The meeting xas postponed from January ?4 to t':is date, Fobruary 3. :'.~.r. Glovers I am speakinE for my neirhbors, the people of Vera, and I put before you the brief which outlinss the way we feel. I think perhaps that the kindest thing tive can say is the P1Ai1ninC ?,oard did rot-understand. At that tima we had six people at the meoting testify:ng aZazrzst !::r. The i.ssue mAy have heen confueed at that time but I felt because of the speedy permission ;iven Mr. Stedmar the Planning Board did not give our siJe suf'ficient thought. I Warit to call your attention to the naraes given you. I think o£ seven property owners ncorest to the property in quvstion six of the geople in question have exQrassed a dosire not to have a property of this kind in the neighborhood. Do p p t, owners have a ri ght to dete:r~ine what type of builciiii~; is to go next [oo ~~ei, or ara they merely victims of the wtiim of the Planning Doard7 Mentioning a parallel cese - a bunga2oT► dental o:tico in the Dishman area clos• to the home of Priae and Barth - application was refused. No one objected to this. It looks like a private resi.dence, except for the sign. Yre try to be carRful o£ our neighbors. Her property described as the U: 75•5' of S: 1251 bf F?.]j df TraCt 1431 4pportunity, exci w. 75f thereof. Her property starts 501 notth di the south boundary of Trh.ct 143# which is 50f off of the Av9nue i Yt wotzld only be fair to her to make t Commercial sone out of it. The property at the west end of Tract 143, rtunning to the City Zimits is all zoned as Commercial. Yt seens urireasonable to me to zone this as Suburban while the rest is zoned as Commercial. It seems to me I that you Gentlemen, in going over the plans, you shouid -bear in mind that thir is n nz_ in high;ray & Commercial property should be adjacent to the Hignway. In planning, you will no doubt come to the conclusion that the time will come that you wi].1 have to zone this entire axea for Com- mercial enterprise:. Th,at doesn't appear to be at the present time, but the time is coming. It is not contemplated that this ' Co.=issi= col:, tho entzre area Commercial, we believe 3001 back from Sprague wouid be a reasonable distance for Commercial zoning. Thare are other gentlemen here who represent other property owners in their investment. i•ir. Coone.y: I represent Mr. Boot, who owns property Ar. i•iunter just spoke ubout. Nr. Root ha.s a cominercial business there and has been granted a permit from the County Commissionera. P.egardless of how the Planning Com- mission passes on this zoning, he may etill keep his business, as I under-- stand zoning is not retroactive. That is true of other properties al.ong there. A small repair shop has beon tbere for quite some time. Just ' generalizing, everything just to the north of East Sprague and everything to the west is commercial. lihen this man bought this property, he w ent ~ over to tbe County Court House and vras advised it was commercial property. Of course it is easy to make a mistake, and after checking it was found that part of the property isn't zoned. Yde find that it is Unclassified property. Thnt is the property which is being considered at this tine. However, we do feei it should be Commercial property. I feel the same as Mr. Munter does. )+ir• Frisseil: I represent P. J. Head, who has property on the W15 of I-d-~~~-, of Tra.ct 143, 4pportunity. $e owns land at the corner of Sprague and Locust. ? feel the same way Mr. IvIunter & 24r. Cooney fee].s. The railroad runs along the front of the property that isnt t considered as residential., that is , commercial. Nir. Head has two very valaa, ble pieces of property for commercia: purDoses. It is very valua.ble as commercial property, but as property for a home, it is not so valuable. It lie$ behind this railroad track. His line extends 2891 from the north boun&-•.ry of Sprague, that is 501 of rail-- road right--of--way, so that makes him 2391 north and south. So, I too feel that is should be zoned as commercial. I fr:el it would be fair to zDne the property 300t back from the north boundary of Sprague Avenue. I -2- SU3URP.kYl Z%~. DI STRICT Continued 14ir. IfIr. Ethrid.ge t I own property adjaoent to all thESe people, except two. I ara north. I was just wondering, it seems the property owned by i4rk Head is only valuable to him as business ptoperty. lhat is the way Y took it. They want to commercialize the land. Of course, it cantt be very valua.ble next to homes. 14r. 14esnach; Your point is, ydu have a home there3 I.ir. Ethridge! Yes+ I have a home there& I k►ant to lmow what protection I have. Idr. ineenacht You want the zoningY ifir. Zthri~gei Yes# I think I started the petitions+ S saw the ma.jority of the people there. For the majority of the ~evple, Suburban Zoning was what they wanted. Ar. Rohwer! Ilould you have any objectiong in ha.ving thia propcrty along Spragu.e zoned ae Commercial3 I4r. Ethridge; Yes, I understand they wiint 1751 back from Sprague. Another man , wants 3041 backl I think iC would be very objectionable. IUIr. Meenach: How far north of Sprague dv you own prnperty? 1•Ir . Ethr i dge l I am 1751 nor th of Sprague. i-It. Fosseen! Is tihere a street tunning through thereY I4r. Ethridge: No. Mr. Meenach: Anyone else to apeakl Mr. Sha.rar: I signed that petition. I6idnlt know i.ti was going to be tntirely Suburban. I thought they were going to set 3.t back a few feet for Commercial on Sprague. Y don't know how far back-. it should be, but * think some Commercial should go in.--- tha.t is along Sprague Avenue. j'Te are betwPen I4rs. Cole and 1-Ir. Ethridge. I thinlc the ?oeople who ovm comraercial property should have some protection. Mr. i4eenach: Now let me get thie straight. I4.r. Ethridge has land atarting 185, north of Sprague. Mr. Sharar has 601 frontage on Farr just north of Mrs. Cole. Mrs. Cole has 751 frontage on Farr, just off Sprague. 14r. Smith; I signed tY~^.t petiti.on, and i feel the same way. I live right on Sprague, between IYIr. Root and Mrs. Cole. But, if this was brougY:t up iong ago it would have been O.K. But Mr. Root is already established. If this had beeA brought up a.bout 13 months ago i.t would have been a different matter, but people just wait until they think they are going to be hurt, then rush in for zoning. I signed the petition because his tank comes right by my bedroom window. The only reason I wAnt it to be a commerCial zone is s0 I Can sell my place and get outl I cantt stand that oil emiill any longer. I have nice neigh-- bors, but I think the property owners should have a say to what they want to ~ go in next door to them. As it is, practically anything can go in. iAr. Meenach: Of course, we have had zoning available for the >>eople for years, but they do%ntt start anythin,, until they fear they are going to get hurt. i4r. Smith; ti'~hen the people build on the oppasite side of the road, we were _ZOtif ied, as it was zoned, but we were not notified about 24r. Root 's business, next door, as it was unclassified. ."r. A~rr,y: I have property next to Iyir. Head and IoIr. Root, on Sprague. I think if 75;~ of the people signed the petition, more or less of them didn't quite -understand just what Suburban zoning is. 'r~ir- Ethridge: I donit think they were mierepresented. I~,r .Berr.y; 14y land begins back from 5pra.gue Avenue. I bought the place because i igured it ~r.,as eommercial. That was in 1942. 2 have had the p3.ace all the time. I also have my home there. i4r,Ethrid4~e : Ifirs. Cole already ha.s the f irat lOG t of hex prDperty on Farr Roa.d •:.oned as Suburban. '~:rs. Cole: ThA.t is just 1001 west of Farr, but Iwauld like to have the rest of it zoned as Commercial. i ;_I4eena.ch: Anyone else t0 b e heard.? Iflr. :4utch has Pa.ssed away now@ kr. Walker: Ts this right between two zones? Irlr. Anderson: Yes, it is ,9,gricultural on one side and Suburban on the other. Mr. Berr.y: I just want to say that t3.s much as the people in the Valley want the Valley to grow, why make a Suburban Zone around Dishman? I don't know what their idea is. 14r. Ethrzdge: These people dontt understa.nd V,hat a 5ubutban zone is. iiIr. Aerrv: It will mean that my property values will- go down. I~ir. Iyleena,ch; It tioould require a special permit for commercial businesses to go into a Suburba.n Zone. Anyone else to be heard? Pronert.y Owner : Isnt t there some zoning in that area that would suit everybody? I,1r. 2•teenach: We would have to have a new petition for any other zoning. This rrras presented for Subwrban. Suburban and Commercial simply dontt go together. . These peop7.e brought in a petition for Suburban. 1,47ha.t I don't understand is, about thie 300t back. On that property the land runs back quite a ways. In the City a Commercial zone goes back 100 1: Af ter all your commerciaZ vaZue lits on the Avenue, Sprague Avenue here in this case. Mr4 Munter! lhere is the railroad right-of-way between Sprague and this pronertya iAr i$ohwer l Hr 4 14unter , you say thi s propetty f ac es on the rai lroad ins t ead of the Highway? There is no dedicated street betwoen this Rail.road and the proverty ovrtier you reprveent+ Like Mr• Iieena.ch saidi tYle cosmercial value lies on the Avenue. Mr. Coone,y; I just want to question this petition. This petition, I dontt believe, is weli followed, as a pPtition for change of classification states that the owner of any property, el:cept unclassified property, may petition the Spokane County Planning Commission for a cha.nge in classification. Thn.t is under Sec. 20, Page 16 of the I4a,ster Zone Ordinance. However, we dont t need to be technictA. The 3001 is tYie north 1.ine of rroperty for Messrs. Head, iloot and Aerry. Their property runs ba,ck about 3001, that is why we ti►ant the commercial zone to go back that far. On page 16, Sec. 19, under amendnents, it reads as iollows: (Rr. Cooney read from the zoning ordinance. ) ;i1e do have the petition filed by the property owners. It says such a petition shall bear the signatures of the owners of three of the five lots or blocks and 51 0 of the property owners. That would ha.ve to do with property that is not unclassified. Ylhst I want to call your attention to is that I donit think the wei5ht of the petition brings tnis before you. ifir. Idalker; This is not a zone classification cha.n.ga. It is an amendment to the zoning. This is an original application. 11r. Hawle.y: St is unclassified at the present time. ' L"fr. Coone.y: I see what you mean. 14y point is not well taken. lfir. Reena.ch: I understand the percentage of the -oeople in the area have signed the petition. Names are not sufficient. They ha.ve to represent something spec if ic. Mr. Anderson; A21 the People who signed that },etition are property owners. I live there. Mr. Meenach; Tha,nlc you very much for coming in* j'his will be decided upon in Executive Session and you will be notified of the action. Mr. McHenr,y: t'jhon a person drivos over the over-pass on Fancher you ca.n , look right down into tho yard. A f enca would do no good there, unless you had a roof over it also. i•ir. I went over to the Courthouse to find out tho zoning. I put up my buildin.g and sold farm machintry and repairs. I had used parts for salQ. As far as looking into the wrecking yard from the over-pass, you can see all over now. There are lots of businesses out there now you can seo from tho over-- pass. 14r- Meenachj: Th,e,nk you very much, we will t,alk this over in Executive Session and make a decision. ,LCTI011: Executive Session reports that the permit be granted, but deferred until the next moeting so the Prosecuting Attorney ca.n present a special permit with proper restrictions. -7- STE.,~LqAY SERVI CE STAi I0N SF. :C Ig-Ii PE?:Xi Ar. That was just a conversAtion Ijust asked for a special permit to operate a service station. -8- STEADI-iUI SrRVI CE STATION Cont inued Mr. Glover; tdr. Steadman came to me a few da,ys ago and told ae about thie service station. Do you remember what I said7 tyir. Steadman: Yes sir. You said you were going to buck it. Mr. Glover: Tha.t is right. Mrs. Conrad is here. I think she signed the petition. Ma.y I ask your permiesion to ask her why she signed this petition4 Mr. Meena.ch: Yes, go ahead. 14rs. Conrad; When tdr. Stead.man cane to me and a.sked me about this service station, he mentioned about building a road behind and Y thought it would be a fine thing. I ha.ve 12 acres of land and thought it would be nice to have a road in the backf then I would have less taxes to pay. Now I wish to withdrativ my na,me from the petition. I4r. Glover; i ha,ve with me a new petition I would like to present. It hae 37 signatures. I think there are 5 people who have signed this petition not owning property. The petition was circulated a little too far* There are b names on our petition that was originally on the other petition. . Mr. Truman signed this petition. He didntt intend to sign any -Oetition in . the fi.rst p'Lra.ce, but he did cha.nge his mind and signe3 our petition against the service station. We ar e in an Agricultural Zone llistrict, and are very, very much against anything Commercial going in there we fear of wha,t may happen in the future. Mr. Meenach: Anyone else present who would like to speak? Let us hear from you. Illrs. aoller; I live next door to I4r. Stead.ma.n. I bought my home with the understanding it was in a residential area. I purchased the place a year ago in September. I am against a servi.ce station going in there. Mrs. Eacret; ►+le plan on buildir.g a home to the west of :dr. Steadman. i;e understood it was a zoned area restricted from businesses. I am opposed to any building going in commercialZy. ~ Mr. Hartunp,: I have been hEre before this Board several times. I am not an immediate neighbor, but I do own property in the same vicinity and ha.ve my own place of business. I have my business back off the Highway. He is going in the same block arhere there are several other service stationa constructed already. I know it isn't good business to talk about peoplets financial status, but I understand the service station on the corner m3y nave to close because of a lack of business. I ca.nit underatand why you would t'ant to build another one there if they are going hungry for busi.ness alread; also between two residences when the ones on the corners canlt make a go of it. i dontt think we should let more come in. 14r. Meenach: Anyone e:Lse to spea.lz? ' ?dr. Steadman; Mrs. Conrad asked me when I presented the petition for the service statidn if it was for the road. I told her no, it was for the cervice station. I4»s. Hartung: Wh,y should a, service station come into a residential area? I-2rs. Rcller has a?ot invested in her home. She is raising her children therea Mr. Stead.man: tdrs. Ao11er mentioned the fact that she ha.d a son who does that type of work and maybe he would work for me. Mrs. $oller: Lr'hen Iqr. Steadman came to my home he toYd me he wanted to put up a sei•vice atation. I told him I didn't want anything commercial next to me. He said he was going to have it regardless. So he goes out and gets these signatures on his petition, and came ba,ck and showed it to ne. He said the next thing would be a beer tavern. I t old him I wa.s going to fight it all I could, but if it did go in we could still be friends and said just aa a joke tha,t my boy could probably work for you then at leaet it would be handyl Mr. Steadman: I asked ilirs. Roller to sign my petition and she sa.id if Mr. Glover signed it, she would also. --9-- SiZ~KkI1 5Z-411VIC3 STATION Continued i4r. That was just a conversAtion T just asked for a special permit to operate a service station. _f3r.. SiEAI?MAN SEZti'I CF STATION Cont inued Mr. Glover; 14.r. Mrs. Conrad is here. I think she signed the petition. 14a.y I ask your permission to ask her why she signed this petition? Mr. Me ena,ch ;Ye s, go ahead. Mrs. Conrad; VThen tdr. Steadman came to me and a.sked me about this service atation, he mentioned about building a road behind and I thaught it would be a fine thing. I have 12 acres of land and thought it would be nice to ha,ve a road in the back, then I would have less taxes to pay. Now I wish to withdraw my name from the peti.tion. Mr. Glover: I ha.ve with me a new petit3.on I would like to present. It ha.s 37 signatures. I think there are 5 Aeople who have signed this petition not owning property. The petition was circulated a little too far. There are 6 names on our petition tr.at was originally on the other peti.tion. Mr. TrUm.ra,n signed this petition• He didnrt intend to sign any -oetition in the first place, but he did change his mi.nd a.nd eigne3 our petition against the aervice station. We are in an Agricultural Zone llistrict, and . are very, very mucYi against anything Cornmercial going in there we fear of what may happen in the futur e. Mr. Meenach; ,A,nyone else present who would like to speak? Let us hear from you. I4rs. Eoller; I live next door to Ur. Steadman. I bought my home with the understanding it was in a residential areai I purchased the place a year ago in September. I am against a, service stati.on going in there. Mss. Eacret :We plan on buil3ir.g a home to the west of Mr. Stea3man. We understood it was a zoned area restricted fron businesses. z am opposed to any building going in commercially. Mr. Hartung: I have been here before this Board several times. I am not an immediate neiglibor, but I do or•n property in the same vicinity and have m3r own place of business. I have my business back off the Flighway. He is going in the sa.me block where there are several other service stations constructed already. I know it isntt good business to talic about peoplets fina, ncial status, but I understand the service station on the corner may have to close becaUSe of a lack of business. I cantt understand why you would want to build another one there if they are going hungry for business already - also botween two residences when the ones on the corners can't make a go of it. I dontt thirLk we should let more come in. 1rlr. Meenach! ,A.nyono else to speak? 14r. Steadman: 1-Irs.. v"onrad asked me when I presented tho petition for the service statidn if it k►a$ for the roc.d. I told her no, 3.t was for the service station. Mrs. H;artung: Why should a service station come into a residential area? ' i4rs. Ro~ller has a lot invested in her home. She is raising her children ther e. Mr. Steadman: T•irs. Aoller mentioned the fact that she had a son who does that type of work and maybe ne vrould work for me. Mrs. Eoller: t^Iher_ Mr. Steadman came to my home he told me he kranted to put up a service station. I told him Z didnit want a,nything commercial next to me. He said he was going to have it regardless. So he goes out a,nd gets these signatures on his petition, and came back and showed it to me. He said the next thing would be a beer tavern.
