Re: Waiver of Violation request by Blaine A. Johnston
Gentlemen:
We the undersigned wish to register the following protest
and comments regarding the waiver of violation being requested
by Mr. Blaine A. Johnston for the duplex which is now under
construction at 10515-17 East Broadway and wh ich same building
is in violation of existing Zoning Ordinance as regards placement
on this lot.
Since Mr. Johnston has been a builder for a number of years and
is experienced in the construction field, he certainly must have
been aware that the placement of this building on this lot was in
violation of existing 7oning Ordinances. However, after the
violation had been reported by a building inspector, he merely
asked for a waiver and continues with the work necessary to
complete the duplex. Why?
Wrhy have building codes, zoning restrictions or any regulations
at all if it is not necessary to comply with them, or is it
necessary for only some people to comply?
Why is it necessary to have this hearing at all? Since a
v ialation has taken place, it should be incumbent on the builder
to correct the violation to meet existing legal requirements
rather than take the time and effort of the undersigned to enforce
what is already a legal ruling.
Mr. Johnston applied for and was issued a building permit
to place this duplex 28 feet from Broadway, 42 feet from East
property line, 25 feet from kTest property line and 56 feet from
North property line. Mr. ,Tohnston did not comply with the
bu i ld ing permit. I f th i s v io lat ion has been by de s ign with the
expectation of receiving a waiver thereby enhancing the chance
of obtaining a variance from the R-1 Zoning restrictions that
apply to the lot located directly North and East of this lot,
we are prepared to take whatever legal action is necessary to
enforce the R-1 Zoning and building requirements that now apply
to this lot. I.E. Lot 3, B3, Block 67 Skgline View Subdivision.
