FINDINGS AND ORDER REGARDING ZOIVING MAP PROPOSAL, ZE-4-74 -
RESIDENTIAL OFFICE TO LOCAL BUSINESS: MAGLARAS

WHEREAS, The Spokane County Planning Commission did, after public
hearing on February 8, 1974, forward to the Board of County Commissfoners a
recommendation that the Zoning Map not be chanqed trom the existing Residentfal
Office classification to the Local Business classification on property described as
follows:
The North 107 feet of the East 196.08 feet of the S 1/2 of Block 76,
Opportunity in Section 16, Township 25 N., Range 44, E.W.M.,
Spokane County, Washington.
and,
WHEREAS, The applfcant before the Planning Commis sion, Gus Maglaras ,
did by letter dated February 13. 1974, request a hearing before the Board of County
Commissioners to present evidence and testimony in favor of their application, and
WHEREAS, The Board of County Commissioners did hold a public hearing on
March 14, 1974, to consider the recommendations of the Planning Commission and ~
testfmony and evidence of the applicant and other interested parties, and
WHEREAS, At said hearing apportunity was afforded those favoring and
those opposing the above-described Zonfng Map proposal, and the Board of
County Commissioners of Spokane County havfng fully considered the testfmony
given, the records and minutes o€ the Planning Commission and all other evidence
presented and havfng personally acquainted themselves with the site and vicinity
in questfon, does hereby find:
1) That the site consists of a 21,000 sq, ft. parcel situated on the west
side of Pi nes Road between Cataldo and 8roadway Avenues.
2) That the applicant proposed to construct a nursery, garden store on
the property utilizing portions of existinq structures.
3) That the property is south of an office complex and southwest of a
neighborhood shopping area.
4) That the proposed use, namely, a garden store and nursery, !s not our
of character with other uses established along Pines Road.
5) That appropriate provisions have been made to assure compatibility of
the project with adjoining properties throuqh preparation of a specific
development plan.
6) That an environmental assessment of the project indicates that
sufficient mitigating measures have been incorporated into the approved
development plan.

NOW, THEREFORE, The Board of County Commissfoners does hereby conclude
that the above-described property should be reclassified in the Local Business

classification and does hereby order that an appropnate resolution for that purpose
be prepared; such resolution ku specify that the development of the property shall

the Board of County Conimissioners.
