FINDINGS AND ORDER
A. I NTRODUCTtON
This matter having come before the Examiner Committee on December 10, 1981,
and the members of the Committee present being Jane Myers, Acting Chair-
person, Kathleen Carstens and Jerry Wi I I iams .
B. PROPOSAL
The sponsor, Norm Sylvester, is requesting approval of a Change of Conditions,
Fife No. ZE-170A-78, Local Business Zone (Approval of a modified site plan), for
the purpose of developing a Zip Trip Service Station and Store.
C. FINDINGS OF FACT
1. That the existing land use in the area is residential and vacant.
2. That the Comprehensive Plan designates this area as appropriate for
Commercjal, adjacent to Pines RQad and the westerly area becoming Urban.
3. That the existing zoning of the property descrjbed in the application is
Local Business.
4. That the proper legal requirements for advertisement of the Agenda Item
have been fulfilled.
5. That the land in this area is suitable for the proposed use, or uses within
the proposed Zone Classification.
6. That the applicant has demonstrated that conditions have substantially
changed since the original zoning of this area and accordingly, the pro-
posed rezone is justified.
7. That the proposed use is compatible with existing uses in the area.
8. That the owners of adjacent lands expressed both approval and disapproval
of the proposed use.
9. The Hearing Examiner Committee finds the proposed use to be in harmony
with the general purpose and will not be otherwise detrimental to the public

D. CONDITIONS OR CONTINGENCIES APPLlED TO THIS APPROVAL
a) COUNTY PLANNiNG DEPARTMENT
1. That the Local Business part of site plan (ZE-170A-78) approved
March 6, 1980, be voided, and that the applicant submit a revised
site plan showing his property with landscaping and the undeveloped
portion of the remaining Local Business Zone.
2. The Zoning Administrator shall approve a specific exterior lighting
plan for the approved area prior to installation of such lighting. (Such
plan shafl attempt to confine illumination to the area with full con-
srderation to adjacent properties).
3. No free-standing sign on the premises shall exceed forty (40) square
feet in area or thirty-five (35) feet in height. Ail signs may be
illuminated provided that they shall not be animated nor flashing and
shall be of low intensity, not exceeding the equivalent of four hundred
twenty-five (425) milliamperes flourescent tubing behind plexiface,
spaced on seven (7) inch or more centers, or of exposed neon not
exceeding thirty (30) milliamperes.
4. Direct light from any exterior area Iighting fixture shall not extend
over the property boundary.
5. All current standards of the Local Business Zone, as amended, shall
be complied with in the development of this site.
6. The applicant shall compty with RCW 58-17 and the Spokane County
Platting Ordinances prior to issuance of building permits.
7. That the landscaping provtsion shall be reviewed by the Zoning
Administrator to blend consideration of safety factors in relation
to access to the property as well as providing a sufficient buffer
for the neighboring residences along Maxwetl Avenue.
8. That the appl icant shall comply with 1208' recommendations for
controlling spills and containing stormwater runoff.
b) COUNTY ENGI N EER 1 NG DEPARTMENT
As previously approved:
1. Applicant shall dedicate a 20 foot radius on Pines Road and Maxwell
Avenue.
2. Applicant shall dedicate half (25 feet) of the proposed Sinto Avenue
extension as shown on the approved plot plan and a 20 foot radius on
Pines and proposed Sinto Avenue extension.
3. Applicant shall construct cement concrete curb, sidewalk and pave to
the existing pavement on Maxwell Avenue.

b) COUNTY ENGINEERING OEPARTMENT (continued)
4. Applicant shall construct cement concrete sidewalk on Pines Road.
5. Access permits and improvements to Pines Road must be approved by
the Washington Department of Transportation.
6. Appiicant shall construct cement concrete curb, sidewaik and pave half
(20 feet) of the proposed Sinto Avenue extension. At the time of
construction, if the property owners to the south are not prepared to
construct their half of the roadway, then the applicant shall pave an
additional 10 feet on the proposed Sinto Avenue extension.
7. An appropriate off-site drainage disposal system and access
plans shall be approved by the Spokane County Engineer's Office
prior to the issuance of building permits for the project.
8. A detailed combined on-site sewage system and surface water
• disposal plan for the entire project shall be approved by the
Spokane County Engineer and the Spokane County Nealth
District prior to the issuance of any building permtt.
9. The design, location and arrangement of parking stalis shall be
in accordance with standard traffic engineering practices. (Any
portion of the project which is to be) occupied or traveled by
vehicles shall be maintained in hard surface paving.
c) COUNTY UTI LITI E5 DEPARTMENT
:
1. Pursuant to Board of County Commissioners Resolution No. 80-0418,
the use of on-site sewer disposal systems is hereby authorized. This
, authoriiation is conditioned on campliance with all rules and regulations
of the Spokane County Health District and is further conditioned and
subject to specific application approval and issuance of permits by the
Heaith Oistrict.
2. The owner, his heirs or successors shall join and participate in any
petition or resolution which purpose is the formation of a utility local
improvement district (ULID) pursuant to RCW, Chapter 36.94, as
amended. The owner, his heirs and successors shall further agree not
to oppose or protest any legal assessments for any utility Iocal
improvement district (ULID) established pursuant to RCW Chapter
36 . 94, as amended.
3. Any water service for this project shalt be provided in accordance with
the Coordinated Water System Plan for Spokane County.
4. Water service as approved by Spokane County Health District
and/or Washington State Department of Social and Health
Services.

d) COUNTY HEALTH DISTRICT
1. A combined surface water and sewage disposal detailed plan shall be
approved by the County Engineer and the Health District prior to the
issuance of any building permit for this project.
2. Sewage disposel method shall be as authorized by the Director of
Utilities, Spokane County.
3. Subject to specific application approval and issuance of permits by the
Heaith Officer, the use of an individual on-site sewage system may be
authorized.
4. Water service must be coordinated through the Director of
Utilities, Spokane County.
5. Water service shall be by an existin public water supply when
~ approved by the Regional Engineer ?State Department
of Social and Health Services.
6. Use of private wells and water systems is prohibited.
e) COUNTY BUILDING AND SAFETY DEPARTMENT
1. The site is located in Fire District #1.

2. Adequate water for fire protection and distribution must be approved
by the Fire District prior to development.
f) WATER PURVEYOR
1. Water service is to be approved by Modern Electric Water Company.
g) SPOKANE COUNTY FIRE PROTECTION DISTRICT NO. 1
1. Mains and hydrants need to be installed. Access plans for fire-
fighting equipment around the building shall be approved prior
to building permit issuance.
