INTRODUCTION This matter having come before the Zoning Heering Exeminer Committee on January 20, 1983, and the members of the Committee present being Ronald L. McVicker, Chairman, Lynn Tennlcan, and Jane E. Myers. 8. PROPOSAL The sponsor, Jim Olinger, is requesting approval of a change of conditjons, File No. ZE•148-80, Restricted Industrial Zone, for the purpose of defeting or mcdifying Condition #5 of the original approval requiring a time frame for fence construction. C. FINDINGS OF FACT 1. That the existing land use in the area is residential, storage, mining, manufactured home park, and undeveloped. 2. That the Comprehensive Plan designates thjs area as appropriate for Restricted I ndustrial development. 3. That the existing =oning of the property described in the application is Restricied I ndustrial . 4. That the provisions of RCW 43.21C (The State Environmental Policy Act) have been complied with, and the Cornmittee concurs with the Declaration of Non-Significance. 5. That the proper legal requirements for advertisement of the Agenda Item have been fulfilled. 6. That the applicant has not demonstrated that conditions have substanttally changed since the originat toning of this area and accordingly, the change of conditions request is not justified. 7. That the applicant has made no attempt to construct the fence. That the applicant has exertised a right, that being the change of land use; but that the adjacent owners have a right of protection. d) That the Committee is only requiring implementation of a previously attached conditfon placed on the property at the time of the zone change approval by the 6oard of County Commissioners. Access permite for approachee to the County Road System shall be obtained f rom the Spokane County Engineer. 3. Applicant shall improve Park Road in a manner consietent with Spokane County TYPICAL roadway section No. 1 minimum paving w3dtb Major Arterial Standard. 4. Applicant shall submit for approval by the Spokane County Engiueer road, drainage, and acceas plans prior to the iseuance of a building permit on the propertq. 5. 1'he applicant shall submit for approval bq the Spokan,e County Engiaeer and the Spokane County Health District a detailed combined on-eite eewage system plan and surface water diepoeal plan for the entire project prior to the ieauance of any building permit on the property. 6. A parking plan and traffic circulation plan shall be eubmitted and approved by the Spokane County Engineer prior to the iesuance of a building permit on the property. The deaiga, location, and arrangemen[ of parking stalls shall be in eccordance with etandard traffic engineering practicee. The properties are currently zoned Agri cul tural Suburban and are occupied by si ngle fami ly resi dences. Many of these res i dents appeared at the publ i c hea ri ng to ob ject to the p roposed variance. Thei r primary concerns were that the proposed structures iocated along the rear lot line would block sunlight to the rear yards, restrict air movement and diminish the enjoyment of their p rope rty. 3) That the Spokane County Hearing Examiner Committee approved the re- zoning of the property (File ZE-29-84, decided May 14, 1984) subject to site development which would not hinder the light or air movement and other amenities of the northerly residential property. 4) Further, the Hearing Examiner Committee has established landscaping conditions along the northerly property line which requires the planting and maintenance of trees. These conditions alone strongly suggest that the minimum setbacks of the Restricted Industrlal Zone be observed. 5) That the appl i cant desi res the proposed vari ance i n o rder to benefi t from an existing retaining wall and masonry fence which would become a portion of the structure's rear wall. 6) That the site lies within the Industrial Category of the Spokane County Comprehensive Plan and is closley bordered by the Urban Cate- ory. Goal 7.2 of the Plan and its Objectives and Decision Guidelines ~particul arly Decision Gui del ine 7.2.1, 7.2. 3, 7.2.4 ( a) ) cal l for the development of buffer areas where industrial and residential uses will be located near one another. That the granting of the proposed variance would in essence be allow- ing the applicant a special privilege to the detriment of adjoining properties. There are several areas in the addendum that were not speci fi cal ly addressed. In an effort to avoid confusion as to present and future uses of this structure, I wili approve the plans based on the following criteria. ~ The butlding is to be used as private storage structure only. The storagewill be restricted to only those individuals ofyour adjacent te bi 1e home park . I f storage is expanded to i ncl ude those customers tside your adjacent mobile home park, a separate permit and strooms per Ttem 1 of my latter dated March 4, 1985, would be qui red. The interior of this structure is approved as "open space only" no rooms, caging, or separation of space is permitted in this permit. Therefore, ttems numbered 15, 179 20, 22, 23, 24, 25, 26, 27, 28, 36, and 53 will not be considered nor approved in this permit inasmuch as those items need specific plan approval. A separate plan, approvi ng, and permit wi11 be requi red for those items or any changes from this approval. Storage of hazardous or flammable materials is not approved under this permtt. Again, from what is presented, our department is reviewing and approving this structure for a storage structure only with no future expansions or uses.
