being the owners of the following described lands in consideration oF Mutual
Benefits to be hereafter derived da for themselves, their heirs, grantees aad
assigns, hereby agree to the followiag:
The owaer(s) or sucreseor(s) in interest agree to suthorize Spokane County
to place their name(s) on a petitian for the formatian of a Road
Improvemeat District (RID) by Che petition method pursuant to Chapter
36.88 RCW, which petition includes the owner(s) property, and further not
to object, by the sigaiag of a ballot, to the formation of a RID by the
resolution method pursuant to Chapter 36.88 RCW, which resolution includes
the awner(s) property. If a RID, is formed by either the petition or
resolution method, as provided for in Chapter 36.88 RCW, the owner(s) or
successor(s) further agree: (1) that the improvements or construction
contemplated within the proposed RID is feasible, (Z) that the beneff.ts
to be derived from the formation of the RID by the property iacluded
theYein, together witb the amount of aay County participatioa, exceeds the
cast and expense of formation of the RID, and (3) that the property within the proposed RID is sufficiently developed. Provided, further, the
owner(s) or successor(s) shall retain the right, as suthoriZed under RCW
36.88.090, to object to any assessment(s) on the property as a result of
the improvementa called for in conjunction with the forazatioa of a RID by
either petition or resolution method under Chapter 36.88 RCW and to appeal
to the Superior Court the decision of the Board of County Commissioners
affirming the final assessment roll.
It is further agreed that at such time as an RZII is created or any Road
Improvement Project is sanctioned by Spokane County, Che imp=ovements
required (curb, aidewalk, drainage contrbl aAd paving to existiag
pavement) will be at the sole expense of the undersigaed owaer, their
heirs, grantees and assigns without pgrticipatian by Spokane County.

The above conditions and covenant apply to the follouring described property:
That portion of the Northeast Quarter (NEI) of the Northeast Quarter (NE}) of
Section 19, Township 25 North, Range 44 E.W.M., in Spokane County, Washington,
described as follows: Beg at a point 1063 fee[ West and 50 feet South of the
Northesst corner of said Section 19; thence South to the North R/W line of lst
Avenue; theace West 25 feet; thence North 50 feet; thenee West 95 feet; thence
North 150 feet; thence East 120 feet to the POB; EXCEPT that portion described
as follows: Beg at a point 9.5 feet South of the Northwesterly corner of above
described property; thence Eaet a Right Angles to the West liAe 1.7 feet; thence
South 48.6 feet; thence Weat 1.3 feet; thence North to the POB.
