That the individuals and parties named herein as having an interest in the above clescribed property ar project agree
to the foliowing:
1. Reimburse Spokane County for project review and inspection fees as specified in Chapter 9.14 af
the Spokane County Code. The fees will be based on actual salary costs incurred by Spokane
Caunry for project reviews and / or inspections plus a ten percent administrative cliarge, and will
be billed monthly as accrued. Any billing amounts due, including any expenses incurred in the
coilection of aa averdue account, must be paid prior ta the Caunty's acceptance Af the project for
filing. If aproject is approved andlor filed with a balance still owing, the unpaid balance shall be
paid within 30 days of the invoice date.
2. The undersigned agrees tliat these fees are due and payable upan receipt af the billing as specified
above.
3. Any invoices not paid within 30 days of the invoice date will be considered delinquenr. if any
autstanding halance Qn the account for this project is nnt paid witliin 30 days of tlie invaice date,
no further reviews of the project documents wiii be conducted untii the entire accclunt balance is
paid. Any balance on the account for this prAject nat paid within 65 days of the invaice date may
result in legal action or the initiation of ottier coilection proceciures, including referral ta a
collectian agency. The Sponsor will be liabie for any and all expenses incurred by the County far
the collection of overdue accaunts.

THIS MATTER, i.s a change to a F'indings of Fact and Condidon of Approval, pursuant to
Spokane County Subdivision regulations, on the G~ffday of February, 1995.
FINDINGS OF FACT AND CUNCLUSIONS
1. The individual signiag below has further been propesly delegated the responsibility for
rendering the decision by the Spokane County Director of Planning.
2. The County Division of Engineering and Roads has requested that the following
finding and condition be amended to the Planning Department's Findings of Fact,
Conclusions and Decision dated Febnary 2,1995.
9. The Spokane County Arterial Road Plan identifies Wellesley Avenue as
a Minor Arterial with a future rig6t of wey widt6 of 80 feet. Tbe
existing rig6t of way widt6 is 60 feeL In order to implement the
Arterial Boad Ptan, t6e County Engineer has requested 4 feet be
dedicated on WeUesley Avenue and t6at a strip of property 6-feet in
width along the frontage be set aside as a Future Acquisition Area. In
additiou, T6e Spokane County Arterial Road Plan identifie9 McDoneld
Road ss a Collector Arterial wit6 a future right of way width of 70 feet.
The existing rig6t of wap width is 40 feeL In order to implement the
Arterial Road Plan, the County Engineer hae requested 5 feet be
dedicated on McDonald Road and that a strip of proper~y 10-Te-et in
width along the frontage be set aside as a Future Acquisition Area.
Therefore, as conditioned, (such as improvements, sidewslks,
dedications, asphalt and acquisition areas) the proposal conforms to the
Road Plan.
DECISION
Based upon the above noted F'uidings of Fact and Conclnsions, Short Plat SP-1003-94 is
hereby APPROVED until March 1,1998. 1'his decision is final unless appealed in writing,
consistent with adopted appeal procedures.
CONDITIONS OF APPR4VAL
Those previous Conditions of Approval specified in the Planning Department's Fiaidings of
Fact, Conclusions and Decision dated February 2, 1995, together with the following amended
condition:
COUNTY DIVISION OF ENGINEERING AND ROADS (AMEND)
19. The County Arterial Road Plan identifies Weilesley Aveaue as a 80 foot

THIS MATTER, an application for subdivision of Iand, from Lori Wick has been received
and decided upon, pursaant to Spokane County Subd.ivision regulations, on the,1 rday of
February, 1995.
FINDINGS OF FACT AND CONCLUSIONS
1. The individual signing below has further been properly delegated the responsibility for
rendering the decision by the Spokane County Director of Planning.
2. The proposal is to divide appnoximately 4.47 acres into 41ots for 1 existing single
family residence and 3 new residearial lots and those uses pemutted in the Urban
Resideatial-3.5 (UR-3.5) zone.
3. The proposal is locat,ed at the northwest corner of the intersecdon of McDonald Road
and Wellesley Avenue in the SW 1/4 of Sectioa 34, Township 26 North, Range 44
E.W.M. Spokane C4unty, Washington.
4. The existi..ng zoning of the property described ia the application is Urban Residential-
3.5 (UR-3.5), previously established as Agricultural (A) (file # ZN-5-61) zoning in
1961 and redesignated to UR-3.5 on January 1, 1991, pursuant to the Program to
Itnplement the Spokane County Zoning Code. Pursuant to RCW 58.17.195 the
proposal does confomn to the requirements of the existing UR-3.5 zone.
5. The Spokane County Comprehensive Plan designates this area as Urban. The
development and uses, as proposcd and c:onditioned are in compliance with this
category.
6. Surrounding uses aze primarily single fami.ly residences on mixed urban size lots and
open space.
7. The required public notice was provided for this proposal and agencies having a
potential interest in the project were notified and recommendations solicited.
8. No written comments were received from any adjoining property awners.
9. The Spokane County Arterial Road Plan identifies Wellesley Avenue as a Principai
Arcerial without c4atrolled access with a future right of way width of 100 feet The
existing right af way width is 60 feet. In order co implement the Arterial Road Plan, the
Gounty Engineer has mquested 4 feet be dedicated on Wellesley Avenue and that a strip
of property 16 feet in wndth along the frontage be set aside as a Future Acquisition
Area. In addition, The Spokane County Arterial Road Plan identifies McDonald Road
as a Collector Arterial with a future aght of way width of 70 feet. The existing right of
way width is 40 feet. In order to implement the Arterial Road Plan, the County
Engineer has requested 5 feet be dedicated on McDonald Road and that a strip of
property 10 feet in width along the frontage be set aside as a Future Acquisition Area.
Therefore, as coaditioned, (such as improvements, sidewallcs, dedications, asphalt and
acquisition areas) the proposal conforms to the Road Plan.
10. The site is located within the Public Transportation Benefit Area (PTBA). The Spokane
Transit Authority (STA) Valley/T'rentwood Route # 20 provides connecting services to
the site.
11. The proposed short plat will be served by a public water system. Waste water disposal
will be as authorized by the Director of Utilities.
12. The Spokane County Parks Department has commented on the proposed short plat
The Pazks Department has requested a voluntary agreement be completed between the
Parks Department and the property owner to mitigate impacts to the County Park
system. County legal counsel has indicated such agreements may be requu+ed. The
Spokane County Planning Degartment recommeads the pnoperty owner negotiate with
the Spokane County Parks Department to provide for apprnpnate capital facilities as
required by the Revised Code of Washington (RCVV) 58.17.110. Approval of this
short plat should include conditions requiri.ng that provisions for appropriate facilities

be in place prior to re,cording this final plat in the form of a written agreement between
the owner and the Spokane County Parks Deparmaent
13. Recognizing the recommended caaditions and Spokane County development standards,
the proposed short plat makes appropnate provisions for the public health, safety and
general welfare and that the pubhc use and interest will be served by platting the
subdivision.
The subdivision proposal is generally consisteat with RCW 58.17 and the Connty
subdivision regulations, promoring the public health, safety and general welfare in
accordance with staadazds established by the staye and Spokane County. The Planning
Departmeat has cansidered the provision of adequate public facilities as cited in RCW
58.17.110 (2). More spe+cifically:

c. public and/or private rights-of-way

14. The projact is exempt from environmental review under the State Environmental Policy
Act pursuant to WAC 197-11-800 (6) (a).
15. The following facts are also relevant
a. Chapter 14.616220 (Accessory Uses) of the Spokane County Zoning C.ade
states: One storage structure, detached, privote, is permitted inside the Urban
Impact Area (UTA) boundury, limited in area to 1,500 square feet gross, and
provided setback and maacimwn building coverage standards are met.
b. Subdivision of property should not allow the creaaon of nonconforiming
setbacks for existing strucwre(s). Complianoe with setback standards in the
Urban Residential-3.5 (UR-3.5) zone may require either an adjustment of the
property lines or removal of the potenrial nonoonforming savcame(s).The
exisang accessory structures on Lot 2 labeled BARN and SHED" exceeds
the number of private detached storage structurw allowed per lot in the LJR-3.5
zone.
DECISION
Based upon the above not,ed Findings of Fact and Conclusions, Short Plat Application SP-
1003-94 is hereby AFFROVED until March 1,1998, subject to conditions aoted below.
Most of the conditiQns of apgmval shall be accomplished by the applicant andJor sponsor prior
to finalization of the short subdivision. This decision is final ualess appealed in wnang,
consistent with adopied appeal proceciures.
COUNTY PLANNING DEPARTMENT CONDITIONS
1. All conditions imposed by the Planning Departnaeat shall be binding on the
"Applicant", which tenn shall include the owner or owners of the property, heirs,
assigns and successors.
2. The proposal shall comply with the Urban Residential-3.5 (iJR-3.5) zflnes as amenderl.
3. The final plat sha11 be designed substantiilly in conformance with the preliminary plat
of record. No increase of density or number of lots shall occur without a chaage of
condition applicatioa submittal and approval.

provide for individual domestic water service as well as fire protectioa to each lot prior

14. No building permit will be issued for any lot within the final plat until certified by a
Washington state-licensed engineer that the water system has been installed pursuant
to the approved Water Plan for the final plat" including a signed license stamp. Tbe
certification may be in the faan of a letter, but is preferned to be ceitified on a copy of
the Water Plan as a schematic map showing the "as-constructed" water system.
15. The Water Plan and the above four (4) conditions of approval regarding the Water Plan
may be waived by the Planning Director/designee upon receipt of letters from the
appropriate water purveyar and fine grotection district stating that simple connections to
an existing, approved water system will provide adequate domestic and fire protection
water to ensure the public health, safety and general welfare.

17. Prior to fiIing of the fiaal plat, the existing accessory structures on Lot "2" must comply
with the provisions of the Urban Residential-3.5 (UR-3.5) zone or be r+emoved.
COUNTY DIVISION OF ENGINEERIIYG AND ROADS CONDITIONS
1. The conditional approval of the plat is given by the County Engineer subject to
dedication of right-of-way and approval of the road system as indicated in the
preliminary plat of record.
2. Drainage plans and design calculations showing the alignm~nt of drainage facilities
shall be submitted to the County Engineer for apgroval prior to construcdon and/or the
filing of die final plat. Ihainage plans to be prepared under the direcdon of a lieensed
Professional Civil Eagineer.
3. No constrnction work is to be perfaimed witbin the existing or proposed public right-
of-way until a germit has beea issued by the County Engineer. All work is subject to
inspection aad approval by the County Engineer.
4. Individual driveway access pemuts are required prior to issuance of a building pennit
for driveway approaches to the county road system.
5. Dedication of 4 feet of additioaal right of-way along Wellesley Avenue is required.
6. Dedicaaon of 5 feet of additional right-of-way along McDanald Road is required.
7. A statement shall be plaved in plat dedication that no direct access be allowed from lots
to Wellesley Avenue.
8. Exdsting county roads providing direct access to the plat shall be paved and/or curbed to
Spokane County standards.
9. Sidewallcs are required along the arterial on Wellesley Avenue.
10. The word "applicant" shall include the owner or owners of the property, tus heirs,
assigns and successors.
11. To ooastruct the road improvements stated herein, the applicant may, with the approval
of the County Engineer, join in and be a willing participant in aay petition or resolution
which purpose is the formarion of a Road Improvement District (RID) for said
improvements, pursuant to RCW 36.88, as amended. At such time as an RID is
created or any Road Improvement Project is sanctioned by Spokane County, the
improvements required (curb, sidewalk, drainage control and paving to existing
pavement) will be at the sole expense of the uadersigned owner(s), their heirs, grantees

It is further agreed that at such time as an RID is created or any Road Improvement

their heirs, grantees and assigas without participation by Spokane County.
The RID waiver contained in this agreement shall expire after ten (10) years fi-om the
date of execution below. However, the owner(s) or successor(s) agree that if said RID
waiver expires without construction of the required improvements, the owner(s) or
successor(s) agree to construct the required imprrovements at their own expense, pay to
Spokane County the then esrimated cost of the required improvemenLs to enable the
Couaty to complete the same, or furnish a boad or other secure method suitable to the
County (which may include the execution of another RID waiver agreement) providing
for or securing to the County the actual construction of the improvements.
All of the requinements of this agreement shall rnn with the land aad shall be binding
upon the owaer(s), their successor(s) or assign(s). This provision is applicable to
Wellesley Avenue and McDonald Road."
14. The County Engineer has designated Typical Roadway Secdon Number 2 Principal
A►rterial Standard for the improvement of Welleqsley Avenue, which is adjacent to the
proposed development. This will require the addidan of approxi.mately 1418 feet of
asphalt along the frontage of the development. The construction of curbing and
sidewalk is also required.
15. The Couaty Engineer has designated Typical Roadway Secdon Number 2 Local Access
Standar+d for the improvement of McDonald Road, which is adjacent to the proposed
developmenL This will requir+e the addition of appmximately 30 feet of asphalt along
the frontage of the development The construCdon of curbing is also requircd.
16. The proposed plat shall be improved to the standards set forth in Spokane County
Board of Commissioners Resolution No. 80-1592, as amended, wluch resolution
establishes regulations for roads, approaches, drainage and fees in new construction.
17. The Couaty Engi.neer has examined this development pr+oposal and has detercnined that
the impact of this proposal upon the existing county road system wanrants the
dedicadon of addidonal right-of-way and the roadway iaapruvements herein specified.

19. The County ArterW Road Plan identifies Wellesley Avenue as a 100 foot Principal
Arterial. The existing right-of-way width of 60 feet is not consistent with that specified

right-of-way dedication, a strip of property 16 feet in width along the Wellesley Avenue

20. The County Arterial Road Plaa identifies McDonald Road as a 70 foot Collector
Arterial. The existing right-of-way width of 40 feet is not consistent with that specified
in the Plan. In order to implement the Arterial Road Plan, in addition to the required
right of-way dedication, a strip of property 10 feet in width along the McDonald Road
frontage shall be set aside in reserve. This property may be acquued by Spokane
County at the time when arterial improvements are made to McDonald Road.
21. There may exist utilities, either underground or overhead, affecting the subject
property, includi.ng property to be dedicated or set aside for future acquisition.
Spokane County assumes no financial obligation for adjusanents or relocation
regarding these ntilities. Applicaat(s) should check with the applicable utility purveyor
and the Spokane County Engineer to detennine whether applicant(s) or the utility is
responsible for adjostinent or relocation costs and to make anangements for any

Basis of Design of Storniwater System:
The intent of this design brief is to detennine the peak stormwater nmoff for a four lot subdivision
located at the intersecdon of Wellseley Avenue and McDoaald Road in Spokane County, Washington
(SW 1/4, S34, T26N, R44 EWM).
The project area slopes generally from north to south with a slope of approximately 1.0%. According
to the Soils Consenradon Service (SCS), the native soils consist of Garrisan gravelly loam (GgA) and
Garrison silt loam (GgB). See attached copies of the SCS Map and soils interpretation sheets.
Attached are two workshe,ets which determine the peak stormwater runoff for boih predeveloprnent „
aad post developrnent coaditions. In each case, the ration.al method (QaCIA) is used to deteaniae the
peak stormwater runoff based on a 10 YR design frequency. The time of concentration (te) for each
case is deternained as the outlined in the "Guidelines for Stornnwater Management", Spokane County,
WA. Using the Iateasity-Duration Curve for the Spokane area, the cornesponding intensity (I) is
deternuned for each time of concentration.
Using the sarfaces tyge.s and arreas within the drainage basin, a weighted runoff ccefficient (G) is
calculated.
'Ihe detetmi.ned peak lOYR stornnwater nmoff (Qpeak) for the overall project area (DA1) is 4.47 cfs
(predevelopment) and 4.66 cfs (postdevelopment). Por gostdevelopment coaditions, an unpervious
area of 2500 SF is applied to each residential lot. The remainder of each lot shall consist of
vegetadve cover (grass).
The treatment of stoanwater runoff is not required since the impervious area of each residential lot
will be less thaa 2,500 sf. Ato aew roadway construction is proposed with the development of this
property. However, the grading of the stoanwater mnoff from each roof area and driveways should be
graded toward grassed areas where possible to achieve some level of stormwater treaiment.

Basis of Design of Stormwater System:
The intent of this design brief is to determine the peak stonnwater runoff for a four lot subdivision
located at the intersection of Wellseley Avenue and McDonaId Road in Spokaue County, Washiagton
(SW 1/4, S34, T26N, R44 EWN).
The project area sloges genetally from north to south with a slope of approximately 1.0%. Accordiag
to the Soils Conservation Service (SCS), the native soils consist of Garrison graveUy loam (GgA) and
Gazrison silt loazn (Gg8). See attached copies of the SCS Map and soils interpretation sheets.
Attached are two worksheets which detemaiae the peak stounwater runoff for both predevelopment
and post development conditions. In each case, the rational method (Q=CIA) is used to deiermine the
peak swnnwatrer nuioff based oa a 10 YR design frequency. The time of concentration (tc) for each
case is determined as the outlined in the "Guidelines for Stornawater Management", Spokane County,
WA. Using the Intensity-Duration Curve for the Spokane area, the corresponding inteasity (1) is
deternuned for each time of concentration.
Using the surface,s types and areas within the drainage basin, a weighted runoff ccefficient (C) is
calculated.
The determined peak lOYR stormwater runoff (Qpeak) for the overall project azea (DA1) is 4.47 cfs
(prredevelopment) and 4.66 cfs (postdevelopment). For postdevelopment conditions, an impervious
area of 2500 SF is applied to each residential lot. The remainder of each lot shall consist of
vegetative cover (grass).
The fteatment of stormwater runoff is aot required since the irnpervious area of each residentiai lot
will be less than 2,500 sf. No new roadway construction is propose,d with the development of this
property. However, the grading of the stormwater cunoff from each roof area and driveways should be
graded towatd grassed at+eas where possible to aciueve some level of stormwater tre-atment,
