DEDICATION
KNOW ALL MEN BY THESE PRESENTS, that Gerald R. Pelley
and Delores Pelley, husband and wife and The Secretary
of Housing and Urban Development have caused to platted
into lots, block and streets the ].and shown hereon as
"SHORT PLAT SP-647-90" and described as follows:
The North 158 feet of Lot 4 in Block 26 of CORBIN ADD-
ITION TO GREENACRES, as per plat thereof recorded in
volume "S" of Plats, page 30; EXCEPT the East 20 feet
AND EXCEPT the North 20 feet of the East 20.feet of the
of the West 166 feet; Situated in the County of Spokane,
State of Washington.
NO more than one (1) dwelling structure shall be
placed on any lot, nor shall any lot be further
ubdivided for the purpose of creating additional
lots, ownerships or building sites without first
filing and receiving approval of a replat.
The owner(s) or successor(s) in interest agree to
authorize the County to place their name(s) on a
petition for the formation of a Road Improvement
District (Rip) by the petition method pursuant Lo
ChaLs:,er 36.85 RCW, which petition includes the
owner(s) prooety, and father not to obiect, by
the signing f a ballot, to the formation of an
flD by the rsesolution method pursuant to Chapter
36.88 RCW, wlich resolution includes the owner(s)
property. If an RID is formed by either the petition
or resolution method as provided for in Chapter
36.66 RCW, Lie owner(s) or successor(s) further
agree:
(a) that the improvement( s) or construction
contemplated within the proposed RID is feasible;
(b) that the benefits to be derived from the
formation of the RID by the property included
therein,togeoher with the amount of any County
participation, exceed the cost and expense of
formation of the RID; and
0 that the property within the proposed RID
sufficiently developed.
Provided further that the owner(s) or successor(s)
shall retain the right, as authorized under RCW
• 36.86.090,to object to any assessment(s) on the
property as as result of the improvements called
f or in conjunction with the formation ot an RID
by either petition or resolution method under
Chapter 36.86 RCW, and to appeal to the Superior
court the decision of the Poard of County Comm
issioners af!Arming the final assessment roll.
It Is further agreed that at such time as an RID
is created or any Road Improvement Project is
sanctioned by Spokane County, the improvements
required (curb, sidewalk, drainage control and
paving) will be at the sole expense of the under-
signed owners), their heirs, grantees and assigns
without participation by Spokane County.
The RID waiver contained in this agreement shall
expire after ten (10) years from the date of
execution below. However , the owner(s) or succ
essor(s) agree that: if said RID waiver expires
without construction of the required improvements,
the owner(s) or successor (s) agree Lo construct
the requited improvements at their own expense,
pay to Spokane County the then estimated cost of
the required improvements to enable the County to
compJete the same, or furnish a bond or other
secure method suitable to the County (which may
inctude the execution of another RID waiver agree-
ment) providing for or securing to the County the
the actual cc of the improvements.
All the requirements of this agreement shail run
with the land and shall be binding upon the
owner(s), thcir successor(s) or assign(s).
Subject to specific application approval and
issuance of permits by the Health Officer, the
use of individual on-site sewage systems may be
authorized.
Use of private wells and water systems is
prohibited.
The public water system as approved by County and
state health authorities and the local fire
district and purveyor, will be installed within
this plat, and the subdivider will provide for
individual domestic water service, as well as fire
protection, to each tract prior to sale of each
tract.
The owner (s) or successor(s) in interest agree t.o
authorize the County to place their name(s) on a
petition for the formation of ULID by petition
method pursuant to RCW 36.94, which the petition
includes the owner(s) property;and futher not to
object by the signing of a protest: petition against
the formation of a ULID by resolution method pursuant
Lo PCW Chapter 36.94 which includes the owner(s)
property. PROVIDED this condition shall not prohibit
the owner(s) or successor(s) from objecting to any
assessment(s) on the property as a result of improve-
ments called for in conJunction with the formation of
a ULID by either petition or resolution method under
RCW :16.94.
Each new dwelling unit shall be double-plumbed for
connection to future areawlde collection systems.
The owner(s) hereby dedicate forever for public
street purposes the roadways shown hereon within
the plat boundary.
Subject to a certain contract, dated July 5, 1923,•
recorded in Volume "X" of MIscellanous, nage 283.
Subject to restrictions imposed by Instrument re-
corded on December 10, 1929, under Recording No.
A 17659.
S ide yard and rear yard setbacks shall be determined
at the time building permits are requested. the set-
backs indicated on this plat may be varied from if
proper zoning approvals are obtained.
