FINDINGS AND ORDER
A. INTRODUCTION
This matter having come before the Zoning Heering Exeminer Committee on
January 20, 1983, and the members of the Committee present being
Ronald L. McVicker, Chairman, Lynn Tennlcan, and Jane E. Myers.
8. PROPOSAL
The sponsor, Jim Olinger, is requesting approval of a change of conditjons,
File No. ZE•148-80, Restricted Industrial Zone, for the purpose of defeting or
mcdifying Condition #5 of the original approval requiring a time frame for fence
construction.
C. FINDINGS OF FACT
1. That the existing land use in the area is residential, storage, mining,
manufactured home park, and undeveloped.
2. That the Comprehensive Plan designates thjs area as appropriate for
Restricted I ndustrial development.
3. That the existing =oning of the property described in the application is
Restricied I ndustrial .
4. That the provisions of RCW 43.21C (The State Environmental Policy Act)
have been complied with, and the Cornmittee concurs with the Declaration of
Non-Significance.
5. That the proper legal requirements for advertisement of the Agenda Item
have been fulfilled.
6. That the applicant has not demonstrated that conditions have substanttally
changed since the originat toning of this area and accordingly, the change
of conditions request is not justified.
7. That the owners of adjacent lands expressed disapproval of the proposed
change of conditions.

8. The Hearing Examiner Committee does not find the proposed change of
conditions to be in harmony with the general purpose and will not be other-
wise detrimental to the public health, safety, and welfare.
9. The following are additional findjngs of fact considered by the Hearing
Examiner Commtttee:
a) That the time frame for fence construction remain as required by the
Findings and Order of the Board of County Commissioners and be
started immediately.
b) That the residences along Broadway pre-exist the Restricted In-
dustrial zone change, and that the area is in mixed land uses.
c) That the fence should be required to maintain compatibility between
adjacent land uses. That the applicant has made no attempt to
construct the fence. That the applicant has exertised a right, that
being the change of land use; but that the adjacent owners have a
right of protection.
d) That the Committee is only requiring implementation of a previously
attached conditfon placed on the property at the time of the zone
change approval by the 6oard of County Commissioners.
D. CONDIT{ONS OR CONTINGENCIES APPLIED TO THIS APPROVAL
a) ALL CONDITIONS OF THE PREVIOUSLY APPROVED ZONE CHANGE
APPLY TO THIS REQUESTED CHANGE OF CONDITIONS.
b) COUNTY BUILDING AND SAFETY DEPARTMENT

1. A plan for emergency equipment access is required to be sub-

b) The Change of Conditions request was denied based on previous
action by the aearing Examiner Committee and Board of Countq
Commiesionera relating to the impact of the northerly boundary
of the proposal to the adjace nt residential properties.
c) The building height restrictioa relative to the decision of the
Zoning Adjustor would neceesitate consideration of the solar
accese and not infringe upon the neighboring residents.

trees be installed along the aorth property line of this rezone
(ZE-29-84) application, ae well as along the north property line
of the Change af Conditions, ZE-148A-80.
2. That accese to the mini-warehouse for the general public be from
a paved driveway to Park Soad.
3. That a f ree-etanding identification sign be limited to the
western portion of the aite along Park Road.
4. The Zoniag Administrator shall approve a specific exterior
lighting plan for the approved erea prior to inetallation of
auch lighting. (Such plan shall attempt to confine illumination
to the area with full consideration to adjacent properties).
5. A specific landacape plan, planting schedule and provieions for
maintenance acceptable to the Spokane County Zoning
Adminietrator shall be submitted with a performance bond for the
project prior to release of buildiqg permite.
6. The applicant shall develop sub3ect property generally in
accordance within the concept presented to the Heariug Examiner
Committee. Variations when approved by the Zoning Administrator
will be penmitted, including, but not limited to the following
changes: Building location, landscape plaas, and general
allowable uses of the permitted zone. All variations must
conform to regulations set forth in the Spokane County Zoning
Ordinance. The original intent of the development plane shall
be maintained. l
7. The specific development plan will be submitted for Planning
Department review and approval prior to iesuance of building
permite.

Sensitive Area Overlay Zonre of the Spokane County Zoning
Ordinance, which eete forth varioue meaeures for Aquifer
protection; epecifically, meaeures dealing with wastewater
diepoeal, epill protection meaeurea, and etoroawater tunoff.
10. Applicant shall comply with 1208' recommendations concerning
stormwater runoff and provide neceesary landscaping for runoff.
11. Any divieion of land for the purpose of sale, lease or tranefer,
ehall comply with RCW 58-17 and the Spokane County Platting
Ordinances prior to iaeuance of building permite.
12. That the provieione of SEPA's NOTICE OF ACTION pureuant to
Chapter 43.21C.080 RCW and the Board of Spokane County
Commiseionere Resolution #77-1392 be initiated by the project
applicant within thirty (30) daye of final dispoeition of thie
application, and prior to any on-eite improvemente, or file
appropriate documente to the effect that the NOTICE OF ACTION ie
waived in accordance with Spokane County Comnniseionere'
Beeolution #82-0458 dated May 4, 1982,
13. A proposed declaration of non-eignificance (a preliminary
decision, which may be reversed, that an environmental impact
statement, an EIS, is not needed) has been adminietratively
iesued. This ineures the applicant of a timelq procegsing of
his/her propoeal at the time of the public hearing. BOT, a
major purpoee of the public hearing is to afford the opportuaitq
to present the decision makers w3th iaforanation as to whether or
not a potentially SIGNZFICANT ADVERSE impact upon the physical
environanent will reeult from implementation of the proposal,
thue resulting in the need for an EIS. However, all "exteneione
of time" and most "change of conditions" are exempt from the
provisione of SEPA; check with the Planning Department etaff if
uncertaintq exiete.

14. That due to the uncertainty of the use or the materiale etored
on thie eite as it relates to the Aquifer Seneitive Area Overlay
Zone, Chapter 4.16A of the Spokane County 2oning Ordinance, a
statement shall be filed of record with the Spokane County
Auditor, shall tun with the land and shall only be removed
pureuant to wtitten consent of Spokane County. Said etatement
shall be, "That prior to the iseuance of building permit(e) or a
Certificate of Occupancy, vbichever ie applied for first,
compliance with the appropriate provisione of Chapter 4.16A
(Aquifer Seneitive Area Overlay Zone), of the Spokane County
Zoning Ordinance shall be demonetrated".
b) COUNTY ENGINEERING DEPARTMENT
Prior To The Iesuance Of A Building Permit:
1. Applicant shall dedicate 4 feet on Park Itoad for right-of-waq
prior to any uae of the property.
2. Access permite for approachee to the County Road System shall be
obtained f rom the Spokane County Engineer.
3. Applicant shall improve Park Road in a manner consietent with
Spokane County TYPICAL roadway section No. 1 minimum paving
w3dtb Major Arterial Standard.
4. Applicant shall submit for approval by the Spokane County
Engiueer road, drainage, and acceas plans prior to the iseuance
of a building permit on the propertq.
5. 1'he applicant shall submit for approval bq the Spokan,e County
Engiaeer and the Spokane County Health District a detailed
combined on-eite eewage system plan and surface water diepoeal
plan for the entire project prior to the ieauance of any
building permit on the property.
6. A parking plan and traffic circulation plan shall be eubmitted
and approved by the Spokane County Engineer prior to the
iesuance of a building permit on the property. The deaiga,
location, and arrangemen[ of parking stalls shall be in
eccordance with etandard traffic engineering practicee. Paving
or surfacing ae approved by the County E ngineer, will be
required for any portion of the project which ie to be occupied
or traveled by vehicles.

10. Roadway etandards, typical roadway eectione and drainage plan
requirements are found in Spokaae Board of County Commiseionere'
Resolution No. 80-1592 as amended.
11. Applicant is requestiug a VariBnce f rom Section 4.11.090-(E-2).
Thie Variance, if granted, would permit the conetruction of the
proposed mini-atorage facility within one foot of the property
line.
Spokan+e County Drainage Standards require that stornwater runoff
from impervioue eurfaces be retained and disposed of on-site.
This will be required of the applicant at the time an
application ie made for a building permit for the proposed
etorage facilitq.
12. It ehould be noted that the roadway improvements specified for
Park Road were aleo required for ZE-148A-80. A portion of that
zone change is aow affected by this action.
c) COUNTY UTZLITIES DEPARTMENT
1. Pureuant to Board of County Commissionere Reeolution No.
80-0418, the use of on-eite eew+er disposal systeme is hereby
authorized. Thie authorization is conditioned on compliance
with all rulee and regulations of the Spokaae County Health
Dietrict and ie further conditioned and subject to specific
application approval and iesuance of peYmite bq the xealth

l. The site ie located in Fire Diatrict # 1.
2. The proposed etructure will require some revisions to provide
the required fire flow for tbis structure. Having calculated
the fire flow requiremente based upon the preaented plan 8 fire
flow of 8,900 g.p.m. is required for thie complex,. It appeare
that four (4) hydrante will be required.
3. A water plan ehowing location, eize, etc. will be required for
approval. The hydrants shall be inetalled prior to the building
permit, and coostruction of the compleu. Each hydrant shall be
capable of flowing a minimum of 8,000 g.p.m, at 20 p.e.i.
reeidual when aay two (2) hydrants are f lowing simultaneou8ly.
These hydrante shall be placed so that no portion of the
building exterior ia more than 175 feet from the hydrant. Each
building conetructed shall be accesaible to Fire Department
apparatua by way of accese roadwaqe with all-weather driving
surface of not lese than 20 feet of unobetructed width with
adequate roadway turning radfus (20 feet and a minimum 45 feet

A. INTRODUCTION
This matter having come before the Zoning Hearing Examiner Committee on
May 14, 1984 (continued f rom May 1, 1984), and the membera of the
Committee present being Kathleen M. Caretene, Chairperson; Kenneth Rennedy,
and Jane E. Myers.
B. PROPOSAL
The spoasor, J. D. Olinger, is Tequesting approval of a change of
condition.s, ZE-148-80, Restricted Iudustrial zone; and a zone
reclassification, File No. ZE-29-84, Residential Manufactured Home to
Restricted Industrial, for the purpose of developing a Mini-WBrehouse aad
Storage Facility and a Change of Condition to allow for administrative
building site plan reviews for fuCure development; as well ae a Variance,
VE-36-84, to allow a 1-foot eide yard sethack in the Restricted Induetrial
Zoae, whereas a 5-fooe setback for each story of a building ia currentlq
requited. (Applies only to mini-warehouse and storage building under this
proposal.)
C. FINDINGS OF FACT
1. That the existing land use in the area is residential, miaing, and
vacant.
2. That Che Comprehensive Plan designates this area as appropriate for
Industrial development.
3. That the exieting zoning of the property described in the application
ie Restricted Industrial and Residential Manufectured Home.
4. That the provisions of RCW 43.21C (The State Lnvironmental Policy
Act) have been complied with, and the Committee concurs with the

This will be required of the applicant at the time an
applicatioa is made for a building permit for the proposed
storage facility.
12. It should be noted that the roadway improvements specified for
Park Road were also required for ZE-148A-80. A portion of that
zone cbange is now af fected by thie action.
c) COUNTY UTILITIES DEPARTMENT
1. Pursuant to Board of Countq Commissionere Resolution No.
80-0418, the use of on-eite sewer disposal eystems is hereby
suthorized. This suthorization is conditioned on compliance
with all rules and regulations of the Spokane Countq Aealth
Dietrict and 18 further conditioned and subject to epecific
application approval and issuance of permits by the Health
Dietrict. `

of a building permit on the property.
5. The applicant shall submit for approval by the Spokane County
Engineer and the Spokane County Health District a detailed

plan for the entire project prior to the iesuance of anq

6. A parking plan and traffic circulation plan shall be submitted
and approved bq the Spokane County E ngineer prior to the
iseuance of a building permit oa the property. The design,
location, and arrangement of parking etalls shall be in
accordance with etandard traffic e ngineering practices. Paving ~

required for any portion of the project which is to be occupied

Resolution #82-0458 dated May 4, 1982.
13. A proposed declaration of non-signif icance (a preliminary
decieion, which may be reversed, that an environmental impact
statement, an EIS, is not needed) has been administratively
issued. This inaures the applicant of a timely processing of
his/her proposal at the time of the public hearing. BUT, a
major purpose of the public hearing ie to afford the opportunity
to present the decisioo makers with infortnation as to whether or
not a poteatially SIGNIFICANT ADVERSE impact upon [he physical
environment will reault from implementatioa of the proposal,
thua resulting in the need for an EIS. However, all "extensione
of t ime" and moe t"change of cond i t ione" are exempt f rom the
provieions of SEPA; check with the Planning Department staff if

maintenance acceptable to the Spokane County 2onfng

project prior to release of building permits.
6. The applicaat shall develop subject property generally in
accordaace within the concept preaented to the Hearing Examiner
Committee. Variations when approved by the Zoning Adminiatrator
will be permitted, including, but not limited to the f ollowing
changes: Building location, landecape plans, and general
allowable uses of the permitted zone. AI1 variations must
conform to regulationa set forth in the Spokane County Zoning
Ordinance. The original intent of the development plans ehall
be maintained.

of the proposal to the adjacent residential propertiee.
c) The building height testrictioa relative to the decision of the
Zoning Adjustor would necessitate corsideration of the solar
accese and not infringe upon the neighboring residente.

F. ZONING AOJUSTOR FINDINGS
.
1) That the proposai consists of the establishment of a mini-storage
faci 1 i ty wi thi n the Restri cted Industri al Zone to be 1 ocated one (1)
foot from the si de property 1 ine whereas the Spokane County Zoning
Ordinance requi res a 10 foot setback for a two (2) story structure.
The proposed structures are greater than 16 feet hi gh thus qual i fy
as a two (2) story structure.
2) That the pmperties principally affected by the proposal lie to the
north of the project. The properties are currently zoned Agri cul tural
Suburban and are occupied by si ngle fami ly resi dences. Many of these
res i dents appeared at the publ i c hea ri ng to ob ject to the p roposed
variance. Thei r primary concerns were that the proposed structures
iocated along the rear lot line would block sunlight to the rear
yards, restrict air movement and diminish the enjoyment of their
p rope rty.
3) That the Spokane County Hearing Examiner Committee approved the re-
zoning of the property (File ZE-29-84, decided May 14, 1984) subject
to site development which would not hinder the light or air movement
and other amenities of the northerly residential property.
4) Further, the Hearing Examiner Committee has established landscaping
conditions along the northerly property line which requires the
planting and maintenance of trees. These conditions alone strongly
suggest that the minimum setbacks of the Restricted Industrlal Zone
be observed.
5) That the appl i cant desi res the proposed vari ance i n o rder to benefi t
from an existing retaining wall and masonry fence which would become
a portion of the structure's rear wall.
6) That the site lies within the Industrial Category of the Spokane
County Comprehensive Plan and is closley bordered by the Urban Cate-
ory. Goal 7.2 of the Plan and its Objectives and Decision Guidelines
~particul arly Decision Gui del ine 7.2.1, 7.2. 3, 7.2.4 ( a) ) cal l for
the development of buffer areas where industrial and residential uses
will be located near one another. The granting of the requested
variance would leave no adequate buffer area as urged in the Compre-
hensi ve P1 an.
7) The appl i cants representati ve i ndi cated that the area is i n transi ti on
f rom resi denti al to more intensi ve uses. However, the northerly
residential properties are we11 maintained and can be expected to
remai n fo r some ti me. The appl icant has al so establ i s hed a mobi 1 e
home park di rectly adrjacent the praposed mini-storage facility in- `
dicating he too finds the area to have continued residential viability.
That the granting of the proposed variance would in essence be allow-
ing the applicant a special privilege to the detriment of adjoining
properties. The appl icant in complying with the zoning ordinance wi11
still be able to use the property for the intended storage use.

G. ZONING ADJUSTOR CONCLUSIONS AND DECISION
1) The variance request is inconsistent with the Hearing Examiner
Committee decision in approving the zone request due to light, air
and aesthetic impacts and the buffering requi rements of the zone
change.

Dear Mr. Olinger:
This depa rtment has received y our 1 etter, (addendum ) addressi ng
required i tems of the Department of 6ui lding and Safety pl an
correction letter dated March 4, 1985. There are several areas in
the addendum that were not speci fi cal ly addressed. In an effort to
avoid confusion as to present and future uses of this structure, I
wili approve the plans based on the following criteria.
~
The butlding is to be used as private storage structure only. The
storagewill be restricted to only those individuals ofyour adjacent
te bi 1e home park . I f storage is expanded to i ncl ude those customers
tside your adjacent mobile home park, a separate permit and
strooms per Ttem 1 of my latter dated March 4, 1985, would be
qui red.
The interior of this structure is approved as "open space only" no
rooms, caging, or separation of space is permitted in this permit.
Therefore, ttems numbered 15, 179 20, 22, 23, 24, 25, 26, 27, 28, 36,
and 53 will not be considered nor approved in this permit inasmuch as
those items need specific plan approval. A separate plan,
approvi ng, and permit wi11 be requi red for those items or any changes
from this approval. Storage of hazardous or flammable materials is
not approved under this permtt.
Again, from what is presented, our department is reviewing and
approving this structure for a storage structure only with no future
expansions or uses.
