A. REASONS:
1. The Zoning Adjustor is of the opinion, considering the very small mount of
the violation, that the owner and (or) contractor had no intent to violate
the Ordinance and were acting in good faith. .
2. Since only a very s mall fraction of the building protrudes a very short
distance into the required setback the .Zoning Adjustor is of the opinion

( 9) A DRAWING (PLOT PLAN) MUST BE SUBMITTED WITH THIS APPLICATION FORM
SHOWING THE FOLLOWING INFORMATION:
a) Scale of drawing.
(Preferred Scale: 1 inch equals 20 feet.)
b) North point and date.
c) All dimensions of property, dimensions of existing buildings, and
dimensions of proposed buildings with dimensions to the nearest property
line must be drawn to scale on the plot plan.
d) Off-street parking area and points of access and egress.
e) Topographic features pertinent to the property (such as rock outcrop,
canyons, hills, etc.)
(10) The necessary fee must accompany this application.
Recognizing the fact that,na building may be erected in good faith with every
intent to comply with the provisions of the Zoning Ordinance in respect to the
location of the building upon the lot and the size and location of required yards,
and that it may later be determined by the Planning Commission that such
building does not comply in every detail with such requirements, although net
violating the spirit and intent of the Zoning Ordinance, the Board of County
Commissioners may on recommendation of the Planning Commission, after
public hearing by the Planning Commission issue a Waiver of Violation.
