STORM DRAINAGE EASEMENT

The Grantor(s) David H. and Janet Wesche; Gregory J. and Margaret Doering and Robert J. and Kim Golden of the County of Spokane, State of Washington, for and in
consideration of Mutual Benefits, to them in hand paid, and receipt of which is
hereby acknowledged, grants to Spokane County, a political subdivision of the State
of Washington, and Easement over, under, upon and across the hereinafter described
lands situated in the County of Spokane, State of Washington:
The North 35 feet of the West 55 feet of the South Half (S 1/2) of Tract
39 of OPPORTUNITY, as recorded in Volume "K" of Plats, Page 20 in Section
15, Township 25 North, Range 44 East, W.M.; in Spokane County, Washington.
DRAINAGE EASEMENTS, as shown hereinabove are for the purpose oi installing,
operating and maintaining drainage swales and drainage facilities to dispose of
runoff, are hereby granted. The County of Spokane is hereby granted the right of
ingress and egress to all drainage easements adjacent to the public right of way.
The property owner shall maintain the drainage swale with a permanent live cover of
lawn turf, with optional shrubbery and/or trees, which do not obstruct the flow and
percolation of storm drainage water in the drainage swale as indicated by the
approved plans. The Grantors agree that Spokane County accepts no responsibility
for maintaining the drainage easemen[, except for the drywell located in the
easement area.
The Grantor(s) hereby releases Spokane County, and all its off irers, employees, and
agents from any responsibility or liability for any damage whatsoever including
inverse condemnation by or to any and all persons or property arising out of or in
any way incident to or attributable to the storm drainage within said Easement.

The Easement described hereinabove is to and shall run with the land. No
modification of the boundaries of said Easement can be made without the prior
approval of Spokane County.

date herewith, payable to 8eneficiary or order, and made by Grantor,
and all renewals, modificatione and exteneione thereof, and also auch
further eume ae may be advanced or loaned by Beneficiary to Grantor, or
any of their eucceeeore or- aseigns, together with intereet thereon at
such rate as ehall be agreed upon.
To protect the security of this Deed of Truat, frantor covenants
and agreee :
1. To keep khe property in good condition and repair; to perinit
no waete thereof; to cornplete any building, etructure or improvement
being built or about to be built thereon; to restore pr.omptly any
building, etructure or improvement thereon which may be damaged or
destcoyed; and to comply with all lawa, ordinancee, regulatione,
covenante, conditione and reetrictione affecting the property.
2. To pay before delinquent all lawful taxee and aesessments upon
the property; to keep the property free and clear of all other charges,
liene or encumbrances impairing the eecurity of this Deed of Trust.
3. To keep ell buildinge now or hereafter erected on the property
deeccibed herein continuouely insured againet loes by fire or other
hazarde in an amount not leeB than the total debt eecured by thie Deed
of Truet. All policies shall be held by the Beneficiary, and be in

proceeding, and in any suit brought by Beneficiary to forecloee this
Deed of Truat.
5. To pay all co9ts, fees and expenses in connection with this
Deed of Truet, including ttie experiees of the Truatee incurred in
enfoccing the obligation secured hereby and Trustee'e and attorney's
fees actually incurred, as provided by etatute.
6. Should Grantor fail to pay vrhen due any taxes, aesesemente,
insurance premiume, liene, encumbrances or other chargee egainet the
property 2iereinabove described, Beneficiary may pay the eame, and the
amount eo paid, with interest at the rate set forth in the Note eecured
hereby, shall be added to and become a par't of the debt eecured in thia
Deed of Truet. IT IS MUTUALLY AGREED THAT:
" 1. In the event any portion of the property is taken or damaged
in an eminent domain proceeding, the entire amount of the award or euch
Nortion as may be neceseary to fully eatiefy tho obligation socured
hereby, shall be paid to 8eneficiary to be applied to eaid obligation.
2. By accepting payment of any Eum Becured hereby after ite due
date, Beneficiacy doee not waive ite right to require prompt payment
When due of all other sume eo eecured or to declare default for failure
to so pay.
j. The Trustee ehall reconvey all or any part of the property
covered by triie Doed of Truet to the person entitled thereto, on
written request of the Grantor and the 8eneficiary, or uPon

reconveyance made by the Beneficiary or the person entitled thereto.
4. Upon default by Grantor in the payment of any indebtednesa
secured hereby or in tne performance of any agreement contained herein.

without warranty, which etiall convey to ttie purchaser the intereat in
the property which Grantor had or had the power to convey at the time
of hie execution of thie Deed of Truet, and such as he may have -
acquired thereafter. Truetee'e deed shall recite the facte ehowing
that the sale wae conducted in compliance with all the requicemente of
law and of thie Deed of Truet, which recital shall be prima facie
evidence of euch compliance and conclueive evidence thereof in favor of

CALL TO ORDER: The meeting was called to order at approximately
11:00 a.m. by Buildinq and Safety's Code Compliance Coordinator,
Tom Davis, with the following in attendance:

ADDRESS CORRECTION:
The address has been changed from North 1308 Vercler to North
1302 Vercler Road to correspond with site location, parcel number
15542-1013.
SCOPE/PROJECT DESCRIPTION:
The applicant is proposing the construction of State licensed 21
bed, 20 room boarding house for ambulatory convalescent care. Day
use care will also be provided.
Meals for the occupants will be prepared on site.
The structure will include two apartments. One for the manager
which will be on call 24 hours a day and one apartment for the
assistant manager.
The boarding house will have approximately 6 to 10 people on
staff including managers.
There is currently a house on the property which will be
demolished.

SUrIIKARY OF DEPARTMENTAL REQUIRffiCKNrS :
I. Building and Safety (456-3675)
A. Discussion/Requirements
1. This building is classified as a type I-2
occupancy. The proposal is a new type of facility
which is diff icult to identify under the UBC.
2. The building is being required to have a sprinkler
system installed. The siamese connection needs to be
located as near as possible to the f ire hydrant.
3. Fire District No. 1 is requiring that the
existing hydrant be changed from a 2 port to a 3 port.
B. Permit Release Requirements
1. The applicant is to meet with Ken Jeffrey at a
later date to discuss comments to be satisfied.
II. Engineering (456-3600)
A. Discussion/Requirements
1. A copy of comments were given to the applicant and
Building and Safety by Bob McCann.
2. A site plan with comments to be satisfied was
given to the applicant by Bob McCann.
3. Your contact person at the Engineer's Office will
be Jerry Sims.
4. The rezone included two parcels 15542-1013 and .
1014. The project is located on parcel number
15542-1013.
B. Permit Release Requirements
1. The following improvements within adjacent
right-of-way are required prior to the release of the
permit:
A. Right-of-way dedication 10 feet along Vercler
Road per the conditions of the zone change.

B. A copy of a recorded deed for the subject
property must be submitted in order that the
Engineer's Office may prepare the right-of-way
deed and/or RID/CRP agreement.
C. Road and drainage plans for street
improvements must be submitted. These plans must
be prepared by an engineer. Plans must be
prepared for Vercler Road.
D. An approach permit must be obtained for
driveway approaches to Vercler Road.
2. The comments on the site plan check print must be
completed and submitted for review and approval.
III. Health District (456-3600)
A. Discussion/Requirements
1. This project will connect to the Valley Sewer
System.
2. Because the proposal is a DSHS licensed facility,
DSHS will handle a1L requirements for food service and
handling.
3. Upon removal of the single family residence the
on-site sewage disposal system which services the
dwelling must be abandoned in accordance with proper
abandonment procedures.
B. Permit Release Requirements
1. The Health District has signed off the building
permit application.
IV. Planning Department (456-2205)
A. Discussion/Requirements l. This project is subject to a zone change ZE-29-87,
Ag suburban to UR-22
B. Permit Release Requirements
1. Conditions of the zone change which must be
satisf ied are as follows :

A. A20 foot wide strip af type III landscaping
adjacent to Vercler Road is required.
B. A 3 foot screen adjoining the parking areas
must be installed.
C. No parking stall shall be lacated more that
60 feet f rom alandscaped feature. Landscaped
features shall not be less than 32 square feet in
area.
D. A6 foot screen or fence shall be installed

E. A 5 1/2 foot wall or fence (sight obscuring)
around the dwtapster i s requi red .
F. 5 feet af type III landseaping shal.l be
installed on the east and svuth property lines,
