SPOKA-NE COUIJTY ZONING ADJUSTOR IN A DECISION TO APPROVE A WAIV'ER OF
VIOLATION, WVE-2-77, SIDE YARD REQUIRE-MENT
WHEREt1S, Application has been presented to the Zoning Adjustor of Spokane
County, W ashington, by Gorcion E o Hawk, reque sting a Waiver of Violation to allow
a structure to remain 17ft. 3in, from the side property line of an adjacent residentfai
use, whereas the Spokane County Zoning Ordinance requires a 20 ft. setback from an
adjoining lot which is occupied by a residential structure. The property in question
is generally located on thc: west side of Pines Road approximately 100 ft, south of
Valley Way, and more specifically described as follows:
Section 16, Township 25N, Range 44 E.W.M.
The North 1/2 of the South 2/3 of the West 3/5
of the North 1/2 of Tract 125, Opportunity
Parcel No. 16544-0307 and,
WHEREAS, the Zoning Adjustor of Spokane County, did, on the 7th day of .
February 1977, hold a public hearing as provided in Section 4.25 of Title IV on the
application of Gordon E. Hawk, for a VUaiver of Violation for the described property,
and,
1I1rHEREAS, the Zoning Adjustor did on the 7th day of February 1977, formally
act upon said application and did approve said application based upon findings of
fact and reasons set forth in the official minutes dated fihe 24th day of February,19 77,

WHEREAS, an appeal from the decision of the Zoning Adjustor for Spokane County
was filed on the 17th day of February, 1977, by Ted L. Harper, ,
and,
WHEREAS, the Board of Adjustment of Spokane County, did on fihe 29th day of
Marcn, 1977, hold a public hearing as prescribed in Sectfon 4.25.of Title IV on the
application of Gordon E. Hawk for said Waiver of Violation, WVE-2-77,
and,
WHEREAS, at said hearing, opportunity was afforded those favoring and those
opposing said application, and the Board of Adjustment having fully considered the
official records avidence and testimony given and having made an investigation of the
matter does hereby find:
1. That we concur with the action of the Zoning Adjustor, as stated within
th2 minutes of the Hearing on the 7th day of February, 1977, and of record
in file WVE-2-77, and further find the reasons stated therein to be
sufficient and controlling.
NOW, THEREFORE, the Board of Adjustment does hereby approve the Waiver
of Violation to allow a structure to remain 17ft. 3in, from the side property line of an
adjacent residential use, on the descrfbed property subject to the conditions specified
by the Zoning Acljustor
