All food will be prepared without the use of cooking utensils, therefore there will be no need for dish washing or grillinq. Leasee will bake their own bread on the premise. Parking requirements of 17 parkinq stalls (16 for restaurant parking; 1 for warehouse parking) have been met. 4. As per the Zone Chanqe, there can be no free-standing signage and signs cannot be located within the eastern 26 feet of the property. The applicant stated that he will apply for a separate sign permit. 6. Location of exterior refuse/dumpster needs to be shown on the revised site plans. A 5- 1/2 foot siqht obscuring fence is required to enclose the refuse/dumpster area. 7. The applicant stated that Wall Pack liqhting will be used as exterior liqhting. Please illus- trate the location and direction of illumination on the revised site plans. As per condition #4 of the Zone Change, no direct exterior light may extend over the property lines. 8. Please contact SCAPCA regarding this. III. Division of Enqineering & Roads (456-3600) - Bob Turner A. Discussion Items 1. Comments were given to the applicant and the Department of Buildings by Bob Turner. 2. Please submit a drainaqe plan for the site that is in compliance with Spokane County Guidelines for Stormwater Management as detailed in the handout qiven to the applicant at the meeting and also attached to the applicant's copy of these minutes. 3. Landscaping appears to be in conflict with the 208 drainage swales. Concerns were expressed that qradfng on the site may not allow for adequate drainage or proper functioning of the swales. Specifically, the elevation of the bark berm appears to be blocking the flow of water to the swale. This berm will need to be removed. 4. Please submit an "as built" illustrating the loca- tion of all existinq landscaping and drainage swales. 5. Verify if an RID/CRP Agreement has already 10een recorded. If not, an RID/CRP Agreement, Notice to the Public No.6 for Sullivan needs to be recorded. Please submit a copy of the recorded property deed to the Division of Engineering and Roads so that the agreement can be prepared. 6. It was noted that proposed has a 40-person seating capacity. 4. A review of the seatinq and the menu will be done to determine if the drainfield and septic system are adequate. The existing drain field has a capacity of 250 gallons per day. The septic tank capacity would handle up to 650 gallons per day. Additional drain lines may need to be installed. Please submit documentation stating that the septic tank has been inspected and pumped if necessary. 5. If the back portion of building is occupied in the future, no doorway will be allowed between the two businesses. INTRODUCTION This matter having come before the Zoning Hearing Examiner Committee on August 6, 1987, and the members of the Committee present being Ron Odell, Chairman, and Gary N. Anderberg and John W. Skadan. B. PROPOSAL The sponsor, Craig Smith, et al, is requesting approval of a zone reclassification, File No. ZE-28-87 Agricultural to Community Business ~j- SB~ Zone, for the purpose of developing a retail site. C. FINDINGS OF FACT 1. That the existing land use in the area is single family residences, duplexes, tavern, abandoned single family residence, large lot single fainily residence, outbuildings, and vacant land. 2. That the Comprehensive Plan designates this a rea as appropriate for 14AJOR COMMERCIAL and URQAN development. 3. That the existing zoning of the property descrtbed in the application i s Agricul tural . 4. That the provisions of RCW 43.21C (The State Environmental Policy Act) have been complied with, and the Committee concurs with the Determination of Non-Signif7cance. 5. That the proper legal requirements for advertisement of the Agenda Itern have been fulfilled. 5. That the land in this area is suitable for the proposed use, or uses within the proposed Zone Classification. 7. That the applicant has demonstrated that conditions have substantially changed since the original zoning of this area and accordingly, the proposed rezone is justified. 8. The Hearing Examiner Committee finds the proposed use to be in harmony with the general purpose and will not be otherwise detrimental to the public health, safety, and welfare. 11. The following are additional findings of fact considered by the Hearing Examiner Committee: ~ a) The ProPosed rezone to Communtty Business is consistent with the Maaor Commercial category and the transitional policy for the Urban category. Sullivan Road is still predominantly Single Family with Commerci 1 uses replacing older residences. The Community Business (6 ~ Zone provides adequate landscaping and buffering techniques to assure compatibility with the single family uses. D. CONDITIONS OR CONTINGENCIES APPLIED TO THIS APPROVAL (All Conditions imposed by the Zoning Hearing Examiner Committee shall be binding on the "Applicant", which term shali include th2 owner or owners of the property, heirs, assigns, and successors.) HEARING EXAMINER COt4MITTEE 1. Add Health District Condition #7 as follows: "Use of pri va te wel 1 s and water s,ystAms is prohi bited." 2. Add County Engineering Condition #16 as follows: "Applicant shall sub;nit for approval, by the Spoicane County Engineer, road, drainage and access plans." 3. "Since the Department of Building and Safety has declared that some of the existing buildings on the subject property are unsafe and does constitute a fire hazard endangering publlc health and safety, it is being recommended that as a condition of approval "that by October l, 1987, the site be cleared of all buildings, wast2 accumulation, and debrls." 2 . . ~ D. CONDITIONS OR CONTINGENCIES APPLIED TO THIS AQPROVaL, (continued) ZF-28-87 a) COUNTY PLANNING DEPARTMENT STANDARD: 1. Approval by the Zoning Administrator of a specific lighting and signing plan for the described property prior to the release of any building permits. 2. A specific landscape plan, planting schedule and prfl visions for maintenance acceptable to the Spokane County Zoning Administrator shall be submitted with a performance bond for the project prior to release of building permits. Landscap1ng shall be installed and maintained such that sight distance at access points is not obscured or impaired. 3. The applicant shall develop subject property generally in accordance within the concept presented to the Hearing Examiner Committee. Variations when approved by the Zoning Administrator will be permitted, including, but not limited to the following changes: 6uilding location, landscape plans, and general allowable uses of the permitted zone. All variations must conform to regulations set forth in the ZONING CODE FOR SPOKANE COUNTY, The original intent of the development plans shall be maintained. 4. Direct light from any exterior area lighting fixture shall not extend over the property boundary. 5. That the project is subject to Section 7.06, the Aquifer Sensitive Area Ov2rlay Zone of the ZONING CODE FOR SPQKANE C4UNTY, which sets forth various measures for Aquifer protection; specifically, :neasures dealing -dith wastewater disposal, spill protection measures, and stormwater runoff. 6. That trie present proposal is not detailed enough to determine whether or not the use of or materials stored on the site are in compliance with Section 7.06 (Aquifer Sensitive Area Overlay Zone) of the ZONING COOE FOR SPOKANE COUNTY. A parking plan and traffic circulation plan shall be submTtted and approved by the Spokane County Engineer. The design, location and arrangement of parking stalls shall be in accordance with standard engineering practices. Paving or surfacing as approved by the County Engineer will be required for any portion of the project which 1s to be occupied or traveled by vehicles. 3. All required improvements shall conform to the current State of Washington Standard Specifications for Road and Bridge construction and other applicable county standards and/or adopted resolutions pertaining ta Road standards and Stormwater Management in effect at the date of construction, unless otherwise approved by the County Engineer. 4. Roadway standards, typical roadway sections and drainage plan requirements are found in Spokane Board of County Commissioners resolution 80-1592 as amended and are applicable to this proposal. 5. The site is located in Fire District #1. 2. This will requlre the addition of approximately 2' to 4' feet of asphalt, curb and sidewalk alon9 the frontage of the development. 10. The proposed plat shall be improved to the standards set forth in Spokane County 8oard of Commfssioners Resolution No. 80-1592, as amended, which establishes regulations for roads, approaches, drainage, and fees in new construction. 11. The County Engineer has examined this development proposal and has determined that the impact of this proposal upon the existing County Road System warrants the dedication of additional right-of-way and the roadway improvements herein specifled. 12. The applicant shall dedicate a 20 foot radius for County Road right-of-way at Valley Way and Sullivan Road.
