1. Reimburse Spokane Caunty fnr praject review and inspection fees as specified in Chapter
9.14 nf the Spokane County Code. The fees will be based on actual salary casts incurred
by Spokane County for pro,ject reviews and ! ur inspections plus a ten percent
administrative Charge, and wiil be billed monthly as accruecl. Any billing amaunts due,
includiiig any expenses incurred in the cUllection of an overdue account, must be paid
priar to the County's acceptance af tlie project for filing. If a project is approved and/or
filed with a balance still owiiig, the unpaid balance sha{1 be paid witliiri 30 days of the
invoice date.

THIS MATTER, an application for subdivisioa of land, from Donna and Jon Lees'~a has
en jeceived and decided upon, pursuant to Spokane County Subdivisioa regulations, on the
day of April, 1995.
FINDINGS OF FACT AND CONCLUSIONS
1. The individuai signiag below has further been properly delegated the responsibility for
rendering the decision by the Spokane County Director of Ptanning.
2. The proposal is to divide apptvximately 1.02 acres into 31ots for residentiai and those
' uses pernnitted in the Urban Residendal - 3.5 (UR-3.5) zone.
3. The proposal is lvcated approximately 150 feet north of the intersecrion of 4th Avenue
and Steen Road and east of aad adjacent to Steen Road in the NE 1/4 of Section 24,
Township 25 North, Range 44 E.W.M. Spokane Countys W$Sh1I1gtOD.
4. The existing tioning of the property described in the application is Urban
Residential -3.5, previously established as Agriculturai zoning in 1942 (File No.
60-42) and redssignated to Urban Residential on January 1, 1991, pursuant to the
Program to Implement the Spokane County Zoning Code. Pursuaat to RCW
58.17.195 the proposal does conform to the requinements of the existing underlying
zone.
5. The Spokane County Comprehensive Plan designates this area as Urban. The
development aad uses, as proposed and conditioned are in compliance with this
category.
6. Swrrounding uses are primarily si.ngle family residential on lots of similar size of that of
the proposal.
7. The required public notice was provided for this proposal and agencies having a
potential interest in the projecr were notified and recommendadans solicited.
8. No written comments were received from any adjoining pr+operty owners.
9. The Spokane County Armrial Road Plan identifies Steen Road as a Local Access with a
future right of way width of 60 feeL The existing right of way width is 50 feet. In
order to implement the Arterial Road Plan a dedication of five feet of add.itional Right-
of-Way along Steen Road is required. In adrdition, the County Engineers will require
30 feet of aspbalt, curbing, sidewalks and drainage control along the frontage of the
development. Therefore, as conditioned, the proposal conforms to the Plan.
10. The site is located outside the Public Transportation Beaefit Area (PTBA).
11. The proposed short plat will be served by a public water system. Waste water disposal
will be as authorized by the D.irector of Utilities.
12. The Spokane County Parks Department has commented on the proposed short plai.
The Parks Department has requested a voluntary agreement be completed between the
Parks Department and the propeny owner to mitigate unpacts to the County Park
system. County legal counsel has indicated such agreements may be required. The
Spokane County Planning Deparnnent recommends the property owner aegotiate with
the Spokane County Parks Department to provide for appropriate capital facilities as
required by the Revised Code of Washington (RG"W) 58.17.110. Approval of this
short plat should include cond.itions requiring that provisions for appropriate facilities
be in place prior to recording this final plat in the fotm of a written agreernent between
the owner and the Spokane County Parks Department
13. The Central Valley School District No. 356 has commented an the proposed Short
Plai, The District has indicated that existing school facilides are iaadequate to serve the
proposed short plat and wishes to negodate with the owner to provide adequate capital
facilities as reqtured by the Revised Code of Washington (RCV) 58.17.110. Review
by County legal counsel indicates the condition requested by the School Diserict can be
required for developments. Approval of this short plat should include condiaons

requiring that provisions for appropriate facilities be in place prior to recording the final
~ short plat in the form of a written agreeaaent between the owner and the school district.
14. The pr+oposed short plat has direct access to public right of way at Steen Road.
Sidewalks are required by the Couaty Engineer along Steen Road regarding this
proposal, and have heen conditioned as part of the future formacioa of a Road
Impr+avement District (RID) project.
15. Recognizing che recommended cond.itions and Spokane County develapment standards,
appropriate provisions should be made to ensure the public health, safety and general
welfare and that the public use and interest will be served by platting the subdivision.
The subdivision proposal is generally consiscent with RCW 58.17 and the County
subd.ivisioa reguIations, promoting the public health, safety and general welfare in
accordance with stanclards established by the state and Sgokane County. The Planning
Depaztment has considered the provision of adequate public facilities as cited in RCW
58.17.110 (2). More specifically:
a. open spaces
b. drainage ways
c. public andlor private rights-of-way
d. tiansit
e. potable water
f. sanitary waste disposal
g. parks and recreation facilities
h. playgrounds
i. schools and schoolgrounds
j . sidewalks
16. The project is exempt from environmental review uader the State Environmental Policy
Act pursuant to WAC 197-11-800 (6) (a).
DECISION
Based upon the above noted Findings of Fact and Conclusions, Short Plat Application
SP-1011-95 is hereby APPROVED until May 1, 1998, subject to conditions noted below.
Most of the condidons of approval shall be accomplishei by the applicant and/or sponsor prior
to finaliza►tion of the short subdivision. This decision is final unless appealed in writing,
consistent with adopted appeal procedtn,es.
COUNTY PLANNING DEPA.RTMENT CONDITIONS
1. All conditians imposed by the Planning Depardment shail be binding on the ~
"Applicant", which term shall include the awner or owners of the pmperty, heirs,
assigns and successors.
2. The proposal shall comply with the Urban Residential - 3.5 (UR-3.5) zone as
amended.
3. The final plat shall be designed substantially in conformance with the preliarinary plat
of record. No increase of density or number of lots shall occur without a change of
condition application submittal and approval.
4. T'he Planning Directar/designee shall review any proposed final plat to ensure
compliance with these Findings and Coadirions of Approval.
5. The preliminary plat is given conditional approval for three (3) years, specifically to
May 1, 1998. The applicant may request an extension of time by subnutting a written
request approximately forty-five (45) days prior to the above expiration date.
6. Three (3) airrent certificates of title shall be furnished to the Planning Department
prior to filing the final plaL
7. Apprapriate utility easements shall be indicated on copies of the proposed final plat.
Written approval of utiliry easements by appropriate utility companies shall be received
with the submittal of the final plaL

8. Prior to filing of final plat, the appropriate road aame(s) and smeet address(es) shall be
indicated.
9. The final plat map shall indicate by a clear, dashed line the required yard setbacks from
all private, "Tract X" or public roads. The dedic;ation shall contain the following
statement
"Side yard and rear yard setbacks shall be determined at the time building pennits are
requested unless these setbacks are specifically drafoed on this final plat. The setbacks
indicated on this plat may be varied firom if proper zoning appmvals are obtained."
10. No water plan is required, and a simple tapr is needed at the time of building perinit
release.
11. The owner shall negotiate with Central ValleySchool District and submit a recorded
copy of a voluntary agreement malcing provisions for public schools prior to
finalizadon and recardtng of the plat The agreement shall provicie a wnttea description
of the subject property to which the agr+eement applies and also state the dollar amount
and any other agreed to mitigating measures.
The owner shall also notify any potential purchasers who have made an agreement to
purchase property within said plat pursuant to the Revised Code of Washington (RCVV)
58.17.205, that adequate provisions for school facilities must be made condiaoned on a
future agreement between the plattor and school d.istdct.
Voluntary agreements between the owner and school district shall confotm to the
requirements of RCW Chapter 82.02.
12. A survey is required prior to the filing of a final plaL
COUNTY DIVISION OF ENGINEERING AND ROADS CONDITIONS
1. That conditional approval of the plat by the County Engineer is given subject to
dedication of Right-of-Way and apgroval of the road system as iadicated in the
preliminary plat of record.
2. No construction work is to be performed within the existing or proposed Public Right-
of-Way uatil a peimit has been issued by the County Engineer. All work is subject to
inspection and approval by the County Engineer.
3. The applic,ant should be advised that individual driveway access peanits are required
prior to issuance of a building permit for driveway approaches to the County road
system.
4. Dedication of 5 feei of additional Right-of-Way along Steen Road.
5. Eacistiag County roads providing direct access to the plat shall be paved andlor curbed
to Spokane County standards.
6. The word "applicant" shall include the owner(s) of the property, his/her heus, assigns
and successors.
7. To construct the road improvements stated herein, the applicant may, with the
approval of the County Engineer, join in and be a willing parcicipant in any pedtion or
resolution which purposes is the formation of a Road Improvement District (RID) for
said unprovements pursuant to RCW 36.88, as amended. At such time as an RID is
created or any Road Improvement Project is saactioned by Spokane County, the
improvements required (curb, sidewalk, drainage conmol and pavi.ag to existing
pavement) will be at the sole expense of the undersigaed owner, their heirs, grantees
and assigns. This provision is applicable to Steen Road..
8. As an alcernative method of constructing the road improvement stated herein, the
applicant may, with the approval of the County Engineer, accomplish the road
improvements stated herein by jaining and participating in a County Road Project
(CRP) to the extent of the required road improvement. At such dme as an RID is
creaLed or any Road Improvement Project is sanctioned by Spokane County, the
unprovements reqtirireti (cwb, sidewalk, drainage control and paving to existing

pavement) will be at the sole expense of the undersigned owner, their heirs, grantees
and assigas. This provision is applicable to Steen Road
9. T'hat the following statement shall appear within the dedicatory language of the final

The owner(s) or successor(s) in interest agree to authorize Spokane County to place
their name(s) on a perition for the fvrmation of a Road Improvement District (RID) by
the petition method pursuant to Chapter 36.88 RCW, which petition includes tbe
owner(s) property, and fiuther not to object, by the signing of a ballot, the fomnation
of a RID by the resolution method pursuant to Chapter 36.88 RCW, which resoludon
inciudes the owner(s) property. If a RID is formed by either the pedtion or resolution
method, as provided for in Chapter 36.88 RCW, the owner(s) or successor(s) further
agree: (1) that the unprovements or construction contemplated within the praposed
RID is feasible, (2) That the benefits to be derived from the formation of the RID by
the property included therein, together with the amount of any County participation,
exceeds the cost and expense of formation of the RID, and (3) that the property within
t6e proposed RID is sufficiendy developed. Provided, further, the owner(s) or
successor(s) shall retain the right, as authorized under RCW 36.88.090, to object to
any assessment(s) on the property as a result of the improvements called for in
conjunction with the formation of a RID by either petitioa or msolution method under
Chapter 36.88 RCW, and to appeal to the Superior Court the decision of the Board of
County Commissioners affirming the final assessment roll. It is further agreed that at
such tYme as an RID is created or any Road Impravement project is sanctioned by
Spokane County, the improvements required (curb, sidewalk, drainage control and
paving) will be at the sole expense of the undeTSigned owner, their heirs, grantees and
assigns without participation by Spokane County.
The RID waiver contained in this agreement shall expire after ten (10) years from the
date of executioa below. However, the owner(s) or successor(s) agree that if said
RID waiver expires without constructioa of the required ianprovements, the owner(s)
or successor(s) agree to construct the required improvements at their own expense;
pay to Spokane County the then estimated cost of the required improvements to eaable
the Couaty to complete the same; or fiunish a bond or other secure method suitable to
the County (which may include the execution of another RID waiver agreement),
providing for or securing to the County the actoal construcdon of the improvements.
All of the requirements of this agreement shall run with the land and shall be binding
upon the owner(s), their successor(s) or ass~ign(s). This provision is applicable to
Steen Road.
10. The County Engineer has designated Typical Roadway Section Number 2 Local
Access Standard for the improvement of Steea Road which is adjacent to the proposed
developmenL This will r+e~quire the addition of approximately 30 feet of asphalt along
the frontage of the developmenL The construction of curbing is also required.
11. The proposed plat shall be improved to the standards set forth in Spokane County
Board of Commissioners Resolutian No. 80-1592, as amended, which establishes
reguladons for roads, approaches, drainagc and fees in new construcdon.
12. The County Engineer has ex.amined this development praposal and has determined that
the impact of this proposal upon the existing County Road System wa,rrants the
dedicatioa of additional Right of Way and the roadway improvements herein specified.
13. The applicant should be advised that there ma►y exist utilities either underground or
overhead affecring the applicants property, including property to be dedicated or set
aside for future acquisition. Spokaine County will assume no fiaancial obligation for
adjusanents or relocation regarding these utilities. The applicant should check with the
applicable utilities and Spokane CouAty Engineer to detennine whether the applicant or
utility is responsible for adjuscment or relocation costs and to make arrangements for
any necessary work.
COUNTY HEALTH DISTRICT CONDTTIONS
1. The final plat shall be designed as indicated on the preliminary plat of record and/or any
attached sheets as noted.

Z. Appropriate urility easements shall be indicated on copies of the prelimimary plat of
recor+d for distribution by the Planning Deparoment to the utility companies, Spokane
Counry Engineer and the Spakane County Health District. Written approval of the
easements by the utility companies must be received prior to the submittal of the fiaal
plaL
3. Sewage disposal method shall be as authorized by the I?irector of Utilities, Spokane
County.
4. Water sesvice shall be coordinated through the Director of Utilides, Spokane Counry.
5. Water service shall be by an existing public water supply when apgroved by the
Regional Engineer (Spokane), State Department of Health.
6. Prior to fiiing the final plat, the sgonsor shall present evidence that the plat lies within
the recorded service area of the water system pmposed to serve the p1aG
7. A public sewer system will be made available for the plat and individual service will be
provided to each oract prior to sale. Use of individual on-site sewage disposal systems
shall not be authorized.
8. A statement sha11 be placed in the dedicarion to the effect that: "A public sewer system
arill be made available for the piat, and individual service will be provided to each tract
prior to sale. Use of individual on-site sewage disposal systems shall not be
authorized."
9. The dedicatory language on the plat shall state: "Use of private wells and water
systems is prohiblced."
10. The plat dedicadon shail contai.n a statement to the effect that: "The public water
system, pursuant to the Wacer Plan approved by county and state health suthariries, the
local fire protecdon district, water purveyor and County Division of Buildings, shall be
installed withui this plat, aad the applicant shaall provide for individual domestic water
service as well as fire protecdon to each tract prior to sale of each tract and prior to
issuance of a building permit for each aact."
COUNTY DIVISION OF UTILITIES CONDITIONS
WATER SERVICE

Water System Plan for Spokane County, as amended.
SEWER SERVICE
1. The owner(s) or successor(s) in interest agree to authorize the County to place their
name(s) on a petition for the form,ation of ULID by petition method pursuant to RCW
36.94, which petition includes the owner(s)' property; and further not to object by the
signing of a protest pedtion against the formation of a ULID by resolution method
pursuant to RCW Chapter 36.94 which inctudes the owner(s) property. PROVIDED,
tbis condition shall not prohibit the owaer(s) or successor(s) from objecting to any
assessment(s) on the property as a result of improvements called for in conjunction
with the forma.tion of a ULID by either petition or resfllution under RCW Chapter
36.94.
2. Applicant shall make connection to Public Sewer System. Sewer Coruiection Permit is
required.
3. Plans and specifications for the public facilities sewer connection are to be reviewed

Spokane County to mitipte the direct impacts that the subdivision has on public parks,
open spaces and recreational facilities within the unincorporated areas of Spokane

The following "Conditions of Approval" for the above referenced subdivision
are subm.itted to the Spokane County Planning Department for inclusion in the
"Findings and Order" should the short plat be approved.
E 1 That conditional approval of the plat by the County Engineer is given
subject to dedication of Right-of-Way and approval of the road system as
indicated in the preliminary plat of record.
E 6 No construction work is to be performed within the existing or proposed
Public Right-of-Way until a permit has been issued by the County
Engineer. All work is subject to inspection and approval by the County
Engineer.
E12 The applicant should be advised that individual driveway access permits
are required prior to issuance of a building permit for driveway
approaches to the County road system.
E13 Dedication of 5 feet of additional Right-of-Way along Steen Road.
E16 Existing County roads providing direct access to the plat shall be paved
and/or curbed to Spokane County standards.
E19 The word "applicant" shall include the owner(s) of the property, his/her
heirs, assigns and successors.
E20 To conetruct the road improvements stated herein, the applicant may,
with the approval of the County Engineer, join in and be a willing
participant in any petition or resolution which purpoees is the
formation of a Road Improvement District (RID) for said improvements
pursuant to RCW 36.88, as amended. At such time as an RID is created or
any Road Improvement Project is sanctioned by Spokane County, the
improvements required (curb, sidewalk, drainage control and paving to
existing pavement) will be at the sole expense of the undersigned owner,
their heirs, grantees and assigns. This provision is applicable to Steen

E21 As an alternative method of constructing the road improvement stated
herein, the applicant may, with the approval of the County Engineer,
accomplish the road improvements stated herein by joining and
participating in a County Road Project (CRP) to the extent of the
required road improvement. At such time as an RID is created or any
Road Improvement Project is sanctioned by Spokane County, the
improvements required (curb, sidewalk, drainage control and paving to
existing pavement) will be at the sole expense of the undersigned owner,
their heirs, grantees and assigns. This provision is applicable to
Steen Road.
E22 That the following statement shall appear within the dedicatory language
of the f inal plat :
The owner(s) or successor(s) in interest agree to authorize Spokane
County to place their name (s) on a petition for the formation of a
Road Improv~ement District (RID) by the petition method pursuant to
Chapter 36.88 RCW, which petition includes the owner(s) property, and
further not to object, by the signing of a ballot, the formation of
a RID by the resolution method pursuant to Chapter 36.88 RCW, which
resolution includes the owner(s) property. If a RID is formed by
either the petition or resolution method, as provided for in Chapter
36.88 RCW, the owner (s) or successor ( s) further agree :(1) that the
improvements or construction contemplated within the proposed RID is

feasible, (2) That the benefits to be derived from the formation of
the RID by 0 the property included therein, together with the amount
of any County participation, exceeds the cost and expense of formation
of the RID, and (3) that the property within the proposed RID is
sufficiently developed. Provided, further, the owner(s) or
successor(s) shall retain the right, as authorized under RCW
36.88.090, to object to any assessment(s) on the property as a result
of the improvements called for in conjunction with the formation of
a RID by either petition or resolution method under Chapter 36.88 RCW,
and to appeal to the Superior Court the decision of the Board of
County Commissioners aff irming the final assessment roll. It is
further agreed that at such time as an RID is created or any Road
Improvement project is sanctioned by Spokane County, the improvements
required (curb, sidewalk, drainage control and paving) will be at the
sole expense of the undersigned owner, their heirs, grantees and
assigns without participation by Spokane County.
The RID waiver contained in this agreement shall expire af ter ten
(10) years from the date of execution below. However, the owner(s)
or successor(s) agree that if said RID waiver expires without
construction of the required improvements, the owner(s) or
successor(s) agree to construct the required improvements at their own
expense; pay to Spokane County the then estimated cost of the required
improvements to enablP the County to complete the same; or furnish a
bond or ather secure method suitable to the County (which may include
the execution of another RID waiver agreement), providing for or
securing to the County the actual construction of the improvements.
Al1 of the requirements of this agreement shall run with the land and
shall be binding upon the owner(s), their successor(s) or assign(s).
This provision is applicable to Steeu Road.
E24 The County Engineer has designated Typical Roadway Section Number 2
1Loca1lacc:eag Standard for the improvement of Steen Road which is
adjacent to the proposed development. This will require the addition of
approximately 30 fPPt, of asphalt along the frontage of the development.
The constructton of curbing is also required.
E32 The proposed plat shall be improved to the standards set forth in
Spokane County Board of Commissioners Resolution No. 80-1592, as
amended, which establishes regulations for roads, approaches, drainage
and fees in new construction.
E33 The County Engineer has examined this development proposal and has
determined that the impact of this proposal upon the existing County
Road System warrants the dedication of additional Right of Way and the
roadway improvements herein specified.
E90 The applicant should be advised that there may exist utilities
either underground or overhead affecting the applicants
property, including property to be dedicated or set aside future
acquisition. Spokane County will assume no financial obligation
for adjustments or relocation regarding these utilities. The
applica.nt should check with the applicable utilities and Spokane
County Engineez to determine whether the applicant or utility is
responsible for adjustment or relocation costs and to make
arrangements for any necessary work.
