the appropriate health authorities, and Spokane County Fire Marshall The health authorities, water supplier (purveyor), fire protection district, and Spokane County Fire Marshall, will certify, prior to the issuance of a building permit, on the face of said water plan that tfie plan is in conformance with their requirements and will adequately satisfy their respective needs Said water plan and specifically defined by conditions attached to this Binding Site Plan are not in any case the responsibility of Spokane County NOTE WASHINGTON LA1dS, 1981, Chapter 292, Sec 2, provides in material part " That the binding site plan and all of its requirements shall be legally enforceable on the purchaser or other person acquiring ownership of the lot, parcel, tract, AND PROYIDED FURTHER, That sale or transfer of such lot, parcel or tract in violation of binding site plan approval, shall be considered a violation of Chapter 58 17 RCW and shall be restrained by injunctive action and be illegal as provided in Chapter 58 17 RCW, and " 13 That the owner or owners, his heirs, assigns, and successors, of property within this Final 6inding Site Plan agree to provide necessary easements across their property for extension of utilities and/or vehicular access to adjacent property (both within and outside the Final Binding Site Plan), as approved by the County Planning Department 14 That aRy division of land for purposes of sale, lease or transfer by the owner or owners, his heirs, assigns, and successors, of property within this Binding Site Plan shall, prior to completion of said transfer of ownership, be revlewed and granted approval by the County Planning Department Director or his designee Said approval is to assure compliance with the condition of approval, the require the surveyor to submit to the County Planning Department a current Assessor map showing the surveyed division and outlining the "remaining portion" in red along with a written legal description for remaining "Parcel ""Remaining portion" is that part of the Binding Site Plan that has not been assigned a"Tract" number code through previous surveys lk8 That no building permit shall be issued without that property having a legal description of 6inding Site Plan No 7"Tract" (number), which indicates a survey-of-record has been filed for public record with proper approval for said property 19 That the provisions of Spokane County Ordinances that are current at the time of "Building Permit - Site Development Plan" review shall be applicable 20 That all building permits within this Binding Site Plan shall be required to have lead agency approval from the County Planning Department for building permit -"site development plan" compliance with the conditions of approval and all other applicable County regulations prior to issuing said permit NOTE It is suggested that the sponsor or applicant coordinate and preview said plan with the County Planning Department prior to commencing or completing work on the building permit -"site development plan " 21 That each building permit - site development plan review shall assure that the "remaining portion" or Binding Site Plan No. 7"Parcelu -(letter) does retain the abilit y t o b e d e v e l o p e d p u r s u a n t t h e c o n d it io n s o f approval and current regulations and standards (such as access, utilities, setbacks, and others) 22 That private road maintenance and access agreement(s) shall be required and filed for public record with the County Auditor when vehicular access across adjacent property is required, prior to issuing a building permit 23 Specific utility locations or easements shall be approved by the utility company and sha11 be determined in con3unction with the issuance of a bullding permit for construction on any divtsion within the Binding Site Plan, prior to Zssuing a building permit for said site development plan 24 That access permits are required for driveway approaches to the County Road System 25, That prior to the issuance of a building permit, the applicant shall :a. Submit for approval by the County Engineer and Spokane County Health District a detailed combined on-site sewage system plan and surface water disposal plan for the entire project b Submit a parking and traffic clrculation plan to the Spokane County Engineer for review and approval The design, location and arrangement of parking stalls shall be in accordance with standard traffic engineering practices Paving or surfacing, as approved by the County Engineer, wil l be requi red for arLy portion of the project which is to be occupied or travelled by vehicles 26 An on-site storm drainage system shall be approved by the Spokane County Engineer's Office prior to release of building permits The '208' drainage concept is to be used in the design of the on-site storm dratnage system 4 ~ BINOING SITE PLAN NO 7(Cont'd) CONDITIONS (cont'd) 27 The word "applicant" shall include the owner(s) of the property, his heirs, assigns, and successors 28 That the applicant must comply with roadway standards, typical roadway sections and drainage plan requirements that are found in Spokane County Road Standards 1981 and Spokane Count,y Guidelines for Stormwater Ranaqement 1M 29 That the owner or owners, his heirs, assigns, and successors, of any "Tract" within the Final Binding Site Plan is responsible for installing at►,y water system and fire protection devices pursuant the Binding Si te Plan approved Water Plan" prior to issuance of any building permit, unless other separate contract(s)/agreement(s) have assigned that responsibility to another party Spokane County will not be responsible for installing such improvements 30 That prior to issuing a building permit evidence shall be submitted by the building permit applicant to the County Planning Department that fire protection and domestic water is available to serve and protect the individual "Tract" and its improvements, which includes approval from the water district/purveyor, the Fi re Di strict and the County Fi re Marshal l 31 Approval of emergency vehicle access shall be required by the Spokane County Fi re hlarshall and appl i cabl e Fire District pri or to issuance of a bui1 di ng permi t 32 No structure shall exceed a helght of thirty -five (35) feet 33 That landscaping and/or screening will be required adjacent Interstate-90 right-of-way as approved by Spokane County Planning Department and as determined through proposed building permit site plan review, where the purpose of said improvements is to assure permanent aesthetic improvements necessary to prevent "unsi ghtly views" from sai d freeway w1 th the intent of maintaining "pleasing aesthetic view" from the freeway That each individual tract of the Binding Site Plan will be required to have made said improvements in conjunction with issuance of a building permit or required to bond for said improvements Q34. The applicant shall provide a performance bond to cover the cost of the required landscaping and/or screen7ng prior to release of building permits ON 35 That subject property shall be lighted in a manner which will not produce undue glare on adjoining residential properties, and onto Interstate-90 Pursuant to the Board of County Commissioners Resolution No. 80-4418, the use of on-site sewer disposal systems is hereby authorited This authoriaation is conditioned on compliance with a11 rules and regulations of the Spokane County Health District and is further conditioned and subject to specific application approval and issuance of pemits by the Health District Subject to amended sectian 10 1.156 of Spokane County Generalized Comprehensive Plan (Res 83-0421) 37 The owner(s) or Successor(s) in interest agree to authorize the County to place their name(s) on a petition for the formation of y petition method pursuant to RCW 36 94 which the petition includes the Owner(s) property and further not to ob3ect by the signing of a protest petition against the formation of a ULID by resolution method pursuant to RCw Chapter 36 94 which includes the Onwer(s) property PROVIDED, this condition shall not prohibit the Owner(s) or Successor(s) from objection to any assessment(s) on the property as a result of lmprovements called for in conjuncti on w1 th the formati on of a UL ID by eithe r peti ti on or resolution method under RCW Chapter 36.94. 5 • ► • ~ ` ~ • BINOING SITE PLAN NO 7(Cont'd) CONDITIONS (cont'd) A 38. If it is determined that the proposed is a critical materials user a manual switch for sump pump ramp drain will be required 5. Daryl Way asked the applicant what the contents are of some barrels and other containers located on the site. The applicant stated that he did not know the contents of most of the containers but that some contain grinding dust from the repaired enqines 6. Daryl Way asked the applicant to please find out what the four inch plumbinq clean-aut located on the property is for. 7 Public sewer is available to the site approximately 160 feet away from the corner of the property The Health District is requirinq that the proposed be conriected to the public sewer system prior to the issuance of the Certificate of Occupancy. B Permit Release Requirements 1 The Health District will release their portion of the building permit with the condition that the proposed will be connected to the public sewer system prior to the issuance of the Certificate of Occupancy IV Fire District No 1(928-2462) A. Discussion/Requfrements 1 Fire flow for the proposed is 5,000 g p.m. only 3,500 g p.m. is available to the site The fire flow needs to be brought down by either constructing area separation walls, sprinklinq the entire building or installing a centrally monitored smoke detection system The fire district would prefer that the entire building be sprinkled 2 A lock (Knox) box entry system for fire department personnel access is required to be installed B Permit Release Requirements i. The f.Lre flow problem shall be addressed prior to permit release V Division of Buildings (456-3675) A Discussion/Requirements 1 Plan review has been completed on the site plan only and a letter was sent to the applicant by Tom Postlewait 2.
