Property located at 5021 E. 8th Ave.
This letter is in response to our meeting on June 29th. You requested the conversation to be memorialized in
writing listing the path to compliance.
First,the property was constructed as a Single Family Dwelling in '04-'05 under permit#04009486. According
to the parcel history, the structure has seen some additional uses such as a jewelry making and event sales in
2012. This approved home occupation was abandoned and is therefore no longer applicable.
Currently the basement of the dwelling is being used as a second dwelling and currently meets the definition of
a separate and distinct dwelling. This is not permitted as the property is only permitted to be used as one (1)
single family dwelling. Further, the area of the parcel does not contain enough area to establish an additional
dwelling unit.
To alleviate the violation, the amenities in the basement which constitutes a second dwelling must be removed.
The structure must be used as one (1) dwelling. Another factor that represents a single dwelling would be if
internal circulation was provided from main level to basement. The exterior access to the basement is permitted
to remain as this does not affect the use of the structure. An inspection to verify these alterations must be
conducted to satisfy these conditions.
As discussed at our meeting, it is my understanding that you currently have active leases for the basement. The
intent of this enforcement action is not to break private contracts. Therefore, full compliance with the adopted
municipal code shall be completed by December 31, 2015 or when the leases come due, whichever comes first.
This compliance structure should give you enough time to provide notice to existing tenants.
