This is true of zoning ordinances, which are laws intended to protect and govern the many different uses of land in Spokane County. It is my responsibility, as the Zoning Investigator, when the situation arises, to help resolve conflicts involving the Spokane County Zoning Ordinance. This office has received reports regarding two occupied residences, one frame and one mobile home, on your property at East 7016 10th Avenue, Spokane County, parcel number 24534-1102. A recent visual inspection by our field inspector indicated, we believe, that these reports are accurate. Unfortunately, Section 4.05.040 of the Spokane County Zoning Ordinance limits the number of residences to be located on a parcel of land in an Agricultural Suburban Zone, in which your property is located, to one. We are of the opinion that since you have now been informed of the require- ments of the Spokane County Zoning Ordinance, a period of 30 days, beginning with your receipt of this letter, should be sufficient time in which to bring your property into compliance by: 1) Removal of one residence; or 2) Legally subdividing parcel number 24534-1102 and obtaining the necessary building permits in order to legally install this second residence on your property. The applicant, Hideo Saiki , filed an application with the Planning Depart- ment on July 9, 1981 requesting approval to allow a single wide mobile home on his property in order to finish repair work and to locate a properly zoned lot on which to locate the mobile home. The subject property is located on 10th Avenue in Section 24, Township 25, Range 43. After receiving public testimony and accepting the file from the Planning Department, the Zoning Adjustor placed this application under advisement for review and decision. That on August 19 , 1981 , the Zoning Adjustor having reviewed the public testimony and having reviewed the file as compiled by the Planning Department concluded that there are sufficient grounds to support this action. CONCLUSION OF LAW I. That the Zoning Adjustor of Spokane County has jurisdiction over the issuance of the building permit for the project to the applicant pursuant to the provisions of Chapter 36.70.810 RCW and Section 4. 25.030 of the Spokane County Zoning Ordinance. That the applicant submitted an application to the Planning Department requesting a public hearing before the Zoning Adjustor, and that pursuant to Chapter 36. 70. 840 and Section 4.25.040 of the Zoning Ord- inance, notice for a public hearing was given through the United States mail to all property owners within a radius of 300 feet from the subject property. II . That all citizens notified and public agencies having, jurisdiction were afforded the opportunity to testify or submit written comments on the proposed project. No one appeared nor any written testimony was received in opposition. III. Pursuant to Section 4.24.010 (b), the Zoning Adjustor reserves the right to stipulate restrictions or conditions that would uphold the spirit and intent of the Zoning Ordinance and to mitigate any adverse effect upon the neighborhood properties. Permits may be suspended or revoked after public hearing and a find- ing by the Zoning Adjustor that a permittee has failed to comply with such re- strictions or conditions. PAGE 2 CUE-22-81 VI. That pursuant to the above provisions of law, Finding of Fact hereinabove substantiates action taken regarding this application. Any Finding of Fact hereinafter stated which is deemed to be a Conclusion of Law is adopted as the same. FINDINGS OF FACT I. The subject property is zoned Agricultural Suburban which does not permit single-wide manufactued homes as residences. Homes constructed and double-wide manufactued homes for single family residences are permitted on minimum lots of 7,000 square feet with 65 feet of continuous public road frontage (See Section 4.05.040 of the Zoning Ordinance) . It is noted that the applicant's property is 10,500 square feet in size and already has an existing residence on the site. II. The applicant is requesting the permit under the zoning provision of Section 4.25.030 (e) , Temporary Structures and Uses. The provision for temporary struct- ures provide that a zoning certificate for such use may be granted in the form of a temporary and revocable permit, for not more than a six (6) month period. III. All applications pending before the Zoning Adjustor are reviewed by all County Departments having jurisdiction. The County Engineer's Office submitted a memo dated August 5, 1981 stating that they had no comments regarding this application. It is noted in a memo dated August 3, 1981 from the Department of Building and Safety that the Zoning Investigator received a complaint concerning this property alleging two (2) occupied residences were located on the property. The Spokane County Utilities Department in a memo dated July 28, 1981 had no objections to the temporary use permit. VI. The applicant, Mr. Saiki , testified that it is his intention to finish the remodeling of the single-wide mobile home and then to locate it on a parcel of land that is properly zoned for a single-wide mobile ho,ie. In his testimony, Mr. Saiki stated that the mobile home is being occupied hut that no sewage or water facilities were connected for use of the mobile home VII. The opportunity was afforded at the hearing to any interested person to testify regarding the applicant's proposal . No one appeared at the hearing in opposition to the application. Mr. Chet Etheridge, an adjacent property owner Parcel #24534-1101 was present at the hearing. In his testimony, he stated that he had no objections to the applicants proposal . VIII. Any Finding of Fact stated hereinabove which is deemed a Conclusion herein- after shall be adopted as the same. CONCLUSIONS I. It is the opinion of the Zoning Adjustor that with the conditions and re- strictions placed on this application, assurances can be made that the public health, safety, convenience, and general welfare are being protected. II. Furthermore, this action cannot be construed to be precedent setting. That this action is granting temporary relief to the applicant without being materially detrirental to the public welfare or injurious to the property or improvements in the vicinity. .c. PAGE 3 CUE-22-81 III. That this action is not considered the granting of a special privilege inconsistent with the limitations placed upon other properties in the vicinity. That with the attachment of conditions to provide public safeguards , the use of the mobile home is not permanent under the terms of existing county codes . IV. From on-site review, the Zoning Adjustor finds that this proposal will not cause injury to property and improvements to adjacent properties. The mobile home is partially screened from view from other properties on 10th Avenue. That further, the use does not involve the construction of a sub- stantial structure, and that the mobile home is not being set up or used as a place for occupancy. Mr. Saiki testified that the was retired, and is therefore repairing the mobile home to supplement his retirement income. CONDITIONS OF APPROVAL I. That pursuant to County Code Section 4. 25.030 (e) this permit is granted for a period of time not to exceed six (6) months from the date of this de- cision. The termination date is set for January 19, 1982. II. That at no time shall the mobile home be connected to water or sewer hookups. Electricity needed for repair work may be extended from the appli- cant's residence. III. The mobile home shall not be skirted nor give the appearance that it is permanently affixed to the lot. That all mobility gears shall remain on the unit. IV. The applicant shall notifiy the Zoning Investigator, Department of Build- ing and Safety, upon removal of the mobile home from the site.
