Pelley and Delores Pelley, husband and wife have caused to platted into lots, block and streets the land shown hereon as "SHORT PLAT SP---647-90" and described as follows: The North 158 feet of Lot 4 in Block 26 of CORBIN ADD- ITION TO GREENACRES, as per plat thereof recorded in Volume "S" of Plats, page 30; EXCEPT the East 20 feet AND EXCEPT the North 20 feet of the East 20 feet of the of the West 166 feet; Situated in the County of Spokane, State of Washinejton. The owner( or euccessor(s) in interest agree to authorize the County to place their name(s) on a petition for the formation of a Road Improvement District (RID) by the petition method pursuant to Chapter 36.88 RCW, which petition includes the owner(s) preperty,and further not to object, by the signing of a ballot, to the formation of an RID by the reselution method pursuant to Chapter 36.66 RCW, which resolution includes the owner( property. If an RID is formed by either the petition or resolution method as provided for in Chapter 36.88 RCW, the owner(s) or uccessor(s) further agree: (a) that the improvemeht(s) or con truction contemplated within the proposed RID is feasible (b) that the benefits to be derived from the formation of the RID by the property included therein,together with the amount of any County participation, exceed the cost and expense of formation of the RID; and (c) that the property within the proposed RID is sufficient eloped. Provided further that the owner(5) or successor( shall retain the right, as authorized under RCW 36.98.090,to object to any assessment(s) on the property as result of the improvements called for in conjunc with the formation of ark RID by either petition or resolution method under Chapter 36.8 RCW, and to appeal to the Superior Court the deci5ion of the Board of County Comm- issioners affirming the final assessment roll. It is further agreed that at such time as an RID is created or any Road Improvement Project is sanctioned by pokane County, the improvements required (cur idewalk, drainage control and paving) will be at the sole expense of the under- signed owner(s), their heirs, grantees and assigns without partpation by Spokane County. The RID waiver contained in this agreement shall expire after ten (10) years from the date of execution beiew. However, the owner(5) or succ- essor(s) agree that if said RID waiver expires without construction of the required improvements, the owner(s) or euccessor(s) agree to construct the required improvements at their own expen5e, pay to Spokane Ceunty the then estimated cost of the required improvements to enable the County to complete the '3ame, or furnish a bond or other secure method suitable to the County (which may include the execution of another RID waiver agree- ment) providing for or securing to the County the the actual construction of the improvements.
