzby APPRAVED until September 1, 1997, subject to condiaons noted
below. Most oF the conditions of approval shall be accomplished by the applicant and/or
sponsor prior to finalizaaon of the short subdivision. This decision is final unless appealed in
writing, consiscen[ with adopted appeal proc.edures.
PLANNING UEPART11aiElVT CpND1TIQNS
1. All condidons imposed by the Planning Department shall be binding on the "Applicant"
which term shall include the owner or owners of the property, he'vs, assigns and
successors.
2. The proposal shall comply with the Urban Residential-3.5 (UR-3.5) zone as amended.
3. The final plat shall be designed substantially in conformance with the preliminary plat of
record. No incnease in density or number of lots shall occur without a change of condition
application submittal and approval.
4. The Planning Direc[or/designee shal] review any prapased final pIat to ensure compliance
with these Findings and Conditions of Approval.
5. Appropriate road nanie(s) shall be indicated.
b. The preliminary plat is given condiaonal approval for three (3) years, specificaUy to
November 1, 1997. The applicant may request an extension of ame by submitting a
written request approximately forty-five (45) days prior to the above expiration date.
7. Appropriate utiliry easements shall be indicated on copies of the proposed final plat.
VWritten approval of utiliry easements by appropriate urility companies shall be received
with the submittal of the final plat.

8. Three (3) current c:ertificates of dtle shall be fumished to the Planning Deparmnent prior to
filing the final plat.
9. The final plat map shall ind.icate by a clear, dashed line the required yard setbacks from all
private, "Tract X" or public roads. The dedication shall contain the following statement:
"Side yard and rear yard setbacks shall be determined at the time building pernuts are
requested unless these setbacks are specifically draf'ted on this final plat. The setbacks
indicated on this plat may be varied from if proper zorring approvals are obtained."
10. A plan for water facilities adequate for domesdc service and fire protecaon shall be
approved by the water purveyor, appropriate fire protection district, County Building &
Safery Department and County Health District. The agencies will certify on the Water
Plan, prior to the filing of a final plat, that the plan is in conformance with their respecave
needs and regulaaons. The Water Plan and cerafication shall be drafted on a transparency
suitable for reproduction and be signed by the plat sponsor.
11. The water purveyor shall certify that appropriate contractual azrangements and schedule of
improvements have been made with the plat sponsor for construcaon of the water system
in accordance with the approved Water Rlan. The time schedule shall provide for
completion of the water system and inspection by the appropriace health authorities prior to
application for building permits within the final plat. The arrangements or agreements
shall include a provision holding Spokane County and the purveyor hazmless from claims
by any lot purchaser refused a building permit due to the failure of the subdivision sponsor
to satisfactorily r.omplete the approved water system.
12. The final plat dedicadon shall contain the following statement:
"The public water system, pursuant to the Water Plan approved by county and state health
authorides, the local fire protecdon district, County Building & Safety Department and
water purveyor, shall be installed within this subdivision, and the applicant shall provide
for individual domestic water service as well as fire protecdon to each lot prior to sale of
each lot and prior to issuance of a building pennit for each lot."
13. No building permit will be issued for any lot within the final plat unril cerdfied by a
Washington state-licensed engineer that "the water system has been installed pursuant to
the appmved Water Plan for the final plat" including a signed license stamp. The
certification may be in the form of a letter, but is preferred to be certified on a copy of the
Water Plan as a schematic map showing the "as-built" water system.
14. The Water Plan and the above four (4) condidons of approval regarding the Water Plan
may be waived by the Planning Director/designee upon receipt of letters from the
appropriate water purveyor and fire protection disarict stating that simpie connections to an
existing, approved water system wi ll provide adequate domesdc and fire protection water
to ensure the public health, safety and general welfare.
15. The final plat shall be addressed in accardance with the provisions of RCW 58. 17. 280
and applicable locdl requirements.
16. A survey is nequired prior to the filing of a final plac.
17. The owner shall negodate with Cencral VaIley School District and submit a recorded copy
of a voluntary agreement making provisions for public schools prior to finalization and
recording of the plat. The agreement shall provide a written description of the subject
property to which the agreement applies and also state the dollar amount and any other
agreed to mitigating measures.
The owner shall also nocify any potential purehasers who have made a.n agreement to
purchase property within said plat pursuant to the Revised Code of Washington (RCW)
58.17.205, that adzquate provisions for school facilities must be made conditioned on a
future agreement between the plattor and school district.
Voluntary agreements between the owner and school district shall tonform to the
requirements of RCW Chapter 82.02.
18. The Spokane County Planning Deparmient shall prepare and record with the County
Auditor a Title Notice spec;ifying a future land acquisition area for road right-of-way and
utiliries. The reserved future acquisidon area Title Notice shall be released, in full or in

' part, by the Planning Depardnent. The notice should be recorded within the same rime
, frame as an appeal dnd shall provide the following:
a. At least 18 feet of reserved future acquisition area for road right-of-way and utilities,
in addition to the existing and/or newly dedicated right-of-way along Flora Road.
NO'TE: The County Engineer ha.s required 2 feet of new dedication along Flora
Road.
b. At least 18 feet of reserved future acquisition area for road right-of-way dnd utilities,
in addition to the existing and/or newly dedicated right-of-way along Broadway
Avenue. NOTE: The County Engineer has required 2 feet of new dedication along
Broadway Avenue.
c. Future building and other setbacks required by the Spokane Counry Zoning Code
shall be measured from the reserved future acquisidon area.
d. No required landscaping, parking, '208' areas, drainfield or allowed signs sbould be
located within the future acquisition area for road right-of-way and utilities. If any
of the above improvements are made within this area, they shall be relocated at che
applicant's expense when roadway improvements are made.
e. The future acyuisition area, until ac:quired, shall be private properry and may be used
as allowed in the zone, except that any improvements (such as landscaping, parking,
surface drainage, drainfield, signs or others) shall be consideret] incerim uses.
f. The property owner shall be responsible for relocadng such "interim" improvements
at the dme Spokane County makes roadway improvements aftzr acquiring said future
acquisition area.
COUNTY ENGINEER'S DEPARTMENT CQNDITIQNS
1. 1'he conditiona] approval of the plat is given by the County Engineer subject to dedication
of right-af-way and approval of the road system as indicated in the preliminary plat of
record.
2. No construction work is to be performed within the existing or proposed public right-of-
way until a petmit has been issued by the County Engineer. All work is subject to
inspecrion and approval by the County Engineer.
3. Individual driveway aecess permits are requireti prior to issuance of a building pernut for
driveway approaches to the county road system.
4. Dedicaaon of 2 feet of additional right-af-way along Broadway Avenue is required.
5. Dedicauon of 2 teet oi' additianill right-of-way along Flora RQad is required.
6. Exisang county roads prpviding direc:t acc:ess to the plat shall be paved and/or curbed to
Spokdne County standa,-ds.
7. Sidewalks are required along the arterial(s) on Broadway Avenue.
8. Sidewalks are required along the arterial(s) on Flora Road.
9. The word "applieant" shall include the owner ar owners of the property, his heirs, assigns
and suecessors.
10. To consavct the road improvements stated herein, the applicant may, with the approval of
the Councy Engineer, join in and be a wiliing participant in any petition or resolution
which purpose iS che forniatioii of a Road lmprovement District (RID) for said
improvements, pursuant to RCW 36.88, as amended. At such time as an RID is created
or any Road Improvement Project is sanctioned by Spokane County, the improvements
required (curb, sidewalk, drainage control and paving to existing pavement) will be at the
sole expense of the undersigned owner(s), their heirs, grantees and assigns. This
provision is applieable to Broadway Avenue and Flora Road.
11. As an alternative method of constructino the road improvements stated herein, the
applicant may, with the approval of the Counry Engineer, accomplish the road
improvements stated herein by jaining and participating in a County Road Project (CRP)
to the extent of the required c-nad improvements. At su4h time as dn RID is created Ar any

Road Improvement Project is sancdoned by Spokane Counry, the improvements required
(curb, sidewalk, drainage control and paving to exisbing pavement) will be at the sole
expense of the undersigned owner(s), their heirs, grantees and assigns. This provision is
applicable to Broadway Avenue and Flora Road.
12. The following statement shall be placed in the plat dedication:
"The owner(s) or successor(s) in interest agree to authorize the County to place their
name(s) on a peation for the fonnation of a Road Improvement District (RID) by the
petiaon method pursuant to Chapter 36.88 RCW, which peation includes the owner(s)'
property, and further not to object, by the signing of a ballot, to the formaaon of an R.ID
by the resolution method pursuant to Chapter 36.88 RCW, which resolution includes the
owner(s)' property. If an RID is formed by either the perition or resolution method as
provided for in Chapter 36.88 RCW, the awner(s) or successor(s) further agree:
(a) that the improvement(s) ar construccion contemplated within the proposed RID is
feasible;
(b) that the benefits to be derived from the formation of the RID by the property included
therein, together with the amount of any County pamcipation, exceed the eost and
expense of farniation of the RID; and
(c) that the property within the proposed R[D is sufficiently developed.
Provided further that the owner(s) or successor(s) shall retain the right, as authorized
under RCW 36.88.090, to objeet to any assessment(s) on the property as a result of
the improvements caJled for in c;onjuncrion with the formation of an RID by either
petidon or resolution method under Chapter 36.88 RCW, and to appeal to the
Superior Court the decision of the Board of Counry Commissioners affirming the
final assessment roll.
It is further agreed that at such time as an RID is created or any Road Improvement
Project is sdnctioned by Spokane County, the improvements required (curb,
sidewalk, drainage control and paving) will be at the sole expense of the undersigned
owner(s), their heirs, grantees and assigns without participation by Spokane
Caunty.
The RID waiver contained in this agreement shail expire afcer ten (14) years from the
date of execution below. However, the owner(s) or successor(s) agree that if said
RID waiver expires without construction of the required improvements, the owner(s)
or successor(s) agree to construct the required improvements at their own expense,
pay to Spokane County the then estimated cost of the required improvements to
enable the County ta complete the same, or fumish a bond or other secure method
suitable to the County (which may include the execudon of another RID waiver
agreement) providing for or securing to the County the actual canstruction of the
improvements.
All of the requirement,s of this agreement shall run with the land and shail be binding upon
the owner(s), their successor(s) or assign(s)." This provision is applicable to Broadway
Avenue and Flora Rodd.
13. The County Engineer has designated Typical Roadway Section Number 2 Minor Arterial
standard for the improvement of Broadway Avenue which is adjacent to the proposed
development. This will require the addition of appraximately 12-14 feet of asphait along
the frontage of the development. The construction of curbing and sidewalk is also
required.
14. The Counry Engineer has designated Typical Roadway Section Number 2 Minor Arterial
standard for the improvement of Flora Road which is adjacent to the proposed
development. This will require the addition of approximately 11-13 feet of asphalt along
the frontage of the development. The construction af curbing and sidewalk is also
required.
15. The proposed subdivision shall be improved to the standards sec forth in Spokane County
Board of Commissioners ReSOlution No. 80-1592, as amended, which resolurion
establishes regulations for roads, approaches, drainage and fees in new construction.
16. The Counry Engineer has examined this development proposal and has deternvned that the
impact of this proposal upon the exisdng county road system warrants the dedicaaon of
additional right-af-way and the roadway improvements herein specified.

17. The applicant shall dedicate the applicable radius on Broadway Avenuc and Flora Road.
18. The County Arterial Road Plan identifies Broadway Avenue as a Minor Arterial. The
exisang right-of-way width of SQ feet is not consistent with that specified in the Plan. In
order to implement the Arterial Road Plan, in addition to the required right-of-way
dedicadon, a scrip of property 18 feet in width along the Broadway Avenue frontage shall
be sec aside in reserve. This property may be acquired by Spokane County at the vme
when arterial improvements are made to Broadway Avenue.
19. The Connty Arterial Road Plan identifies Flora Road as a Principal Arterial. The existing
right-of-way width of 60 feet is not consistent with that specified in the Plan. In order to
implement the Arterial Road Plan, in addidon to the required right-of-way dedicarion, a
strip of property 18 feet in width along the Flora Road frontage shall be set aside in
reserve. 1'his praperty may be acquired by Spokane County at the time when arterial
improvements are made to Flora Road.
20. There may exist utilities, either underground or overhead, affecting the subject propercy,
including property to be dedicated or set aside for future acquisiaon. Spokane County
assumes no financial obligadon for adjusmients or relocation regarding these urilities.
Applicant(s) should check with the applicable uriliry purveyor and the Spokane County
Engineer to determine whether appticant(s) or the utility is responsible for adjustment or
relocation costs and to make arrangemen[s for any necessary work.
COUNTY HEALTH DISTRIGT CONDITIONS
1. The final plat shall be designed as indicated on the preliminary plat of record and/or any
attached sheets as noted.
2. Appropriace utility easements shall be indicated on copies of the preliminary plat of record
for distribution by the Planning Department to the utility companies, Spokane Counry
Engineer and the Spokane County Health District. Written approval of the easements by
the utility companies must be received prior to the submittal of the final plat.
3. Sewage disposal method shall be as authorized by the Direc;tor of Utiliaes, Spokane
Counry.
4. Water service shall be coordinated through the Directar of tJtilities, Spokane County.
5. Water service shall be by an exiscing publir water supply when appraved by the Regional
Engineer (Spokdne), State Department of Health.
6. Prior to filing the final plat, the sponsor shall demonstrate to the satisfacaon of the
Spokane County Health Disrrict thac an adequate and potable water supply is available to
each aract of the plat.
7. Prior to filing the final plat, the sponsor shdll to the satisfacrion of the Spokane County
Health District thac suitable sites for on-site sewage disposal systems are available on tract
A and B.
8. Subject to specific applicaaon approval and issuance of permits by the Health Officer, the
use of individual on-site sewage disposal systems may be authoriied.
9. The dedicatory language of the plat will state: "Subject to specific application approval and
issuance of pemnits by [he Health Officer, the use of individual on-site sewage disposal
systems may be authorized."
10. The dedicatory language oil the plat shall state: "Use of private wells and water systems is
prohibited."
11. The final plat dediraaon shall contain the following statement: "The public water system,
pursuant to the water plan approved by counry and state health authorities, the local fire
protecdon district, County Building ttnd Safety Department, and water purveyor, shaU be
installed within this subdivision dnd the applicant shall provide for individual domestic
water service as well as fire protecrion to each lot/tract prior to sale of each lot/tract and
prior to issuance of a building permit for each traet."

CAUNTY UTILITIES DEPARTMCiVT CUNDITIONS
1. Any water service for this project shall be provided in aeeordance with the Coordinated
Water System Plan for Spokane County, as amended.
2. Pursuant to the Board of County Commissioners Resolution No. 80-0418, the use of on-
site sewer disposal systems is hereby authorized. This auchorization is conditioned in
compliance with all rules and regulaaons of the Spokane County Health District and is
further condiuoned and subject ta specific apglication approval and issuance of permits by
the Health District.
3. The owner(s) or successor(S) in interest agree to authorize the Caunty to place their
name(s) on a petirion for the fonnation of ULID by perition method pursuant to RCW
36.94, which petition includes the owner(s)' property; and further not to object by the
signing of a protes[ perition against che formdtion of a ULID by resolution method
pursuant to RCW Chapter 36.94 which includes the owner(s)' property. PROVIDED,
this condition shall not prohibit the owner(s) or successor(s) from objeccing to any
assessment(s) on the praperry as a result of improvements called for in conjunction with
the formation Qf a ULID by either petition or resolution under RCW Chapter 36.94.
4. Each dwelling unit shall be double-plumbed for connection to future areawide collecrion
systems.
BUILDING AND SAFETY DEPARTMENT CQNDITIUNS
The applicant shall contact the Department of i3uildings at the earliest possible stage in
order to be infornied of code reyuirements administered/enforced as authorized by the
State Building Caie Act. Design/development concerns include: Addressing; fire
apparatus access roads; fire hydrant/flow; approved water systems; building accessibility;
consavction rype; occupancy classificaaon; exiang; exterior wall protection; and energy
code reguladons. (Note: The Deparcment of Buildings reserves the right to confirm the
actual address at the time af buiiding permit.)

The following "Conditions of Approval" for the above referenced subdivision
are submitted to the Spokane County Planning Department for inclusion in the
"Findings and Order" should the short plat be approved.
E 1 That conditional approval of the plat by the County Engineer is given
subj ect to dedication of Right-of-Way and approval of the road system as
indicated in the preliminary plat of record.
E 6 PIo construction work is to be performed within the existing or proposed
Public Right-of-Way until a permit has been issued by the County
Engineer. All work is subject to inspection and approval by the County
Engineer.
E12 The applicant should be advised that individual driveway access permits
are required prior to issuance of a building permit for driveway
approaches to the County road system.
E13 Dedication of 2 feet of additional Riqht-of-Way along Broadwav Avenue.
E13 Dedication of 2 feet of additional Right-of-Way along Flora Avenue.
E16 Existing County roads providing direct access to the plat shall be paved
and/or curbed to Spokane County standards.
E18 That sidewalks are required along the arterial on Broadwav Avenue.
E18 That sidewalks are required along the arterial on Flora Road.
E19 The word "applicant" shall include the owner(s) of the property, his/her
heirs, assigns and successors.
E20 To consLruct the road improvements stated herein, the applicant may,
with the approval of the County Engineer, join in and be a willing
participant in any petition or resolution which purposes is the
formation of a Road Improvement District (RID) for said improvements
pursuant to RCW 36.88, as amended. At such time as an RID is created or
any Road Improvement Project is sanctioned by Spokane County, the
improvements required (curb, sidewalk, drainage control and paving to
existing pavement) will be at the sole expense of the undersigned owner,
their heirs, qrantees and assigns. This provision is applicable to
Broadwav Avenue and Flora Road.
E21 As an alternative method of constructing the road improvement stated
herein, the applicant may, with the approval of the County Engineer,
accomplish the road improvements stated herein by joining and
participating in a County Road Project (CRP) to the extent of the
required road improvement. At such time as an RID is created or any
Road Improvement Project is sanctioned by Spokane County, the
improvements required (curb, sidewalk, drainage control and paving to
existing pavement) will be at the sole expense of the undersigned owner,
their heirs, grantees and assigns. This provision is applicable to
Broadwav Avenue and Flora Road.
E22 That the following statement shall appear within the dedicatory language
of the f inal plat:
The owner(s) or successor(s) in interest agree to authorize Spokane
County to place their name (s) on a petition for the formation of a
Road Improvement District (RID) by the petition method pursuant to

Chapter 36.88 RCW, which petition includes the owner(s) property-, and
further not to object, by the signing of a ballot, the formation of
a RID b.y the resolution method pursuant to Chapter 36.88 RCW, which
resolution includes the owrier(s) property. If a RID is formed by
either'the petition or resolution method, as provided for in.-Chapter
36.88 RCW, the owner ( s) or successor ( s) furttier agree :(1) that the
improvements or construction contemplated within the proposed RID is
feasible, (2) That the.benef its to be derived from the formation of
the RID by the property includ'edtherein, together with the.-amount
of an.y County participation, exceeds the cost and expense of formation
of the RID, and (3) t-hat the property within the, proposed RID is
suffic'iently, developed. Provided, further, the owner(s) or
successor,(s) shall retain the right, as authorized undjer RCW
16 . 8:8 . 09'0 , to obj ect to any assessment ( s) on the property as,,a r.esult.
of the iinprovements called for in,conjunction with the formation of
a RID by either petition or resolution method under Chapter 36.8-8 RCW,,
and to appeal to the Superior Court the decision of the Board of
County Commissioners, affirming the fina-1 assessment roll. It is
further agreed that at such time as an RID' is created or any Road .
Improvement project is sanctioned by S,pokane County, the improvements
required (curb, sidewalk, drainage contr.ol and paving) will be at the
sole expense of the undersigned owner, their heirs, grantees and
assigns without participation by Spokane County.
The RID waiver conta_ined in this agreement shall expire a,fter -ten
(10) years from the date of execution below. However; the-owner'(s)
or successor(s) agree that if said RID waiver expires w'lthout
construction of the r.equired improvements, the owner(s) or
succes'sor ( s) aqree to construct the required improvements at their own
expense; ,pay to Spokane County the then est imated cost of the required
improvements to enable the County to complete the same; or furnish a
bond or other secure method su.itable to the County (wh_ich may include
the execution of another RID wai-ver agreement), providirig, for or
securinq to the County theactual construction of the improvements.
All of the requirements of this agreement shall r-un with the land and
shall be binding upon the owner(s), their successor(s) or assign(s).
This provision is applicable to Broadway Avenue and. Floa Road.
E24 The County Engineer has designated Typical Roadway Section Number 2
-Minor Arterial Standard for the -improvement of Broadwav Avenue which is
adjacent to the proposed deuelopment. This will require, the. addition of
approximately, 1-2-14 feet of asph'alt along the frontage of the
deve,lopment. The const-ruction of curbing and sidewalk is also,required.
E24 The Count.y Engineer has designated Typ-ical Roadway Section -ATumber 2
Minor Arter-ial Standard for the improvement of Flora Road which is
adjacent to, the proposed development. This will require the addl-t-ion of
appr-oximately 11-13 feet of asphalt along the frontage of the
development. The construction of curbing and sidewalk is also required.
E32 The proposed plat shall be improved to the standards set forth in
~Spokane County Board of Comnnissioners Resolution No. 80-15:92,, as
amended, which establishes regulations for roads, approaches, dr-.ainaqe
and fees in new construction.
E33 The County Engineer has examined this development proposal and Yias
determined that the impact -of this proposal upon the existing County
Road System warrants the dedication of additional Right of Way-and the
roadway improvements herein specif=ied.
E38 Applicant shall dedicate the applicable radius on Broadwav Avenue and
Flora Road.
E61 The County Arterial Road pla~n identif ies Broadwav Avenue as a Minor
Arterial. The existing right of way width of 50 feet is not consistent
with that specified in The Plan. In order-to implement the Arterial
Road Plan it is recommended that in addition to the required right of
way dedication, a strip of property 18 feet in width alonq the Broadwav

by Spokane County at the time when Arterial Improvements are made to

E61 The County Arterial Road plan identifies Flora Road as a Principal
Arterial. The existing right of way width of 60 feet is not consistent
with that specified in The Plan. In order to implement the Arterial
Road Plan it is recommended that in addition to the required right of
way dedication, a strip of property 18 feet in width along the Flora
Road frontage be set aside in reserve. This property may be acquired by
Spokane County at the time when Arterial Improvements are made to Flora
Road.
E90 The applicant should be advised that there may exist utilities either
underground or overhead affecting the applicants property, including
property to be dedicated or set aside for future acquisition. Spokane
County will assume no financial obligation for adjustments or relocation
regarding these utilities. The applicant should check with the
applicable utilities and Spokane County Engineer to determine whether
the applicant or utility is responsible for adjustment or relocation
costs and to make arranqements for any necessary work.
