DECISION
The application is approved.
INTRODUCTION
This matter being the consideration by the Zoning Adjustor for Spokane
County and pursuant to Chapter 4.25, Section 4.25.010, the Zoning Adjustor has
the authority to hear and decide such matters coming before him. After con-
ductina a public hearing to receive all public testimony and after reviewing
the public record, examining available information, and visitina the property
and surrounding area, the Zoning Adjustor in accordance with Chapter 36.70.810
Revised Code of Washington, and Section 4.25.030 of the county zonino ordinance
•
hereby makes the following Findings of Fact and Conclusions of Law hereinbelow
stated.
The applicant, George Koeller, filed an application on December 5, 1980 re-
questing a variance approval for relaxation of the required frontage on a public
road in order to construct a single family residence on a parcel of land 2 acres
in size. The property is located on Eight Avenue and east of Evergreen Road in
Section 23, Township 25, Range 44.
This matter was first heard before the Zoning Adjustor on December 22, 1980.
At the hearing it was determined that insufficient information regarding the
division of the subject lot was presented. Further, the subject property was

not in compliance with Section 4.17.130 titled Lot Depth to Width Ratio. It was
ordered that the matter be continued to January 14, 1981 for additional research
and that the staff shall renotifiy as required by law.
That on January 14, 1981, the hearing of this application was concluded. The
announcement of a decision was set for January 21, 1981 at 1:15 p.m.
FINDINGS OF FACT
That from additional research by staff it was confirmed to the Zoning Adjustor
that a proper and legal segregation of the subject property was made. That a
Certificate of Exemption No. CE-1512-79 (B) was issued by the Acting Short Plat
Administrator on December 5, 1980. The provision cited was Section 3.3B.3. A
Certificate of Exemption was originally issued in 1979, however, due to an error
in the legal description with the original application, a revised and corrected
certificate was issued. Staff assured the Zoning Adjustor that a legal division
of land was made.
II.
It was reported that the applicant's property has 55 feet of public road front-
age whereas the zonina ordinance requires a minimum of 65 feet for the Agricultural
Suburban zone.
III.
The applicant's lot width at building line is 165 feet which is sufficient to
accommodate a single family residence.

IV.
All matters before the Zoning Adjustor are reviewed by agencies of
jurisdiction with the following agencies submitting recommendations to the
Zoning Adjustor for consideration:
SPOKANE COUNTY ENGINEERS OFFICE: It was recommended at the hearing that the
applicant agree to dedicate the south 10 feet along 8th Avenue for right-of-
• way purposes. Further, the applicant shall execute a Tract "X" Agreement
with Spokane County for the north 30 feet of the subject property for future
extension of 6th Avenue.
SPOKANE COUNTY UTILITIES: It was recommended that the applicant shall partici-
pate in any formation of a utility improvement district to provide central
sewage to this area.
SPOKANE COUNTY HEALTH DISTRICT: It was reported that this project lies over
the Spokane Aquifer but within the service area of Vera Irrigation District.
That water service shall be by Vera Irrigation and that subject to specific
design anproval, the use of an individual on-site sewage system may be author-
ized.

SPOKANE COUNTY PLANNING DEPARTMENT: Staff confirmed that the application is
in compliance with the established procedures for processing such applications.
That a legal division of land for building purposes has been created. Staff
reported that there are similar in size which do not have the required minimum
width for road frontage.
V.
The applicant testified at the hearing that they would comply with those
requirements recommended in the agency's review.
VI.
The opportunity was afforded at the hearing to any interested person to
testify regarding the applicant's proposal. An area property owner did testify
regarding concern over the division of the subject property.
Finding Number I describes the issue of the segregation. It was confirmed
• . that the segregation was in compliance with the existing laws at the time appli-
cation for segregation was made in 1979.
Since that time the Short Plat Ordinance, Section 3.36.3 was amended to
further clarify the intent of the provision for division of land to a souse,
son or daughter. Therefore, future segregations under this provision cannot be
sold, leased, or transferred without compliance with Chapter 58.17 RCW.
From the above Findings of Fact, the Zoning Adjustor enters these:
CONCLUSIONS OF LAW
That the Zoning Adjustor of Spokane County has jurisdiction over the issuance
of the building permit for the project to the applicant pursuant to the provisions
of Chapter 36.70.810 RCW and Section 4.25.030 of the Spokane County Zoning Ord-
inance.

That the applicant submitted an application to the Planning Department re-
questing a public hearing before the Zoning Adjustor, and that pursuant to
Chapter 36.70.840 and Section 4.25.040 of the zoning ordinance, notice for a
public hearing was given through the United States mail to all property owners
within a radius of 300 feet from the subject property.
III.
That all citizens notified and agencies having jurisdiction were afforded
the opportunity to testify or submit written comments on the proposed project.

IV.
That in review of the assessor's maps for this general vicinity, it is
found that there are other divisions both smaller and larger in size which
do not have the required frontage on a public maintained road as specified
by the zoning ordinance. Therefore, this action does not constitute the
orantinq of a special privilege inconsistent with the limitation placed up-
on other properties in the vicinity and under the same zone classification
as cited in Chapter 36.70.810 RCW, and if denied, the applicant would be de-
. prived of a minimum and basic right to construct a single family residence on
a parcel of land which has been found to be sufficient in size to support such
a use.
V.
The Zoning Adjustor finds that the proposed use on a parcel consisting of
2 acres and having 55 feet of road frontage is a reasonable request for relaxa-
tion of the zoning provision. Denial would be an unreasonable imposition placed
on the applicant.
VI.
That this action was taken after finding that the public health, safety
and aeneral welfare will not be infringed upon. That furthermore, this action
conforms to the intent of the zoning ordinance and general comprehensive plan
adopted by Spokane County. That reasonable assurances have been provided by the
applicant that future right-of-way will be made available to Spokane County for
public road purposes.
VII.
Any Conclusion of Law which is deemed a Finding of Fact is hereby adopted
as the same.

CONDITIONS OF APPROVAL
That an on-site sewage disposal system shall be approved by the County •
Health Officer.
II.
That the proposed project shall be in substantial conformance to the plot
plan on file with this application, and shall observe all setback requirements
as prescribed by the Spokane County Zoning Ordinance.
III. •
That the subject property shall not be further subdivided unless said
division is in compliance with Chapter 58.17 RCW and applicable county ordinance
governing such divisions. Any such division shall be in compliance with the
adopted comprehensive plan for Spokane County.
IV.
Prior to the issuance of a building permit, the applicant shall dedicate to
Spokane County the south 10 feet of the advertised property for right-of-way
purposes. Further, the applicant shall execute a Tract "X" agreement for the
north 3Q feet of the property for future right-of-way for 6th Avenue.
