agree: (1) that the improvements or construction contemplated within the
prnposed kID is feasible, (2) that the benef its to be derived From the
formation of the RID by the property included therein, together with the
amount of any County participatioa, exceeds the cost and expense of
formation of the RID, and (3) that the property within the proposed RID
is suff iciently developed. Provided, further, the owner(s) or
successor(s) shall retain the right, as authorized under RCW 36.88.090, to
object to any assessment(s) on the propertp as a result of the
improvements called for in conjunction with the formation of a RID by

It is further agreed that at such time as an RID is created or any Road
Improvement Pro,7ect is sanctioned by Spokane County, the improvements
required (curb, sidewalk, drainage control and paving to existing
pavement) will be at the sole expense of the undersigned owner, their
heirs, grantees and assigns.

We have completed our investigation into the status of the unna.med road ;
lying north of Appleway between Barker and Greeaacres roads. This road was ;
originally a 100 foot wide right of way. ~

It appears that in 1941 the east 20 feet and the west 20 feet of this ~
right of way were vacated. In 1973 actioa was started to vacate the remaining a
road righ[ of way along with various lots in the same area. gowever, in
viewing the final resolution (73-810), it appears that the road was omitted
from the actian. We find aothing to explain why this might of happened. ~
Consequently, we must conclude that there still remains a 60 foot wide right h
of way.
By copy of this leCter, we are informing our Engineerfng Administrator
(Mr. Smale) of this condition. If you desire to have this 60 feet vacated, I ~
would suggest that you contact him at 456-3600. If we can be of further
assistance to you, please let us know.
