Splash-Down Concessions is desiring to be open ta the public on
May 28, 1983, and thus needs to obtain a permit from Spokane
County to operate its facility.

THIS MATTER, Being the consideration b the Zoninq Adjusto r of Spokane
County, approving the application (CUE-5- 83~, for the purpose of establishinq
a communi ty watersl ide, concessions and off-street parking facil it,v, herein-
after referred to as the "Proposal", and the Zoning Adjustor of Spokane County
havi nq hel d a publ i c heari nq on Apri 1 1, 1983 and havi nq ful ly consi dered al l
testi mony presented thereat, and further having vi si ted the si te and vi ci ni ty
in question, and having rendered a decision on the 6th day of April , 1983,
approvinq sai d proposal, does hereby make the fol lowina:
FINDINGS OF FACT
1. That the proposal is qenerally located in Valley Mission Park, east
of Pie rce Road, adjacent and north of Mission Avenue. Parking area is south
of Mission Avenue. Parcel #'s 09543-0606 and 16542-0324.
2. That the oroposal consists of a conditional use request for a com-
muni ty watersl i de, hot tubs, and smal l concession area as wel l as a condi ti onal
use request for an associated 228 car off-street parking facility across
Mission Avenue from the slide and park area.
3. That the adopted Spokane County Generalized Comprehensive Land Use
Plan indicates Urban usage of the area encompassed by the proposal.
4. That the site is zoned Agricultural-Suburban and Agricultural.
5. That the existing land uses in the area of proposal include the exist-
ing Valley Mission Park, single family residences to the south of the parkinq
area, multiple family residences to the southeast, single family residences to
the west and the park and Interstate 90 to the north.
6. That the appl i cant submi tted an Envi ronmental Checkl i st whi ch was re-
viewed by the Zoninq Ad,justor and a Preliminary Declaration of Non-Siqnificance
was issued for this Qroject on March 15, 1983. The Proposed Declaration was
ci rculated to thi rteen local and state aqencies for comrnents and concerns re-
qardinq the aroposal. No aqencies have recommended that the Proposed Oeclaration
be changed.
' 7. The applicant has entered into a lease aqreement with Spokane County
~ whi ch al l ows for the operati on of the watersl i de acti vi ty on County property sub-
ject to certain conditions.
8. That the wateslide activity is proposed to ope rate on 100 day seasons
beqinning on Memorial Day (May 30) and concludinq on Labor Day. The daily
ope ration of the slide activity would run from 10 a.m. to 10 p.m.
9. To handle traffic at the park, the applicant p roposes development of
a pa rking area of initially 2.5 acres which may be expanded to 5 acres if
warranted by parki ng demand.
10. That the p roposal is a Conditional Use within the Agricultural-Suburban
zone under Sections 4.24.300 and 4.24.310 of the Spokane County Zoninq 0 rdinance.
Additionally, the proposed uses compiy with the dimensional and location standards
for these uses as noted in Zoning Ordinance Provision 4.24.300 (a) (2) (1); mini-
mum lot size: 12,500 square feet, and 4.24.310 (b) (1); minimum lot size; 7,500
square feet, (b) (2) [the parking area must abut or be directly across the street
from the property served by the parking area].
11. Publ i c testimony from more than a dozen res4dents voi ced stronq concern
over the development of the waterslide and parking facility. Chief concerns
were that the praposal is a commercial use in a residential area. The parking
lot which is located near residential uses will not be compatible with them due
to noise, litterinq, liqhts and substantially increased traffic.

12. The description of the proposal establishes that the proposed water-
sl i de faci 1 i ty i s primari ly a recreational venture consistent with other park
and playqround activities. Further, this use has been found in keepinq with
the Spokane County Conprehensive Land Use Plan as indicated by a merto dated
March 31, 1983 from the Spokane County Long Ranqe Planning Administrator.
13. The Zoning Ad3ustor notes that public testimony further indicated the
pa rk's present uses of a softball field, swimming pool, picn3c a rea, tennis
courts, etc., al ready util ize most of the existing parkina capacity at the park
during the sprinq, summer and fall.
14. The Zoning Adjustor finds that the waterslide would contribute ad-
di tional amounts of new traffi c to the i mmedi ate area whi ch requi res that a
properly paved, fenced and iandscaped parking facility be vonstructed to handle
the anticipated traffic and parking needs as noted in the conditional use
standards (4.24.300 b2, b4 and 4.24.310 b5-9).
15. That vehi cul ar and pedestri an access to the si te i s pr+oposed to be re-
viewed and controlled by the Spokane County Engineer's Office. The Enqineers
Office has further made recommendations for this use to promote the public
heal th, safety an d qeneral wel fare i n i ts i ni ti al operati on.
16. That the State Department of Social and Health Services has indicated
that the applicant must conform to State Wastewater Disposal requlations and
construct all necessary facilities to prope rly dispose of this wastewate r qen-
erated by this use.
17. That i s i s di ff3 cul t to predi ct i n advance exactly the traffi c, park-
inq an d use demands created by the proposal as there has been no previous
experience with this use in Spokane County.
18. That to maintain compatibility af the project with ad,jacent uses, the
project shoul d be administratively reviewed by the Zoning Administrator after
the initiai season to determine if other reasonable conditions or limitations
shoul d be attached for the conti nued use of the watersl i de and parki ng faci 1 i ty.
19. That the proposal', except as provided herein meets all current
standards of the Spokane County Zoni ng Ordinance for thi s use.
20. That the proper leqal requirements for advertising of the hearing be-
fore the Zoning Adjustor of Spokane County have been met.
DECISION
, From the foreqoing Findings, a review of the Planning Department File No.
. CUE-5-83, testimony at the public hea ring, an d a site visit, the Zoning Ad,justor
hereby in approving the proposal makes the followinQ conditions:
Prior to occuaancy permit release and authorized use of the proposed
faci 1 i ty, the appl i cant shal l: +
A. COUNTY PLANNING DEPARTMENT
1) Submit a finalized development and parking plan fo r approvai to the
Planning Department indicating the type of recreational facilities
established and all proposed structures to be utilized in connection
with the facility.
2} The existing parkinq area in Valley Mission Park shall be striped for
parking in accordance with the Final Development Plan.
3) The parking area south of Mission Avenue shall:
a) Be developed in compliance with setback requirements and be fully
paved and striped.
b) Be developed with a 6' sight obscuring cyclone fence along the
paved areas easterly, westerly and southern borders.
c) The appl i cant provi de and develop an evergreen and ground cover
landscape plan for the front yard alonv Mission Avenue and side
yard areas of the southern parking facility. ~
d) The applicant is responsible to control dust, litte r and othe r
waste i n thE parki ng faci 1 i ty duri ng seasonal ope rati on.

4) That the Director of Planning or Engineering may direct that the
additional 2.5 acre off-street parking be developed at either's deter-
mi nati on that the traffi c to the s i te requi res addi tional parki nq
space.
5) That this project shall be monitored during operation and reviewed by
the Spokane County toning Administrator in October, 1983. Further,
conditions or limitations may be attached for subsequent use of the
watersl i de and parki ng faci 1 i ti es.
B. DEPARTMENT OF 6UILDING AND SAFETY
1) Al l bui 1 di ngs and structures requi re bui 1 di ng permi ts as per Secti on
301 of the Uniform Bui 1 ding Code.
C. UTILITIES DEPARTMENT
1) Pursuant to the Board of County Commissioners Resolution No. 80-0418,
the use of on-site sewer disposal sys tems is he reby authorized. This
authorization is conditioned on compliance with all rules and requ-
lations of the Spokane County Health District and is further conditioned
and subject to specific application approval and issuance of permits
by the Heal th Dis tri ct.
2) The owne r, his heirs or successors shall Join and pa rticipate in any
petiti on or resol uti on whi ch pur ose i s the formation of a uti 1 i ty
local imp rovement district (ULiD3 pursuant to RCW Chapter 36.94, as
amended. The owner, his hei rs and successors shal l further agree not
to oppose or protest any legal assessments for any utility local im-
provement dis trict (ULID) established pursuant to RCW Chapter 36.94,
as amended.
3) Any wate r service for this p ro3ect shall be provided in accordance with
the Coordinated Water System Plan for Spokane County.
4) Each unit shall be double plumbed for connection to future area-wide
colle ction systems.
0. DEPARTMENT 4F SOCIAL AND HEALTH SERVICES
1) Applicant shall demonstrate that the use is in compliance with all
state requl ati ons regardi ng wastewater di sposal pri or to occupancy per-
mit release.

1) Applicant shall demonstrate that the use is in compliance with all
County regul ati ons regardi ng wastewate r di sposal .
F. ENGINEERING DEPARTMENT
1) Applicant shall dedicate two (2) feet on Mission Avenue south side fo r
ri ght-of-way prior to any use of the property. Need a 64' ri qht-of-way.
2) Access permi ts for approaches to the County Road System shall be ob-
tained from the Spokane County Engineer.
3) Appl i cant shal l i mp rove Miss i on Aven ue i n a manner cons i s tent wi th
Spokane County TYPICAL roadway secti on No. 1 mi nimum pav3ng wi dth
Secondary Arteri al Standard.
4) Applicant shall submit for approval by the 5pokane Caunty Engineer
road, drainaqe and access plans.
5) The applicant shall submit for approval by the Spokane County Engineer
and the Spokane County Health Dis trict a detailed combined on-site
sewage system plan and surface water disposal plan for the entire
project.
6) The word "appl i cant" shal l i ncl ude the owner or owners of the property,
his heirs, assigns and successors.

7) The construction of the road improvements stated herein shall be
accomplished as approved by the Spokane County Engineer.
8) Al l requi red improvements shal l conform to the current State of
Washington Standard Specifications for Road and 6ridqe Construction,
and other appl i cabl e county standards and or adopted resol uti ons per-
taining to Road Standards and Stormwater Management in effect at the
date of construction, unless otherwise approved by the County Enqineer.
9) Access to Maxwell Avenue shall be prohibited.
10) Roadway standards, typical roadway sections and drainage plan requi re-
ments are found in Spokane County Board of County Commissioners
Resolution No. 80-1592, as amended.
11) That the constructi on of this faci 1 i ty wi 11 gi ve ri se to the need for
a delineated crosswalk on Mission Avenue and the installation of
associated signs. It shall be the responsibility of the applicant to
assure that these improvements are made. Applicant may arranqe with
Spokane County to install the improvements. However, it will be done
at the applicant's expense.
12) If in the future, Spokane County determines that a mid-block pedestrian
signal is necessary to control pedestrian traffic to this facility,
the signal shall be installed at the applicant's expense.
13) It may be necessary for the applicant to construct adequate barrie rs
to control pedestrian access to Mission Avenue an d channel pedestrian
traffi c to the approved crosswal k on Mi ssi on.

SUBJECT: COMMENTARY IN ADDITION TO ZONING ADJUSTOR FINDINGS DATED APRIL 6, 1983
The above referenced Zoning Adjustor case has been appealed to Spokane County
Zoning Board of Adjustment. The case wi11 be presente d to the Board vf Adjustment
at 9:00 A.M. on May 9, 1983.
A review of the Zoning Adjustor findings suggests the Board may wish to clarify
several points if their decision is to reaffirm a11 or a portion of the decision
af the Zoning Adjustor.
There are really two issues before the Board which are combined under the same
file number. Th,ere is the issue of whether Qr not to issue a conditional use
ialley-Mi'ssion ermit for Splashdown's waterslide „activi~~ proposed to 6e contained in the
County Park. The second issue is whether or not t~rant -Mroval
to the requested condi ti onal use permi t for an offs ite-parV~g ~ t tmnedi ately
south of the Coun'ty park and-The proposed Splashdown facirifty and as proposed
to be loca e on fhe south side of Mission Avenue.
The folTowing points are raised for cvnsideration by the Board:
(1) although side yard landscaping is stated as a condition in the
written decision, the approved site plan does not indicate either
the presence ot design of side yard landscaping for the parking
]ot on the south side of Missian.
(2) With regard to the landscaping, I find there to be no reference
to requiring that the landscaping be irrlgated and maintained on
a periodic basis at the applicant's expense or responsibility. I
would so recommend.
lot There is some question with regard to whether or not tl~e parking
on the south side of Mission would be closed, inc1uding locked
gates, during the off-season. I recommend that this issue be addressed
by the Board.
(4) This kind of activity, as located alongside of a major interstate
highway, will invariably attract a certain number of vacationers
who would ordinari1y not stop at Valley-h1ission Park. Some of these
vacationers will be arriving in completely self-contained recreational
vehicles. The decision makers should address whether or not to
allow self-contained recreational vehicles to remain in the parking
lot overnight. If it 1s desirable to disallow such an overnight
use, then the project sponsor should be directed to specifically
take steps to see that the situation does not occur.
(5) It is allowable to have some alcoholic be verages in a County
park. The Board should address the matter of whether or not any,
or some, permitted alcoholic beverages should be consumed within
the Splashdown area. Consideration should be given to any negative
effects that alcohQlic beverages may have on swimmers.

imposed if approval for these projects is granted, it would be practical
to have a"sign-off" in the Planning Department prior to the issuance
of an Occupancy Permit.
(8) The decision as issued by the Zoning Adjusto!r stipulates that
a review woul d occur i n October of 1983 as a means of determi ni ng
whether or not additional ad3ustmerts shou1d be made to the project
or to the parking situation. It might be advisab1e for the 6oard
to ca11 for a review at the completion of the first fu11 or partial
season, lregardless of whether it occurs in the fa11 of 1983. There
seems to be a need to involve citizens of the area in such a review.
Toward that end, it might be advisab1e to ca11 for a public hearing
or meeting for the purpose of receiving commentary prior to any
decision issued to modify these conditiona1 use permits. Or, alter-
natively, an administrative decision made wlthout benefit of public
gathering could be advertised and posted in a manner which would
allow an appea1 to a public meeting situation.
