The members of the Committee present are: Brenda Bodenstein, Chair, Jane Myers and Harry Gibbons. PROPOSAL Appeal of ad.ministrative approval of a preliminary short plat, SP-999-94, to divide approximately 35,575 square feet into two lots for single-family residences and those uses permitted in the existing Urban Residential-3.5 (UR-3.5) zone. FINDINGS OF FACT AND CONCLUSIQNS 1. The property is generally located 325 feet west of Adams Road and south of and adjacent to 24th Avenue, in the SW 1/4 of Section 26, Township 25 North, Range 44 EWM, Spokane County, Washington. 2. The Comrnittee adopts the Planning Department Report as a part of thi,s record. 3. The existing land uses in the area include an elementary school, single fannily residences and small agricultural pursuits. 4. The proposed use is compatible with existing uses in the area. 5. The property is located within the Suburban Plus (S+) category of the Comprehensive Plan, and inside the Aquifer Sensitive Area (ASA) and Priority Sewer Service Area (PSSA). The Suburban Plus Gategory is intended to provide the opporninity for development and maintenance of residential areas with large yards and open spaces that allow limited large-animal keeping, as well as opportunides for some small aeighbarhood commercial developments which serve adjacent Suburban Plus residential development Resideatial densities in the Suburban Plus categQry shall range firom one acre to five acres per dwelling unit. The proposed division, with a density of 17,788 square feet per dwelling unit, is generally not consistent with nor dces it unplement the Goals, Objectives aad Decision Guidelines af the Suburban Plus category. However, the Suburban category of the Comprehensive Plan, which was in existence in this area at the tune of the zone redesignation to Urban Residential-3.5 (UR-3.5) in 1986 (ZE-22-86), allowed for densities of 1/2 acre to 21/2 acres per dwelling unit. In 1990 the Comprehensive Plan in this area was amended to the present Suburban Plus category. Due to the 1986 zone change that occwTed in conjunction with the "Ferguson's Addition", the underlying zone of Urban Residential-3.5 (UR-3.5) prescribes the allowable densides for this area. At thc time of the Urban Residential-3.5 (UR-3.5) zone change, the Comprehensive Plan f allowed far "transition" of densities at the boundary of the existing Plan categories-- Urban north of 24th Avenue and Suburban south of 24th Avenue. Since the property has legally received the Urban Residential-3.5 (UR-3.5) zoning and the Prograrn to Implement the Zoning Code specifically aUowed for reiaining all zoning granted during the five-year sunset period between 1986 and 1991, the proposed densities are legally permitted. 6. The proposed existing zoning does implement aad conform to the Comprehensive Plan. 7. The Gounty Arterial Road plan identifies 24th Avenue as a Collector Arterial. The existing right-of-way width of 60 feet is not consistent with that specif ed in the Plan. In order to implement the Arterial Road Plan it is recanunended that in addition to the required right-of-way dedication, a strip of property 5 feet in width along the 24th Avenue frontage be set aside in re-serve. Thi,s property may be acquired by Spokane County at the time when Arterial Improvements are made to 24th Avenue. 8. The existing zoning of the property described ia the application is Urban Residential-3.5 (UR-3.5) previously established as Agricultural (A) zoning in 1942 and redesignated to Urban Residential-3.5 (UR-3.5) in 1986 pursuant to the Program to Implement the Spokane County Zoning Code. Pursuant to RGW 58.17.195 the proposal does conform to the requirements of the existing z.one. 9. The groject is exempt from environmental review under State Environmental Policy Act pursuant to WAC 197-11-800(6)(a). 10. Ttie legal raqnirements for public notice have beea fulfilled. 11. The owners of adjacent lands expressed disapproval of the proposed use and cited inoompatibility with adjacent land use densities and increased a-affic as their primary conceins. 12. The proposed ase will not be detrimental to the public health, safety, morals or welfane especially in light of the conditions r+econunended by the reviewing agencies. 13. The subdivision proposal is generally consistent with RCW 58.17 and the County subdivision regulatioas, promoting the public health, safety and general welfare in accordanQe with staadards established by the state and Spokane County. The proposal as conditioned does provide adequate public facilities as cited in RCW 58.17.110 (2). All Conditions imposed by the Hearing Examiner Committee shall be binding on the "Applicant," which term shall include the owner or owners of the property, heirs, assigns, and successors-in-interest. 2. The conditions of approval apply to the preliminary short plat of record. COUNTY PLANIVING DEPARTMENT CONDITIONS 1. All oonditions imposed by the Planning Departinent shall be binding on the "Applicant", which term shall include the owner or owners of the property, heirs, assigns and successors. 2. The proposal shall comply with the Urban Residential-3.5 (UR-3.5) zone as amended. 3. The final plat shall be designed substantially in confotmance with the preliminary plat of record. No incnease of density or number of lots shall occur without a change of condition application submittal and approval. 4. The Planning Direct,or/designee shall review any proposed final plat to ensure conapliance with these Findings and Conditions of Approval. 5. The preliminary plat is given conditional approval for three (3) years, specifically Apria 1,1998. The applicant may request an extension of time by submitting a written request approximately forty-five (45) days prior to the above expiradon date. 6. T'hree (3) current certificates of tide shall be furnished to the Planning Department prior to fil'ing the final plat, 7. The Spokane County Planning Department shall prepare and recozd with the County Audit.or a Tide Notice specifying a future Iand acquisition area for road right-of-way and utilities. The reserved future aoquisition anea Tide Notice shaU be released, ia full or in part, by the Planning Departmeat. The notice should be recorded within the same rime frame as an appeal and shall provide the following: a. At least five feet of reserved futare acquisition area far road right-of-way along the frontage of 24th Avenue. b. Future building and other setbacks required by the Spokane County Zoning Code shall be measured from the reserved future acquisition area. c. No required landscaping, parking,'208' areas, drainfield or allowed signs should be located within the future acqaisition area for road right-of-way and urilities. If any of the above impmvements are made within this area, they shall be relocated at the applicant's expense when roadway improvements ane made. d. The future acquisition area, until acquired, shall be private property and may be uscd as allowed in the zone, except that any improvements (such as landscaping, pazking, surface drainage, drainfield, signs or others) shall be considered interim uses. e. The pmperty owner shall be responsible for relocating such "interim" improdements at the time Spokane County makes roadway unprovements aftier acquiring said future area. 11. No water plan is required, and a simple tap is needed at the time of building permit release. 12. The owner shall negotiate with Central Valley School Di.strict and submit a reconded capy of a voluntary agreement making provisions for public schools prior to finalizadon and recording of the plat. The agreement shall provide a writtea description of the subject praperty to which the agreement applies and also state the dollar amount aad any other agreed to mitigating measures. The owner shall aiso notify any potential purchasers who have made an agreement to purchase property within said plat pursuaat to the Revised Code of Washington (RCVV) 58.17.205, that adequate provisions for school facilities must be made conditioned on a futune agreemeot between the plattor and schooi districL Voluntary agreements between the owner and school district shall conform to the requirements of RCW Chapter 82.02. 13. A survey is required prior to the filing of a final ptat. HEC Order for SP-999-94 Page 4 COUNTY DIVISION OF ENGINEERING AND ROADS CONDITIONS 1. That conditional apgroval of the plat by the County Engineer is given subject ta dedication of Right-of-Way and approval of the road system as indicated in the preliminary plat of record. 2. No construction work is to !e perfoimed within the exisdng or proposed Public Right-of-Way unti.l a pernut has been issued by the County Engineer. All work is subject to inspecdon and approvai by the County Engineer. 3. The applicant should be advised that iadividual driveway access pennits are required prior to issuance of a building permit for driveway approaches to the County road system. 4. The word "applicant" shall include the owner(s) of the property, his/her heirs, assigns and successors. 5. The proposed plat shall be improved to the standards set forth in Spokane County Board of Commissioners Resolution No. 80-1592, as amended, which establishes regulations for roads, approaches, drainage and fees in new construction. b. The County Arterial Road plan identifies 24th Avenue as a Collector Arterial. The existing right-of-way width of 60 feet is not consistent with that specified in the Plan. In order to implemeat the Arterial Road Plan it is recommended that in additian to the required right-of-way dedication, a strip of property 5 feet in width along the 24th Avenue frontage be set aside in reserve. This property rray be acquir+ed by Spokane County at the time when Arterial Improvements are made to 24th Avenue. 7. The applicant should be advised that there may exist utilities either underground or overhead affecdng the applicant's property, including property to be dedicated or set aside for future acquisition. Spokane County will assume no financial obligarion for adjustments or relocation regarding these utilities. The applicant shonld check with the applicable utilities and Spokane County Engineer to determine whether the applicant ar utility is responsible for adjusanent or relocation costs and to make anangements for any necessary work. 8. The 12 foot driveway easement as shown on the preliminary plat shall serve only Tract "B". If Tract "A" uses the easement, than it shall become a private road and be constructed to Spokane County Private Road Standerds within a 30 foot private road easement. Private road approval shall include the review of road and drainage plans and the execudon of necessary documents as prescribed by the County Engineer. 9. The applicant shall sobmit to the County Engineer fmm the applicable local fire district written approval for the proposed turnaround as shawn on the preliminary plat. The County Engineer shall also review aad approve the proposed turnaround. HEC Order for SP-999-94 Page 5 COUNTY HEALTH DISTRICT CONDITIONS 1. The final plat shall be designed as indicated on the preliminary plat of recond and/or any attached sheets as noted. 2. Appropriate utility easeaents shall be indicated on oopies of the preliminary plat of recard for di.stribution by the Planning Department to the utility companies, Sgokane County Engineer, and the Spokane County Health District. Written approval of the easements by the utility companies must be received prior to the submittal of the final plat. 3. Sewage disposal method shall be as authorized by the Director of Utilities, Spokane County. 4. Water service shall be coordinated through the Director of Urilities, Spokane County. 5. Water service shall be by an existing public water supply when approved by the Regional Engineer (Spokane), State Department of Health. 6. Prior to filing the final plat, the sgonsor shall demonstrate to the satisfaction of the Spokane County Health District that an adequate and potable water supply is available to each tract of the plat. 7. Priar to filing the final plat, the sponsor shall present evidence that the plat lies within the recorded service area of the water system proposed to serve the plat. 8. A public sewer system will be made available for the plat and individual service will be provided to each tract prior to sale. Use of individual on-sitie sewage disposal systems shall not be authorized. 9. A statement shall be pla,ced in the dedicadon to the effect that: "A public sewer system wiU be made available for tbe plat and individual service will be provided to each tract prior to sale. Use of individual on-site sewage disposal systems shall not be authorized." 10. The dedicatory language on the plat shall state: "Use of private wells and water systems is prohibited." 11. The plat dedication shall contain a stamment to the effect that: "The public water system, pursuant to the Water Plaa appmved by county and state health authorities, the local fire protection d.istrict, water purveyor and Couaty Division of Buildings, shall be installed within this plat, and the applicant shall provide for individuai domestic water service as well as fire protection to each lot prior to sale of each tract and prior to issuance of a building pemiit for each tract." COUNTY DIVISION OF UTILITIES CONDITIONS WATER SERVICE HEC Order for SP 999-94 Page 6 1. Any water service for this project shall be provided in aecordance with the Coord.inated Water System Plan for Spokane County, as amended. SEWER SERVIGE 1. A wet (live) sewer connection to the existing area-wide Public Sewer System is to be constructed. Sewer coonection penrut is required. 2. Applicant shall submit expressly to Spokane County Utilities Department "under separate cover", only those plan sbeets showing sewer plans and specifications for: Public sewer connecdons for review and appmval by Utilities Department prior to issuance of pemut to connect 3. Arrangements for payments of add.itional sewer charges must be made for prior to issuance of sewer connection permit. SPOKANE CQUNTY PAR.KS AND RECREATION DEPARTMENT 1. To satisfy the requirements of RCW-58-17-110 that a subdivisioa make appropriate provisions for public parks, recreation and playgrounds, the owner, at his/her option, shall either dedicate land within the subdivision or enter into a voluntary agneement with Spokane County to mitigate the direct impacts that the subdivision has on publie parks, open spaces and recreational faciliries within the unincoiporated areas of Spokane County. If the owner opts to enter into a voluntary agreement, the agreement shall be executed prior to the finalization and recordi.ag of the plat and re.corded in conjunction therewith. The agreement shall be consistent with RCW 82.02.020 and substantially the same as the standandized agreement prepared by the Spokane County Parks, Recreation and Fair Department. Prior to finalization of the plat, the owner shall advise any purchaser of property, as authorized under RCW 58.17.205, oF the obiigations within the voluntary agreement, Additionally, the owner shall submit a recorded copy of said voluntary agreement to the Spokane County Planning Department prior to finalization. COUNTY DIVISION OF BUILDINGS CONDITTONS 1. The applicant shall contact the Division of Buildings at the earliest possible stage in order to be infonned of code requirements admiaistered/enforced as authorized by the Staie Building Code Act Desigra/development concerns include: addressing, 5re apparatus access roads; fire hydrant/flow; approved water systems; building accessibilicy; construction type; occupancy classification; exiting, exterior wall pmtection; and energy code regulations. Appeal: The appeal of the Planning Departmenf s administrative approval of preliminary short plat SP-999-94 was filed on February 13, 1995 by Tim Trotter, owner of the adjacent property to the south of the proposal, representing himself and other neighbors. The completed appeal form was filed in a timely manner and the appellant's basis for appeal is cited oa the appeal form as "This is the lst lot to be used in this way. We'the neighbors' do not agree with the Planaing Deparoment." The appellant has cited those Findings and Conditions that he finds not acceptable: County Planning Department Conditioa Nucnber 3, and County Division of Engineering and Roads Coadition Number 8(see attached Exhibit A). Therefore, the Planning Department cannot respand in detail to the appeal except to reference Section G of this report wluch clarifies the procedural process utilized in review of the preliminary short, explains the criteria provided for review of subdivisions by RCW 58.17.110, and which concludes that the preliminary short plat, as cond.itioned, is consistent with RGW 58.17.110. II. SITE INFORMATION A. Site Size: Approximately 35,575 square feet Grass Density: Approximately 17,788 square feet per unit. B. Compre6ensive Plan 1. Land Use Plan: The property is located within the Suburban Plus (S+) category of the Comprehensive Plan, and inside the Aquifer Sensitive Area (ASA) and Priority Sewer Service Area (PSSA). The Suburban Plus category is intended tu provide the opportunity for development and maintenance of residential amas with large yards and opea spaces that allow limited large-animal keeping, as well as opportunities for same small neighborhood cornmercial developments which serve adjacent Suburban Plus residential development. Resideatial densities in the Suburban Plus category shall range from one acre to five acres per dwelling unit. The proposed division, with a density of 17,788 square feet per dwelling unit, is geneislly not consistent with nor does it implement the Goals, Objectives and Decision Guidelines of the Suburban Plus category. However, the Suburban category of the Comprehensive Plan, which was in existence in this area at the rime of the zone redesignation to Urtan Residential-3.5 (UR-3.5) in 1986 (ZE-22-86), allowed for densities of 1/2 acre co 21/2 acres per dwelling uait. In 1990 the Comprehensive Plan in this area was ameaded to the present Suburban Plus category. Due to the 1986 zoAe change tha►t occurned in conjuaction with the "Ferguson's Addition", the underlying zone of Urban Residenaal-3.5 (LTR-3.5) prescribes the allawable densities for this area. At the ame of the Urban Residential-3.5 (UR 3.5) tione change, the Comprehensive Plan allowed for "vansition" of densities at the boundary of the existing Plan categories Urban north of 24th Avenue and Suburban south of 24th Aveaue. Since the property has legally received the Urban Residendal-3.5 (UR-3.5) zoning and the Frogram to Implement the 7oning Code specifically allowed for retaining all zoning granted during the fivc-year sunset period between 1986 and 1991, the proposed densities are legally permitted. C. Site Characteristics: The topography of the site can be described as even terrain slaping from the curb line along 24th Avenue to the south property line. FINDINGS OF FACT AND CONCLUSIONS 1. The individual sigaing below has further been properly delegated the responsibility for rendering the decision by the Spokane County Director of Pla.cining. 2. The proposal is to replat Lot 4(approximately 35,575 square feet) of "Ferguson's Addition" into 21ots for residential use and those uses pernutted in the Urban Residential - 3.5 (UR-3.5) zone. 3. The proposal is located approximately 325 feet west of Adams Road and south of and adjacent to 24th Avenue, in the SW 1/4 of Section 26, Township 25 North, Range 44 E.W.M. Spokane Connty, Washington. 4. The exisring zoning of the praperty described in the applicatioo i.s Urban Residential - 3.5 (UR 3.5), previously established as Urban Residential - 3.5 (iJR-3.5) zoning (F'ile No. ZE-22-86) in 1986. The Program to Implement the Spokane County Zoning Code provided afive (5) year "sunset" period. Zone changes that had occurred during this 5 year period were allowed to remain in effect after the county-wide reclassification went into effect, January 1, 1991. Pursuant to RCW 58.17.195 the proposal does conform to the requirements of the existing zone. 5. The Spokane County Comprehensive Plan designates this area as Suburban Plus. In 1986, a zone change (File No. ZE-22-86) from Agricultural to Urban Residential - 3.5 (UR 3.5) was granted based upon the Comprehensive Plan designation of the then existing Suburban Category. The Suburban Categary allowed for residential densities of .5 acres to 2.5 acres. The Comprehensive Plan was later amended in this area to its' current status of Subarbaa Plus Category on May 22, 1990. Densities for this new category are 1 acre to 5 acnes per dwelling unit. However, because of the 1986 zone change that occurred in conjunction with the "Ferguson's Addition", the uuderlying zQne of UR-3.5 prescribes the allowable deosides for this area. At the time of the UR-3.5 zone change, the Comprehensive Plan also allowed for "Transition" of densities at the boundary of the existing Plan Categories (Urban nardh of 24th Avenue and Suburban south of 24th Avenue). Since the property has legally received the UR 3.5 zoning and the Program to Implement the Zoning Code spocifically a.llowed for retaining all zoning granted during the 5 year "sunset" period, between 1986 and 1991, the praposed densities are legally permitted 6. Land use in the sumounding area consist of residenrial with Sunrise Elementary School direcdy to the north of the subject site. 7. The requined public nodce was provided for this proposal and agencies having a potential interest in the projcct were notified and rerAmmendations solicited. 8. Written comments were neceived from adjoining property owners. The owners were generally against the proposal. The concerns wer+e primarily of the praposed higher densides and W. Ferguson's intent when be received approval to divide the property in 1986. RESPONSE: While the proposal would reduce the existing pancel to lots smaller than adjacent properties with Suburban Residential -1 zoning, the propasal is within the legal limits of the UR-3.5 zone and is in an ar+ea with urban services. In regard to Mr. Ferguson's 1986 intent, the record shows that the 1986 request was made to divide and rezone the property to allow for duplexes. On June 19,1986, the project received an approval to divide and rezone, but as a condidon of approval duplexes were prohibited. Further, a condition was pla,ced on the plat that prevented additional division of the land "without first filing a replat" (a short plat of the "Ferguson's Addition" wonld be a replat). No covenants, condidons, ar restrictions have been found that would prevent "Ferguson's Addition from being further divided. 9. The Spokane County A►rterial Road Plan idendfies 24th Avenue as a Collector Artierial with a future right of way width of 70 feeL The existing right of way width is 60 feeL In order to unplement the Arterial Road Piaa, the County Engineer has requested that a strip of prope,rty 5 feet in width along the 24th Avenue frontage be set aside as a Future Acquisition Area, therefore, as conditioaed, the proposal confomas to the Plan. 10. The site is located within the Public Transportation Benefit Area (PTBA). The Spokane Transit Authority (STA), Route #22 provides connecdng services to the site. 11. The proposed short plat will be served by a public water system. Waste water disposal will be as authorized by the Dir+ector of Utilities. 12. The Spokane County Parks Department has commented on the proposed short p1aG The Parks Department has requested a voluntary agreement be completed between the Parks Department and the pmperty owner t,o mitigate impacts to the Couaty Park syscem. County legal counsel has indicated such agreements may be required. The Spokane County Planning Departmeat recommends the property owner negotiate with the Spokaane County Parks Department to provide for appropriate capital facilities as required by the Revised Code of Washington (RCVV) 58.17.110. Approval of this short plat should include conditions requiring that provisians for appropriat,e facilities be in place prior to recording this final plat in the form of a written agmeement between the owner and the Spokane Counry Parks Department 13. The Cenaal Valley School District has comment,ed on the prnposed Short Plat. The I?istrict has indicated that existing school facilides are inadequate to serrve the proposed short plat and wishes to negotiate with the owner to provide adequate capital facilides as required by the Revised Code of Washington (RCW) 58.17.110. Review by County legal counsel indicates the condition requested by the School District can be requ,ired for developments. Approval of this short plat should include cond.itions requirng that pmvisions for appmpriate facilities be in pla,ce priar to reconding the final shon plat in the form of a written agreement between the owner and the school district 14. The proposed short plat has direct access to public right of way at 24th Avenue. No sidewalks are required by the County Engineer along 24th Avenue reganling this proposal. The "Ferguson's Addition" conditions af approval gzovides for a RID agreement thai requined sidewalks aad will cazry over to this short plaL 15. Recognizing the recommended conditions aad Spokane County development standards, appropnate provisioas should be made to ensure the public health, safety and general welfare and that the public use and interest will be served by platting the subdivision. The subdivision proposal is generally consistent with RCW 58.17 and the County subd.ivision regulations, promoting the public health, safety and general welfare in accordance with staadands established by the state and Spokane Couaty. The Planning Departrnent has considerned die provision of adequate public facilities as cited in RCW 58.17.110 (2). More specifically: a. open spaces b. drainage ways c. public and/or private rights-of-way d. uwsit e. potable water f. sanitary waste disposal g. parks aad recreation facilities h. playgrounds i. schools and schoolgrounds j. sidewalks 16. The project is exempt from environmental review under the State Envir+onmental Policy Act pursuant to WAC 197-11-800 (6) (a). DECISION Based upon the above noted Findings of Fact and Conclusions, Short Plat Application SP-999- 94 is hereby APPBOVED until March 1,1998, subject to condidons noted below. The proposal shaU comply with the Urban Residential - 3.5 (UR-3.5) zone as amended. 3. The fiaal plat shall be designed substantially in conformance with the preliminary plat of record. No increase of densiry or number of lots shall occur without a change of condition application submittal and appmval. 4. The Planning DirecLor/designee shaU review any proposed final plat to ensure compliaace with these Fiadings and Conditions of Approval. 5. The preliminary plat is given condiaonal approval for duve (3) years, specifically to March 1,1998. The applicant may request an extension of time by submitling a written request approxinately forty-five (45) days prior to the above expuation date. 6. The time schedule will provide for completion of the water system and inspection by the appropriate health authorities prior to application for building permits within the final plat. The arrangements or agreements will include a provision holding Spokane County and the purveyor harmless from claims by any lot purchaser refused a building permit due to the failure of the plat sponsor to satisfactorily complete the approved water system. The plat sponsor shall also sign the WATER PLAN to confirm the contractual arrangements or agreements. The final plat dedication will contain the following statement: "The public water system, pursuant the wATER PLAN approved by County and State Health authorities, the local fire district, County Building 8 Safety Department, and water purveyor, will be installed within this plat, and the subdivider/sponsor will provide for individual domestic water service as well as fire protection to each lot Prior to sale of each lot and prior to issuance of a building permit for each lot." 14.
