HEARING EXAMINER COMMITTEE
FINDINGS ANO ORDER
A. INTRODUCTION
This matter having come before the Examiner Committee on September 10, 1981,
and the members of the Committee present being Kathieen Carstens, Chair-
person, Eidon Thomas, and Jerry Williams.
B. PROPOSAL
The sponsors, Darroll Waller and Robert Lyons, are requesting approval of a
Zone reclassification, Fiie No. ZE-79-$1, Agricuitural Suburban to Commercial,
for the purpose of continuing auto service and repair.
C. FINDINGS OF FACT
1. That the existing land use in the area is residential, commercial, Freeway,
and vacant.
2. That the Comprehensive Plan designates this area as appropriate for Major
Commercial development.
3. That the existing Zoning of the property described in the application is
Agricultural Suburban.
4. That the provisions of RCW 43.21C (The State Environmental Policy Act)
have been complied with, and the Committee concurs with the Declaration of
Non-Sjgnificance.
5. That the proper legal requi rements for advertisement of the Agenda I tem
have been fulfilled.
6. That the land in this area is suitable for the proposed use, or uses within
the proposed Zone Classifjcation.
7. That the applicant has demonstrated that conditions have substantially
changed since the original zoning of this area and accordingly, the pro-
posed rezone is justified.
8. That the proposed use is compatible with existing uses in the area.
9. That the owners of adjacent lands expressed disapproval of the proposed
use.
10. The Hearing Examiner Cammittee finds the proposed use to be in harmony
with the general purpose and will not be otherwise detrimental to the public
health, safety, and welfare.
11. The following are additional findings of fact considered by the Hearing
Examiner Committee:
a) That the proposed re=one extends the commerciaily zoned property
already in existence in the surrounding area.

D. CONDITIONS OR CONTINGENCIES APPLIED TO THIS APPROVAL
a) COUNTY PLANNING DEPARTMENT
1. The Zoning Administrator shall approve a specific exterior
lighting plan for the approved area prior to installation of such
lighting. (Such plan shall attempt to confine illumination to the
area with fuli consideration to adjacent properties).
2. A 6-foot sight-obscuring barrier shall be provided along the western
line of this proposal to provide a buffer for the existing residential
use located immediately west of this site.
3. A specific landscape plan, planting schedule and provisions for main-
tenance acceptable to the Spokane County Zoning Administrator shali
be submitted with a performance bond for the project prior to release
of building permits.
4. Applicant shall comply wjth 1208' recommendations concerning storm-
water runoff and provide necessary landscaping for runoff.
5. The applicant shall comply with RCW 58-17 and the Spokane County
Platting Ordinances prior to issuance of building permits.
6. That the provisions of SEPA's NOTICE OF ACTION pursuant to
Chapter 43.21C.080 RCW and the Board of Spokane County Commfs- ,
sioners Resolution #77-1392 be initiated by the project applicant within
thirty (30) days of final disposition of this application, and prior to
any on-site improvements.
7. Pursuant to the provisions of Chapter 43.21C RCW, the SEPA Guide-
lines (WAC 197-10) and the Spokane County Environmental Ordinance
(SCEO), a proposed declaration of non-significance has been issued at
least fifteen (15) days prior to this date; the official file, written
comments and/or public testimony contain information regarding assess-
ment of the proposal's adverse impacts to the physical environment; a
finding is hereby made that no potentially signlficant adverse impacts
upon the physical environment are anticipated as a result of the
project; and a final declaration of non-significance is hereby to be
issued.
8. All current standards of the Commercial Zone, as amended, shall
be complied with in the development of this site.
b) COUNTY ENGINEERING DEPARTMENT
1. Applicant shall dedicate a 20 foot radius on Mission Avenue and SR-27
(Pines) prior to any use of the property.
2. Access permits and improvements to SR-27 must be approved by the
Washington Department of Transportation.

3. Applir.ant shali construct cement concrete curb and sidewalk and pave
Lo the existing pavement adjacent to the property on Mission Avenue
and Maxwell Avenue.
4. Applicant shall submit for approval by the Spokane County Engineer
road, drainage, and access pians prjor to the issuance of a building
perrnit on the property.
5. The appticant shall submit for approval by the Spokane County
Engineer and the Spokane County Heaith District a detailed combined
on-site sewage system plan and surface water disposal plan for the
entire project prior to the issuance of any building permit on the
property.
6. A parking plan and traffc circulation plan shall be submitted and
approved by the Spokane County Engineer prior to the issuance of a
building permit on the property. The design, iocation, and arrange-
ment af parking stalls shall be in accordance with standard traffic
engineering practices. Paving or surfacing as approved by the
County Engineer, will be required far any portion of the proJect which
is to be occupied or traveled by vehicles.
7. The word "applicant" shall include the owner or owners of the
property, his heirs, assigns, and successors.
8. As an alternative method of constructing the raad improvement
stated herein, the applicant may, with the approval of the
County Engineer, accocnplish the road improvements stated herein
by joining and participating in a County Road Project (CRP) to
the extent of the required road improvement. Spokane County
will not participate in the cost of these improvements.
9. The construction of the road improvements stated herein shall be
accomplished as approved by the Spokane County Engineer.
10. All required improvements shall conform to the current State of
Washington Standard Specifications for Road and Bridge
Construction, and other applicable county standards and/or
adopted resolutions pertaining to Road Standards and Stormwater
Management in effect at the date of construction, unless other-
wise approved by the County Engineer.
c) COUNTY UTILITIES DEPARTMENT
1. Pursuant to Board of County Commissioners Resolution No. 80-0418,
the use of on-site sewer disposal systems is hereby authorized. This
authorization is conditioned on compliance with all rules and regulations
of the Spokane County Health District and is further conditioned and
subject to specific application approval and issuance of permits by the
Health District.

c) COUNTY UTtLITIES DEPARTMENT (continued) 2. The owner, his heirs or successors shall jain and participate in any
petition or resolution which purpose is the formation of a utiljty local
improvement district (ULID) pursuant to RCW, Chapter 36.94, as
amended. The owner, his heirs and successors shall further agree not
to oppose or protest any legal assessments for any utility local im-
provement d+strict (ULIO) estabtished pursuant to RCW Chapter 36.94,
as amended.
3. Any water service for this project shall be provided in accordance with
the Coordinated Water System Plan for Spokane County.
d) COUNTY HEALTH DISTRICT
1. Water service must be coordinated through the Director of Utilities,
Spokane County. 2. Water service shall be by an existing pubiic water supply
when approved by the Regional Engineer (Spokane), State
Department of Social and Health Services.
3. Use of private wells and water systems is prohibited.
4. Sewage disposal method shal I be as authorized by the Di rector of L
Utilities, Spokane County.
5. Subject to specific application approval and issuance of permits by the
Health Officer, the use of an individuai on-site sewage disposal system
may be authorized. As of June 1, 1981, a moratorium has beecr placed
on the practice of installing subsurface sewage dfsposai systems under
paving.
6. A combined surface water and sewage disposal detailed plan shall be
approved by the County Engineer and the Health Oistrict prior to the
issuance of any building permit for this project.
e) COUNTY BUILOING AND SAFETY DEPARTMENT
1. The site is located in Fire District #1.
2. Mains and hydrants need to be installed in accordance with the
Spokane County Department of Building and Safety. Access plans for
firefighting equipment around the building shall be approved prior to
building permit issuance_
3. Reclassification of an existing building shall require an applf-
cation for change of occupancy permit, and subsequent inspec-
tion for approval.

f) WATER PURVEYOR
1. The proposal falls wlithin the boundaries of Modern Electric Water
Company who has indicated that they are able to serve thjs project.
They are now serving the site and can continue to serve it.
g) WASHINGTON STATE DEPARTMENT OF TRANSPORTATION
1. That a 35-foot building setback from the existing rlght of way on
Pines Road be established prior to any" building construction.
E. ORDER ,
The Hearing Examiner Committee, pursuant to 'the aforementioned, finds that the
application of Darroll Waller and Robert Lyons, for a zone reclassification as
described in the application should be approved.

SCOPE/PROJEGT DESCRIPTION:
I. General Overview - The applicant is proposing the construction
of a convenience store and muffler shop. Circle K will occupy the
convenience store and a local family business will occupy the
muffler shop. The balance of the property will be developed at a
later date.
It was stated that the applicant had submitted two proposals and the
second of the two would be used.
II. Construction Schedule - Construction is scheduled to begin as
soon as possible.
SUMMARY OF DEPARTMENTAL REQIIIREMENTS:
I. Planning Department (456-2205)
A. Discussion/Requirements
1. It was stated that the property is located within a
commercial zone which was subject to a zone change, number
ZE-79-81.
2. It was noted that the parking as illustrated is
adequate.

8. Permit Release Requirements
1. There are several conditions applicable to the zone
change, all of which must be satisfied prior to issuan+ce
of the permit. The canditians are as follows:
a. Exterior lightinq and signage plans are required
to be submitted. It rr►tas noted that signage must be
approved by the State i7epartment af Transportati.on.
b. Compliance with 02081 require.ments must be
satisfied.
c, A Zandscape glan which illustrated the size,
types anci quantities is required tv be submittea for
' review and apgraval.
d. An estimate fram a nursery for landscaging must
be submitted, along with a promissory letter to
install la.ndscaping is required.
e. An ASA Notice tv the Public xttust be recorded at
the County Auditar' s Of fice .
f. A six foot sight obseurring barrier shaZl be
provided along the west boundary of the site.
2. A Certifi.cate vf Exemptian must be filed at the
Planning Department in order to combine the numervus
paraels into ane.
3. A revised site plan illustrating the canopy and the
required setbacks frvm the prvperty line must be
submitted.
II. Engineering (456-3+600)
A. Discussion/Requirements
I.. A copy of contments was gaven to the app►licant and
Building and Safety by Bab McCann.
2. It was noted that Jack Finney and the CourYty
Engineer's Office may be contacted in arder to find the
cvntact person for the State Department of Transportatfon
far information on alignment far the 20 foat radius at
Miss ion and Fines.

B. Permit Release Requirements
1. A drainage plan with calculations, which has been
prepared in compliance with Spokane County "Guidelines for
Stormwater Management" must be submitted and approved.
2. Right-of-way dedication consisting of 20 feet is
required on Pines Road and Mission Avenue. A copy of the
property deed must be submitted in order to prepare the
docwnents for dedication. The deed may include the
present legal description.
3. Plans for street improvements on Maxwell Avenue which
have been prepared by an engineer must be submitted for
review and approval. The applicant indicated that raad
%improvements would be made around the entire site. The
applicant may choose to bond the improvements.
4. Approach perntits must be obtained from the State
Department of Transportation for approaches on Pines Road.
Permits for approaches on Mission and Maxwell must be
obtained from the County Engineer's Office.
III. Health District (456-6040)
A. Discussion/Requirements
l. It was noted that there are several on-site sewage
systems and numerous drywells. These drywells must be
drained, filled with pea gravel, removed or crushed.
2. All debris on site due to demolition must be taken to
a licensed landfill when disposed of.
3. It was noted that a food service permit will be
required for the food service facility.
4. This project will connect to valley sewer.
B. Permit Release Requirements
1. A full set of plans and specifications for the food
service facility is required to be submitted for review
and approval. It was noted, there is a fee for this plan
review.
2. The Health District requires that a Critical
Materials list be submitted to Building and Safety.

IV. Utilities Department (456-3604)
A. Discussion/Requirements
1. The utilities Department was not present, however,
comments were submitted prior to the conference.
2. A sewer connection permit will be required to be
obtained at the time of connection.
B. Permit Release Requirements
1. The Utilities Department will sign off the permit.
VI. Building and Safety (456-3675)
A. Discussion/Requirements
1. It was noted by the applicant that future plans for
the remainder of the site are not known at this time.
2. It was noted that the plans are preliminary. The
plan review has not been completed at this time. Upon
completing the plan review a letter will be sent to the
applicant which will outline all requirements.
3. The applicant needs to contact Fire District No. 1
regarding fire flow requirements and hydrant locations.
4. Double containment for the tanks will be required.
5. The possibility exists that soil compaction tests may
be required to be completed by a Testing Laboratory if
footings are located over fill material. Building and
Safety should be contacted after demolition in order to
determine this requirement.
B. Permit Release Requirements.
1. A Critical Materials List is required to be
submitted.
2. The plans were preliminary in nature, therefore, a
complete plan review could not be done. Upon completion
of a full plan review and approval by Building and Safety
the permit will be released.

drywells on the site.
APPLICANT•8 COMMEII'1'B/ACRNOAL$DGEMRNT:
l. The applicant requested clarification on the planting strips
alonq Pines Road. That in order to use a 5 foot wide strip 2 feet
would be located on State riqht-of-way. John Pederson indicated
that the landscaping condition required a minimum 3 foot wide strip.
2. A1so reqarding demolition of the buildings any asbestos found,
the applicant is to contact Spokane County Air Pollution Control
Authority.

The applicant acknowledged that all conuaents/requirements were
understood. The applicant had no further questions at this time
regarding permit requirements.
CORRECTIONS:
To Yninutes or changes from what appears in the minutes, we should be
notified within one day of your receipt of these minutes.
To plans as required by any or all of the above-listed departments
shall be submitted in sets of 7 to Building and Safety who will then
distribute accordingly to each department.
AD.7oURNMENT: There being no further business, Tom Davis thanked the
applicant and the departments for their participation and reminded
all that he should be contacted if there are any unforeseen problems
which may arise.
