rJlr. Walker: Ady main ob jection is to get these pits off the mQin high-
ways there are places back off the roe.ds in Spoka-^e County you can
remove soil from. You donft have ta go along the highway fio get good
black dirt.
ldlr. VIallace: ti''lell, I vrould go back 604' at leAat. And about the weeds,
I don~t know if we have any that you mentioned.
PIr. Pendell: I don't think you realire the location-of this 5 acre
tract. lt is on the old highwe.y and not the new highway. It does not
touch tho new highway.
Mr. Walker: It is on the old highVray, but it is still a much traveied
ha,ghtivay. A bus goes by twice a d ay. There are plenty places in the
county to dig oits withcut getting on these main line highways•
Mr. Wallace :We have another locati.on in mind, almost in another tivor],d•
We will be out of sight.
Mr. Vialker: That is where they should be. There is a r_e;►~~ house going up
on Eighviay #11. It is a nice development. You c Qn see tr.f7.t from the
other road.
r~r. Wallace; Mr. Pendell lives about 300 yards from where I tivill take
the dirt.
Mr. Pendell: Yes, that is right.
Mr. 'Tallace : Thnt is the only new house in there that I knav;i about.
Ir. Anderson : Any other qLiestions?
Mr. Pende : Being the owner of this property, I dontt intend to have
it destroyed. IVe want to got the black dirt frnm the places where it
would be of no use to us for farming. It is just pasture novr, and it
has been f or the last 10 years. We have had a Iot of unsucces s ful erops.
I oan tt seA where these fellows wnuld damRge thA pasture by taking the
top soil. A oreek runs into thP pasture during the winter, thus re-
fertilizes the property•
Ivlr. Walke r: I f you c ou ld b e back 1000 f eet, would that be 0. K.
Mr. Pendell: There is a lot of scab-rock there, and it wouldnft be f3t
for top soil.
Mr. VTalker : I move t he mattEr be referred t o Executive Session.
Mr. Jtate: I second that motion.
Mr. t~"~nderson: Mr. Walker said he aould go out the first of the week and
check the property over again.
Mr. l7allace : That z s f ine.
Mr. Pendell: Wou].d you plea.se stop at the house so I can show you just
f where we heve in mind of taking the soil from?
~ Mr. Anders on :We sha].1 do that.
~ AT'I`IM:A motion was carried to appoint a committee composed of Messrs.

eLpgroximstely 32 letters all favorable to this. I haven=t had time to check
them to see if they are all property owners, but I'11 have to taka his word
f or it at the present time. R4r. Godfrey, how far are these peaple from the
proposed buiiding?
Mr. God£re,y: They are located in the Vera District, not aIl on Sprague Avenue,
some far back as Eighth Avenue.
Mr. Anderson : Thera are about 8 homes in thst block.
'Ar. Gadfre,y: Most of the homes are on the south side. There are 6 people
adjacent to this property 2 on the east end 4 on the west. They are all
favorable to this project.
Mr. Hawle,y: Would you like to explain your pZansi
Mr. Godfre,y: This plan is being approved and being built under the supervision
oF`Die P . 97 A o
' Mr. Wa.lker : This is Q plan for a bungalow type res idence.
Pr. (ToTfre,y: This is going to be a bungalow type resider.ce. We have styled
it that way £or Q neat looking building. If it doesntt work out as a businese
we will just have to put a few partitions in it end have a nice home . We
intend to ].andscape the property and have a set b ack of at Ieast 35' frnm
the line and do some shrub planting. There will be no bright lights. We
don't intend t o have anything more then an ord inary s ign to advertise the
work. We won't carry a large line of supplies, w e will have some paint and
a good line of fi-ne hardware thet goes into a nice plaae. That is what we
want et this time. Ilfe wP.nt to make a modern type residence. The buil.ding
will be set baak 35' from the street Iine and we will be back 14' for parking
space.
Mr. Howell : I am the owner of the property. I have 1801 frontage on Sprague.
~have west of my home, then my home on this 501 lot, then there is
another 50' lnt east of my house. This building will go on the 80t lot.
Mr. Walker : Do you plan to carry a stock of lumber?
Mr. Godfrey: rIo sir, we may put in a cabinet shop in the rear later on. ViTe
have not decided on that as yet.
Mr. Walker: Is it that old shed to be remodeled?
Sr. G-71rey: Tt is the shed in the back, but it is in good condition. It
has a concrete floor. Y'Je dontt intond to go into any extensive Manufaaturingp
but we intend to do our own work. ZVe wi11 have to have an off ice girl to keep
track of the accounts.
Mr. Anderson: Anybody to ask any questions"
, -re fTe-riou=ric : I live at 14712 East Spragua. I would like to lnow if their
~ business is not s,)ecessful, whAt would prevent them £rnm putt ing in a beer
• tavern?
Mr. Godfre,y: The morals o£ these people are not to put up a tavern.
Rr. '.~lalker: HQ wouldn't be able to put up a beer tavern without a special
permit, and besides he is too close to a school to do so. xe is within 300
f eot f rom a s chool.
Mr. Hawle,y: They can't put in a tavern, that is out of the question.
Mr. I'Jleigs : He would have to have a special permit for that. This is a spec3.a1
permif-7o-r one purpnse. If he put anything else up, he would be in violation
of the zoning ordinance.
Mr. 1116G-uldric : I f you would grant one pe rson a spec i al pe rmit! what would
keep you from granting others? I have a pretty nice home there.
Mr. Godfrev; We would like to go on reonrd as respecting that partioular

month ago we considered the matter of the` lumber yard. At that meeting, I I
protosted the lumber vard. Y w ould like to explain a little more in detail
today. Between the streets of Evergreen and Progress, just a distance of
3A of a mi2e, it so hapgens to be a very beautiful section of residences.
Most of these residenaes cost from $20,000 to $25,000 to build. They are
not only on the Appleway, but they are also found on the north and south
streets. For instance, Mr. Gillespie has a very beautiful home and I know
he would hate to have it marred• T c an't see why a man wants to put a com-
meroial building up in a Residential seotion. Along the Agpleway, eest of
Progress and west of Evergreen is more business, why doesn't he go over there?
ldy protest is, don't ruin 3/4 of a mile of tood res adential district. It
seems tc, me the people in this district shou1d te cnnsulted.
Mr. Gillespie : I own 10 acros of property, 500' frontage on Sprague. Anyone
on Eighth a4enue has no cnncern whatsoever in this. They are too far away to
~ be acljacent property nwners. I consider my 10 acres to be residential. T
think it is not only important to the people, it is ir.iportant to the County.
' Y+Te pay plenty of taxes in the valley. I don`t want my place to be commero3al.
Mr. Anderson: Anynne else?
Virs. Aovrel : I would like to krnaw just i•rhere our democrQCy is. We have bnught
our home with the idea of having aur dresamaking shop. I am sorry that so
many people are Qgainst it.
Mr. Kimble : I li4Q at 14817 East Sprague. Just across the highway f rom this
property and e little west. I would like to first protest the granting of
the application to Mr. Godfrey As already stated. I would like ta s ay that it
seems that most of the people are against it that own property. I would like
to say also that there is a hardware store about one block east of him and
one in Opportunity, which is about a 2 minute walk from that location. You
oan walk in 1/2 a rninute to another store on Progress. It seems to me the
xoning laws prohibit any retail store. Th~~t would be a nuisance to the neigh-
borhood. A lot of the people have been misinformed. If a rea~ estate man
sells the property with them thinking they can he.ve businesses.,then the real
estate ma.n is guilty of fraud. I£ you alook traffia there you have practically
none with the excoptinn of school kirls. I am against this application. Mr•
Anderson, I don't knovr if this is the right time to bring this up, but we
want snme informati.^n. Several times we have had to s top our work or b e away
from our homes to come down here to protest a business to protect nur interost
in our homes. There seems to be Q lot of confusion as to what is the most
efficient way to save the people an(l the County Planning Commission's time
~ in ob jeotion t o t hese things. I would like to have this go an record. T
~ don't want these things answered now, I woulc3 rather have them ansx*ered on
' a sheet of paper. First, is it necessary tn take +he time nf the P1Rnning
Cnmmission, anA nur time to make speEChes at these hearings. Is it necessary
to appenr at these hearings ° It would bv v ery much easier to circulate a
getition and present it to CaptQin HQwley. If it is necessar,y to appear,
what is the quickest way we can get it over with? "Te just li.ke to know all
thr t. It is hard for Q business mtn to g et away fr^m his work. Cnn the
people nf these pronerty owners m-i.ke objections. Could i'le send in a petition
stating we are protesting it"' Does it haQe to be notari2ed? I would
like to know how that wo•sld be presented. In an application of this kind, how
far from the actual locRtion of this will people be notified? 17nuld you
consider 6th or 8th Averiue in granting a perrnit on Sprague? j'+Te da.an't want
to get up a petition we clicin't know how far to gn. Ynu cAn read the law
on t he se things, w e don't knotiv the lciw. Then, is the Planning Commiss ionls
decision mandatory? 1 would like to know if the Planning Commission daes
, have discretion 'i-n making their decision, if the majority i$ againat it,
could they grani-. it? zf that is the case, a gond orator • may limit your

Is it nocessary to hire an attorney to protect us?
k?Ir. Hnzvle,y: Here are copies o£ the zoning ord inance. You will f ind your
answers hera. (Dis+.,ributes copies of the zoning ordinance)
Mr. Ar.dersnn: Anybody else to be heard?
Mr. Leslie : Wheen Mrs. Howell, moved there she moved with the purpose of
putting her shop right along side of her house, also her dressmaking shop.
These people petitionod the neighborhood right on that block and they have
6 signers for thczt block. Mrs. Howell is quite well known in that area. I
don't think the.t a beauty shop would in jure a neighborhood or sliding a few
cans of paint across the shelfs. As far as the band ssw making any noise
around thore, the tractor of Mr. Gillespie's mQkes a dQrn s4r'r.t more noise
thun a band saw does. It wil.l be 17 blooks off the roarl and abnut 2 b locks
from Iulr. Gillespie. The Railroud runs on one side of Mr. Gillespie, That
~
makes more noise than a beauty shop. Mrs. Howell has nothi.ng on her side
~ of the lot that wnuld hinder these penple at all. They dnntt have the money
to build a$35, 044 home on thct lot, and if they had it they never would.
There is too much trOffic for a home of that vAlue. We value the property
around $1,500. This building will be a bungalow type home, it will look
like a home. It will not look like a bus iness shop. I would like to see
it granted.
Mr. Rl.ton: My place overlooks their property, I nm protesting the special
perma.t because if you grant Mrs. Howell a permit, then next you would have
an auto oourt there, etc. There are a lot of beautiful homes in that diat-
rict. Thc:t district was set aside for a farming district - Agriculturale
i-`ry. Howell bought that property knowing the property was zoned and couldntt
put a s hop in.
Mrs. Howell: I would like to defond myselfe jle crune here 3 years ago. Vfe
were not acquainted lvith this country at all. Ididn't know anything About
the Planning Board. They tell us to get nnother locr-tinn. That is our

if that is znned as Residential.
Mr. Walker: It is Agriculturnl, it is not zoned as Res idential.

1.6r. Reed : I live at 405 r?orth Progress. I am against this for reasnns
already stated.
, Mr. Anderson: An,ybody else'? We want to give everybody a chanco.
, Mr, Godfrey: Diri any of the people try to get propArt7 betweQn McDonald
Sullivan within the 1Rst month? I know of people who asked for a spQCiFl
