INTRODUCTION This matter having come before the Zoning Hearing Examiner Committee on August b, 1987, and the members of the Committee present being Ron Odell, Chairman, and Gary N. Anderberg and John W. Skadan. B. PROPOSAL The sponsor, Craig Smith, et al, is requesting approval of a zone reclassification, File No. ZE-28-87 Agricultural to Community Business (6-2) Zone, for the purpose of developing a retail site. C. FINDINGS OF FACT 1. That the existing land use 1n the area is single famlly residences, duplexes, tavern, abandoned single family resldence, large lot single family residence, outbuildings, and vacant land. 2. That the Comprehensive Plan designates this a rea as appropriate for MAJOR COMMERCIAL and URBAN development. 3. That the existing zonfng of the property described in the application i s Agricul tural . 4. That the provisions of RCw 43.21C (The State Environmental Policy Act) have been complied with, and the Committee concurs with the Determination of Non-Significance. 5. That the proper legal requirements for adve rtlsement vf the Agenda Item have been fulfilled. 6. That the land in this area is suitable for the proposed use, or uses within the proposed Zone Classiffcation. 7. That the applicant has demonstrated that conditions have substantially changed since the origfnal zoning of this area and accordingly, the propvsed rezone is 3ustified. 8. The Hearing Examiner Committee finds the proposed use to be in ha rntony with the general purpose and will not be otherwise detrimental to the public health, safety, and welfare. 11. The following are additional findings of fact considered by the Hearing Examiner Committee: a) The proposed rezone to Community Business (6-3) is consistent with the Ma3or Commercial category and the transitional policy for the Urban category. Sullivan Road is still predominantly Single Family with Commercial uses replacing older residences. The Community Busfness (B-3) Zone provides adequate landscaping and buffering techniques to assure compatibility with the single family uses. D. CONOITIONS OR CONTINGENCIES APPLIEO TO TNIS APPROVAL (Al1 Conditions fmposed by the Zoning Hearing Examiner Committee shall be binding on the "Applicant", which term shall include the owner or owners of the property, hef rs, assigns, and successors. ) HEARING EXAMINER COMMITTEE 1. Add Health District Condition N7 as follows: "Use of private wells and water systems is prohibited." 2. Add County Engineering Condition #16 as follows: "Applicant shall submit for approval, by the Spokane County Engineer, road, drainage and access plans." 3. Modify Planning Department Condition #10 to read as follows: "That the area within the easterly 26 feet (designated as future acquisition by the County Engineer) of the subject site shall not be used for parking, 1208' , drainfield, or landscaping requirements and no advertising signs are allowed within the area. If any of the above are placed within this area, removal at the time of widening of Sullivan Raad shall be at the applicant's expense." 4. Modify County Building and Safety Department's Condition #6 to read as follows: "Since the Department of Building and Safety has declared that some of the existing buildin9s on the subject property are unsafe and does constitute a fire hazard endangering public health and safety, it is being recommended that as a condition of approval "that by October 1, 1987, the site be cleared of all buildings, waste accumulation, and debris." 2 . a • ► • - s ~ R t • 1 0. Approval by the Zoning Administrator of a specific lighting and signing plan fo r the described property prior to the release of any building permits. 2. A specific landscape plan, planting schedule and provisions for maintenance acceptable to the Spokane County Zoning Administrator shall be submitted with a performance bond for the project prio r to release of building permits. Landscaping shall be installed and maintained such that sight distance at access points is not obscured or impaired. 3. The applicant shall develop subject property generally in accordance within the concept presented to the Nearing Examiner Committee. Variations when approved by the Zoning Administrator wi11 be permitted, including, but not limited to the following changes: Building location, landscape plans, and general allowable uses of the permitted zone. All variations must conform to requlations set forth in the ZOHING CODE FOR SPOKANE COUNTY. The original intent of the development plans shail be maintained. 4. Direct light from any exterior area lighting fixture shall not extend over the property boundary. 5. That the project is subject to Section 7.06, the Aquifer Sensi ti ve Area Overl ay Zone of the ZONI NG CODE FOR SROKANE COUNTY, which sets forth various measures for Aquifer protection; specifically, measures dealing with wastewater disposal, spill protection measures, and stormwater runoff. 6. That the present proposal is not detailed enough to determine whether or not the use of or materials stored on the site are in compliance with Sectfon 7.06 (Aquifer Sensitive Area Overlay Zone) of the ZONING CODE FOR SPOKANE COUNTY.
