Certificate of Occupancy for Opportunity Manor.
I was advised this morning by Pery Maxey at the Department of
Revenue in Olympia that the south half of the rental property at
12413 E. Main, which was formerly taxable, has been added to the
~ tax exempt property of Opportunity Presbyterian Church as a care-
taker's residence. In discussing this matter with Linda Rouse
in the assessor's office, Linda advises me that she can now make
the administrative segregation for county purposes.
I am enclosing copies of all of my correspondence with the
Tax Comanission for your file and will deliver the same to Linda.

Pursuant to our severai telephone conversations and
letters, I am enclosing the Exemption Application for Opportunity
Presbyterian Church and Opportunity Manor.
For several years past, Opportunity Presbyterian Church has
owned the property described on the January 3, 1989 Renewal/
Determination Schedule. (Copy attached). On September 26, 1988,
Opportunity Presbyterian Church deeded certain property to
Opportunity Manor, a tax-exempt non-profit corporation who has
built a 40-unit elderly/low-income H.U.D. housing unit on said
property. (Copy of deed and tax-exempt status attached). In
conjunction with the project, Opportunity Presbyterian Church
deeded 6 feet of property to the County for sidewalk. (Copy of
deed attached).
As indicated on the prior exemption statement, there were
two rental properties contained in Opportunity Presbyterian
Church's legal description. (Smith House and Stafford House.
See sketch). Part of the Stafford property was conveyed to the
H.U.D. project, and what is left of it will be used as an on-
site caretaker's residence. Accordingly, we are requesting a
segregation of the H.U.D. project with exempt status as well as
exempt status of the remaYnder of the Opportunity Presbyterian
Church property except the Smith House. (W 225 feet of the N 501).
The H.U.D. property was deeded September 26, 1988, so the
cost of that application is $85, and the cost of the application
for Opportunity nresbyterian Church is $35. Accordingly, I am
enclosing a check for $120 to cover both applications.

revieWed your latest submittal regardinq the Opportunity Manor. We
did not teceive the sepaZate sheets refe=zed to on the site plan,
therefore tie request that you submit those at this time. We also
tequest that two copies of these plans be forwarded to the Building
and Safety Department.
We also need a bond for the sidewalk in the amount of $1,520.00.
This is calculated based upon $8.00 pe= foot for the remainder of
your garcel Which does not yet have sidewalk. Accordinq to your
plans, this is approximately 190 feet. You previausly indicated that
the parcel had been seqregated foZ the purposes of this building
permit. We have researched the Assessor's records, and cannot find
that this segregation has been done. If you can provide us with
evidence that this has been done, We can reduce the amount of the
bond to reflect the appropriate frontage.

Dear Gary:
In reply to your letter of November 21, please find new
calculations and a new plan for the drainage swale as you
have requested. George Maddox. PE, prepared these and if you
have further questions it would be best to talk to him directly.
Your question on drainage into the swale is answered by
noting the pitched roof drains off all around the building into
swales following the natural slope and leading to the main drain
area on the South. See the contours on site plan sheet #1 and
detail of drain under sidewalk on sheet #11.
Other items from your original check list are noted following.
These are being handled by Howard Herman, Attorney and Sponsor
of the project.
l. Deed ROW on Main Avenue to the County.
2. Sidewalk to be installed full width of property, or
segregate a parcel out. Herman will probably let a
contract to Guthrie Construction to install sidewalk to
the East PL and if so a copy will be sent to you and to
6uilding Department.

I. General overview - The agplicaxxt stated that this praposal
has been discussed for aggroximate].y 3 years. It originally was
gaing to be a 60 unit agartment complex, but decided td gv with 40
units. Eventually it wil l increase to 50 uni.ts. The apartments
will be accupied by the independent elderly.

1. Planning Degartment (456-2205)
A. Discussion/Requirements
1. The site is zvned UR--22 and is subject to zone change
ZE-IOZ--85.
2. There was a parking varf ance (VE-11-8 6) granted that
allows the site tv have half ~-.he amount of the required
parking-
3. T'he site plan illustrating the rQquired parking and
setbacks are in campliance.

4. There shall be 20 feet of Type III landscaping along
the north and east property lines. Also, a 5 foot high
fence alonq the north and east property lines shall be
installed.
5. There has td be some revisions made to the
landscapinq plan. It should be noted on the plan the
height of the plants at the time of planting.
6. An estimate from a nursery including the type,
quantity, and size/height at time of installation along
with a promissory letter stating the specific date of
installation of the landscapinq. (John Pederson stated
that he will provide specifications on Type III
landscaping for the applicant)
B. Permit Release Requirements
1. A revised site plan illustrating the required fencing
needs to be submitted for review and approval.
2. A revised landscape plan illustrating the
requirements stated in Item 5 submitted for review and
approval.
II. Engineering Department (456-3600)
A. Discussion/Requirements
1. Comments were qiven to the applicant and Building and
Safety by Bob McCann. Also, written comments on the check
print were given to the applicant.
2. Bob McCann stated that there needs ta be some changes
on the drainage plan.
3. Resolvement of the Right-of-Way dedication along Main
Avenue needs to be completed.
4. An approach permit for Main Avenue needs to be
obtained.
5. Any sidewalks to be constructed shall be completed
prior to release of the buildinq permit.
6. There was some discussion on the drywelZ located in
the driveway. It does not have to be installed, an outlet
may be installed that will drain into an approved swale.
The applicant should discuss the situation with Gary
Nelson.

1. The proposed project will be connectinq to the valley
sewer.
2. Daryl Way indicated that his records do not show any
on-site sewage system. If one is found during
construction, the tank should be pumped and crushed or
filled.
3. Any debris from the construction phase shall be taken
to and disposed of at a licensed facility.
4. Valley Garbaqe Service should be contacted for the
appropriate location of the dumpster.
5. Daryl Way released his portion of the building
permit.
IV. Utilities Department (456-3604)
A. Discussion/Requirements _
1. The Utilities Department was not present, however,
comments, statinq the project will connect to the valley
sewer, were given to Jeff Forry prior to the
Pre-Construction Conference.
V. Building and Safety (456-3675)
A. Discussion/Requirements
1. Plan review has been completed and a letter was given
to the applicant by Ken Jeffrey. A copy of Fire District
No. 1 requirements were also qiven to the applicant.
2. Ken Jeffrey stated that the Fire Degaz-tYaent wants
access from the west side of the property.

3. The fire hydrant located at the northwest portion of
the property is to close to the building - it needs to be
relocated. The existinq fire hydrant locations need to be
modf f ied .
4. The appliCant stated that he needs a letter from the
County Building Department statinq that the plans have
been reviewed and a building permit may be issued. (A
letter will be prepared for the applicant).
5. Comments in the plan letter were to be discussed
after the meeting.
B. Permit Release Requirements
1. Two complete revised sets of plans addressing the
items discussed during and after the meeting and other
items from the plan review letter needs to be submitted
for review and approval.

The applicant acknowledged that all comiaents/requirements were
understood and had no further questions at this time regarding
permit requirements.

FINDIHGS AND ORDER
A. INTRODUCTION
This matter having come before the Zoning Hearing Examiner Committee on
March 6, 1986, and the members of the Comnittee present being
Jane E. Myers, Chairperson, Gary Anderberg and Donald E. Neraas.
B. PROPOSAl.
The sponsor, Opportunity Presbyterian Church, is requesting approval of a
zone reclassification, File No. ZE-102-85, Agricultural Suburban and
Residential Office to Urban Residential (UR-22) with Planned Unit
Development Overlay Zone, PUDE-1-86, and Density and SeNer Bonuses for the
purpose of developing a 60-Unit Retirement Apartment Complex. A1so, a
request for a Variance, VE-11-86, to allow a formula of orte-half parking
space per retirement apartment, whereas the Spokane County Zoning Code,
Section 8.02.060-(3) requires a formula of one parking space per
retirement apartment.
C. FINDINGS OF FaCT
1. That the existing land use in the area is church, resldential (single
family, duplex and apartments), bank, offices and vacant Mhich is
being farmed.
2. That the Comprehensive Plan designates this area as appropriate for
Major Conmercial and Urban development.
3. That the exi sti ng zoni ng of the property descri bed i n the appl i cati on
is Agricultural Suburban and Residential Office.
4. That the provisions of RCW 43.21C (The State Envirorraental Policy
Act) have been complied with, and a Determination of Non-Significance
has been issued.

(All Conditions imposed by the Zoning Hearing Examiner Committee shall be
binding on the "Applicant", which term sha11 include the owner or owners
of the property, heirs, assigns, and successors.)
a) COUNTY PLANNING DEPARTMENT
1. That should the use change from a retirement person's housing
facility to a standard apartment use, that all the normal
parking requirements shall be met.
2. A specific landscape plan, planting schedule and provisions for
maintenance acceptable to the Spokane County Zoning
Administrator shall be submitted with a performance bond for the
project prior to release of building permits. Landscaping shall
be installed and maintained such that sight distance at access
points is not obscured or impaired.
3. The applicant shall develop subject property generally in
accordance within the concept presented to the Hearing Examiner
Commi ttee. Vari ations when approved by the Zoni ng Admi ni strator
will be permitted, including, but not limited to the following
changes: Building location, landscape plans, and genersl
allowable uses of the permitted zone. All variations must
conform to regulations set forth in the Spokane County Zoning
Ordinance. The original intent of the development plans shall
be maintained.
4. The specific development plan will be submitted for Planning
Department review and approval prior to issuance of building
permi ts.
5. All current standards of the UR-22 Zone, as amended, shall be
complied with in the development of this site. "The UR-22 zone
contains development standards addressing: Parking, lot
standards, signage, landscaping, storage, refuse storage, and
uti i i ti es standards. "
6. That the pro3ect is sub3ect to Section 4.16A.050, the Aquifer
Sensi ti ve Area Over1 ay Zone of the Spokane County Zoni ng
Ordinance, which sets forth various measures for Aquifer
protection; specifically, measures dealing with wastewater ~
disposal, spill protection measures, and stormwater runoff.

7. Applicant shall comply with '208' reconenendations concerning
stormwater runoff and provide necessary landscaping for runoff.

Commissioners Resolution #77-1392 be initiated by the project
applicant within thirty (30) days of final disposition of this
application, and prior to any on-site improvements, or file
appropriate documents to the effect that the NOTICE OF ACTION is
waived in accordance with Spokane County Commissioners'
Resolution #82-0458 dated May 4, 1982.
b) COUNTY ENGINEERING DEPARTMENT ,

1. Access permits for approaches to the County Road System shall be
obtained from the Spokane County Engineer.
2. Access permits and improvements to Pines Road must be approved
by the Washington De►partment of Transportation.
3. Applicant shall improve Main Street in a manner consistent with
Spokane County TYPICAL roadway section Ho.l minimum paving width
Access Standard.
4. Applicant shall submit for approval by the Spokane County
Engineer road, drainage, and access plans prior to the issuance
of a building permit on the property.
5. The applicant shall submit for approval by the Spokane County
Engineer and the Spokane Countyr Health District a detailed
combined on-site sevage system plan and surface water disposal
plan for the entire project prior to the issuance of aRy
building permit on the property.
6. A parking plan and traffic circulation plan shall be submitted
and approved by the Spokane County Engineer prior to the
issuance of a building permit on the property. The design,
location, and arrangement of parking stalls shall be in
accordance with standard traffic engineering practices. Paving
or surfacing as approved by the County Engineer, will be
required for any portion of the project which is to be occupied
or traveled by vehicles.
7. The word "applicant" shall include the owner or owners of the

Construction, and other applicable County standards and/or
adopted resolutions pertaining to Road Standards and Stormwater
Management in effect at the date of construction, unless
otherwise approved by the County Engineer.
10. Roadway standards, typical roadway sections and drainage plan
requirements are found in Spokane Board of County Commissioners'
Resolution No. 80-1592 as amended.
11. Appl3cant shall dedicate to Spokane County sufficient right of
way so as to permit construction of the roadway improvements
which have been speci fi ed for Mai n Avenue ( typi cal Roadway
Section #1 Access Standard).
c) COUNTY UTILITIES DEPARTMENT
1. The owner(s) or Successor(s) in interest agree to authorize the
County to place their name(s) an a petition for the formation of
a ULID by petition method pursuant to RCW 36.94 which the
petition includes the Owner(s) property and further not to
object by the signing of a protest petition against the
formation of a ULID by resolution method pursuant to RCW Chapter
36.94 which includes the 4wner(s) property. PROYIDED, this
condition shall not prohibit the Owner(s) or Successor(s) from
obJection to any assessment(s ) on the property as a resul t of
improvements called for in conjunction with the formation of a
ULID by either petition or resolution method under RCW Chapter
36.94.
2. Any water service for thi s project shal l be provi ded i n
accordance with the Coordinated Water System Plan for Spokane
County, as amended.PURYEYOR
3. Sewer connection is to be made to the North Pines ULID.
d) COUNTY HEAI.TH OISTRICT
1. Sewage disposal method shall be as authorized by the Director of
Utilities, Spokane County.
2. A publ ic sewer system wi 11 be made avai 1 abl e for the project.
Use of individual on-site sewage dystems shall not be authorized.
