That the individuals and parties named herein as having an interest in the above described property or project
agree to the fallawing:
1. Reimburse Spokane County far project review and inspectian fees as specified in Chapter
9.14 of rhe Spokane County Code. The fees will be ba.sed on actual salary casts incuned
by Spokane CAUnty far praject reviewS and / or inspections plus a ten percent
administrative charge, and will be billed monthly as accrued. Any billing amounts due,
including any expenses incurred in the collection of an Averdue account, must be paid
prior to the Courty's acceptance of the project far filing. If aproject is appraved and/or
filed vvith a batance still owing, the unpaid balance shall be paid within 30 days of the
invoice date.
2. The undersigned agrees that these fees are due and payable upon receipt of tbe biiling as
specifed above.
3. Any invoices not paid within 30 days of the invoice date will be cansidered delinquent.
Tf any outstanding balance on the account for this project is nvt paid within 30 days of
the invAice date, no further reviews of the praject dACUments will be cpnducted until the
entire account balance is paid. Any balance an the accAUnt fc►r this project not paid
within 65 days of the invoice date may result w legal action or the initiation of other
cAllection procedures, including referral tn a collection agency. The Sponsor will be
liable for any and all expenses incurred by the County for the coilection of averdue

THIS MATTER, an application for subdivision of laad, firom Richard Niain has been C, ,
received and dccided upon, pursuant to Spokane County Subdivision regulations, on the 1995
23;6 day of Ja.nuary, 1995.
FINDINGS OF FACT AND C4NCLUSIONS
1. The ind.ividual sigrv.ng below has further been properly delegated the responsibility for
rendering the decision by the Spokane County Director of Planning.
2. The prnposal is to dividc approxi.mately .76 acres into 2lots for 2 existing
commercial/business structures and those uses permitted in the Regional Business (B-3)
zone.
3. The proposal is located south of and adjacent to Sprague Avenue, approximately 450 feet
west of Farr Road in the NW 1J4 of Section 20, Township 25 North, Range 44 E.W.M.
Spoka.ne County, Washington.
4. The existing zoning of the property described in the application is Regi.onal Business (B-
3), previously established as Commercial (C) (file # 101-41) zoning in 1941 and
redesignated to B-3 on January 1, 1991, pursuant to the Program to unplement the
Spokane County Zoning Code. Pursuant to RCW 58.17.195 the proposal does conform
to the requirements of the existing B-3 zone.
5. The Spakane County Comprehensive Plan designates this area as Major Commercial. The
development and uses, as proposeti and conditioned are in compliance with this category.
6. Swrroundi.ng uses are primarily commercial, industrial and open space.
7. The r+equined public notice was provided for this proposal and agencies having a potential
interest in the project were notified and rec+ommendadons solicited.
.8. No written comments were received from any adjoining property owners.
9. The Spokane Gounty Arterrial Road Plan identifies Sprague Avenue as a Principal Arterial
without controlled access with a future right of way width of 130 feet. The existing right
of way width is 130 feet. Therefore, as conditioned the proposal conforms to the Road
Pla.a.
10. The site is located within the Public Transportation Benefit Area (PTA). The Spokane
Transit Authority (STA) East Sprague Route 9 provides connecting services to the site.
11. The proposed short plat wi]I be served by a public water system. Waste water disposal
will be as authorized by the Director of Utilities.
12. Recognizing the recommended conditions and Spokane County development standards,
the proposed short plat makes appropriate provisions for the public health, safety and
general welfare and that the public use and interest will be served by plattinng the
subdivision.
The subdivision proposal is generally consistent with RCW 58.17 and the County
subdivision regulauans, promocing the public health, safery and general welfare in
accordancc with standands established by the state and Spokane County. The Planning
Deparnnent has considered the provision of adequate public facilities as cited in RCW
5$.I7.110 (2). More specifically:
a. open spaces
b. drainage ways
c, public and/or private rights-of-way
d. transit
e. potable water
f. sa.nitary waste disposal
g. parks and recreation facilides
h. playgrouads
i. schools and schoolgrounds

13. IV'o buiiding pemnit will be issucd for any lot within the fuial plat until cesdfied by a
Washington state-licensed engineer that "the water system has been installed pursuant to
the approved Water Plan for the final plat" including a signed license stamp. 1'he
certificadon may be in the form of a letter, but is prefen-ed to be certified on a copy of the
Water PIan as a schematic map showing the "as-constructed" water system.
14. The Water Plan and the above four (4) conditions of approval regarding the Water PIan
may be wa.ived by the Planning Director/designee upon receipt of letters from the
appropriate water purveyar and fire pratection district stating that simpie connections to an
existing, approved water system will provide adequate domestic and fire protection water
to ensure the public health, safety and general welfare.
15. A survey is required prior to the filing of a final plat.
COUNTY DIVISION OF ENGINEERING AND ROADS CONDITIONS
1. The conditional approval af the plat is given by tha County Engineer subject to dedication
of right-of-way and approval of the road system as indicated in the preliminarY Plat of
record. 2. No construction work is to be performed within the existing or proposed public right-of-
way until a pernnit has been issued by the County Engineer. All work is subject to
inspection and approval by the County Engineer.
3. Intlividual driveway access permits are required prior to issuance of a building pennit for
driveway approaches to the counry rnad system.
4. The word "applicanc" shall include the owner or owners of the property, his heirs, assigns
and successors.
5. The pzoposed plat shall be improved to the standards set forth in Spokane Counry Board
of Commissioners Resolution No. 80-1592, as amended, which resolution establishes
regulations for roads, approaches, drainage and fees in new construction.
6. Applicant shall provide documentation to the satisfaction of the County Engineer that the
apgropriate access easements have be.en filed allowing Tract "B", as shown on the
preliminary plat, to cross Tract "A" to gain access to the rear of the tract Review and
approval of easements shall occur prior to finalization of the plat
COUNTY HEALTH DISTRICT CONDITIQN'S
1. The final plat shall be designed as indicated on the preli.nainary plat of record and/or any
attached sheets as noted.
2. Appropriate utility easements shall be ind.icated on copies of the prelimuiary plat of record
for distribution by the Planning Department to the uriliry companies, Spokane County
Engineer and the Spokanc County Health District Written approval of the easements by
the utiliry comganies must be received prior to the submittal of the fi.nal p1aG
3. Sewage disposal method shall be as authorized by the Director of Utilities, Spokane
County.
4. Water service shall be coordinated through the Director of Utilides, Spokane County.
5. Water service shall be by an existing public water suppiy when approved by the Regional
Engineer (Spokane), S tate Department af Health.
6. Prior to filing the final plat, the sponsor shall demonstrate to the satisfaction of the
Spokane County Health District that an adequate and potable water supply is available to
each tract of the plat.
7. Prior to f~Iing the final plat, the sponsor shall present evidence that the plat lies within the
recorded service area of the water system proposed to serve the plat.

8. A public sewcr system will be nzade available for the plat, and individual service will be
provided to each tract prior to sale. Use of individual on-site sewage disposal systems
shall not be authorized.
9. A statement shall be placed in the dedication to the effect that: "A public sewer system will
be made available for the plat, and individual service will be provided to each tract prior to
sale. Use of ind.ividual on-site sewage disposal systems shall not be authorized."
10. The dedicatory language on the plat shall state: "L se of private wells and water systems is
pmhibited."
11. The plat dedication shall contain a statement to the effect that: "The public water system,
pursuant to the Water Plan approved by county and state health authorities, the local fire
protecdon district, water purveyor and Caunry Division of Buildings, shal.l be installed
within this plat, and the applicant shall provide for individual domestic water seMce as
well a,s fire protection to each tract prior to saie of each tract and prior to issuance of a

COUNTY DI'VISZON OF UTILITIES CONDITI4NS
1. Any water service for this groject shall be provided in accordance with the Coordinated
Water System Plan for Spokane County, as amended.
2. A wet (live) sewer connection to the existing area wide Public Sewer System is to be
constructed. Sewer Connecdon Permit is required.
3. Applicant shall subnait exgressly to Spokane County Division of Utilities "under separate
cover", only those plan sheets showing sewer plans and specifications for: Public
Sewer/Privaie Sewer connections for review and appmval by the Counry Division of
Utilities prior to issuance of pemait to connect.
