SP-980-94 ) COriCLUSIONS AND 1994 ) DECISION County Egineerir►2 THIS MATTER, an application for subdivision of land, from John A. Wiess has been received and decided upon, pursuant to Spokane Counry Subdivision regulations, on the ~ day of 1994. FINDINGS OF FACT AND CONCLUSIONS 1. The individual signing below has further ber.i properly delegated the responsibility for rendering the decision by the Spokane Counry Director of Planning. 2. The proposal is to divide approximately 1 acre into 21ots for 1 existing duplex and 1 proposed duplex and those uses permitted in the Urban Residential-3.5 (UR-3.5) zone. 3. The proposal is generally located north of and adjacent to Boone Avenue, approximately 180 feet east of Wilbur Road in the NE 1/4 of Section 16, Township 25 North, Range 44 E.W.M. Spokane Counry, Washington. 4. The existing zoning of the property described in the application is Urban Residential-3.5 (UR-3.5), previously established as Agricultural Suburban (AS) (file # 99-55) zoning in 1955 and redesignated to UR-3.5 on January 1, 1991, pursuant to the Program to Implement the Spokane County Zoning Code. Pursuant to RCW 58.17.195 the proposal dces conform to the requirements of the existing UR-3.5 zone. 5. The Spokane County Comprehensive Plan designates this area as Urban. The development and uses proposed are generally in accord with this category. 6. Surnounding uses are primarily single and multifamily residences on mixed tu-ban size lots and open space. 7. The required public notice was provided for this proposal and agencies having a potential interest in the project were notified and recommend.ations solicited. 8. Written comments were received from an adjoini.ng property owners who questioned the use of a private driveway (easemeot) to serve more than one dwelling. 9. The use of a private driveway (easement) to provide access to this proposal has been addressed by the County Engineer's Conditions of Approval. 10. The site is located witbin the Public Transportation Benefit Area (PTBA). The Spokane Tran,sit Authority (STA) Valleyfl'rentwood Route # 20 provides connecting services to the site. 11. The proposed short plat will be served by a public water system. Waste water disposal will be as authoriz,ed by the Director of Utilities. 12. The Central Valley School District No. 356 has commented on the proposed Short Plat. The District has indicated that existing school faciliaes are inadequate to senre the proposed short plat and wishes to negotiate with the owner to grovide adequate capital facilities as required by the Revised Code of Washington (RCW) 58.17.110. Review by County legal counsel indicates the cand.ition requested by the School District can be requireti for developments. Approval of this short plat should include conditions requiring that provisions for appropriate facilides be in place prior to recording the final short plat in the form of a written agreement between the owner and the school district. 13. The proposed short plat has direct access to public right of way at Boone Avenue. No sidewalks were required by the County Engineer along Boone Avenue regazding this proposal, but is conditioned as part of the future formation of a Road Improvement District (RID) project 14. Recognizing the recommended conditions and Spokane County development standards, the proposed short subdivision makes appropria.te provisions for the public health, safety and general welfare and that the public use and interest vwill be scrved by platcing the subdivision. The subdivision proposal is generally consistent with RCW 58.17 and the County subdivision regulations, promoting the public health, safety and general welfare in accordance with standards established by the state and Spokane County. The Planning Department has considered the provision of adequate public facilities as cited in RCW 58.17.110 (2). More specificaily: a. open spaces b. drainage ways c. public and/or private rights-of-way d . transit e. potable water f. sanitary waste disposal g. parks and r+ecreation facilities b . playgrounds i. schools and schoolgrounds j. sidewalks 15. The pmject is exempt from environmental review under the State Environmental Policy Act pursuant to WAC 197-11-$00 (6) (a). 16. The following facts are also relevant: a. Subd,i.vision of property should not allow the creation of nonconfonning setbacks for existing structures. Structure setbacks for the existing duplex on Tract "A" adjacent to the "Proposed Private Driveway Easement" must comply with the setback standards of the Urban Residential-3.5 (tJR-3.5) zone. b. An Application for Administrrative Exception (fiie # AEE-110-94) was received and approved by the Planning Department, which granted the owner of the property a 2.5 feet (14%) reducrion in the required 25 foot flanking yard setback stand.ards of the UR-3.5 zone. c. One storage structure, detached, private, is permitted ituide the Urban Impact Area (UTA) bouruiary, limited in area ro 1,500 square feet and provided serbacks and maximum building coverage standards are met. d. The owner of the property has indicated that the existing structure on Tract "B" labeled "SHED" will be removed. DECISION Based upon the above noted Findings of Fact and Conclusions, Short Plat Application SP-980- 94 is hereby APPROvED until December 1, 1997, subject to conditions noted below. Most of the conditions of approval shall be accomplished by the applicant and/or sponsor prior to finalizarion of the short subdivision. This decision is final unless appealed in writing, consistent with adopted appeal procedures. COUNTY PLANNING DEPARTMENT CONDITIONS 1. All condirions imposed by the Planning Department shall be binding on the "Applicant", whi.ch term shall include the owner or owners of the property, heirs, assigns and successors. 2. The pmposal shall comply with the Urban Residential-3.5 (UR-3.5) zone as amended. 3. The final plat shall be designeci substantially in conformance with the preliminary plat of record. No increase of density or number of lots shall occur without a change of condicioa application submittal and approval. 4. T'he Planning Director/designee shall review any proposed final plat to ensure compliance with these Findings and Cond.itions of Approval. 5. The preliminary plat is given conditional approval for three (3) years, specifically to December 1, 1997. The applicant may request an extension of time by submitting a written request approximately forty-five (45) days prior to the above expiration date. FIIVDINGS AND DECISION SP-980-94 Page 2 . • 6. Three (3) current certificates of title shall be furnished tn the Planning Department prior to filing the final plat. 7. Appropriate utility easements shaU be indicated on copies of the proposed final plaL Written approval of utility easements by appropriate utility companies shaU be received with the submittal of the final plat. 8. Prior to filing of final plat, the appropriate road name(s) and street address(es) shaU be I inciicated. 9. The final plat map shall indicate by a clear, dashed line the required yard setbacks firom all private, "Tract X" or public roads. The dedication shaU contain the foilowing statement: "Side yard and rear yard setbacks shall be determined at the time building pemuts are requested unless these setbacks are specifically drafted on this final pla.t. The setbacks ind.icated on this plat may be varied from if proper zoning approvals are obtained." 10. A plan for water facilities adequate for domestic service and fire protection shall be approved by the water purveyar, appropriate fire protection d.istrict, County Division of Buildings and County Health District. The agencies will certify on the Water Plan, prior to the filing of a final plat, that the plan is in confoimance with their respective aeeds and regulations. The Water Plan and certification shall be drafted on a uansparency suitable for reproduction and be signed by the plat sponsor. 11. The water purveyor shall certify that appropriate contractual arrangements and schedule of improvements have been made with the plat sponsor for construction of the water system in accordnnce with the approved Water Plan. The tirne schedule shall provide for completion of the water system and inspection by the appropriate health authorities prior to application for building pemuts within the final plat- The anangements or agreements shall include a provision hold.ing Spokane County and the purveyor haraaless frnm claims by any lot purchaser refused a building pernut due to the failure of the subdivision sponsor to satisfactorily complete the approved water system. 12. The final plat dedication sha11 contain the following statement: "The public water system, pursuant to the Water Plan approved by county and state health authorities, the local fire protection district, water purveyor and Spokane County Division of Buildings, shall be installed within this subdivision, and the applicant shaU provide for individual domestic water service as well as fire protection to each tract prior to sale of each tract and prior to issuance of a building pemut for each tract." 13. No building permit will be issued for any lat within the final plat undl certified by a Washington state-licensed engineer that "the water system has been installed pursuant to the approved Water Plan for the final plat" including a signed license stamp. The cerafication may be in the form of a letter, but is preferred to be certified on a copy of the Water Plan as a schematic map showing the "as-built" water system. 14. The Water Plan and the above four (4) conditions of approval regard.ing the Waxer Plan may be waived by the Planning Director/designee upon receipt of leaers from the appmpriate water purveyor and fire protection district stating that simple connections to an existing, approved water system will provide adequate domesdc and fire protection water to ensure the public health, safety and general welfare. 15. The owner shall negotiate with Central Valley School District and submit a recorded copy of a voluntary agreement maldng provisions for public schools prior to finalization and m.cording of the plat. The agreement shall provide a written description of the subject property to which the agreement applies and also state the dollar amount and any other agreed to mitigating measures. The owner shall also notify any potential purchasess who have ma,de an agreement to purchase property within said plat pursuant to the Revised Code of Washington (RCW) 58.17.205, that adequate provisions for school facilities must be made conditioned on a future agreement between the plattar and school districL Voluntary agreemencs between the owner and school district shaU conform to the requirements of RCW Chapter 82.02. 16. A survey is required prior to the filing of a final plat. FINDINGS AND DECISION SP-980-94 Page 3 • ~ I COUNTY DI'VISION OF ENGINEERING AND ROADS CONDITIONS 1. The conditional approval of the plat is given by the County Engineer subject to dedicarion of right-of-way and approval of the road system as indicated in the preliminary plat of record. 2. No construction work is to be performed within the existing or proposed public right-of- way until a permit has been issued by the Caunty Engi.neer. All work is subject to inspection and approval by the County Engineer. 3. Individual driveway access perrnits are required prior to issuance of a build.ing permit for driveway approaches to the county road system. 4. Dedication of 5 feet of additional right-of-way along Boone Avenue is required. 5. Exisdng county roads providing d.irect access to the plat shall be paved and/or curbed to Spokane Counry standards. 6. 1'he word "applicant" shall include the owner or owners of the property, his heus, assigns and successors. 7. To construct the road improvements stated hcrein, the applicant may, with the approval of the County Engineer, join in and be a willing participant in any peetion ar resolution which purpose is the formation of a Road Improvement District (RID) for said improvements, pursuant to RCW 36.88, as amended. At such time as an RID is created or any Road Improvement Project is sanctioned by Spokane County, the improvements required (curb, sidewalk, drainage control and paving to existing pavement) will be at the sQle expense of the undersigned owner(s), their heirs, grantees and assigns. 1'his provision is applicable to Boone Road. 8. As an alternative method of constructing the raad improvements stated herein, the applicant may, with the approval of che County Engineer, accomplish the road improvements stated herrecin by joining and participating in a County Road Project (CRP) to the extent of the required road improvements. At such time as an RID is created or any Road Improvement Project is sanctioneci by Spokane County, the improvements required (curb, sidewalk, drainage control and paving to existing pavement) will be at the sole expense of the undersigned owner(s), their heirs, grantees and assigns. This provision is applicable to Boone Road. 9. The following statement shall be placed in the plat dedication: 'The owner(s) or successor(s) in interest agree to authorize the County to place their name(s) on a petition for the fonnation of a Road Improvement District (RID) by the petition method pursuant to Chapter 36.88 RCW, which petition includes the owner(s)' property, and further not to object, by the signing of a ballot, to the formation of an RID by the resolution method pursuant to Chapter 36.88 RCW, which resolution includes the owner(s)' property. If an RID is formed by either the petition or resolurion method as provided for in Chapter 36.88 RCW, the owner(s) or successor(s) further agree: (a) that the improvement(s) or construction contemplated within the proposed RID is feasible; (b) that the benefits to be derived from the formation of the RID by the property included therein, together with the amount of any County participation, exceed the cost and expense of fonnation of the RID; and (c) that the property within the proposed RID is sufFciently developed.. Provided further that the owner(s) or successor(s) shall retain the right, as authorized under RCW 36.88.090, to object to any assessmeat(s) on the property as a result of the improvements called for in conjunction with the formation of an RID by either petition or resolution method under Chapter 36.88 RCW, and to appeal to the Superior Courc the decision of the Board of County Commissioners affirnung the final assessment roll. ' / It is further agreed that at such time as an RID is created or any Road Improvement Project is sanctioned by Spokane County, the improvements required (curb, sidewalk, drainage control and paving) will be at the sole expense of the undersigaed owner(s), their heirs, grantees and assigns without participatton by Spokane County. The RID waiver contained in this agreement shaU expire after ten (10) years from the date of execution below. However, the owner(s) or successor(s) agree that if said RID waiver expires without construction of the required improvements, the owfler(s) or successor(s) agree to construct the required improvements at their own expense, pay to Spokane County the then estunated cost of the requi.red improvements to enable the County to complete the same, or furnish a bond or ocher secure method suitable to the County (which may include the execution of another RID waiver agreement) providing far or securing to the County the acrual construcdon of the improvements. All of the requirements of this agrcement shaU run with the land and shall be binding upon the owner(s), their successor(s) or assign(s)." This provision is applicable to Boane Road. 10. The County Engineer has designated Typical Roadway Section Number 2 Local Access Standard for the improvement of Boone Road, which is adjacent to the proposed development. This will require the addition of approximately 8-10 feet of asphalt aloag the frontage of the developmenL The construcdon of curbing is also reqcrired. 11. T'he proposed plat shall be improved to the standards set forth in Spokane County Board of Commissioners Resolution No. 80-1592, as amended, which resolution establishes regulations for mads, approaches, drainage and fees in new consavction. 12. The County Engineer has examined this development praposal and has determined that the impact of this proposal upon the existing county road system warrants the dedication of additional right-of-way and the roadway unprovements herein specified. 13. There may exist utilities, either underground or overhead, affecting the subject property, including property to be dedicated or set aside for future acquisition. Spokane County assumes no financial obligation for adjusmneats or relocation regarding these utilities. Applicant(s) should check with the applicable utility purveyor and the Spokane County Englneer to determine whether applicant(s) or the utility is responsible for adjustnnent or relocation costs and to make arrangements for any necessary work. 14. The applicaat shall provide documentation to the satisfaction of the County Engineer that the locai fire district will approve the proposed twrnaround as shown on the preliminary plat. The County Engineer shaU also review an approve the praposed tarnaround. 15. The pmposed12 foot driveway easement as shown on the preliminary plat shaU serve only Tract B„.If any other lot or parcel used the easement, than it shall become a private rQad and be constructed to Spokane County Private Road Standards within a 30 foot private road easement. Pri.vate road approval shall include the review of road and drainage plans and the execution of necessary documents as prescribed by the County Engineer. COUNTY HEALTH UISTRICT CONDITIONS 1. The final plat shall be designed as indicated on the preliminary plat of record and/or any I attached sheets as noted. 2. Appropriate utility easements shall be indicated on copies of the preliminary plat of record for distribution by the Planning Department to the utility comparues, Spokane County Engineer and the Spokane County Health District Wntten approval of the easements by the urility companies must be received prior to the submittal of the final plat. 3. Sewage disposal method shaU be as authorized by the Director of Utilities, Spokane County. 4. Water service shall be coordinated through the Director of Utilities, Spokane County. 5. Water service shaU be by an existing public water supply when approved by the Regional Engineer (Sgokane), State Department of Health. FINDINGS AND DECISION SP-9$0-94 Page 5 . - ~ - 6. Prior to filing the final plat, the sponsor sball demonstrate to the satisfaction of the Spokane County Health District that an adequate and potable water supply is available to each tract of the plat. 7. Prior to filing the fina] plat, the sponsor shall present evidence that the plac lies within the recorded service area of the water system proposed to serve the plaL 8. A plan for water facilities adequate for domestic use, domestic irrigation use and fue protection use shall be approved by the water purveyor. Said water plan must have been . approved by the fire protecdon district and the appropriate llealth authorities. The health authorities, water supplier (purveyor) and the fire protection district will certi.fyy, prior to the filing of the finai plat, on the face of said water plan that the plan is in confermance with their requirements and will adequately satisfy their respective needs. Said water plan and certification will be drafted on a transparency suitable for reproduction. 9. T1ie purveyor will also cemf}► prior to filing the final plat on a copy of said water plan that appropriat,e contractual arrangements have beeo made with the plat sponsor for construction of the water system, in accordance witb the approved plan and time schedule. The time schedule will provide, in any case, for completion of the water system and inspection by the appropriate health autharides priar to application for building permits within the plat. The contractual arrangements will include a provision holding Spokane County, Spokane County Health Distnct and the purveyor haimless from claims by any tract purchaser refused a building pernut due to failure of the plat sponsor to satisfactorily complete the approved water system. 10. Prior to filing the final plat, the sponsor shall demonstrate to the satisfaction of the Spokane County Health District that suitable sites for on-site sewage d.isposal systems are available on Tract "B". 11. Subject to specific applicadon approval and issuance of permits by the Health Officer, the use of individual on-site sewage disposal systems may be authorized. 12. The dedicatory language of the plat will state: "Subject to specific applicarion apprnval and issuance of permits by the Health Off'icer, the use of inclividual on-site sewage systems may be authorized." 13. Tbe dedicatory language on the plat shall state: "Use of private wells and water systems is prohibited." 14. The plat dedication shall contain a stacement to the effect that: "The public water system, pursuant to the Water Plan approved by cour,:y and state health authorities, the local fire protection district, water purveyor and County Division of Buildings, shall be installed within this p.lat, and the applicant shall provide for individual domesac waxer service as well as fire protection to each tract prior to sale of each tract and prior to issuance of a building permit for each tract." COUNTY DIVISION OF UTILITIES CONDTTIONS 1. Any water service for this project shall be provided in accordance with the Cooniinated Water System Plan for Spokane County, as amended. 2. The owner(s) or successor(s) in interest agree to authorize the County to place their name(s) on a petition for the fonnation of ULID by petirion method pursuant to RCW 36.94, which petition includes the owner(s)' property; and further not to object by the signing of a protest petition against the formation of a ULID by resolution method pursuant to RCW Cbapter 36.94 which includes the owner(s)' property. PROYIDED, this condition shall not prohibit the owner(s) or successor(s) from objecting to any assessment(s) on the praperty as a result of improvements called for in conjunction with the formation of a LJLID by either petition or resolution under RCW Chapter 36.94. 3. Provided, further, the owner(s) or successor(s) shall retain the right, as authorized under RCW 36.88.090, to object to any assessment(s) on the property as a result of the improvements called for in conjunction with the formation of a RID by either petition or resolution method under Chapter 36.88 RCW, and to appeal to the Superior Court the decision of the Board of County Commissioners affirming the final assessment roll. It is further agreed that at such time as an RID is created or any Road Improvement project is sanctioned by Spokane County, the improvements required (curb, sidewalk, drainage control and paving) will be at the sole expense of the undersigned owner, their heirs, grantees and assiqns without participation by Spokane County. The RID waiver contained in this agreement shall expire after ten (10) years from the date of execution below. However, the owner(s) or successor(s) agree that if said RID waiver expires without construction of the required improvements, the owner(s) or successor(s) agree to construct the required improvements at their own expense; pay to Spokane County the then estimated cost of the required improvements to enable the County to complete the same; or furnish a bond or other secure method suitable to the County (which may include the execution of another RID waiver agreement), providing for or securing to the County the actual construction of the improvements. All of the requirements of this agreement shall run with the land and shall be binding upon the owner(s), their successor(s) or assign(s). This provision is applicable to Boone Avenue. E24 The County Engineer has designated Typical Roadway Section Number 2 Local Access Standard for the improvement of Boone Avenue which is adjacent to the proposed development. This will require the addition of approximately 8-10 feet of asphalt along the frontage of the development. The construction of curbing is also required. E32 The proposed plat shall be improved to the standards set forth in Spokane County Board of Commissioners Resolution No. 80-1592, as amended, which establishes regulations for roads, approaches, drainage and fees in new construction. E33 The County Engineer has examined this development proposal and has determined that the impact of this proposal upon the existing County Road System warrants the dedication of additional Right of Way and the roadway improvements herein specified. E90 The applicant should be advised that there may exist utilities either underground or overhead affecting the applicants property, including property to be dedicated or set aside for future acquisition. Spokane County will assume no financial obligation for adjustments or relocation regarding. these utilities. The applicant should check with the applicable utilities and Spokane County Engineer to determine whether the applicant or utility is responsible for adjustment or relocation costs and to make arrangements for any necessary work.
