FIHDINGS AND ORDER
A. INTRODUCTION
Thi s matter havi ng come before the Zoni ng Hear1 ng Exami ner Conaai ttee on
November 1. 1964, and the members of the Coaenittee present being
Kenneth KenneQy, Chairman, and F. L'ynn Tennlcen. Mr. Skalstad excused,
himsel f fran heari ng thi s agenda i tem because of the Appearance of
Fairness Ooctrine.
B. PROPOSAL
Thesponsor,, Dwight J. Hwne, is requesting approval of a zone
recl assi f ication, Fil e Ido. IE-91-84, Agricul tural to Mul ti p1 e Fami ly
Suburben, for the purpose of developing an 140-Uni,t Apartinent Caaplex.
C. FINDINGS OF FACT
1. That the existing land use in the area is residential, chunches,
school, and vac8nt. The context of the nelghborhood 1s quite well
establ i shed and` i s basi cai 1y not i n a transi tion area.
2. That the Comprehensive Pian desfgnates this area as appropriate for
Urban development.
3. That the ex,i sti ng zoni ng of the property descri bed 1 n the appl ication
is Agricultural.
4. That the prodisions of RCW 43.21C (The State Environmentsl Policy
Act) have 'been compl ied wi th, and the Coumittee concurs wi th the
Declaration of Non-Signifi'cance.
5. That the proper legal requirements for adverti,senent of the Agenda
Item have been fulfilled.
6. That the land in this area is suitable for residentiel use but not at
the hlgh density proposed.

C. FINDINGS Of FAC1 (continued)
1. That the applicant has demonstrated that conditlons have
substantially changed since the original zoning of thls area and
accordingly, the proposed rezone is justified. The present owner,
the Y.N. C, A. , i s not abl e to use the properttiy at th1 s time for a new
faci 1 i ty. lhat resl dential devel opment, doth si ngl e fami ly and
mul ti -fami ly have devel oped adjacent to the si te.
8. That the proposed use as modified is compatible with existing
densi ti es f n the area. Adjacent propertles have devel oped wi th
multlple family uses. The concept of the proposal does not
constitute "spot zoning" per se. However, the proposed densities and
building masses are substantlally dlfferent and would have a high
probabillty of changing the character of the neighborhood.
y. That the owners of adjacent lands expressed disapproval of the
proposed use.
10. The Nearing Examiner Committee does not find the proposed use to be
i n hamory wi th the general purpose and may be otherwi se detrimental
Lo the public health, safety, and welfare.
11. The following are additional findings of fact considered by the
Hearing Examiner Committee:
a I 'ihat the Heari ng Exami ner Conmi ttee i s aware that, apparently,
there are three different agencies of goverranent which have
jurisdiction over the type of sewage disposal system, depending
on the quantity of effluent which is discharged; i.e., County
Health District. Department of Social and Health Services, and
Department of Ecology.
b) That a developer can determine which of these agencies wi11 have
jurisdiction over his project by the manner in wfiich it is
devel oped; i. e. , dividi ng the enti re project i nto parts. It i s
the responsi b91 i ty of this Heari ng Exemi ner Carm1 ttee to protect
the general public's welfare and interest as well as the sole
source aqui fer; therefore, i t i s necessary not to al l ow the
proposed densi ty of di scharge no matter how i t i s di vi deG.
c) 1he Valley is being sewered on a base of need. The proposed
s i te i s not on the pri ori ty 1 i st for those areas w1 th the
greatest need for seweri ng.
d) Thet fundi ng f or the i nstal l eti on of trunk and co)1 ector l i nes
is uncertain with regard to both timing and source.
e) That the pre] imi nary site pl an does not gi ve consi derati on for
compatlbility with the existing neighborhood and adjacent
properties.

12. Pursuant to the provisions of Chapter 43.21C RCW, the SENA
Guidelines (WAC 197-10) and the Spokane County Environmental
Ordinance (SCEO), a proposed declaration of non-stgnificante has
been issued at least fifteen (15) days prior to this date; the
of f 1 c i al f i1 e, wri tten comments and/or publ i c testi mony conta i n
information regarding assessment of the proposal's likely
significant adverse impacts to the phjrsicai environment; a
finding is hereby made that no probable significant adverse
impacts upon the physical environment are antlcipated as a
result of the project; and a final declaration of
non-slgnificance is hereby to be issued.
13. That the setback area between buildings and the east property
line be maintained in dense landscaping 1n additlon to the
requi red si ght-obscuri ng fence.
b) COUNTY ENGINEERING DEPARTPIENT
Prior To The Issuance Of A 8uilding Permit:
4i-i licant shall dedicate 10 feet on McDonald Road for
rip9ht-of-way Prior to any use of the property.
2. Access permi ts for approaches to the County Road System shal l be
obtained from the Spokane County Engineer.
3. Appl icant sha11 improve McDonal d Road i n a manner consi stent
with Spokane County TYPICAL roadway section No. 1 minimum paving
width Collector Standard.
4. Applicant shall submit for approval by the Spokarte County
Engineer roed, dra3nage, and access plans prior to the issuance
of a bullding pemit on the property.
5. The applicant shall submit for approval by the Spokane County
Engineer and the Spokane County liealth District a detailed
combined on-site sewage system plan and surface water disposal
pl an for the enti re proj ect pri or to the issuance of any
bui 1 di ng permi t on the property.
6. A parki ng pl an and traf f i c C i rcul ati on pl an shal l be submi tted
and approved by the Spokane County Engineer prior to the
issuance of a bu1]aing pemit on the property. The design,
location, end arrangement of parking stalls shall be in
accordance with standard traffic engineering practices. Paving
or surfaci ng as approved by the County Engi neer, wil l be
required for any portion of the pro3ect which is to be occupied
or travel ed by veh i cl es.

8. The construction of the road improvements stated herein shall be
accomplished as approved by the Spokane County Engineer.
9. A11 required improvements shall conform to the current State of
Washington Standard Specificetlons for Road end Brldge
Construction, and other applicable County standards and/or
edopted resol uti ons pertal ni ng to Road Standards and Stormewater
Management in effect at the date of construction, unless
otherwise approved by the County Engineer.
10. Roadway standards, tjrpical roadway sections and drainage plan
requi rements are found i n Spokane Board of County CoaAmi ssi oners'
Resolutlon No. 80-1592 as amended and are applicable to this
proposal.
c) COUNTY UTILITIES DEPARTMENT
1. Pursuant to Board of County Coami ssioners Reso1 ution No.
80-041 6, the use of an-si te sewer di sposal systens 1 s hereby
authorized. This authorization is conditioned on compliance
with a)1 rules and regulations of the Spokane County Health
Distrlct and is further conditioned and subject to specific
application approval and iasuance of permits by the Health
Oistrict.
2. The owner(s) or Successor(s) in interest agree to authorize the
Coun to pl ace thei r naaie ( s) on a peti tion for the fonuati on of
a Ull by petition method pursuant to RCW 36.94 which the
petition includes the Owner(s) property and further not to
object dy the s 1 gni nq of a protest peti tt on agai nst the
fonmation of a ULID by resolution method pursuant to RCw Chapter
36.94 which lncludes the ONner(s) property. PROVIDED, this
condition shall not prohibit the Owner(s) or Successor(s) from
objecti on to any assessment(s) on the property as a resul t of
improvements called for in conjunction Nith the formation of a
ULIU by either petltion or resolution method under RCW Chapter
36.94.
3. Any water service for this project shell be provided 1n
accordance with the Coordinated Mater System Plan for Spokane
County, as amended.

4. It hds been determined that firepiaces and wood stoves are a
significant source of suspended particulates. The sme11
particles l(kmicrons) are resplrable and can have an adverse
effect upon the health of the public. We strongly urge that if
Mood stoves/fireplaces are used, thet burning be done as
efficlently as possible. All wood should be seasoned and stored
in a dry place. During periods of poor ventilation or elevated
air pollution levels, we request that use of wood stoves and
flreplaces be discontinued.
