Short Plat l 000=94 -is -a three lot short piat located at the NW corner of Main Avenue and Marguerite Rosd in the Spokane VsIley with one improved lot witti house and garage and~

The land has a sligbt slope fo the northeasteirty-direction. The calculated flow at existing

THIS MATTER, an application for subdivision of land, from Jay Naccarato has beetiego Engineeft
eived and decided upon, pursuant to Spakane County Subdivision regulations, on the
day of March,1995.
FINDINGS OF FACT AND CONCLUSIONS
1. The individaal signing below has forther been praperly delegated the respansibility for
rendering the decision by the Spokane County Director of Planning.
2. The prvposal is to divide appnoximately 1 acre iato 31ots for 1 existing single farnily
residence aad 2 new additional residential lots and those uses permitted in the Urban
Residential-3.5 (UR-3.5) zone.
3. 1he pmposal is located northwest corner orf the intersection of Mazguerite Road and Main
Avenue, in the SE 1/4 of Section 18, Township 25 Narth, Range 44 E.W.M. Spokane
Couaty, Washington.
4. The existing tioni.ng of the property described in the application is Urban Residential-3.5,
previously established as Agricnltural Suburban (AS) (file # 43-56) zoning in 1956 and
redesignated m UR-3.5 on Januazy 1,1991, pursuant to the Program to Implem+eat the
Spokane County Zoning Code. Pursuant to RCW 58.17.195 the proposal dces conform
to the reqairements of the existing UR 3.5 zone.
5. The Spolutne Conaty Comprehensive Plan designates this area as Urban. The
development and uses, as proposed and conditioned are in compliance with this category.
6. Surrowading uses are primarily single family residences on tnixed urban size Iots and open
space.
7. The required public notice was provided for this groposal and agencies having a potenrial
inu,rest in the project were notified and recommendations sohcited.
8. No written comments were received from any ad,joining praperty owners.
9. The Spokane County Aroerial Road Plan identifies Main Avenue as a Local Access Road
with a future aght of way width of 60 feet. The existing right of way width is 40 feet In
order m iniplement the A►rterial Road Plan a stdp of property 5 feet in width along the
frontage is to be set aside as a Futuie Acquisition Area. The County Lngineer has
requested aa addidonal5 feet be dedi.cated on Main Avenue. In additian, the Spokane
County A,rterial Road Plan identifies Marguerite Road as a Local Access Road with a
futm right of way width of 60 feet. The existing right of way width is 40 feet In order
to implement the A►rterial Road Plan a strip of property 5 feet in width along the fi+Qntage is
to be set aside as a Future Acquisition Area. The County Engineer has requesoed an
additional5 feet be dedicaoed on Marguente Road. Therefore, as conditioned (such as
improvements, acquisition areas and dedications), the proposal conforcns to the Raad
Plan.
10. The site is located within the Public Transponation Benefit Area (PTBA). The Spokane
Transit Anthority (STA) East Sprague Route # 9 provides connecting services to the site.
11. The prapa►sed shart plat will be served by a public water system. Waste water dispasal
will be as anthoritied by the Director of Uttlides.
12. The Spokane County Parks Departnent has commented on the progased shart plat. The
Parks Departiment has requested a voluntary agreement be completed between the Parks
Depermaent and the pmperty owner to mitigate impacts to the County Park systeem.
County legal coansel has iadzcatod such agreetnents may be required. The Spokane
County pianning Depardment recommends the p:roperty owner negotim with the Spokane
County Parks Departrnent to pmvide for appropriate capital facilities as roquired by the
Revised Code of Vvashington (RCVV) 58.17.110. Approval of this short plat should
include conditions requiring that provisions for appropriate facilities be in place prior to
recarding this fiaal plat in the fo2an of a written agreement between the owner and the
Spokane County Parks Department

13. Recogaizing the recommendod cflndiaons and Spokane County development standards,
the proposed short plat mekes appropfim pruvmons for the public health, safety and
general welfare and that the public use and mterrest will be served by platting the
subdivision.
The snbdivision propasal is generally consistent with RCW 58.11 and the County
subdivision regulations, promating the pnblic health, safety and general welfare in
aocordance with standards established by the state and Spokane Counry. The Planning
Department has considered the pTOVisian of adequate public faciliues as cited in RCW
58.17.110 (2). More specifically:
a. open spaces
b. dminage ways
c. public and/or private rights-of-way
d. transit
e. potable water
f. sanituy waste disposal
g, pazks and recreation facilities
h, playgrounds
i, schools and schoolgronnds
j. sidewalks
14. The project is exempt finm envuonmental review under the State Environmental Policy
Act pursuant to► WAC 197-11-800 (6) (a).
15. The following facts are also relevant
a. Subdivision of pmperty should not allow the creation of noncanfonning setbacks for
existing structia*s). Compliance with setback standards ia the Urban Residendal-
3.5 (UR-3.5) zone may require either an adjusoment of the property lines or removal
of the potential nonoonfonming structure(s). T'be applicant has indicated that the
exisung accessory strucam on Tiract B labeled Garage will be removod.
b. The proposed Short Plat is a replat of Lot 10, Block 2 of Hazrington's Addition to
Hutchinson, which was recorded as final plat on December 16,1919.
DECISION
Based upon the above noted F'mdings of Fa+ct and Conclusions, Short Plat Application SP-
1000-94 is hereby APPROVED until Apri11,1998, subject to conditions noted below. This
deci~ion is final unless appealed in writing, consistent with adopted aPPeal Procedurres.
COUNTY PLANNIIWG DEPARTMENT C4NDITIONS
1. All canditians unposed by the Planning Department shall be binding an the "Applica►nt",
which tern shall include the owner or owners of the property, heirs, assigns and
successors.
2. The proposal shall comply with the Urban Residential.-3.5 (UR-3.5) zone, as amended.
3. The Snal plst shall be designed substanrially in confarmance with the pre 'luninary plat of
recaord. No incmase of density or number of lots shaU occur without a change of condition
application submittal and approval.
4. The PZanning Direct,orldesignee shall review anY P'roPosed final plat to ensure compliance
with these F'indwgs and Conditions of Approval.
5. The pre 'hminary plat is given condition.al approval for three (3) years, specifiically to April
1, 1998. The applicant may request an extension of time by submitting a written request
approxiaoately forty-five (45) days prior to the above expiration date.
6. Three (3) current certificates of tide shall be furnished to the Planning Department prior
to fili.ng the final plat.
7. Appropiiate utility easements shall be indicated on vopies of the proposed final plat.
Written appraval of utility easements by aFProP1'iate utility companies shall be received
with the subimttal of the final plat.

10. The Spokane County Planning Department shall prepare auud record with the County
Auditar a Tide Notice specifying a future land acquisitian area far road right-of-way and
utilities. The resedved future acquisition area Tide Notice shaU be released, in full or in
part, by the PIanning Department The notice should be recorded the same time as the

COUNTY DIVISION OF ENGINEERING AND ROADS CONDITIONS
1. The conditionel approval of the plat is given by the County Engiaeer subject to daiication
of ri ght-of-way and appmval of the road system as indicated in the pre hminary plat of
record.
2. Drainage plans aad design calculations showing the alignment of drainage facilities shall
be submitted to the County Engineer for approval prior to construction and/or the filing of
the ~'inal plai. Dhainage plans to be prepared under the direction of a licensed Professional
Civil Engineer.
