Buccessoce oc assigns, hereinafter called the "DEVELOPER," and SPOKANE COUNTY, 8 municipal corpocation in the State of Washington, for the purpose of improving the intersection of Sprague Avenue and Gillis Road by inetallation of traffic signal eystem and appurtenant channelization and roadway improvementa, which improvemente are for the purpose of enhancing access to Developer's property under the following mutually agreed conditions, to wit: Spokane County egree• to perform the following: 1. To prepace plane, specifications and estimate of cost for the project and Call for Bide from private contracroca to accomplish said work. 2. To enter ieto a contract with the contractor submitting the loweat and best bid, subject to the approval of the Developer, and the deposit by the Developer of the contract amount, including signal equipment, plus 20% for construction engi- neering, inspection and contingencies with Spokane County. 3. To pay the contractor amounte due as the work is accomplished. 4. To deduct from the Developer's deposit the total coste and expenses of the pro- j ect upon the completion thereof, including eogineering, administration and associated coete. 5. To refund any balance of the Developer's deposit in excesa of the total coet and expense of the improvement, or 6. To bill the Developer for the costs and and expenses of the pcoject which exceed the deposit amount, if any. 1. Upon completion of the work to accept the same as part of the County road system and assume maintenance responsibility Cherefor. . The Developer agreee ae followe: • 1. To depoait the amount of Eight Thousand and No/100 Oollars ($8,000.00) with ' Spokane County at the time of executian of this Agreement to initiate prelimin- ary engineering for the pro,ject. 2. After bid opening by the County, but prior to award of the contrect, to promptly deposit the contract amount, including signal equipment, plus twency percent (20X) for construction engineering, inspection, contingenciea, and associated costs with Spokane County. 3. To pay promptly to the County, as billed, for any aad all coete of the project which exceed the depoeit amounte.
