DECISION
That the "Prel imi nary Bi ndi ng Site P1 an of Record" i s hereby aPPROVED by
Spokane County Planning Department, as lead agency, for three (3) years to
November 1, 1986, pursuant to the below conditions
That divisions of land for sale, lease, or transfer of property within this
Binding Site Plan shall hereinafter be accomplished through the Binding Site
P1an process and is considered "Exempt" from the subdivision provisions of
Spokane County and Washington State subdivision regulations
All APPEALS of this decision shall be submitted to Spokane County Planning
Departnent within ten (10) calendar days of this Decision date, being
November 1, 1983

1 That a Final Binding Site Plan shail be filed for public record with the
Spokane County Auditor, as approved by County Planning Department, prior
to issuing any building permits
2 That the Final Binding Site Plan boundary shall be surveyed by a
Washington State licensed surveyor The surveyed legal description shall
be included in the dedication of said final plan to define the property
being "bound" to the binding site plan process
3 To initiate the process to record the Final Binding Site Plan copies of
the "DRAFT" Final Binding Site Plan (without signatures) will be submitted
to Spokane County Planning Department for coordination and review by all
appl i cabl e Departments and agenci es Note Other materi al s are al so

4. That a current "Certificate of Title" for the binding site plan property
prepared by a Title Compartiy in Washington State shall be provided to
County Planning Departnent prior to submitting the ORAFT Final Binding
Site Plan The certificate shall include the surveyed legal description
of the Bindi ng Si te P1 an property
5 That the County Planning Department will assign the "Tit1e" or "Name" for
the Final Binding Site Plan and each subsequent ownership will be assigned
a"parcel/tract" sequential code as the abbreviated title for the surveyed
legal description of each ownership and sald title and ownership code3
will be shown an all plans and maps filed of publtc record tvith the County
Auditor
6 Appropriate utility easements shall be indicated on copies of the
prel iminary Bi ndi ng Si te Pl an of record for di stri buti on by the
sponsor/applicant to the utility companies, County Engineer, and Spokane
County Health District Written approval of the easements by the utility
companies must be received by the County Planning Department prior to the
submittal of the DRAFT Final Binding Site Plan

7 The sponsor shall present evidence that the Binding Site Plan lies within
the recorded service area of the water system proposed to serve the
Binding Site Plan The sponsor shall submit a plan or documentation for
water facilities adequate for domestic use, irrigation use and fire
protection use and said water plan shall be approved by the water
supplier Said water plan must have been approved by the fire protection
district, the appropriate health authorities, and Spokane County Fire
Marshall The health authorities, water supplier (purveyor), fire
protection district, and Spokane County Fire Marshall, will certify, prior
to the issuance of a building permit, on the face of said water plan that
tfie plan is in conformance with their requirements and will adequately
satisfy their respective needs Said water plan and certification will be
drafted on a transparency suitable for reproduction Both shall be
submitted with the ORAFT Final Binding Site Plan
8 Water service shall be by an existing public water supply when approved by
the Regional Engineer (Spokane), State Department of Social & Health
Services

9 Once the Final Binding Site Plan is filed as public record, all building
permi t- site devel opment pl ans and/or Draft Survey-of-Records shal l be
reviewed for compliance with the Binding Site Plan conditions of approval
and all then current County regulations prior to issuing any building
- permit The above review will be initiated through the County Planning
Department and must receive County Planning Department approval before
recording said survey-of-record or before any bui 1 di ng permi t i s i ssued
10 That all building permit - site development plans and associated
survey-of-record sha11 be reviewed to assure
a that the proposal complles with the conditions of approval and
current County regulations and ordinances, and
b that the proposal assures extension of utilities and access to the
adjacent property (both in and outside of the Binding Site Plan), and
c that the "remaining portion" (that portion of the Binding Site Plan
not part of said site development plan or said survey) has the
ability to be developed pursuant (a.) and (b ) above
THAT THE FINAL BINDING SITE PLAN DEDICATION SNALL INCLUDE THE FOLLOWIMG

12 "Warning" Spokane County has not reviewed or approved "individual
building sites, individual site access, Individual drainage, individual
water, i ndivi dual sewer avai1 abi 1ity or other i ndivi dual uti 1 ity
improvements Spokane County has not determined that future building
sites comply with the Spokane County Zoning Ordinance or other
developmental rules or regulations applicable to site development
Spokane County in recording the Binding Site Plan makes no guarantees as
to the performance of required lmprovement This Binding Site Plan does,
however, disclose to future buyers the conditions and guidelines by which
future divisions of property and building permits shall be subject to
Qbligations for conformance to said revierring agencies' requirements and
cQnditions imposed by this Binding Site Plan where not specifically
defined by conditions attached to this Binding Site Plan are not in any
case the responsibility of Spokane County
NOTE WASHINGTON LA1dS, 1981, Chapter 292, Sec 2, provides in
material part
" That the binding site plan and all of its
requirements shall be legally enforceable on
the purchaser or other person acquiring ownership
of the lot, parcel, tract, AND PROYIDED FURTHER,
That sale or transfer of such lot, parcel or tract
in violation of binding site plan approval, shall
be considered a violation of Chapter 58 17 RCW
and shall be restrained by injunctive action and
be illegal as provided in Chapter 58 17 RCW,

13 That the owner or owners, his heirs, assigns, and successors, of property
within this Final 6inding Site Plan agree to provide necessary easements
across their property for extension of utilities and/or vehicular access
to adjacent property (both within and outside the Final Binding Site
Plan), as approved by the County Planning Department
14 That aRy division of land for purposes of sale, lease or transfer by the
owner or owners, his heirs, assigns, and successors, of property within
this Binding Site Plan shall, prior to completion of said transfer of
ownership, be revlewed and granted approval by the County Planning
Department Director or his designee Said approval is to assure
compliance with the condition of approval, the provisions ofi the County
Binding Site Plan Ordinance, and current applicable local and state
regulations.
15 That arUr division of land within the Final Binding Site Plan shall be
surveyed by a Washinton State licensed surveyor and filed for public
record prior to sale, lease or transfer of said division
NOTE It is suggested that the sponsor or applicant coordinate and
preview the intended survey with Spokane County Planning
Department prior to commencing or completing said survey
16 That all surveys for division of land within the Fina7 Binding Site Plan
shall include a"binding" reference to the dedication of Binding Site Plan
No 7 and shall identify the surveyed property as "Tract" -(with the next
sequential numerical number) and tidentify the remaining portion as
"Parcel" -(with the next sequential alphabetical letter), as approved by
the County Planning Department

17 That each survey for said division of land sha11 require the surveyor to
submit to the County Planning Department a current Assessor map showing
the surveyed division and outlining the "remaining portion" in red along
with a written legal description for remaining "Parcel ""Remaining
portion" is that part of the Binding Site Plan that has not been assigned
a"Tract" number code through previous surveys
lk8 That no building permit shall be issued without that property having a
legal description of 6inding Site Plan No 7"Tract" (number), which
indicates a survey-of-record has been filed for public record with proper
approval for said property
19 That the provisions of Spokane County Ordinances that are current at the
time of "Building Permit - Site Development Plan" review shall be
applicable
20 That all building permits within this Binding Site Plan shall be required
to have lead agency approval from the County Planning Department for
building permit -"site development plan" compliance with the conditions
of approval and all other applicable County regulations prior to issuing
said permit
NOTE It is suggested that the sponsor or applicant coordinate and
preview said plan with the County Planning Department prior to
commencing or completing work on the building permit -"site
development plan "
21 That each building permit - site development plan review shall assure that
the "remaining portion" or Binding Site Plan No. 7"Parcelu -(letter)
does retain the abilit y t o b e d e v e l o p e d p u r s u a n t t h e c o n d it io n s o f
approval and current regulations and standards (such as access, utilities,
setbacks, and others)
22 That private road maintenance and access agreement(s) shall be required
and filed for public record with the County Auditor when vehicular access
across adjacent property is required, prior to issuing a building permit
23 Specific utility locations or easements shall be approved by the utility
company and sha11 be determined in con3unction with the issuance of a
bullding permit for construction on any divtsion within the Binding Site
Plan, prior to Zssuing a building permit for said site development plan
24 That access permits are required for driveway approaches to the County
Road System
25, That prior to the issuance of a building permit, the applicant shall
:a. Submit for approval by the County Engineer and Spokane County Health
District a detailed combined on-site sewage system plan and surface
water disposal plan for the entire project
b Submit a parking and traffic clrculation plan to the Spokane County
Engineer for review and approval The design, location and
arrangement of parking stalls shall be in accordance with standard
traffic engineering practices Paving or surfacing, as approved by
the County Engineer, wil l be requi red for arLy portion of the project
which is to be occupied or travelled by vehicles
26 An on-site storm drainage system shall be approved by the Spokane County
Engineer's Office prior to release of building permits The '208'
drainage concept is to be used in the design of the on-site storm dratnage
system

27 The word "applicant" shall include the owner(s) of the property, his
heirs, assigns, and successors
28 That the applicant must comply with roadway standards, typical roadway
sections and drainage plan requirements that are found in Spokane County
Road Standards 1981 and Spokane Count,y Guidelines for Stormwater
Ranaqement 1M
29 That the owner or owners, his heirs, assigns, and successors, of any
"Tract" within the Final Binding Site Plan is responsible for installing
at►,y water system and fire protection devices pursuant the Binding Si te
Plan approved Water Plan" prior to issuance of any building permit,
unless other separate contract(s)/agreement(s) have assigned that
responsibility to another party Spokane County will not be responsible
for installing such improvements
30 That prior to issuing a building permit evidence shall be submitted by the
building permit applicant to the County Planning Department that fire
protection and domestic water is available to serve and protect the
individual "Tract" and its improvements, which includes approval from the
water district/purveyor, the Fi re Di strict and the County Fi re Marshal l
31 Approval of emergency vehicle access shall be required by the Spokane
County Fi re hlarshall and appl i cabl e Fire District pri or to issuance of a
bui1 di ng permi t
32 No structure shall exceed a helght of thirty -five (35) feet
33 That landscaping and/or screening will be required adjacent Interstate-90
right-of-way as approved by Spokane County Planning Department and as
determined through proposed building permit site plan review, where the
purpose of said improvements is to assure permanent aesthetic improvements
necessary to prevent "unsi ghtly views" from sai d freeway w1 th the intent
of maintaining "pleasing aesthetic view" from the freeway That each
individual tract of the Binding Site Plan will be required to have made
said improvements in conjunction with issuance of a building permit or
required to bond for said improvements
Q34. The applicant shall provide a performance bond to cover the cost of the
required landscaping and/or screen7ng prior to release of building permits

35 That subject property shall be lighted in a manner which will not produce
undue glare on adjoining residential properties, and onto Interstate-90
Pursuant to the Board of County Commissioners Resolution No. 80-4418, the
use of on-site sewer disposal systems is hereby authorited This
authoriaation is conditioned on compliance with a11 rules and regulations
of the Spokane County Health District and is further conditioned and
subject to specific application approval and issuance of pemits by the
Health District Subject to amended sectian 10 1.156 of Spokane County
Generalized Comprehensive Plan (Res 83-0421)
37 The owner(s) or Successor(s) in interest agree to authorize the County to
place their name(s) on a petition for the formation of y petition
method pursuant to RCW 36 94 which the petition includes the Owner(s)
property and further not to ob3ect by the signing of a protest petition
against the formation of a ULID by resolution method pursuant to RCw
Chapter 36 94 which includes the Onwer(s) property PROVIDED, this
condition shall not prohibit the Owner(s) or Successor(s) from objection
to any assessment(s) on the property as a result of lmprovements called
for in conjuncti on w1 th the formati on of a UL ID by eithe r peti ti on or
resolution method under RCW Chapter 36.94.

I General Overview - The owner Edwards Engine Rebuild is
proposinq the construction of a 5,000 square foot addition to the
existing enqine rebuild business The addition will be used for the
storage of engines Also proposed is a loading dock that will
accommodate three semi-trucks.

A. Discussion/Requirement
1. Comments were qiven to the applicant and the Dfvision
of Buildings by Bob Turner.
2. The drainage check print was returned to the architect
during the meeting Please address the comments on the
check print and return to the Division of Engineering &
Roads
3. All conditions of 2one change ZE-125-80 must be met
4 An RID/CRP Agreement, Notice to the Public No 6 needs
to be recorded. Please submit a copy of the recorded
property deed to the Division of Engineerinq & Roads so
that the agreement can be prepared An RID/CRP Agreement
may have already been recorded when the existing building
was built, please verify
5 If the proposed has a metal roof the roof drainage may
go dxrectly into a drywell
6. There is a Bindinq Site Plan on the property
(BSP-83-7). Bob Turner stated that he was unaware of the
Bindinq Site Plan prior to the meeting and is reservinq
his comments of the 8indinq Site Plan until after his
review.
7. An Agreement to Pay Fees was given to the applicant
during the meeting. The aqreement is to be signed by the
owner and returned to the Division of Engineerinq & Roads
Plan review will not be completed until this document is
executed

B Permit Release Requirements
1. Please address the comments on the drainaqe check
print and return the check print to the Division of
Enqineerinq & Roads.
2. Please submit a copy of the recorded property deed so
that the RID/CRP Agreement can be prepared or submit
verification that an RID/CRP Agreement has already been
recorded
3. Please submit a copy of the Agreement to Pay Fees
signed by the owner.
III Health District (456-6040)
A Discussion/Requirements
1. The Department of Ecology requires that the effluent
from the jet spray be tested Please submit a full
explanation of how the effluent is processed
2. The applicant stated that the oil/water separator
located in the existing building is serviced approxiaately
once a month
3 Please submit a critical materials list to the
Division of Buildings for review
4. If it is determined that the proposed is a critical
materials user a manual switch for sump pump ramp drain
will be required
5. Daryl Way asked the applicant what the contents are of
some barrels and other containers located on the site.
The applicant stated that he did not know the contents of
most of the containers but that some contain grinding dust
from the repaired enqines
6. Daryl Way asked the applicant to please find out what
the four inch plumbinq clean-aut located on the property
is for.
7 Public sewer is available to the site approximately
160 feet away from the corner of the property The Health
District is requirinq that the proposed be conriected to
the public sewer system prior to the issuance of the
Certificate of Occupancy. Please contact Jim Legat,

8. The water purveyor for the site is Consolidated
Irriqation District No 19 (924-3655).
B Permit Release Requirements
1 The Health District will release their portion of the
building permit with the condition that the proposed will
be connected to the public sewer system prior to the
issuance of the Certificate of Occupancy
IV Fire District No 1(928-2462)
A. Discussion/Requfrements
1 Fire flow for the proposed is 5,000 g p.m. only 3,500
g p.m. is available to the site The fire flow needs to
be brought down by either constructing area separation
walls, sprinklinq the entire building or installing a
centrally monitored smoke detection system The fire
district would prefer that the entire building be
sprinkled
2 A lock (Knox) box entry system for fire department
personnel access is required to be installed

permit release
V Division of Buildings (456-3675)
A Discussion/Requirements
1 Plan review has been completed on the site plan only
and a letter was sent to the applicant by Tom Postlewait
2. Accordinq to the Division of Huilding's records the
existinq building is Type IIIN.
3 Fire flow is determined by usinq the Insurance
Services Office (ISO) Guide
4 Tom Postlewait reconuaended that the applicant
construct a four-hour area separation wall between the
existinq building and the proposed addition to reduce the
