At a meeting of the Spokane Covaty Plaaning Commission beld Thureday,
afternoon, Auguet 27, 19539 the following action was taken and is recommeai,E-'.

1• AP'PLICATION FOR SPEC IAL PERI+IT
Approval of an appli.cation by the S& F CONSTRUCTION COMPANY to operate
an asphalt plant and rock cruaher to remove rock to Highway letiel, to
cruBh eame with a 75 tons per hour rock crusher and to operate a 21000
~ pound aspha.lt miaing pla,nt for a period of not to exceed, 15 years,
equipment to be operated with water well dust aollector and introduction
of water on primary unit of rock crusher, eubject to the following aon--
ditions:
l. That equipment no larger than the equipment described in the
appl icat ion b e used.
2. That satiefaatory duat arresting equipment as described in the
application ba inatalled a.nd maintained at ili t3mes in euch a
manner as to obtain the optimum degaree o4 dust control and that
the equipment be covered to the exteat neoessary to obtaia
optimum duat control.
3. That a fence be constructed aad maintained arvund the property
• at all times.
4. That rock be removed to highway grade and natural slope only
8e stated in the applicatioa and that no pite be dug.
5. That equipmeat be installed oa the east sSde of the property and
that the operatioa be conduated from the east slde of the property
in auah a manner as to be as uas ight ly as poae ible and to provide
a maximum emount of na.tural screening.
6. That all equipment be removed after operation has been abandoned
and that the area be satieiactorily rehabilitated ao as not to
constitute aa unsightly scar on the land.
7. That the permit for the extraotioa of rock, the crushing of rock
and the mixiag of asphalt be limited to e, period not to exceed
seven yeare.and tb.at the permit erpire at whatever t ime the
sourca of rock as limited by condition 4 is exhausted.
8. That only crushed rock obtained on the aite be used ia the
asphalt mizing operation.
9. That operat3,ons tie aarried on between 7 A.M. and 5 P.M. only.
The Planning Commission is making the recommendation to issue the speaial
permit on the grounds the operation, when limited to specific period of
years, is not unduly out of harmony with existing development; that as a ~
temporary operation it will not have a permanent effect on the general
character of the area; and that the operation caxried oa in accordance
with the conditions dsscribed will not have a detrimental effect on reei-
dente of the eree and public health, eafetq and welfare.
.2. Denial of a request by Oran Turner to maintain an establishment for the
feeding of garbage to swine on:
Lot 1 and the SEs of the A1Ea of Sec. 2-25--41, and Gov. Lot 2
in Sec. 2-25-419 and that par t of the SEy of S ec. 35-26-41
deearibed as follows: Beginning at the SW corner of the a4
of Sec. 35--26--419 th. E. along the S. line of said Sec. 35,
829 feet, th. N. 23° 40t west 655 feet to a point on the
county road, th. N. 581 20'West 391 feet along the oouaty road,
th. West 233.3 feet to a poiat on weat line of said SE4 of said
Sec. 359 th. S. 805.3 feet along west line of SE4 of said Sec.
35 to the poiat of beginaing.
Under the provisions of the County Zoning Resolu~ i on the applicant is
entitled to a permit to feed garbage to swine u:a:.e,3s it is found that
such an activity be detrimental to pu.blic heaith; safety e,nd welfare.
As a ma,tter of policy the Planning Com.mis$ion has nut approq^ed permita
of any kind uader oiraumstance where health officials are not satisfied
that eanitary and health standards hav0 been met or satisfactory plana
for compliance ha.ve been accepted and approved by the Health officials.
In respect to this appliaation for the feedirg of garbage to swine, the
I owner of the establishment has had eixty days in which to bring his
ogeration into campliance or to present his plans and demcnatrate his
ability to conaply. Dr. Arthur E. Lien, County Health Officer, forwarded
a report from Mr. Stenhen Excell, County Sanitarian, indicating that
at tho time of inspection August 6, 19531 the operation was aot in com-
plia.nce with County Health Regul--tions. Mr. Excell further stated that
at the time the action was taken, Augt.st 27, 19539 he had not received
plans and specffications iadiaating intent and ability to comply. Dr.
Haxvey, StateVeterinarianand- Dr. Donald Jaxvis, State Department of
Agricultures teatified that as of that day, August 27, 19531 the operation
Idas not in compliance with 3tate Idaw. For these reasons the Planning
Commission adopted the report of the committee appointed to investigate
the eite and reconmen&dthgt the permit be denied. A copy of the report
of the committee consisting of Mr. A. B. Fosseea, Mr. C. A. Reasor & NIr.
Ted McCoury, ia attached. Mr. Francis Schadegg was vnable to participate
in the work of tha c ommit t ee.
3. Approval of a request by Mr. & Mra. Fred Tirk, owners of I:ot ll, 3lock 1,
Replat of Tract 13, Vera, in the 1640C Block on the aorth side of East
Sprague to re-define the canditions and limitations of a epecial pernit,
dated Februsry 39 1948, to construct and maintain a building to house
and operate a hardware store, grocery atore, and theater building aubsti--
tuting the following permitted uses:
, 1. Food stores.
2. Restaurants and confectioneries.
3. Hardware, appliance and furniture stores.
4. Dry cleaning and pressing shops,
