Dear Bill:
I have visited the site and found no e.vidence of drainage.swales or ditches that would require
drainage easements on,the Final Short Plat. There is, an irrigation ditch along Farr Road , but it has
been abandoned.
The supportin,g calculations show the post-development runoff will be increased by 0.08 cfs. This
change is insignifi - cant and should not cause drainage problems downstream of the project: No
drainage easements will be needed.

insLalling, operating and maintaining drainage swales and-drainage facilities, as conditions
of plat approval. are hereby granced to the public.
SpoIcane County and its authorized agenEs are herebv granted rhe right of ingress and
egress to, over, and from sa.id easements for the purpose of inspection and emergencv
maincenance of water qualiry treatment swales C"208 swales "a and other dra.inage
facilities, if noc properly maintained by the property owner. Spokane County does not
accept che responsibiIity to inspect or mainmin the drainage easements or drainage
swales, nor does the County accept any iiabilirv for any failure by the lot owner(s) to
properly maintain such areas.
3. The properry owners within this Plat shall be held responsible for keeping open and
0 maintaining the surface path of natural or man-made drainage flow over and across their
respecave properties.
4. The propem owners within this Plat shall mainmin all wacer qualiry treatmenc swales
("208 swales and drainage ditches situated on their respective properties, and anv
portion of a 208 swale situated in the public right-ot-way adjacent to their respective
properties, with a petmahent ground cover as specified on the current approved plans on
file at the County Engineer's Office. The property owners may install approved
shrubbery and/or trees which do noc obstruct che rlow and percolaQOn of storm drainage
water in the 208 swale a.nd drainage ditches, as indicated by the current approved plans
on file with the Counry Engineer's Office.
5. The propem owner or his representative shall inform each succeeding purchaser of all
drainage easements on the property and oi his responsibiliry for maincaining surface
drainage paths and swales within said easements.
6. Spoicane Councv does noc accept the responsibilirv of mainraining rhe drainage course on
private lots within drainage easements or floodplain areas, nor the responsibility for anv
damage whatsoever, including, but not limited to, inverse condemnation to any propercies
due to deticient construction and or maintenance of drainage courses in drainage

flow, or the drainage swale, a nocice of such failure may be oiven to the properry owner.

to cocrect the maintenance failure, or have it correcLed, at the expense of the properry
owner.
Any building that is constructed on a lot in this Plat shall be set at such an elevadon so
as to provide posirive drainage away from any drainage enrry point co the buiid,ing
(including but not limited to a window.well, a window unprocected bv a window weIl,
or a doorway). Said posiave draina.ge shall consist of a minimum slope of 3 o away from
the building for a disrance of at least 10 feet from the building. The lots shall be graded
so that either a) all runoff is routed away from the building, and conveyed over the lot
to a nanral drainage swale or approved drainage faciiinr, or b} draina.ge intercepted on
the loc is disposed ot on the lot in an approved drainage faciiirv. The approved drainage
faciliry shall be constructed in accordance with the approved plans on file at the County
Engineer's Office. Any revisions ro che approved dminage plans must be approved by
the Counry Engineer's Office prior co construction of said revisions.

THTS MATTER, an application for subdivision of land, from Barry Mazgolese has been
received and decided upon, pursuant to Spokane County Subdivisinn regulations, on the
aJl -kh day of February, 1995.
FINDINGS OF FACT AND CANCLUSIONS
1. The inclividual signing below has further been properly delegated the responsibility for
rendering the decision by the Spokane County Director of Planning.
2. The pmposal is to divide approxiinately 3 acre(s) into 41ots for single family residential
and those uses permitted in the Urban Residential - 3.5 (UR-3.5) zone.
3. The proposal is located approximately 195 feet south of the interseetion of Fourth
Avenue and Barker Road and west of and adjacent to Barker Road in the NE 1/4 of
Section 19, Township 25 North, Range 45 E.W.M. Spokane County, Wachingcon.
4. The existing zoning of the property described in the application is Urban Residential-
3.5 (UR-3.5), previously established as Agricultural zoning in 1957 (File No. 286-57)
and redesignated to UR-3.5 on January 1, 1991, pursuant to the Program to Implement
the Spokane County Zoning Code. Pursua.nt to RCW 58.17.195 the proposal does
conform to the requirements of the existing UR-3.5 zone.
5. The Spokane County Comprehensive Plan designates this area as Urban. The
development and uses, as proposed and conditioned are in compliance with this
category.
6. Surrounding uses are primariiy residentia.l, consiscent with the proposed short plat.
7. The required public notice was provided for this proposal and agencies having a
potential interest in the project were notified and recommendations solicited.
8. No written comments were received fzom any adjoining property owners.
9. The Spokane County Arterial Road Plan identifies Barker Road as a Principal Arterial
with a future right of way width of 100 feet. The existing right of way width is 60 feet.
In order to implement the Arterial Road Plan, the County Engineer has requested a 2
foat dedication and that a strip of property 18 feet in width along the Barker Road
frontage be set aside as a Fnture Acquisition Area. In addirion, the Engineer's office
ha.s requested 11-13 feet of asphalt, curbiag and sidewalks along the frontage of thz
developmenL Because Barker is a Future Principal Arterial, the number of residential
aCCesses are being limited to a.ssure improved arterial function and safery. Therefore,
as conditioned, the proposal conforms to tbe Plan.
10. The site is located within the Public Transportarion Benefit Area (PTBA). The Spokane
Transit Autbority (STA), Route # 9 provides connecdng services to the site.
11. The pmposed short plat will be served by a public water system. Waste water disposal
will be as authorized by the Director of Utilities.
12. The Spokane County Parks Department has commented on the proposed short plat,
The Parks Department has requested a voluntary agreement be completed between the
Parks Depa,rtment and the property owner to mitigate impacts to the County Park
system. County legal counsel has ind.icated such agreements may be required. The
Spokane County Planning Department recommends the property owner negotiate with
the Spokane County Parks Department to provide for appropriate capital facilities as
required by the Revised Code of Washington (RCW) 58.17.110. Approval of this
short plat should include condidons requinng that provisions for appropriate facilicies
be in place prior to recordiag this final plat in the form of a written agreement between
the owner and the Spokane Counry Parks Department
13. The Central Valley Schaol District No. 356 has conunented on the proposed Short
PIat. The District has indicated that existing school facilities are inadequate to serve the
proposed short plat and wishes to negotiate with the owner to provide adequate capital
facilities as required by the Revised Code of Washington (RCV) 58.17.110. Review
by County legal counsel indicates the condition requested by the School District can be
required for developments. Approval of this sbort plat should include conditions
requiring that provisions for appropriate facilities be in place prior to recording the final
short plat in the forrn af a written agreement between the owner and the school district.
14. The proposed short plat has direct access to public right of way at Barker Road.
Sidewalks are required by the County Engineer along the frontage of the development
regarding this proposal, and has been conditioned as part of the future formation of a
Road Improvement District (RID) project.
15. Recognizing the recommended conditions a.nd Spokane County development standards,
appropriaie provisions should be made to ensure the public health, safety and general
welfare and that the public use and interest will be served by platting the subdivision.
The subdivision pmposal is generally consistent with RCW 58.17 and the County
subdivision regularions, promoting the public health, safety and general welfare in
accordance with stand.ards established by the state and Spokaae County. The Planning
Department has considered the provision of adequate public facilities as cited in RCW
58.17.110 (2). More specifically:
a. open spaces
b. drainage ways
c. public and/or private rights-of-way
d. Uransit
e. potable water
f. sanitary waste disposal
g. parks and recreation facilities
h . playgrounds
i. schools and schoolgrounds
j . sidewalks
16. The project is exempt from environmental review under the State Environmental Policy
Act pursuant to WAC 197-11-800 (6) (a).
DECISION
Based upon the above noted Findings of Fact and Conclusions, Short Plat Application SP-
1004-94 is hereby APPROVED until March 1, 1998, subject to conditions noted below.
Most of the condi.rions of approval shall be accomplished by the applicant and/or sponsor priox
to finalization of the short subdivision. This decision is final unless appealed in writing,
consistent with adopted appeal procedures.
COUNTY PLANNING DEPARTMENT CONDITIONS
1. All conditions imposed by the Planning Department shall be binding on the
"Applicant", which term shall include the owner or owners of the property, heirs,
assigns and successors.
2. The proposal shall conlply with the Urban Residential-3.5 zone as amended.
3. The final plac shall be designed substantially in conformance with the preliminary plat
of record. No increase of density or number of lots shall occur without a change of
condition applicati.on submittal and approval.
4. The Planning Director/designee shall review any proposed final plat to ensure
compliance with these Findings and Cond.itions of Approval.
5. The preliminary plat is given conditional approval for three (3) years, speci#ically to
March 1,1998. The applicant may request an extension of ti.me by subnutting a written
request approximately forty-five (45) days prior to the above expiration d.ate.

! 6. Three (3) current certificates of title shall be furnished to the Planning Departinent
prior to filing the final plaL
7. Appropriate utility easements shall be indicated on copies of the proposed final plat.
Written approvai of utility easements by appropriate udlity companies shall be received
with the submittal of the final plat.
8. Prior to filing of final plat, the appropriate road name(s) and street address(es) shall be
indicared.
9. The final plat map shall indicate by a clear, dashed line the required yard setbacks firom
all private, "Tract X" or public roads. The dedication shall coniain the follawing
statement:
"Side yard and reaz yard setbacks shall be determined at the dme building pernuts are
requested unless these setbacks are specifically drafted on this final plat. The setbacks
indicated on this plat may be vazied from if proper zoning approvals are obtained."
lp. The Spokane County Plaruiing Department shall prepare and record with the County
Auditor a Tide Nodce specifying a future land acquisitioa area for road right-of-way
and utilities. The reservei future acquisition area Title Norice shall be released, in full
or in gart, by the Planning Department. The notice should be recorded with the final
plat and shall provide the followi.ng:
a. At least 18 feet of reserved future acquisition area for road right-of-way along
Barker Road.
b. Future building and other setbacks required by the Spokane County Zoning
Code shall be measured from che reserved future acquisition area.
c. No required landscaping, parking, '248' areas, drainfield or allowed signs
should be located vvithin the future acquisition area for road right of-way and
utilities. If any of the above improvements are made within this area, they shall
be relocated at the applicant's expense when roadway improvements are made.
d. The future acquisition area, until acquired, shall be private property and may be
used as allowed in the zone, except that any improvements (such as
landscaping, parki-ng, surface drainage, drainfield, signs or others) shall be
considered i.aterim uses.
e. The property owner shall be responsible for relocating sucb "interirn"
improvements at the time Spokane County makes roadway irnprovements after
acquiring said future acquisidon area.
11. No water plan is required, and a simple ta.p is needed at the time of building permit
release.
12. The owner shall negodate widi Cenual Valley School District and submit a recorded
copy of a voluntary agreement making provisions for public schools prior to
finalization and recording of the plat. The agreement shall provide a written description
of the subject propeny to which the agreement applies and alsa state the dollar amount
and any other agreeti to mitigating measures.
'I'he owner shall also notify any potential purchasers wbo have made an agrzement to
purchase property within said plat pursuant to the Revised Code of Washington (RCW)
58.17.205, that adequate provisions for school facilities must be made condidoned on a
future agreement between the plattor and school district.
Voluntary agreements between the owner and school district shall conform to the
requirements of RCW Chapter 82.02.
13. A survey is required prior to the filing of a final plat.
COUNTY DIVISION OF ENGINEERING AND ROADS CQNDITIQNS
1. That conditional approval of the plat by tbe County Engineer is given subject to
dedication of Right-of-Way and approval of the road system as indicated in the
preliminary plat of record.

0.2 That drainage plans and design calculations showing the alignment of drainage facilities
be submitted to the County Engineer for approval prior to construction andlor the filing of
the final plat Drainage plans to be prepared under the direction of a licensed
Professional Civil Engineer.
3. No construcaon work is to be performed within the existing or proposed Public Right-of-
Way until a permit has been issued by the Counry Engineer. All work is subject to
inspection and approval by the County Engineer.
4. The applicant should be advised chat ind.ividual driveway access permits are required
prior to issuance of a building permit for driveway approaches to the County road
system.
5. Dedication of 2 feet of additional Right-of-Way along Barker.
6. Existing County roads providing direct access to the plat shall be paved and/or curbed to
Spokane Counry standards.
7. That all public roads within the plat be designed and constructed to Spokane County
standards.
8. That sidewalks are required along the arterial(s) on Barker Road.
9. The word "applicant" shall include the owner(s) of the property, his/her heirs, assigns
and successors.
10. To construct the road imp.rovements stated herein, the applicant may, with the approval of
the County Engineer, join in and be a willing participant in any petition or resolution
which purposes is the formation of a Road Improvement District (RID) for said
improvements pursuant to RCW 36.88, as amended. At such time as an RID is created
or any Road Improvement Project is sanctioned by Spokane County, the impmvements
required (curb, sidewalk, drainage control and paving to exi.sting pavement) will be at the
sole expense of the undersigned owner, their heirs, grantees and assigns. This provision
is applicable to Barker Road
11. As an alternative mechod of constructing the road improvement stated herein, the
applicant may, with the approval of the County Engiaeer, accomplish the road
improvements stated herein by joining and participating in a County Road Project (CRP)
to the exteot of the required road improvement. At such time as an RID is created or ajiy
Road Improvemeat Project is sanctioned by Spokane County, the improvements required
(curb, sidewalk, drainage control and paving to existing pavenient) will be at the sole
expense of the undersigned owner, their heirs, grantees and assigns. This provision is
applicable to Bazker Road.
12. That the following statement shall appear within the dedicatory language of the final plat:
The owner(s) or successor(s) in interest agree to authorize Spokane County to place their
name(s) on a getition for the formation of a Road Improvement Disaict (RID) by the
peutioa method pursuant to Chapter 36.88 RCW, which petition includes the owner(s)
property, and further not to object, by the signing of a ballot, the formation of a RID by
the resolution method pursuant to Chapter 36.88 RCW, which resolution includes the
owner(s) property. If a RID is formed by either the petition or resolution method, as
providetl for in Chapter 36.88 RCW, the owner(s) or successor(s) further agree: (1) that
the unprovements or construction contemplated within the proposed RID is feasible, (2)
That the benefits to be derived from the formation of the RID by the property included
therein, together with the amount of any County participation, exceeds the cost and
expense of formation of the RID, and (3) that the property within the proposed RID is
suff'iciently developed. Provided, further, the owner(s) or successor(s) shall retain the
right, as authorized under RCW 36.88.090, to object to any assessment(s) on the
pmperty as a result of the improvements caUed for in conjunction with the formation of a
RID by either peridon or resolution method under Chapter 36.88 RCW, and to appeal to
the Superior Coort the decision of the Board of County Camm.issioners affirming the
final assessment roll. It is further agreed that at such time as an RID is created or any
Road Improvement project is sancaoned by Spokane County, the improvements required
(curb, sidewalk, drainage control and paving) will be at the sole expense of the
undersigned owner, their heirs, grantees and assigns witllout participation by Spokane
County.

i T'he RID waiver contained in this agreement shall expire after ten (10) years from the
date of execution below. However, the owner(s) or succeSSOr(s) agree that if said RID
waiver expires without construction of the required improvements, the owner(S) or
successor(s) agree to consrruct the required improvements at their own expense; pay to
Spokane County the then estimated cost of the required irnprovements to enable the
County to complete the same; or fumish a bond or other secure method suitable to the
County (which may inelude the execution of another RID waiver agreement), provid.ing
for or securing to the County the actual construction af the improvements.
All of the requirements of this agreement shall run with the land and shall be binding
upon the owner(s), their successor(s) or assign(s). This provision is applicable tor.X'
13. The County Engineer has designated Typical Roadway Section Number 2 Minor Arterial
Standard for the improvement of Barker Road which is adjacent to the proposed
development. This will require the addition of approximately 11-13 feet of asphalt along
the frnntage of the develapment. The construcdon of curbing and sidewalk is also
required.
14. The proposed plat shall be improved to the standards set forth in Spokane County Boaxd
of Commissioners Resolution No. 80-1592, as amended, which establishes regulations
for roads, approaches, drainage and fees in new construction.
15. The County Engineer has examined this development proposai and has determined that
the impact of this proposal upon the exisring Counry Road System warrants the
dedicadon of additional Right of Way and the roadway improvements herein specified.
16. The County Arterial Road plan identifies Barker Road as a 100 foot Principal Arterial.
The existing right of way width of 60 feet is not consistent with that specified in The
Plan. In order to implement the Arterial Road Plan it is recommended that in addition ta
the 2 feet of requixed right of way dedication, a strip of property 18 feet in width along
the Barker Road frontage be set aside in reserve. This property may be acquired by
Spokane County at the ume when Arterial Improvements are made to Barker Road.
17. The applicant should be advised that there may exast utilities either underground or
overhead affecting the applicants property, including property to be dedicated or set aside
for fuiure acquisition. Spokane County will assume no financial obligation for
adjustments or reiocatian regarding these utilides. The applicant should check with the
applicable utilities and Spokane Counry Engi.neer to detennine whether the applicant or
utility is responsible for adjustment or relocation costs and to make arrangements for any
necessary work.
18. Barker road is a Minor Arterial. To minimize the amou nt of direct access onto Barker ~e
Road the applicant shall locate joint driveway approaches between Lots "A" and "B" and ~ `
Lots "C" and'D" respe+ctively. The dimensions of the easement shall be designed bY he
applicant and subnutted for revlew and approval of the county enguieer prior to finalization
of the plat.
19. at prior to finaiizarian of the plat the appiicant shall demonstrate to the satisfaction of the
county engi.neer, the location of the 20 by ZO Irrigation Turnout Easement shall not
prohibit or interfere with the current dedication requirement listed above or any future
widening of Barker Road.. Additionaily, the applicant shall further demonstrate that the
location of the easement will not prohibit or interfere with the location of the joint
driveway access easement as stated above.
COUNTY HEALTH DISTRICT CONDITIONS
1. The final plat shall be designed as ind.icated on the preliminary plat of record and/or any
attached sheets as noted.
2. Appropriate utility easements shall be inclicaced on copies of the preliminary plat of
record for distribution by the Planning Department to the utility companies, Spokane
County Engineer and the Spokane County Health District. Written approval of the
easements by the utility companies must be reGeived prior to the submittal of the fina.l
plat.
3. Sewage disposal method shall be as authorized by che Director of Utiliues, Spokane
County.

4. Water service shall be coordinated through the Director of Urilities, Spokane Counry.
5. Water service shall be by aa existing public water supply when approved by the
Regional Engineer (Spokane), State Department of Health.
6. Prior to filing the final plat, the sponsor shall demonstrate to the satisfacdon of the
Spokane County Health District that an adequate and potable water supply is available
to each tract of the plat.
7. Prior to filing the final plat, the sponsor shall present evidence that the plat lies within
the recorded service area of the water system proposed to serve the plat
8. Prior to filing the final plat, the sponsor shall demonstrate to the sadsfaction of the
Spokane County Health District that suitable sites for on-site sewage disposal systems
are available on all tracts.
9. Subject to specific application approval and issuance of permits by the Health Off cer,
the use of individual on-site sewage disposal systems may be authorized.
1'0. The dedicatory language of the plat will state: "Subject to specific applicadon approval
and issuance of pernuts by the Health Officer, the use of individual on-site sewage
systems may be authorized." The use of alternative methods of disposal may be
required.
11. The dcdicatory language of the plat wil.l state: "The sponsor will assume responsibility
for the provision of domestic-use water."
12. The dedicatory language on the plat shall state: "Use of private wells and water
systems is prohibited."
13. The plat dedicatian shall contain a statement to the effect that: "The public water
system, pursuant ta the Water Plan approved by counry and state health authorities, the
local fire protection district, water purveyor and County Division of Buildings, shall be

Water System Plan for Spokane County, as amended.
SEWER SERVIGE
1. Pursuant to the Board of County Comm,issioners Resolution No. 80-0418, the use of
on-site sewer d.isposal systems is hereby authorized. This authorization is conditioned
in compliance with all rules and xegulations of the Spokane County Health District and
is fuuther conditioned and subject to specific application approval and issuance of
pernuts by the Health District.
2. The owner(s) or successor(s) in interest agree to authorize the County to place thcir
name(s) on a petition for the formation oF ULID by petiuon method pursuant to RCW
36.94, which petition includes the owner(s)' property; and further not to object by the
signing of a protest peti.tion against the formation of a ULID by resolution method
pursuant to RCW Chapter 36.94 which includes the owner(s)' property. PRO`rIDED,
this condition shall not prohibit the owner(s) or successor(s) from objecdng to any

PARBS DEPARTMENT CONDITIONS
1. To satisfy the roquirements of RCW-58-17-110 that a subdivision make appropriate
provisions for pnblic parks, recreation and playgrouncls, the owner, at his/her oprion,
shall either dedicate land within the subdivision or enter into a voluntary agreement with

The following "Conditions of Approval" for the above referenced subdivision are submitted to the Spokane
County Planning Department for inclusion in the "Findings and Order" should the short plat be approved.
E 1 That conditional approval of the plat by the County Engineer is given
subject to dedication of Right-of -Way and approval of the road system as
indicated in the preliminary plat of record.
E 3 That drainage plans and design calculations showing the alignment of
drainage facilities be submitted to the County Engineer for approval
prior to construction and/or the filing of the final plat. Drainage
plans to be prepared under the direction of a licensed Professional
Civil Engineer.
E 6 No construction work is to be performed within the existing or proposed
Public Right-of-Way until a permit has been issued by the County
Engineer. All work is subject to inspection and approval by the Cownty
Engineer.
E12 The applicant should be advised that individual driveway access permits
are required prior to issuance of a building permit for driveway
approaches to the County road syatem.
E13 Dedication of 2 feet of additional Right-of-Way along Barker Road.
E16 Existing County roads providing direct access to the plat shall be paved
and/or curbed to Spokane County standards.
E18 That sidewalks are required along the arterial on Barker Road.
E19 The word "applicant" shall include the owner (s) of the property, his/her
heirs, assigns and successors.
E20 To construct the road improvements stated herein, the applicant may,
with the approval of the County Engineer, join in and be a willing
participant in any petition or resolution which purposes is the
formation of a Road Improvement District (RID) for said improvements
pursuant to RCW 36.88, as amended. At such time as an RID is created or
any Road Improvement Project is sanctioned by Spokane County, the
improvements required (curb, sidewalk, drainage control and paving to
existing pavement) will be at the sole expense of the undersigned awner,
their heirs, grantees and asaigns. This provision is applicable to
Barker Road.
E21 As an alternative method of constructing the road improvement stated
herein, the applicant may, with the approval of the County Engineer,
accomplish the road improvements stated herein by joining and
participating in a County Road Project (CRP) to the extent of the
required road improvement. At such time as an RID is created or any
Road Improvement Project is sanctioned by Spokane County, the
improvements required (curb, sidewalk, drainage control and paving to
existing pavement) will be at the sole expense of the undersigned owner,
their heirs, grantees and assigns. This provision is applicable to
Barker Road.
E22 That the following statement shall appear within the dedicatory language
of the f inal plat :

The owner(s) or successor(s) in interest agree to authorize Spokane
County to place their name(s) on a petition for the formation of a
Road Improvement District (RID) by the petition method pursuant to
Chapter 36.88 RCW, which petition includes the owner(s) property, and
further not to object, by the signing of a ballot, the formation of
a RID by the resolution method pursuant to Chapter 36.88 RCW, which
resolution includes the owner(s) property. If a RID is formed by
either the petition or resolution method, as provided for in Chapter
36.88 RCW, the owner ( a) or successor ( s) further agree :(1 ) that the
improvements or construction contemplated within the proposed RID is
feasible, (2) That the benefits to be derived from the formation of
the RID by the property included therein, together with the amount
of any County participation, exceeds the cost and expense of formation
of the RID, and (3) that the property within the proposed RID is
sufficiently developed. Provided, further, the owner(s) or
successor(s) shall retain the right, as authorized under RCW
36.88.090, to obj ect to any assessment ( s) on the property as a result
of the improvements called for in conjunction with the formation of
a RID by either petition or resolution method under Chapter 36.88 RCW,
and to appeal to the Superior Court the decision of the Board of
County Commissioners aff irming the final assessment roll. It is
further agreed that at such time as an RID is created or any Road
Improvement proj ect is sanctioned by Spokane County, the improvements
required (curb, sidewalk, drainage control and paving) will be at the
sole expense of the undersigned owner, their heirs, grantees and
assigns without participation by Spokane County.
The RID waiver contained in this agreement shall expire after ten
(10) years from the date of execution below. However, the owner(s)
or successor(s) agree that if said RID waiver expires without
construction of the required improvements, the owner(s) or
successor (s) agree to construct the required improvements at their own
expense; pay to Spokane County the then estimated cost of the required
improvements to enable the County to complete the same; or furnish a
bond or other secure method suitable to the County (which may include
the execution of another RID waiver agreement), providing for or
securing to the County the actual construction of the improvements.
All of the requirements of thia agreement shall run with the land and
shall be binding upon the owner(s), their successor(s) or assign(s).
This provision is applicable to Barker Road.
E24 The County Engineer has designated Typical Roadway Section Number 2
Minor Arterial Standard for the improvement af Barker Road which is
adj acent to the proposed development. This will require the addition of
approximately 11-13 feet of asphalt along the frontage of the
development. The construction of curbing nd sidewalk is also required.
E32 The propased plat shall be improved to the standards set forth in
Spokane County Board of Commissioners Resolution No. 80-1592, as
amended, which establishes regulations for roads, approaches, drainage
and fees in new construction.
E33 The County Engineer has examined this development proposal and has
determined that the impact of this proposal upon the existing County
Road System warrants the dedication of additional Right of Way and the
roadway improvementa herein specified.
E61 The County Arterial Road plan identif ies Barker Road as a 100 foot
Principal Arterial. The existing right of way width of 60 feet is not
consistent with that specified in The Plan. In order to irnplement the
Arterial Road Plan it is recommended that in addition to the required
right af way dedication, a strip of property 18 feet in width along the
Barker Road frontage be set aside in reserve. This property may be
acquired by Spokane County at the time when Arterial Improvements are
made to Barker Road.
E90 The applicant should be advised that there may exist utilities either
underground or overhead affecting the applicants property, including

property to be dedicated or set aside for future acquisition. Spokane
County will assume no financial obligation for adjustments or relocation
regarding these utilities. The applicant should check with the
applicable utilities and Spokane County Engineer to determine whether
the applicant or utility is responsible for adjustment or relocation
costs and to make arrangements for any necessary work.
SPECIAL CONDITION:
Barker Road is a Minor Arterial. To minimize the amount of direct
access onto Barker Road the applicant shall locate joint driveway
approaches between Lots "A" &"B" and Lots "C" and "D" respectively.
The dimensions of the easement shall be designed by the applicant and
submitted for review and approval of the County Engineer prior to
finalization of the plat.
SPECIAL CONDITION:
That prior to finalization of the plat the applicant shall demonstrate
to the satisfaction of the Caunty Engineer, the location of the 20 by 20
Irrigation Turnout Easement shall not prohibit or interfere with the
current dedication requirement listed above or any future widening of
Barker Road. Additionally, the applicant shall further demonstrate that
the location of the easement will not prohibit or interfere with the
location of the joint driveway access easement as stated above.
