WAIVER OF VIOLATION
WVE-3-78, SETBACK REQU i REMENT
ZONING ADJUSTOR DECISION: After public testimony and review, the decision
of the Zoning Adjustor is to approve the applicant's request for a Setback
Requirement Variance in the Agricultural Suburban Zone.
A. FINDINGS FOR APPROVAL: Pursuant to Section 4.25.030 (f) of the
Spokane County Zoning Ordinance, the Zoning Adjustor has the responsibility
of determining that the granting of a Waiver of Violation will not be detrimental
to the surrounding properties. ln assuring compatibility, the Zaning Adjustor
based his decision on the testimony presented at the September 6, 1978 Zoning
Adjustor Hearing as well as criteria set forth in the Spokane County Zoning
Ordinance for issuance of a Waiver of Violation. The Zoning Adjustor hereby
finds the following:
1. It was noted that topographic problems (i.e., grade level 6 feet higher than
roadway), would not allow the garage to be located anywhere else on the
property.
2. It was found that the strict application of the Zoning Ordinance would deprive
the subject property of rights and privileges enjoyed by other properties in the
vicinity.
3. After a site inspection, the Zoning Adjustor is af the opinion that the granting
of the Variance will not be materially detrimental to the public welfare or in-
jurious to the property or improvements in the vicinity.
B. ORDER :
1. Prior to the issuance of a building permit, the applicant shall submit evidence
to the satisfaction of the Short Plat Administrator, which shows compliance with
the Short Plat Ordinance.
2. The applicant shall maintain his site design in substantial conformance with the
"plot plan" on file with this application, and in any case, shall observe all
setback requirements as prescribed by the Spokane County Zoning Ordinance.
3. The building shall be located no closer than 16.44 feet from the flanking street
property line.
