IN THE MATTER OF ) FINDINGS OF FACT,
SHORT PLAT NO. SP•994-94 ) CONCLUSIONS AND
) DECISION
THIS MATTER, an application for subdivision of land, finm Arnold Peterson has been
received and decided upon, pwrsuant to Spokane County Subdivision regulations, on the
~j.h day of January, 1995.
FINDINGS OF FACT AND CONCLUSIONS
1. The individual signing below has further been properly delegated the responsibility for
rendering the decision by the Spokane County Director of Planning.
2. The pr+oposal is to clivide approximately 3.2 acre(s) into 21ots (Tract "A" and "B") for
residential dwellings and those uses genmiued in the Commnnity Business (B-2) and
Regional Business (B-3) zone.
3. The proposal is Iocated adjacent and between Rockwell Avenue and Trent Road (SR-280),
approximately 310 feet west of Best Road in the NW 1/4 of Section 2, Township 25
North, Range 44 E.W.M. Spokane County, Washington.
4. The existing tioning of the property described in the application are Commuaity Business
(B-2) and Regional Business (B-3), previously established as Agricultural zoning in 1942
(File No. 424-42) and redesignated to Community Busiaess (B-2) and Regional Business
(B-3) on January 1,1991, pursuant to the Program to Implemeat tbe Spokane County
Zoning Code. Pursnant to RCW 58.17.195 the proposal dces confonn to the
requirements for minimum lot and firontage of the existing Communiry Bnsiness (B-2) and
Regional Business (8-3) zones. However, Tract B of the proposal has two existi~ng single
family structures that are used for residential hoasing. The curnent zoning does not permit
residential dwellings without having a commercial or business use on the ground floor.
1'herefore, the existing dwellings may qualify as nonconforming in the Community
Business (B-2) and Regional Business (B-3) zones, pursuant to Chapter 14.508 of the
Spokane County Zoning Code. The B-3 zone daes allow a residential dwelling as a
caretaker residence for a commercial use, "prnvided thai it is limited to the duration of need
associated with the custodial, maintenance or overseeing of the owner's property, building
and/or use."
5. The Spokane County Comprehensive Plan designates this area as Major Commescial
Category. The Comprehensive Plan state.s " Residential use in Major Commenial ar+eas is
not intended to be a high priority in this caZegory and may be limited tD preeacisting uses."
The development and uses, as proposed and oondidoned are in compliance with this
category.
6. Surrounding uses aze primarily resideadal east and west of the subject site. To the north
there is single family housing combined with vacant pareels. The southern off-sioe view is
of the Kaiser Aluminum Plant, with vacant laad in the foreground.
7. The required public notice was provided for this pmposal and agencies having a potential
interest in the project were notified and recomaaendations solicited.
8. No written comments were received from any adjoining property owners.
9. The Spokane County Arterial Road Plan identifies Trent Road (SR-290) as a STATE
HIGHWAY and Rockwell Avenue as a LOCAL ACGESS ROAD with a future right of
way width of 60 feet. The existing Rockwell Avenue right of way width is 50 feet and
has a graveled roadway improved to a width of approximately 24 feet In order to
implement the Art+erial Road Plan, a strip of property S feet in width along the Rockwell
frontage shall be set aside as a Future Acquisitioa Area. The County Engineer's has
requnred 30 feet in width of asphalt, in addidon to curbing, sidewalks and drainage
control, along the frontage of the development on Rockwell Road, therefore as
condidoned, the proposal conforms to the Plan.
10. The site is locaied within the Public Transportadon Benefit Area (PTBA). The Spokane
Transit Authority (STA), Route #20 provides connecting senrices t+o the site.
. 11. The proposed short plat will be served by a public water system. Waste water disposal
will be as authorized by the Director of Utilities.
12. The Spokane County Parks Department has comnnented on the progosed short plat and
does not request a voluntary agreement, at this time.
13. The East Valley School District has not commented on the proposed Shart P1at,
14. The proposed short plat has direct accesss to public right of way at Rockwell Avenue and
Trent Road (SR-290). Sidewalks aze required by the County Engineer along RoGkwell
Avenue regarding this proposal, and have been coad.itioned as part of the future formation
of a Road Improvenient District (RID) project. No sidewallc.s are required along Trent
Road.
15. Recognizing the recommended conditioas and Spokane County development standards,
approgriate provisions should be made to ensure the public health, safety and gexierai
welfare and that the public use aad inrerest will be served by platting the subdivision.
The subdivision proposal is generally consistent with RCW 58.17 and the County
subdivision regularions, promoting the public health, safety and general welfare in
accordance with standard,s established by die state and Spokane Couaty. The Planning
Department has considered the provision of adequate public facilities as cited in RCW
58.17.110 (2). More specifically:
a, open spaces
b. drainage ways
c. public and/or private rights-of-way
d. transit
e. potable water
f. sanitary waste disposal
g. parks aad recreation facilities
h. playgrouads
i. schools and schoolgrouads
j . sidewalks
16. The project is exempt finm environmental review under the State Environmental Policy
Act pursuant to WAC 197-11-800 (6) (a).
DECISION
Based upon the above noted Findings of Fact and Conclusions, Short Plat Application
SP-994-94 is hereby APPROVED until February 1,1998 subject to conditions noted below.
Most of the conditions of approval shall be accomplished by the applicant and/or sponsor prior
to fuialiution of the short subdivision. This decision is final unless appealed in wnting,
consistent with adopted appeal procedures.
COUNTY PLANNING DEPARTMENT CONDTTIONS
1. All conditions imposed by the Planning Department shall be binding on the "Applicant",
which term shall include the owner or owners of the property, heirs, assigns and
successors.
2. The proposal shall comply with the Community Business (B-2) and Regional Business
(B-3) zone(s) as amended.
3. The final plat shall be designed substaatially in conformance with the preliminary plat of

regulations. The Water Plan and certification shall be clrafted on a transparency suitable
for reproduction and be signed by the plat sponsor.
12. The water purveyor shall certify that apgmpriate convactual anangements and schedule of
improvements have been made with the plat sponsor for construction of the water system
in accordance witb the approved Water Plan. The time schedule shall provide for
compledon of the water system and inspecdon by the appropriate health authorities prior to
application for bu.iiding pemiits within the final plat, The arrangements ar agreements
shall include a provision holding Spokane County and the piuveyor harmless from claims
by any lot purchaser refused a building permit due to the failnre of the subdivision sponsor
to satisfactorily complete the appmved water system.
13. The final plat deciication s►hall contain the following statement:
"The public water system, pursuant to the Water Plan approved by couaty and statie health
authorities, the local fine protection di.strict, water purveyor and Spokane County Division
of Buildings, shall be installed within this subdivision, and tbe applicant shall provide for
iadividual domestic water service as well as fire protection to each tract prior to sale of

14. No building permit will be issued far aay lot within the final plat until cerdfied by a
Washing►ton state-licensed engineer ttat "the water system has been installed pursuant to
the approved Water Plan for the final plat" including a signed license stamp. The
certificadon may be in the farna of a letter, but is preferred to be certified on a copy of the
Water Plan as a schematic map showing the "as-constructed" water system.
15. The Water Plan and the above four (4) conditions of approval regarding the Water Plan
may be waived by the Pl~anning Dinector/designee upoa receipt of letters from the
approp~iaoe water purveyor and f re protecdon district stating that simple cAnnections to an
existing, approved water system will provide adequate domestic and fire prote,ction water
to ensure the public health, safety and general welfare.
16. A survey is requir+ed prior to the filing of a final plat.
COUNTY DIVISION OF ENGINEERIlYG AND ROADS CONDITIONS
1. The conditional approval of t6e plat is given by the Gounty Engineer subject to approval of
the road syscem as iadicated in the preliminary plat of record.

8. The following statement shall be placed ia the plat dedication:

feasible;
(b) that the benefits to be derived from the fornaation of the R.ID by the property included
therein, togetber with the amount of any County participation, exceed the cost and
expense of foimation of the RID; and
(c) that the property within the proposed RID is sufficiently developed.

decision of the Board of County Commissioners affuming the final assessment roll.
It is fiirther agreed that at such time as an RID is created or any Road Improvement Project

control and paving) will be at the sole expense of the undersigned owner(s), their heus,
grantees and assigns without participation by Spokane County.
The RID waiver contained in this agneement shaU expire after ten (10) years from the date
of execution below. However, the owner(s) or successor(s) agree that if said RID waiver
expires without coastruction of the required improvements, the owner(s) or successor(s)
agree to construct the required improvemeats at their own expense, pay to Spokaae
County the then estimated cost of the required improvements to enable the County ta
complete the same, or furnish a bond or other secure method suitable to the County (which
may include the execution of another RID waiver agreement) providing for or securing to
the County the actual construction of the improvements.
All of the requirements of ttiis agreement shall run with the land and shaU be binding upon
the owner(s), their successor(s) or assign(s)." This provision is applicable to Rockwell
Avenue.
9. The County Engineer has designated Typical Roadway Section Number 2 Local Access
standard for the improvement of Rockwell Avenoe, which is adjacent to the pmoposed
development. This will require the add.ition of approxirnately 30 feet of asphalt along the
frontage of the development.
10. The proposed subdivision shaU be improved to the stand,ards set forth in Spokane County
Board of Co►mmissioners Resoludon No. 80-1592, as amended, which resolution
establishes regulations for roads, approa,ches, drainage and fees in new constzvction.
11. The County Engineer has examined this development propasal and has determined that the
impact of this proposal upon the existing county road system wamants the roadway
~ improvements herein specified.
2) Access pennits and improvements to SR-290 must be approved by the Washington State
Department of Transpartadon (WSDOT).
13. The applicant is advised that no access will be from Rockwell Avenue for commercial
purposes until such time as specifically allowed by the County Engineer. Should the
County Engineer allow commercial access firom Rockwell Avenue, the RID Agreement
shaU be declared null and void and the applicant shaU design and constract Rockwell

COUNTY HEALTH DISTRICT CONDTTIONS
1. The final plat shaU be designed as indicated on the preliminary plat of recozd and/or any
attached sheets as noted.
2. Appropriate udlity easements shall be indicated on copies of the plat of reoord for
distiribution by the Planning Department to the utility oompanies, Spokane County
Engineer and the Spokane Counry Health DistricG Written approval of the easemeats by

3. Sewage disposal method shall be as authorizze~d by the Director of Utilities, Spokane

available on tract A and B.
9. Prior to filing the final plai, the sponsor shall demonstrate to the satisfaction of the

the front residence located on tiract B is wholly located within the boundaries of the uract

PARKS DEPAItTMENT CONDITIONS
1. To satisfy the requirements of RCW 58-17-110 that a subd.ivision make appropriate
provisions for public parks, recreation and playgrounds, the owner, at his/her option,
shall either dedicate land within the subdivision or enter into a voluntary agreement with
Spokane County to mitigate the diroect impacts that the sabdivision has on public parks,
open spaces and recreadonal facilities within the unincorporated areas of Spokane County.
If the owner opts to enter into a voluntary agmement, the agr+eement shall be executed prior
to the finalization and recording of the plat and reoonded in conjuncdon therewith. the
agreement shall be vonsistent with RCW 82.02.020 an substantially the same as the

on the proposed CHANGE AND VACATION of a portion of ROCKWl:LL AVENUE, proceedi4ge

the Board on proof duly mede that notice of the hearing was published and posted in
the manner and for the time requiced by law, and the Board after examining all
claime and all mapa and papere on file and after heering the evidence adduced at
