(4-ez :(app,(,6,--(7040 V,7;. 7-te-ef) ZONING ADJUSTOR SPOKANE COUNTY, WASHINGTON IN THE MATTER OF CUE-35-84 & VE-133-84; KOPP ) FINDINGS OF FACT, DUPLEX IN THE AGRICULTURAL ZONE AND ) DECISION AND CONDITIONS RELAXATION OF FRONTAGE REQUIREMENTS THIS MATTER, Being the consideration by the Zoning Adjustor of Spokane County, in hearing the application (CUE-35-84 & VE-133-84), for the purpose of establishing a a duplex in the Agricultural zone hereinafter referred to as the "Proposal", and the Zoning Adjustor of Spokane County having held a public hearing on July 25, 1984 and having fully considered all testimony presented thereat, and further having visited the site and vicinity in question, and having rendered a decision on the 6th day of August, 1984, APPROVING said proposal, does hereby make the following: FINDINGS OF FACT 1. That the proposal is generally located on the northwest corner of 11th Avenue and Clinton Road in Section 25, Township 25, Range 44 E.W.M., Spokane County, PARCEL: 22544-1112. 2 . That the proposal consists of establishing a duplex on a lot having approximately 14,000 sq. ft. and a front yard of 92 feet frontage whereas Spokane County Zoning Ordinance requires 100 feet of frontage and 15,000 sq. ft. with the approval of a Conditional Use Permit. 3. That the adopted Spokane Countyy Generalized Comprehensive Land Use Plan indicates URBAN usage of the area encompassed by the proposal. 4. That the site is zoned Agricultural. 5. That the existing land uses in the area of proposal include single family residences and duplexes in the general area. 6. That the proposal conforms to all setback requirements of the Spokane County Zoning Ordinance and further is consistent with development density in the area and in the County Comprehensive Plan Urban Category. 7. That the County departments reviewing the proposal generally indicate that no adverse impacts are anticipated if the proposal is approved. 8. That the proposal does not appear to be detrimental to adjacent properties nor have an adverse impact upon the property and improvements in the area. 9. That no one appeared to oppose the proposal nor were any written comments adverse to the proposal received. 10. That the proper legal requirements for advertising of the hearing before the Zoning Adjustor of Spokane County have been met. CONCLUSION Following review of the Planing Department file, consideration of the public testimony, and circumstances in the area of proposal, the Zoning Adjustor concludes that the proposal is not detrimental and is compatible to the public health, safety, welfare and consistent with the Spokane County Comprehensive Plan. J a • I FINDINGS OF FACT, DECISION AND CONDITIONS ' CUE-35-84 & VE-133-84 PAGE 2 DECISION From the foregoing Findings, a review of the Planning Department File No. CUE-35-84 & VE-133-84, testimony at the public hearing, and a site visit, the Zoning Adjustor hereby in APPROVING the proposal establishes the following conditions: A. CONDITIONS OF APPROVAL 1) The proposal shall be developed consistent with all building setbacks for this zone (Agricultural) . 2) The Owner(s) , or Successor(s) in interest agree to authorize the County to place their name(s) on a petition for the formation of a ULID by petition method pursuant to RCW 36.94 which the petition includes the Owner(s) property and further not to object by the signing of a protest petition against the formation of a ULID by resolution method pursuant to RCW Chapter 36.94 which includes the Owner(s) property. PROVIDED, this condition shall not prohibit the Owner(s) or Successor(s) from objection to any assessment(s) on the property as a result of improvements called for in conjunction with the formation of a ULID by either petition or resolution method under RCW Chapter 36.94. 3) Each dwelling unit shall be double plumbed for connection to future area-wide collection systems. 4) Sewage disposal method shall be as authorized by the Director of Utilities, Spokane County. 5) Subject to specific application approval and issuance of permits by the Health Officer, the use of an individual on-site sewage system may be authorized. 6) Water service shall be by an existing public water supply when approved by the Regional Engineer (Spokane), State Department of Social and Health Services. 7) Use of private wells and water systems is prohibited. 8) All buildings and structures require building permits as per Section 301 of the Uniform Building Code.
