INTRODUCTION
This matter has come before the Heanng Examiner Comtruttee on February 22,1994.
, The members of the Comrruttee present are Ron Odell, Chairperson, and Jane Myers.
PROPOSAL
The sponsor. Cfiarles Yoke, requests appmval of a zone mclassificaaon frotn
Agncultural (A) to Community Busines.s (B-2) and from Commercial (C) to Regional
Business (B-3), File No. ZE-52-89, for the purpose of expandhng an existing
supermarket and constructmg an accessory warehouse.
FINDINGS OF FACT AND CONCLUSIONS
1. The propesty is geaeraUy located ia the Spokane Valley, on the northeast corner of
Progress Road and Sprague Avenue, in Se,crion 14, Township 25 N., Range 44,
EWM, Sgokane County, Washington.
2. The committee adopts the Planning Deparnnent Report as a part of this record.
3. 'Ibe existing land uses in the wea are connmercial along Sprague Avenue, single
faauly residential and vacant along Progress Road.
4. The Comprehensrve Plan designates this site as Major Commercial and Urban. The
Major CommercW category is for the purpose of oommercial developmeat while the
Urban category is primanly for residennal uses. The site, beiag within two
categories of the Comprehensive Plan comphes with the transition area pohcy since
adequate buffering along the north property has been required.
5. The Artaial Road Plan designates Sprague Avenue as a Principal A,rcerial, with a
recommended righc of way widch of 130 feet and Progress Road as a local aocess
sawt. The County Engineer's Office has requurA 10 feet of additionai nght of way
along Progress Road (tota160, to unplement the Artenal Road Plan.

6. The existing zaning of the pr+operty described in the application is Agncultural, •
previously estabUshed in 1942.
7. The pmvisions of RCW 43.21C (The State Environmental Pohcy Act) have been
compLed with and a Detennuution of Nonsigaificance was tssued.

8. The legal requirements for public notice have been fulfilled
9. The owners of adjacent lands expressed both approval and disapproval of the
proposed use.
10 The proposed use is compatible with exisung uses in the area
11. The proposed zoning does implement and conform to the Comprehensive Plan

7. The County Engineer has designated Typical Roadway Secaon Number One,
' Acce,ss Street Standar-d for the improvement of Progr+ess Road, which is adjacent to
the proposed development. This wdl require the addiuon of approximately 12 to 14
foet of asphalt, curb and sidewalk along the frontage of the development.
a ~ 8• All required unprovements shall conform to the current State of Waishington
Standard Specifications for Road aRd 8ridge Constrvcrion, and other applicable
County standards and/or adopted resoIutions pertaining to Road Standards and
Starmwater Managetnent in effcct at the datc of oonstrucdon, unless otherwise
appmved by the County Engineer.
9. Roadway standards, typical roadway sections and dmnage plan reqwrements are
found in Spokane Board of County Conunissioners' Resolution No. 80-1592 as
aanended and are apphcable to this propasal.
10. No construction work is to be perforaned within the existing ar proposed right of
way until a percnit has been issued by the County Enginecx. All wark within the
public road nght of way is subject to inspection and approval by the County
Engineer.
11. All required consauction within the existing proposed public right of way is to be
camipleted prior tio the release of a bwlding penYUt ar a bond in an amount esamted
by the County Engineer tio cover the cost of construction ar improvernents shall be
filed with the County Engiaeer.
So&ial Conditions:
12. The site plan shall be revised so as tio provide ananeuvering room on site for trucks
wluch vnll be making deliveries to the site. The purpose of this condiaon is the
eliminadon of uuck backing movements on Progress Road. Tivck baclang
movements onto the site from Progress Road is prohibited. The on-site truck
circulation plan for the site shaU be review and approved by the County Engineer.
13. The appLcant shall coatribute a proportionate share of the cQSt of the installation of
anraffic signal at the inte:rsection of Spmgue Avenue and Progress Road. The need
. .
for traffic signal installaaon at the Sprague-Progress intersection arises from the
increase in the occurnence in traffic accidents at that intersection and on Sprague
Avenue in finnt of the Yoke's Pak 'N Save. The accidents are primarily the result of tuming movements of vehicles ingressing and egressuig the site.
14. In addiaon to participauon in signal installanon, the applicant should provide a
second access to Progress Road. The centerline of this driveway should be at least
160 fL North of the Sprague-Progress intersection The alignment of parlang stalls '
wit}un the existing parlang Iot may have to be changed so as to encourage the use of
Progress Road by those vehicles which will be returning to Sprague Avenue to
travel tn an easterly direction on Sprague.
COUNTY UTILITIES DEPARTMENT
1. Project will make connection to Valley Sewer, sewer connection agreement and
sewer connection permit mqwred.

SCOPE/PROTgCT DBSCRIPTIONs
I. General Overview - The owner Charles Yoke is proposing an
addition and remodel to the existfng building. Proposed is an
addition and remodel to the front entrance, an addition to the east
side of the buildinq, and an addition for loading dflcks located at
the back of the building. Other interior remodelinq is also
proposed. The buildinq will be 67,000 square feet when the
additions are complete.
BOMIriARY OF D$PARTMgNTAL REQIIIRgMgNTB:
I. Planninq Department (456-2205)
A. Discussion/Requirements
1. A minimum of three off street loading docks are
required for the proposed. The loading docks are to be 15
feet wide, the size of the loadinq docks as shown on the
site plan is not adequate.

2. Please submit a detailed landscape plan for reviek and
approval. Type IV landsc,aping is required for the
. , ppoposed. A copy of the landscape requireYnents were given
to the apolicant during the meetinq.
3. Parkinq as shown on the site plan is adequate, 276
spaces are shown and 274 spaces are required.
4. All conditions of Zone Chanqe ZE-52-89 must be met.
8. Permit Release Requirements `
1. Please submit a detailed landscape plan for review and
approval.
2. An estimate from a nursery includinq size, type and
quantity alonq with a promissory letter from the owner
stating the landscapinq will be installed shall be
submitted.
3. Please revise loading docks so that they are a minimum
of 15 feet wide.
II. Engineering Department (456-3600)
A. Discussion/Requirement
1. Comments were qiven to the applicant and Building and
Safety by Scott Eqqer.
2. The maximum curb cut allowed by the county is 35 feet.
Please submit a desiqn deviation for the curb cut widths
shown on the site plan.
3. Please submit a more detailed 208 drainaqe plan that
is in compliance with Spokane County Guidelines for
Stormwater Manaqement.
4. The truck pit must contain a catch basin and
stormwater taust be pumped to a 208 drainaqe area.
5. All conditions of Zone Change ZE-52-89 must be met.
6. The applicant must share in the cost for a traffic
signal, an agreement statinq such shall be siqned by the
owner prfor to permit release. The design for the traffic
signal shall be determined by the Enqineering Department.
7. An approach permit must be obtained for the driveway
approach alonq Progress Road.

acquisition area. All required construction within the

10. An Aqreement to Pay Fees was qiven to the applicant
durinq the meeting. The agreement is to be siqned by the
owner and returned to the Engineerinq Department. Plan
review will not be completed until this document fs
executed.
B. Permit Release Requirements
1. Please submit road and drainaqe plans for road
improvements along Proqress Road.
2. Please submit a copy of the recorded property deed so
that an RID/CRP Aqreement can be prepared.
3. Please submit a design deviation for the curb cut
widths shown on the site plan.
4. Please submit a copy of the Aqreement to Pay Fees
signed by the owner.
III. Health District (456-6040)
A. Discussion/Requirements
1. The existing buildinq is connected to the public sewer
system.
2. Please indicate if the residence that was previously
located at the site has been dernolished or moved from the
site. If the residence was moved from the site, please
indicate its new location.
3. Please locate the existinq on site sewaqe disposal
system and properly abandon it.
4. The qarbaqe and debris left on the site shall be
removed as soon as possible. Also all construction and
demolition debris must be taken to a licensed landfill.

5. The pwmp that is to be installed in the loading'dock
area needs to have a reversted switch, which will enable
, the pump to, be- turned on only when stormwater is in the
loadinq ddck area.
B. Pern►it Release Requirements
1. Please submit a complete set of plans so that the
Health District can review the food service areas.
IV. Fire District No. 1(928-2462) A. Discussion/Requirements
i. The fire district needs assurance that they will have
access to the east side of the buildinq where the main
fire hydrant is located.
2. Dedicated fire lanes must have a minimum 20 foot
width.
3. Hydrant #871 located on the northwest corner of
Proqress Road needs to be changed from a two port hydrant
to a three port hydrant.
4. A lock (Knox) box entry system for fire department
personal access is required to be installed.
V. Department of Buildings (456-3675)
A. Discussion/Requirements
1. The future etoraqe building to be located at the back
of the site may be required to be sprinkled. Ren Jeffrey
suqgested that the applicant consider extendinq the water
line at this time so as not to have to cut the pavement at
a later date.
2. Ken Jeffrey also suqqested that the applicant have
soil compaction tests performed on the areas where
residences have been removed.
3. Parking for the proposed shall meet the minimum
requirements of the Requlations for Barrier Free
Facilities.
4. The existinq structure is a Type IIN Construction
fully sprinkled buildinq. All materials used in
construction were to be noncombustible however, some
combustible materials were used in the mezzanine area.

S. The exitinq system is to be evaldated by Ken Jeffrey.
At this time Ken's calculations show that 35 feet of
exitinq and a minimum of four separate exits will be
required.
6. Please submit a critical materials listinq to the
Department of Buildinqs alonq with a clean up procedure
' for review.
B. Permit Release Requirements
1. Two complete revised sets of plans addressinq the
items dfscussed durinq and after the meetinq and other
items from the plan review letter needs to be submitted
for review and approval.
COVNTY ACTION:
It was aqreed upon by all departments present that a
Pre-Construction Conference would not be necessary for the proposed.

Dear Mr. Egger:
As discussed with you on Wednesday, August 15, copies of the grading/drainage plan and
208 drainage calculations are transmitted for your review.
Our calculations indicate that with Spokane's 10 year design storm the maximum Q would
be 5 cfs. Time of concentration for the designed configuration will be 5.6 min.
Retaining the first 1/2 inch of runoff wiU require a V gpa volume of 3,340 cu ft. The
designed trapezoid V gpa has a volume of 3,560 cu ft.
Since the project is located in a Garrison soil area, we have assigned an outflow value
of 1 cfs to type B dry wells. The diminishing intensity of the typical storm curve
combined with the outflow characteristics of the dry wells indicates that the capaciry of
two type B dry wells will contain the design storm flow with a 10 percent safety factor.

INTRODUCTION
This matter has carrie before the Heanng Facaminer Committee on February 22.1940.
The members of the Committee present are Ron Odell. Chairperson, and Jane Myers.
PROPOSAL
The sponsor, Charles Yoke, iequests approval of a zone reclassification from
A g r i c u l t u r a l (A) t o C o m m u n it y B u sin e ss (B-2) and from Commercial (C) to R e g ional
Business (8-3). File No. ZE-52-89, for the purpose of expanding an existing
supenmarket and canstructing an acces5ory warehouse.

FIrIDINGS OF FACT AND CONCLUSIONS
1. The property is generally located in the Spokane Vailey, on the Aortheast corner of
Proogress Road and Sprague Avenue, in Section 14, Township 25 rI., Range 44,
EWM, Spokane Counry, Washington.
2. The conunittee adapts the Planning Department Report as a part of this record.
3. The existing land uses in the area are commencial along Sprague Avenue; single
fanuly residential and vacant along Progress Road.
4. The Comprehensive Plan designates this site as Ma}or Cornmercial and Urban. The
Major Commercial category is for the purpose of commercial development while the
~ Urban category is priniarily for residential uses. The site, being withi.a two
categories of the Comprehensive Plan complies with the transidon area policy since
adequate buffering along the north property has been requiuned.
5. The Arterial Road Plan designates Sprague Avenue as a Principal Artierial, with a
recommended right of way width of 130 feet and Progress Road as a local avicess
street. The County Engineer's Off'tce has required 10 feet of addidonal right of way
along Progress Road (total 64) to implement the Arterial Road Plan.
6 The existing zoning of the property described in the application is Agncultural,
previously established in 1942.
7. The provislons of RCW 43.21C (The State Environmental Policy Act) have been
complied with and a Determination of Nonsignificance was issued.
' 8. The legal requirements for public nonce have been fulfilled.
9. The owners of adjacent lands expressed both approval and disapproval of the
proposed use.

WHEREAS, Yoke's Foods Iuc., dba Yoke's Pac-N-Save has a project uaderway
for expaasion of their facility st the southeast corner of Progress Road and
Sprague Avenue; and
WHEItEAS, this expansion aecessitates the installation of a Traffic Signal
System at the interaection of Progresa Road amd Sprague Avenue; and
WHEREAS, an agreemeat has been prepared regarding participation in the cost
of this installation wherein Yoke's Foods Inc. agrees to participate in the
project 10% or up to $10,000.00; and
WHEREAS, the County Engirteer recommends approval of the agreement and
requests authorization to proceed with Preliminary Engineerimg for this
improvement.
THEREFORE, BE IT RESOLVED By the 8oard of County Commisaioners of Spokane
Caunty, Washington that the agreement between Yoke's Foods Iac. and Spokane
County regarding participation in the installatioa of a Traffic Signal Systera at
the iatersection of Spra,gue Avenue and Progress Road is hereby approved and the
Chairmaa of the 8oard authorized to execute the same by and on behalf of Spokane
County.
8E IT FURTHER RESOLVED that the 1990 Annual Road Construction Program is
hereby unanimously sinended to include this project and fuads in the following
detail hereby appropriated for this pro3ect:

Washington, For the purpose of improving the intersection of Sprague Avenue and
Progress Road by installation of traffic signal system, which improvement is for
the purpose of enhancing access to the Developer's property under the following
mutually agreed conditioas, to wit:
Spokane County agrees to perform the followiag:
1. To prepare p1aRS, specifications and estiraate of cost for the project and Call
for Bids f rom private contractors to accomplish said work.
2. To enter into a contract with the contractor submiCting their lowest and best
bid, subject to the deposit by the Developer, the lesser of $10,000.00 or lOX
of the total project amount, including preliminary engineering, tight of way
acq,uisition, contract amouat, signal equipment, 20% for construction
engineering, inspectioa and coatiagencies.
3. To pay the contractor ainouats due as the work is accomplished.
4. To deduct from the Developer's deposit lOX of the toCal costs aad expenses of
the pro ject upoa the completion thereof, includf,ng engineering, administration
and associated costs.
5. Ta refund any balance of the Developer's deposit in excess of 10% of the total
cost and expense of the improvement.
6. Upon completion of the work to aecept the same as part of the County road
systean and assume maintenance responsibility therefor.
The Developer agrees as f ollows:
1. After bid openiag by the Couaty, but prior to award of the cvntract, to
proaptly deposit the lesser of $10,000.00 or lOX of the total project ainount,
including preliminary eagineering, right of way acquisition, contract amount,

Dear Mr. Nelson,
Attached are the road plans and calculation.s for the Progress R,oad Improvements
adjacent to the Yoke's Valley Store. The installation consists mainly of an overlay
over approximately 27b li.neal feet of existing ~asphalt road end matchi.ng to a new
existing curb along the east side of the road. The road section used over the existing
unpaved area is the same as the section ap proved on the drawing completed by
Bovay Northwest, Inc. The section over the eidsting pavement is Z" ACP with a
minimum 1" crushed surfacing top course where necessary.
The attached calculations are in regards to the cross slope of the new road The
slope of the road from the design centerline to the existing new curb is between 2%
and 4.5% as required by Spoksne County.

SUHJBCT: Yokes URM Grocery, Problem with 208 swale in northwest corner of
reat parking lot.
Jon, on Friday, Atovember 16, 1990 I met with Mari Webb from Pacific
Northwest Alliance and R.C. Oakey, an inspector from the Department of
Buildinqs. The reason for our meeting was to observe the drainage swale in
question, see attached map. The consensus was that the swale is sloped much
steeper than the 1 1/2 to 1 called out on the plans. Because of this
condition placement and maintenance of the sod would be extremely difficult.
Liabilfty associatecl with the steepness and depth of the swale was also
expressed.
Suggestions to rectify this condition centered around flattening the
slope or fillinq in the area in question and usfnq this area for landscaping.
I don't feel this loss of basin area will greatly affect the efficiency of
the 208 swale as a whole. Revised calculations would of course be necessary
though to vezffy this.
Mari Webb has submitted a letter outlining her concerns and a
preliminary drawinq showinq how the problem could be solved; both of these
ftems are attached.
Our intention Jon, as I am sure yours is also, is to create a superior
product which meets both the clfents and the publics needs. Please contact me
if you have any concerns or comments relating to this matter.

The sxte plan cJated September 10, 1990 sMows the battom of the
swale at grade elevation 141.06 and the top of the adjacent
driveway at qrade elevatian 105. 04 for a dif ference of 3.98.

As discussed with you on Wednesday, August 15, copies of the grading/drainage plan and
208 drainage calculations are transmitted for your review.
Our calculations indicate that witb Spokane's 10 year design storm the maximum Q would
be 5 cfs. Time of concentration for the designed configuradon will be 5.6 min.
Retaining the first 1/2 inch of runoff will require a V gpa volume of 3,340 cu ft. The
designed trapezoid V gpa has a volume of 3,560 cu ft.
Since the project is located in a Garrison soil area, we have assigned an outflow value
of 1 cfs to type B dry wells. The diminishing intensity of the typical storm curve
combined with the outflow characterisdcs of the dry wells indicates that the capacity of
two type B dry wells will contaia the design storm flow with a 10 percent safety factor.
