BEFORE THE SPOKANE COUNTY PLANNING DEPARTMENT
IN THE MATTER OF ) FINDINGS OF FACT,
SHORT PLAT NO. SP-997-94 ) CONCLUSI4NS AND
) DECTSION
THIS MATTER, an application for subdivision of land, from Donald and Mariann
Heinemann has beeureceived and decided upon, pursuant to Spokane County Subdivision
regulations, on the 14L day of February, 1995.
FINDINGS OF FACT AND CONCLUSIONS
1. The individual signing below has further been properly delegated the responsibility for
rendering the decision by the Spokaue County Director of Planning.
2. The proposal is to divide approximately 3.48 acre(s) into 31ots far those uses permitted
in the Urban Residential - 22 (UR 22) and Regional Business (B-3) zones. The sponsor
proposes to divide the Regional Business (B-3) zoned property from the Urban
Residential - 22 (CTR-22). Thereby, allowing the spoasor to sell the Regional Business
(B-3) zoned praperty (I,ot 3), continue the existing use of a mobile home park in the
Urban Residearial - 22 (iJR-22) zone (Lot 2) and request a zone change for Lot 1 to
Regional Busiaess (B-3) in the future.
3. The praposal is located appr+oximately 700 feet east of Adams Road and south of and
adjacent to Sprague Avenue, in the NE 1/4 of Section 23, Township 25 North, Range 44
E.W.M. Spokane County, Washington.
4. The existing zoning of the property described in the application is Urban Residential - 22
(UR-22) and Regional Business (B-3), previously established as Muldple Family
Suburban zoning in 1957 (File No. 32-57) and Commercial zoning in 1979 (File No.
174-79) redesignated to Urban Residential - 22 (UR-22) and Regional Business (B-3) on
]anuary 1, 1991, pursuant to the Program to Implenlent the Spokane County Zoning
Code. Pursuant to RCW 58.17.195 the proposal dces conform to the requirements of
the existing zones.
5. The Spokane County Comprehensive Plan designates this area as Major Commercial.
Residential uses ia the Major Commer+cial Category are not intended to be a high priority,
however, they may be limited to preeexistiag uses. Therefore, the development and uses,
as proposed and conditioned are in compliance with this category. •
6. Surnounding uses are diverse and range from residential to manufacturing. To the north
of the subject site are commercial sales operations aad retail "fast food"; to the south are
aparnnent units; and to the east there are c01113mercial sales and vacant land; to the west
there is manufacturing. The subject site is currendy a mobile home park, known as,
Americana Mobile Park. The "park" has 22 mobile homes aad one "conventional built"
house on-site currendy.
7. The required public notice was provided far this proposal and agencies having a potential
interest in the prroject were nodfied and recomaaendations solicited.
8. No written comments were received from any adjaining property owners.
9. The Spokane County Arterial Road Plaa identifies Sprague Avenue as a Principal
Arterial with a future right of way width af 130 feet The exisdng right of way width is
110 feet. In order to implement the Aroerial Road Plan, the County Eagineer has
requested that a strip of property 10 feet in width along the Sprague Avenue frontage be
set a,side as a Future Acqoisition Area. In addition, the Spokane Cflunty Arterial Road
Plan identifies the South Valley Arterial as a Controlled Access Arterial with a fuuure right
of way width of 160 feeL Tlie existing right of way width is 60 feet. In arder to
implement the Arterial Road Plan, the County Engineer has requested that a strip of
property 60 feet in width along the South Valley Arterial frontage be set aside as a Future
Acquisition Area. Therefore, as condidoned, (curbs, sidewalks and Future Acquisition
Area) the proposal coaforms to the Plaa.
10. The site is located within the Pnblic Transportation Benefit Area (PTBA). The Spokane
Transit Authority (STA), Route # 9 provides connecting services to the site.

11. The proposed short plat will be served by a public water system VVaste water disposal
will be as authorized by the Diremr of Utilities.
12. The Spokane County Parks Department has commented on the proposed short plat. The
Parks Department dces not require a voluntary agr+eement be completed at this time.
13. The Central Valley School District No. 356 has commented on the proposed Short Plat.
The District has indicated that no written agreement is needed at dus time.
14. The proposed short plat has dinect access to public right of way at Sprague Avenue.
Sidewalks are requined by the County Fngineer along Sprague Avenue regarding this
proposal.
15. Recognizing the recommended conditions and Spokane County develapment standards,
appropriate pr+vvisions should be made to ensure the public health, safety and general
welfare and that the public use and interest will be served by platting the subdivision.
The subdivisioa proposal is generally consistent with RCW 58.17 and the County
subdivision regulations, promoting the public health, safety and general welfare in
accordance with staadards established by the state and Spokane County. T'he Planning
Departiment has considered the pmvision of adequate public facilities as cited in RCW
58.17.110 (2). More specifically:
a. open spaces
b. drainage ways
c. public andlor private rights-of-way
d. nnsit
e. potable water
f. sanitary waste disposal
g. parks aad recr+eation facilities
h. playgrounds
i. schools and schoolgrounds
j. sidewalks
16. The project is exempt finm environmental review under the State Environmental Policy
Act pursuant to WAC 197-11-800 (6) (a).
DECISIQN
Based upon the above noted Findings of Fact and Conclusions, Short Plat Application SP-997-
94 is hereby APPROVED until March 1,1998, subject to cooditions noted below. Most of
the conditions of approval shall be accomplished by the applicant andlor sponsor prior to
finalization of the short subdivision. This decision is final unless appealed in writing,
consistent with adopted appeal procedures.
COUNTY PLANNING DEPARTMENT CONDITIONS
1. All conditions imposed by the Plao.aing Depamment shall be binding on the "Applicant",
which term shall include the owner or owners of the property, heirs, assigns and
snccessors.
2. The praposal shall comply with the Urban Residential - 22 (UR-22) and Regional
Business (B-3) zone(s) as amended. NOTE: The approval to create thme lots, dces not
in any way grant or imply approval of a B-3 zone change for Lot 1. Such a zoning
reclassificaxion application will be required to meet the standards for that acdon, aside frrom
and separate from the prieliminary approval of this short plat
3. The final plat shall be designed subsmtially in confarmance with the pnliminary plat of
record. No increase of density or number of lots shall occur without a change of candition
application submittal and approval. In addition, the mobile homes noted on the
preliminary Plat as "to be removed" shall be removed prior to final approval.
4. The Plannin~ Director/designee shall review any proposed final plat to ensure compliance
with these Fuidings and Conditions of Approval.
5. The preliminary plat is given conditional approval for three (3) years, specifically to March
1, 1998. The applicant may request an extension of time by submitting a written request
appnoximately forty-five (45) days prior Lo the above expiration date.

6. Three (3) cument certificates of title shall be furnished to the Planning Deparmnent prior to
filing the final plaL
7. Appropriate utility easements shall be indicated on oopies of the proposed final plat.
Written appmval of utility easeaaents by appropriate utility compaaies shall be received
with the submittal of the final plaL
8. Prior to filing of final plat, the appropriate r+aad name(s) and street address(es) shall be
indicated.
9. The final plat map shall indicate by a clear, dashed line the reqirired yar+d setbacks from all
private, "Tract X" or public rnads. The dedication shall contain the following statement:
"Side yard and rear yard setbacks shall be detemnined at the time building pennits are
requested unless these setbacks are specifically drafted on this final plat The setbacks
indicated on this plat may be varied from if proper zoning approvals are obtained."
10. 'Ihe Spokane County PLanning Department shall prepare and record with the County
Auditor a Title Notice specifSnng a fueane land acquisition area for road right-of-way aad
utilities. The resesved future acquisition area Tide Notice shall be released, in full or in
part, by the Planning Department. The notice should be recorded with Final Plat and shall
provide the following:
a. At least 10 feet of reserrved future acquisition area for road right-of-way along the
frontage of Sprague Avenue and at least 60 feet of reserved fuam acquisidon am,a
for mad right-of-way along the fmntage of South Valley Arterial.
b. Future building and other setbacks reqiured by the Spokane County Zon.ing Code
shall be measured from the reserved future acquisition area.
c. No required landscaping, parking, '208' areas, drain,field or allowed signs should be
located within the future acquisition area for road right-of-way and utilities. If any
of the above irnprovements are made withia this area, they shall be relocated at the
applicant's expense when roadway unprovements are made.
d. The future acquisidon area, until acquired, shaU be private property and may be used
as allowed in the zone, except that any improvements (such as landscaping, parldng,
surface drainage, drainfield, signs ar others) shall be considered interim uses.
e. The property owner shall be responsible for relocating such "interim" unprovements
at the time Spokane County makes roadway improvements after acquiring said future
acquisition area.
11. No water plan is required, and a simple tap is needed at the time of building permit release.
12. A survey is required priar to the filing of a final plat.
13. A specific and detailed site improvement plan will be submit~ed for Planning Deparnnent
review and receive approval pnor to recording the final plat Prior to the issuance of any
further bvilding germits, change of use permit or certificabe of occupancy the site plan
must be approved. Appropriate bonds or pmof of consauction must be subnritted at the
time of final plat review t,o cover the estimated cost of on-site improvements which were
required as a part of the short plat approval.
COUNTY DIVISION OF ENGINEERING AND ROADS CONDITIONS
1. That conditional approval of the plat by the County Engineer is given subject to
dedication of Right-of-Way and approval of the road system as indicated in the
pre 'luninary plat of recorrl.
2. That plans, profiles and cross secdons as designed to County standarrds showing
proposed smeet centerline and curb gmdes be submitted to the Couaty Engineer for
approval prior tn construction and/or the filing of a final plat; road plans to be prepared
under the direction of a licensed Professional Civil Engineer.
3. That drainage plans and design calculations showing the alignment of drainage facilities
be submitted to the County Engineer for approval prior to construcdon aad/or the filing of
the find plat Drainage plans to be prepared under the direction of a licensed
Professional Civil Engineer.

4. No construcdon work is to be performed within the existing or proposed Public Right-of-
Way until a permit has been issued by the County Engineer. All work is subject to
inspection and approval by the County Engineer.
5. The applicant should be advised that individual driveway access pernnits are required
prior to issuance of a building pennit for driveway approaches to the County road
system.
6. Existing County roads pmviding direct access to the plat shall be paved aad/or curbed to
Spokane County staadards.
7. That sidewalks are required along the arterial(s) on Sprague Avenue.
8. The woni "applicant" shall include the owner(s) of the property, his/her heirs, assigns
and successors.
9. The proposed private road(s) as shown on the preliminarY plat serving 3 lots is approved
by the County Engineer.
10. That private raad(s) be improved to Spokane County standard for an urban private road
standard serving 31ots.
11. All vested owners shall sign and record private road documents as prescribed by the
Sgokane County Engincer. These documents shall be reviewed and approved by the
Spokane Counry Engineer prior to record,ing with the Spokane County Auditor.
Recording numbers shall be referenced in the dedicatory language of the plat.
12. That the following statement be placed in the plat dedication: WA►RNING: Spokane
County has no responsibility to build, improve, maintain or other wise service the private
roads contained vvithin or pravid.ing service to the property described in this plat By
accepting this plat or subsequendy by allowing a building pennit to be issued on property
on a private road, Spokane County assumes no obligation for said private road and the
owners hereby aclanowledge that the County has no obligation of any ldnd or nature
whatsoever to establish, examine, suivey, construct, alter, repair, improve, anaintai.n,
provide drain$ge ar snow removal on a private road. This requirement is and shall run
with the land and shall be binding upon the owner, their heirs, successors or assigns
including the obligation to participate in the maintenance of the private road as provided
herein.
13. The proposed plat shall be improved tio the standands set forth in Spokane County Board
of Comnussioners Resolution No. 80-1592, as amended, which establishes reguladons
for roads, approaches, drainage and fees in new construcdoo.
14. The County Engineer has examined this development proposal and has detenmined that
the impact of this proposal upon the existing County Road System warrants the
dedication of additional Right of Way and the roadway improvemeats herein specified.
15. That the following stanement must be placed in the plat dedication: "The private road as
shown hereon is an easement which provides a means of ingress aad egress for those lots
within the plat having frontage thereon."
16. The County Arterial Road plan identifies Sprague Avenue as a 130 foot Principal Arterial.
The existing right of way width of 114 feet is not coasistent with that specified in the
Plan. In amder to implement the Arterial Road Plan it is recommended that in addition to
thc required right of way dedication, a strip of pmperty 10 feet in width along the
Sprague Avenue frontage be set aside in reserve. This property may be aoquired by
Spokane County at the tnme when Arterial Improvements ame made to the Sprague
Avenue.
17. The County Arterial Road plan identifies the South Valley Artaial as a 160 foot
Controlled Acoess Arterial. The existing right of way width of 60 feet is not consistent
with that specified in the Pla.a. Ia order to implement the Arterial Road Plan it is
recommended that in addition to the required right of way dedication, a strip of property
60 feet in width along the South Valley Arterial frootage be set aside in reserve. This
property may be acquued by Spokane County at the time when Artezial Improvements are
made to the South Valley Arterial.
18. The appliGaat should be advised that therre may exist utilities either underground or
overhead affecting the applicants property, including property to be dedicated or set aside
for future acquisition. Spokaae County will assume no financial obligation for

adjustments or relocation regarding these utilities. The applicant should check with the
applicable utilities and Spokane County Eagineer to determine whether the applicant or
udlity is responsible for adjustment or relocation costs and to make arraagements for any
necessary work.
19. The applicant shall provide documentation to the satisfaction of the County Engineer that
the local fire district will approve the proposed tum arouad as shown on the pre 'liminary
p1aG The County Engineer shall also review and approve the proposed turn around.
COUNTY HEALTH DISTRICT CONDITIONS
1. The final plat shall be designed as indicated on the preliminary plat of racord and/or any
auached sheets as noted.
2. Appropriate utility easements shall be indicated on copies of the preliminary plat of record
for distribution by the Planning Department to the utility companies, Spokan.e County
Engineer and the Spokane Caunty Health DistricL Written approval of the easements by
the utility ooinpanies must be received prior to the submittal of the final plat.
3. Sewage disposal method shall be as autharized by the I?irector of Utilities, Spokane
County.
4. Water service shall be coordinated through the Director of Utilities, Spokane County.
5. Water service shall be by an existing public water supply when approved by the Regional
Engineer (Spokane), State Department of Healtb.
6. Prior to filing the final plat, the sponsor shall demonstrate to the satisfacdon of the
Spokane County Health District that an adequate and potable water supply is available to
each tra+ct of the plat.
7. Prior to filing the fin.al plat, the sponsor shall present evidence that the plat lies within the
recorded senrice area of the wacer system proposed to serve the plat.
8. A pnblic sewer system will be marde available for the plat and individual service will be
provided to each tract prior to sale. Use of ind.ividual on-site sewage disposal systems
shall not be authorized.
9. The declicatory language on the piat shall state: "Use of private wells and water systems is
prolubited"
10. The plat dedicatian shall oontain a statement to the effect that: "The public water system,
ptrsuant to the Wata Plan appmoved by county and stm health authorities, the local fire
protection district, water purveyor and County Division of Buildings, shall be installed
within this plat, and the applicant shall provide for individual domestic water service as
well as 5re protection to each tract prior to sale of each tract and prior to issuance of a
building pemut for each tract."

Short P1 at 997-94, we herewi th submi t pl ans, speci f i cati ons, and
calculations. These plans are for the private road as required
under items 29 39 79 9 and 10 of the Engineering Department's
requirements.
Original Plan Sheets are submitted with signature & seal. Drain
calculations are attached to this letter and hereby submitted
under signature & seal. These drainage calculations include a
copy of a tapographic map, 3 handNritten sheets, and a printout
of a"bowstring" routing for the drain swale. The topogrephic
map is an extract of the plan view of the road plan with the
dr-ainage pattern delimited in red. The 3 handwritten sheets
quantif y the hydrology and hydraulics for this work.

The following "Conditions a►f Approval" for the above referenced subdivision are submitted to the Spokane
County Planning Department for inclusion in tlle "Findings and Order" should the short plat be approved.
E 1 That conditional approval of the plat by the County Engineer is given
subject to approval of the road system as indicated in the preliminary
plat of record.
E 2 That plans, profiles and cross sections as designed to County standards
showing proposed street centerline and curb grades be submitted to the
~ County Engineer for approval prior to construction and/or the filing of
a final plat; road plans to be prepared under the direction of a
licensed Professional Civil Engineer. '
E 3 That drainage plans and design calculations showing the alignrnent of
drainage facilities be submitted to the County Engineer for approval
prior to construction and/or the filing of the final plat. Drainage
plans to be prepared under the direction of a licensed Professional
Civil Engineer.

E 6 No construction work is to be performed within the existing or proposed
Public Right-of-Way until a permit has been issued by the County
Engineer. All work is subject to inspection and approval by the County
Engineer.
E12 The applicant should be advised that individual driveway access permits
are required prior to issuance of a building permit for driveway
; approaches to the County road system.

E14 A statement ahall be placed in plat dedication that no direct access be
allowed from lots to SDrauue Avenue.
E16 Existing County roads providing direct access to the plat shall be paved
and/or curbed to Spokane County standards.

E31 That the following statement be placed in the plat dedication: WARNING:
, Spokane County has no responsibility to build, improve, maintain or

' service to the property described in this plat. By accepting this plat

road and the owners hereby acknowledge that the County has no
obligation of any kind or nature whatsoever to establish, examine,
survey, construct, alter, repair, improve, maintain, provide drainage or
. snow removal on a private road. Thi9 requirement is and shall run with
; the land and shall be binding upon the owner, their heirs, successors or
assigns including the obligation to participate in the maintenance of
the private road as provided herein.
E32 The proposed plat shall be improved to the standards set forth in
Spokane County Board of Commissioners Resolution No. 80-1592, as
amended, which establishes regulations for roads, approaches, drainage
and fees in new construction.
E32 The County Engineer has examined this development proposal and has
determined that the impact of this proposal upon the existing County
" Road System warrants the roadway improvements herein specified.
E35 That the following statement must be placed in the plat dedication:
"The private road as shown hereon is an easement which provides a means
of ingress and egress for those lots within the plat having frontage
, thereon."
E61 The County Arterial Road plan identifies Soracrue Avenue as a 130 foot
Principal Arterial. The existing right of way dvidth of 110 feet is not
consistent with that specif ied in The Plan. In order to implement the
Arterial Road Plan it is recommended that a strip of property 10 feet in
width along the SArac{ue Avenue frontage be set aside in reserve. This
property may be acquired by Spokane County at the time when Arterial
Improvements are made to Snracrue Avenue.

E61 The County Arterial Road plan identifies the South Vallev Arterial as a
' 160 foot Controlled Acceas Arterial. The existing right of way width of
50 feet is not consistent with that specif ied in The Flan. In order to
implement the Arterial Road Plan it is recommended that in addition to
the required right of way dedication, a strip of property 60 feet in
width along the South Vallev Arterial frontage be set aside in reserve.
This property may be acquired by Spokane County at the time when
Arterial Improvements are made to the South Vallev Arterial.

EgQ The applicant should be advised that there may exist utilities either
' underground or overhead affecting the applicants property, including
, propertx to be dedicated or set aside for future acquisition. Spokane
County will assume no financial obligation for adjustments or relocation
regarding these utilities. The applicant should check with the
applicable utilities and Spokane County Engineer to determine whether
the applicant or utility is responsible for adjustment or relocation
costs and to make arrangements for any necessary work.
SPECIAL CONDITION:
~ The applicant shall provide documentation to the satisfaction of the
. County Engineer that the local f ire district will approve a proposed
turn around for the preliminary plat. The County Engineer shall also
review an approve the proposed turn around.
