1989, and the members of the Committee present being Chauperson Verona
Southern, Lunell Haught and Don Nezaas.
PROPOSAL
The sponsar, Sampson Aycrs House of Music % Dan L. Kennedy, r+equests
approval of a zone reclassification h+om Residential Off'ice (RO) to Neighbarhood
, Business (B-1), File No. ZE-49-89, far the puapose of developing retail distribution
of sheet music from an existing building. The west 135' of this site is undeweloped..
FINDINGS OF FACT AND CONCLUSIONS
1. The property is generatly locaoed in the Dishman area of the Spokane Valley, west of
and adjavent to Argonne R,oad and between AIIQ and Broadway Avennes in Section
18, Township 25N., Range 44 EWM, Spokane County, Washington.
2. The coaanuuee adopts the P`lanning Deparment Report as a part of this rward.
3. The existinng land uses ui the area are affice buildings, an aparcment complex, single
family residences and vacant areas.
4. The Comprehensive Plan designates this s'ste as Majar Commercial and Urban. The
westein appncfxunately 135' is in the Urban category.
5. The Arterial Road Plan demgnaties Argonne Road as a principal armnal. The
Argonne,lMullan oouplet genera]ly implements the artenal road plan.
6. The existing zoning of the property described in the application is Residential Qffioe,
previously established ia 1978. The propeny wiII cross aver to Urban Residendal-22
(tTR-22) in 1991.
The provisions of RCW 43.21 C(The State Environmental Pobcy Act) have been
complied with and a Deternnination of Nonsignificance was issued.
8. The pmpcr legal requirements far advemsement and notice have been fulfilled.

10. 1'he Commiaee addiaonally finds:
The depth of Neighborhood 8usiness (B-1) Zoning is a conc:ern along Argonne
Road; however, the B-1 zone is the least intensive Conunercial Zone. The B-1 Zone
contains height lunitations and landscaping standards when B-1 Zoning abuts
adjacent residential zones. Tlus will pmovide transition between the elnsang uses. If
the vacant propeity along the west 135' was not zoned, it would cnoss over to Urban
Resuientml (UR-22) lugh density Residenaal Zone. While both B-1 and UR-22

could provide a tnansuion from commomal uses along Argonne Road, the 8-1
Z,owng would allow for a unified development and not allow mixing of business and
high density residential traff'ic on the site The neaiest north/south street, Marguerite
Road, is 670 feet west of Argonne Road. This makes providing of the zonmg
transition as found in other areas of the ArgonnelMullan corridor very difficult The
B-1 standards will provide adequatc buffer and tiansition tio exisang residenaai uses
to the south, west and north, as the B-1 Zone is a Neighborhood Business Zone
11. The proposed use is compatible with existing uses in the area.
12. The proposed zoning does implement and confarm to the Comprehensive Plan.
13. The apphcant has demonstrated that conditions have substanaally changed since the
original zonmg of tlus area and acxordingly, the proposed zone reclassificadon is
, jusafied.
14. The proposal does not result in spot zoning.
15. The proposed use will not be detnmental to the pubhc healdi, safety, inorals ar
welfare
CONDITIONS OR CONTINGENCIES APPLIED TO THIS APPROVAL
1. All Conditions imposed by the Heanng Facaminer Comnuttee shall be binding on the
"Applicant", whicb term shall include the owner ar owners of the property, heirs,
assigns, aad successozs-in-inwnesL
2. The following Conditians of Approval apply to the following descnbed real property:
Hutchinson's Addition, Portion of Lot 8, 9, and 10, Block 17, N. 1J2 of Lot 8 and 9,

1. The specific development plan will be submitted far Planning Depardment review
and approval prior to issuance of building pezmits.
2. All curnent standards of the B-1 Zone, as amended, shall be complied with in the
development of dus site.
3. The project is sublect to Secaon 14.706, the Aquifer Sensiave Aiea Overlay Zone
of the ZONIIVG GODE FOR SPOK:ANE COUNTY, wtuch sets forth vanous
measures for Aquifer protecaon; specifically, measures dealing anth wastewater
disposal, spill protecaon measures, and stormwater runoff.
4. The present proposal is not detailed enough to deternune whether or not the use of
or mamrials scored on the site are in comphance with Secdon 14.706 (Aquifer
Sensitive Area Overlay Zone) of the ZONIIVG CODE FOR SPOR:ANE COUIV'TY.
Accorduigly, as a condznon of approval, the sponsor/applicant shall be requued to
file wnth the Spokane County Auditor, vsnthin durty (30) days of the signing of
