At this hearing the County engineers are recommending the vacation but at a price in excess of value and with terns that would be impossible for the ad,oining property owners rn meet. ~am asking ttze county to allow vacation of DAle Road at no charge and Ido nat feel this request is unreasonable based on the following facts : 2. Prior to listing the adjoining property, Pat Kenny, of F.S. Barrert Company, was told by the Cousity Engineers there should be no problem vacating Dale Road and most likely there would nvt be a charge. Based partly on this information, 2 purchased the adjoining property. Attached is a letter from Mr. Kenny to my agent substaatiating this. 2. According to Mr. Orville Moe, he former owner of mv property, since the County was unable to use the ~edicated property for 1ts intended use i.e., a roadway, the adjoining property owners do have the right to paxk on said property. If this is in fact true, it would seem the County is unable to sell the property ta any other user. The likely alternarive is to vacate. It does not seem reasonable for the County to charge for the vacatxon as the Couaty does not now or cannot in future use the property for the purpose it was deeded to them for. The adjoining property owners do have x need for the property and in fact are currently using it openly and without paying taxes. Most likely, no benefit to the County or the tax- payers would be derived by denying thevacation or by charging a fee that could not be paid by the adjoining property owners. In order for the property in question to be a benefit to the citizens of Spokane Cnunty, it , appears the most logical and fair process would be to allow the vacation request at no charge to the petitinners.
