Exe~nption CE-28-89. This Certificate of Exemption created two (2) pamels of
land. Records indicate that one of these parcels was further divided without

The County Engineering Department has completed a review of
the above referenced project. The followinq information must be
provided in order for us to proceed with our review.
A) For any new hard surface area, for an asphaltic roof, or
a roof containinq HVAC machinery, a drainage plan
for the site shall be prepared in compliance with
Spokane County "Guidelines for Stormwater Manaqement". At
a n►inimum the plan must contain:
1. Drainage calculations for stormwater volumes
qenerated on site.
2. Calculations for total impervious surfaces
contained withfn the site.
3. Finished grade elevations for structures to be
constructed on site.
4. Finished grade elevations at the top and bottom of
the 208 swale.
5. A typical cross section of the 208 ewale.
6. Calculations to justify the number and type of

III. BACKGROUND/ANALYSIS
On April 19, 1973, the 6oard of County Commissioners approved a zone
reclassification for a portion of this site. The development plan at
that time indicated a restaurant,and the reclassification was conditioned
that construction on the restaurant shall commence within 90 days of the
decision. No restaurant was built on the site.

The applicant is requesting a deptfi of 485 feet from Sprague Avenue.
The Commercia] depth on the north side of Sprague Avenue has been main-
tained at approximately 400 feet; however, the adjacent site to the east
has a Commercial depth of 470 feet.
IV. AGENCIES RECOMMENDED CONDITIONS
a) COUNTY FIRE MARSHAL
1. The site is located in Fire District #1.
2. Adequate arater for fire protection and distribution of such
water is required. A plot plan showing water source and
eniergency vehicle access is required for approval prior to
any land development.
b) COUNTY ENGINEER
1. Applicant shall dedicate 25 feet on 6est Road and a 20 foot
radius on Best Road and Main Avenue for right of way priar to
any use of the property.
2. Applicant shall dedicate a 50 foot radius circle for cul de .
sac use at the south end of existing 6est Raad right of way as
shown on the plat of Vera Vu Addition. There shal] be no access
to Best Road until all improvements to Best Road stated below
have been constructed.

b. It is within Critical Water Supply Service Area No. 3
and within service area of Vera Water and Power.
Groundwater resources appear to support development
at this density.
c. The project is: inside the 201 Sewer Study Area Zone 3
and inside the Primary Sanitary Sewer Area recommended
i n the `208 ` Study. The method of sewage di sposal i s
subject to approval of the Director of Utilities pursuant
to County Resolution 80-0418 adopted March 24, 1980.
The topography and soils in the area are g enerally
suitable for use of individual on-site sewage systems.
T he lot is of the proper dimensions to permit use of
both an individual well and sewage systen.
2. Recorronendations;
a. Water service need not be coordinated through the
Oirector af Utilities, Spokane County.
b. 4later service shal l be by an existing publ ic water
supply.
c. The use of individual wells is not authorited.
d. Sewage disposal method shall be as authorized by the
Director of Utilities, Spokane County.
e. Subject to specific application approval and issuance
of permits by the Nealth Officer, the use of individual
on-site sewage disposal systems may be authorized.
f. The owner, his heirs and successors, shall agree to not
protest legal assessments and utility local improvement
districts to provide central sewerage service to this -
lot. •
g. A combined surface water and sewage disposal detailed
plan sha11 be approved by the County Engineer and the
Health Officer prior to the issuance of any building

. 1. That the provisions of SEPA's NOTICE OF ACTION pursuant to
Chapter 43.21C.080 RCW and the Board of Spokane County
Commissioners Resolution #77-1392 be initiated by the project
applicant within thirty (30) days ot final disposition of this
application, and prior to any on-site improvements.
2. Pursuant to the provisions of Chapter a3.21C RCW, the SEPA
Guidel ines (bIAC 197-10) and the Spokane County Environmental
Ordinance (SCEO), a proposed declaration of non-significance
has been issued at least fifteen (15) days prior to this date;
the official file, written cortnunnents and/or publ ic testimony
contain information regarding assessment of the proposal's
adverse impacts to the physical environnent; a finding is hereby
made that no potentially significant adverse impacts upon the
physicial enviro ronent are anticipated as a result of the proj ect;
and a final declaration of non-significance is hereby to be
issued.

3. Approval by the Zoning Administrator of a specific lighting and
signing plan for the described property prior to the release of
any building permits.
4. A specific landscape plan, planting schedule and provisions for
w maintenance acceptable to the Spokane County Zoning Administrator
shall be submitted with a performance bond for the project prior

5. The applicant shall develop subject property generally in
accordance within the concept presented to the Hearing Examiner
Committee. Minor variations when approved by the Zoning

FINDINGS AND ORDER
A. lNTRODUCTION
This matter having come before the Examiner Committee on September 10, 1981,
and the members of the Committee present being Kathleen Carstens, Chair-
person, Eidon Thomas, and Jerry Williams
B. PROPOSAL
The sponsor, Jim Dorsey, is requesting approva) of a zone reclassification, File
No. ZE-88-81, Agricultural Suburban to Local Business, for the purpose of
developing a retail bakery.
C. FINDINGS OF FACT
1. That the existing land use in the area is residential, commercial, and
vacant.
2. That the Comprehensive Plan designates this area as appropriate for Major
Commercial development.
3. That the existing zoning of the property described in the application is
Agricultural Suburban.
4. That the provisions of RCW 43.21C (The State Environmental Policy Act)
have been complied with, and the Committee concurs with the Declaration of
Non-Significance.
5. That the proper legal requirements for advertisement of the Agenda Item
have been fulfilled.
6. That the land in this area is suitable for the proposed use, or uses within
the proposed Zone Classificativn.
7. That the applicant has demonstrated that conditions have substantially
changed since the original zoning of this area and accordingly, the pro-
posed rezone is justified.
8. That the proposed use Is compatible with existing uses in the area.
9. That the owners of adjacent lands expressed neither approval or dis-
approval of the proposed use.
10. The Hearing Examiner Committee finds the propased use to be in harmony
with the general purpose and will not be otherwise detrimental to the public
health, safety, and welfare.

O. CONDITIONS OR CONTI NGENCI ES APPL! ED TO TH IS APPROVAL
a) COUNTY PLANNING DEPARTMENT
1. A specific landscape plan, planting schedule and provisions for
maintenance acceptable to the Spokane County Zoning
Administrator shall be submitted with a performance bond for the
project prior to release of building permits.
2. The appticant shall develop subject property generaliy in accordance
within the concept presented to the Hearing Examiner Committee. Minor
variations when approved by the Zonrng Administrator will be per-
mitted, including, but not limited to the following changes: Building
location, landscape plans, and general allowable uses of the permitted
zone. A(I variations must conform to regulations set forth in the
Spokane County Zoning Ordinance. The original intent of the develop-
ment plans shall be maintained.
3. Applicant shall comply with 1208' recommendations concerning storm-
water runoff and provide necessary landscaping for runoff.
4. That the provisions of SEPA's NOTICE OF ACTION pursuant to
Chapter 43.21C.080 RCW and the Board of Spokane County Commis-
sioners Resolution #77-1392 be initiated by the project applicant within
thirty (30) days of final disposition of this application, and prior to
any on-site improvements.
5. Pursuant to the provisions of Chapter 43.21C RCW, the SEPA
Guidelines (WAC 197-10) and the Spokane County Environmental
Ordjnance (SCEO), a proposed declaration of non-significance has been
issued at least fifteen (15) days privr to this date; the official file,
written comments and/or public testfmony contain information regarding
assessment of the proposal's adverse impacts to the physical environ-
ment; a finding is hereby made that no potentially sjgnificant adverse
impacts upon the physical environment are anticipated as a result of
the pro}ect; and a final declaration of non-significance is hereby to be
issued.
6. All current standards of the Local gusiness Zone, as amended, shall
be complied with in the development of this site.
b) COUNTY ENGlNEERING DEPARTMENT
1. Applicant shall construct cement concrete sidewalks adjacent to the
property on Sprague Avenue.
2. The appl icant shal I submit for approval by the Spokane County
Engineer and the Spokane County Health District a detailed combined
on-site sewage system plan and surface water disposal plan for the
entire project prior to the issuance of any building permit on the
property.

3. A parking plan and traffic circulation plan shall be submitted and
approved by the Spokane County Engineer prior to the issuance of a
building permit on the property. The design, location, and arrange-
ment of parking stails shail be in accordance with standard traffic
engineering practices. Pavtng or surfacing as approved by the
Gounty Engineer, will be required for any portion of the project which
is to be occupied or traveled by vehicles.
4. The word "applicant" shall include the owner or owners of the
property, his heirs, assigns, and successors.
5. The construction of the road improvements stated herein shall be
accomplished as approved by the Spokane County Engineer.
6. Ali required improvements shall conform to the current State of Wash-
ington Standard Specifications for Road and Bridge Construction, and
other applicable cbunty standards and/or adopted resolutions pertain-
ing to Road Standards and Stormwater Managemenfi in effect at the
date of construction, unless otherwise approved by the County
Engineer.
c) COUNTY UTILITIES DEPARTMENT
1. Pursuant to Board of County Commissioners Resolution No. $0-0418,
the use of on-site sewer disposal systems is hereby authorized This
authori2ation is conditioned on compliance with all rules and regulations
of the Spokane County Health District and is further conditioned and
subject ta specific application approval and issuance of permits by the
Health Distrirt.
2. The owner, his heirs or successors shall join and participate in any
petition or resolution which purpose is the formation of a utility Iocal
improvement ctistrict (ULID) pursuant to RCW.. Chapter 36.94, as
amended. The owner, his heirs and successors shall further agree not
to oppose or protest any legal assessments for any utility local im-
provement district (ULID) established pursuant to RCW Chapter 36.94,
as amenc#ed.
3. Any water service for this project shall be provided in accordance with
the Coordinated Water System plan for Spokane County.
d) COIJNTY HEALTH DISTRICT
1. A combined surface water and sewage disposal detailed plah shall be
approved by the County Engineer and the Health District prior to the
issuance of any building permit for this project.
2. Sewage disposal method shall be as authorized by the Director of
Utilities, Spokane County.

d) COUNTY HEALTH DISTRICT (continued)
3. Subject to specific application approval and issuance of permits by the
Health Officer, the use of an individuaf on-site sewage system may be
authorized. No record of the existing on-site sewage disposal system
is an file with the Health Officer.
4. Water service must be coordinated through the Director of
Utiiities, Spokane County.
5. Water service shall be by an existing public water supply when
approved by the Regional Engineer (Spokane), State Department
of Social & Health Services.
6. Use of private wells and water systems is prohibited.

e) COUNTY BUILDING AND SAFETY DEPARTMENT
1. The site is located in Fire District #1 .
2. Mains and hydrants to be installed, in accdrdance with the Spokane
County Department of Building and Safety.
3. Reclassification of an existing building shall require an application
for change of occupancy permit, and subsequent inspection for
approval.
f) WATER PURVEYOR
1. Purveyor is Vera Water and Power, and they will supply the site with
adequate water for domestic, fire and i rrigation uses.
2. They indicate tihat they are able to service this slte with adequate
water.
g} SPOKANE COUNTY FIRE PROTECTION DISTRICT NO 1
1. Mains and hydrants need to be installed, and access plans for
fire fighting equipment around the building shall be approved
prior to issuance of a building permit.
