RE: Letter from Stan Schultz with ' respect to Preliminary Plat
No. 85-355
Attached please find a letter which was directed to my attention
with respect to the above captioned matter. I believe that the
letter is self erplainatory.
Based on the policy of the County Commissioners to facilitate the
development of properties in Spokane County consistent with state
law, I am forwarding the orginal of the letter to Jim Manson with
direction that it be placed in his files ,and that the property he
issued building permits consistent with the request in the
letter .
In my judgement , legally , we have the ability to issue the
building permits under RCW 58 . 17 . 210 ona finding that it is not
contrary to public health,' safety and welfare.

Re: Building Permits for Short Plat No. 85-355
Dear Mr. Emacio:
Consistent with our discussions regarding the above-referenced
Short Plat, this letter will constitute the Tupper , Inc. ' s
agreement to the following conditions for issuance of building
permits on Parcel C and Parcel B of Short Plat No. 85-355.
As a matter of background information, preliminary to the
enumeration of specific conditions, the need for this agreement
arises out the following facts and circumstances : Short Plat
No. 85-355 was preliminarily approved with the understanding
that each of the three parcels in the Short Plat would contain
a minimum of 12, 500 square feet, the minimum lot size in the
agricultural zone. Due to an innocent mistake, it appears that
only Parcel C complies with this 12, 500 square foot lot size
requirement. In addition, it appears that certain variances
may be necessary on at least Parcel C to allow variations in
the front yard set back. Based on the approval of the
preliminary Short Plat, Tupper, Inc. , has proceeded to obtain
FHA approval . The final plat of Short Plat No. 85-355 cannot
be filed until the parcels are brought into conformance with
the Zoning Code either through rezone and/or variance
procedures .
In consideration of Spokane County immediately issuing building
permits for Parcel C and Parcel B of Short Plat No. 85-355 ,
Tupper, Inc. , agrees to the following conditions :

1 . Prior to finalization of the plat of Short
Plat No. 85-355 , Tupper, Inc. , shall obtain a zone change
and/or variances as applicable for all parcels in the
Short Plat. Tupper, Inc . , represents that it has , prior
to this date, made application for these zone changes and
variances and the same are scheduled for hearing April 24 ,
1985.
2 . That no Certificate of Occupancy shall be issued nor shall
third-party purchasers be allowed to occupy the houses to
be constructed on Parcels B and C prior to finalization of
}
the plat.
3 . That Tupper, Inc. , will indemnify and hold Spokane County
harmless from any and all claims, actions or judgments
against Spokane County arising from or connected with the
issuance of said building permits.
4 . Tupper, Inc. , hereby waives any right of action or cause
of action against Spokane County arising out of or
connected with the issuance of building permits on
Parcels B and C of Short Plat No. 85-355 .
5 . Tupper, Inc . , understands and agrees that if said zone
changes and variances are not obtained, then lot line
adjustments and redesign of Short Plat No. 85-355 shall be
completed forthwith which may prevent construction on
Parcel A.
We believe this sets forth the conditions necessary for
immediate issuance of the building permits for Parcels C and B
on Short Plat No. 85-355. Please review and advise at your
earliest convenience. Tupper, Inc. would like to obtain these
building permits on Monday, March 17 , 1986 .
Thank you for your cooperation and kind consideration on this
matter.
